Glaisyer at 7:30 P.M. Felton; la'ayne Crookston Minutes of the previous meeting were approved as read. Agenda Beer and Wine Application - E1 Zocalo - 729 E. First Street 1 Ron Butler was present to request a Beer and Wine License for the new restaurant to be located in the basement of the remodeled Woodman's Hall and will now be called the HERITAGE BUILDING. There were no objections from the Council concerning the Beer and Wine License. The Motion was made by Brewer and seconded by Williams that the Beer and Wine License Application be approved for the E1 Zocalo Mexican Restaurant, 729 E. First Heritage Building, expiration date to be December 31, 1981. Motion Carried: Williams, yea; Brewer, yea; Kingsford, yea; Orton, yea Agenda pre-termination Hearing for Water/Sewer/Trash Delinquencies 2 Mayor Glaisyer read the Turn Off Notice and invited anyone present to defend the claim made by the City that their water, sewer and trash bill is delinquent. There was no response. Mayor Glaisyer: "Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on October 21st, 1981. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, Pursuant to Idaho Code. Even though they appeal, the water will be shut off." The Motion was made by Williams and seconded by Orton that the delinquent water, sewer and trash accounts have their service discontinued October 21st, 1981 unless paid in full. Motion Carried: Williams, yea; Kingsford, yea; Orton, yea; Brewer, yea Agenda Payor Glaisyer read Ordinance Number 401 entitled: AN ORDINANCE AMENDIPJG TITLE 8, 3 CHAPTER 16, OF THE REVISED AND COP•1PILED ORDINANCES OF THE CITY OF MERIDIAN, ENTITLED POLICE REGULATIONS, "1ISDEP1EANORS, BY ADOPTING A P1EW SECTION 8-1637, TO BE ENTITLED POSSESSION OF CIGARETTES OR TOBACCO BY PIINORS; SALE OF CIGARETTES OR TOBACCO TO h1INORS. Attorney Crookston made a synopsis of Ordinance No. 401. Mayor: "Is there anyone from the public that would request that Ordinance 401 be read in it's entirety?" There was no response. The Motion was made by Kingsford and seconded by Williams that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Plumber 401 as read be passed and approved. Brewer, yea; Orton, gea Agenda 4 DEPARTMENT REPORTS Councilman Brewer stated that a petition signed by about 160 students of Meridian Intermediate School is asking that warning signs be erected near the school to slow motorists. The petition was presented by Lois 6.arcia, a crossing guard at the school. He recommended that Garcia not stop motorists when there ~ i Meridian City Hall .2. October 19,_1981 Agenda 4 (Cont'd) Department Reports..... was an influx of cars, but to wait until there was a break in traffic. Also, that Garcia should wear more visible clothing while on duty. He also stated that this area is being patrolled and will continue to do so, even more. Councilman 4illiams stated that Brewer's suggestions should alleviate most of the problems. Brewer stated that he and members of the Police Department would meet with school officials to formally make those recommendations in the future. Agenda 5 Jim Felton - BSU INSTRUCTOR WASTEWATER TREATMENT PROGRAM Jim Felten was present to display architectural drawings of the Boise State University Wastewater Treatment School to be located at the old Wastewater Treatment Site, West 8th Street. Felton stated that the school had received a $500,000 Federal Grant that will allow construction of a 6,000 sq. ft. building for an 11 month program for entry-level, sewage-plant operators. Felton said the school will be the third in the Pacific Northwest and one of 11 nationwide. The school will be excepting bids on the 24 student school by late Dec. or Jan. with construction beginning in April or May. The plant will use fresh water instead of effluent. Councilman Williams expressed his admiration of the program and the fact that the City of Meridian can be proud of this type of industry. Felton publicly expressed his appreciation to the KEYSTONE PIZZA for allowing them to use the restaurant for lunch purposes and their hospitality. ENTITLED POSSESSION OF CIGARETTES OR T.C$A000 BY MINORS; SALE OF CIGARETTES OR TOBI~CCO TO MINORS. WHEREAS, the City Council and the Mayor of the City of Meridian have concluded that it is in the best interest of said City to Amend Title 8, Chapter 16, Section 8-1637, NOW, THEREFORE, BE IT .ORDAINED RY THE MAYOR AND CITY COUPICIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, Section l: That title 8, Chapter 16, Section8-1637 shall be and the same hereby is amended by the adoption of a new Section 8-1637, to be entitled Possession of Cigarettes or Tobacco By Minors; Sale of Cig- arettes or Tobacco to Minors and to read as folio-ws: 8-1637 POSSESSION OF CIGARETTES OR TOBACCO BY MINORS; SALE OF CIGARETTES OR TOBACCO TO MINORS: (A) It shall be unlawful for any person under the age of eighteen ('18) years to buy, accept or have in his possession any cigarette, cigar, or tobacco in any form, or to buy, accept or have in his possession any cigarrette paper or other paper or wrapper intened for the wrapping of tobacco into the form of a cigarette: (B) It shall be unlawful for any person to sell or give away, directly or indirectly, to any person under the age of eighteen (18) years any cigarette, cigar or tobacco in any form or to sell or give away, directly or indirectly, to any person under the age of eighteen (18) - years an,y cigarette paper or other paper or wrapper intended for the wrapping of tobacco into the form of a cigarette.
