I MERIDIAN CITY HALT Meeting was called to order by Mayor Joe flaisyer at 7:30 P.M. ruarv 4. 1980 Councilmen present: Richard Williams, Grant Kingsford, Bill Brewer, Ric Orton Jr. Others present: Earl Ward, Bruce Stuart, Vernon Schoen, Leo Edward Miller, Roger Welker, Gene Wright, Gary Smith, Kelly Everitt, Ray Sotero, Ardyce Quenzer, Eugene Quenzer, Paul lJhite, Doug Nichols, David Davenport, John Cooknel1, Joel Petty. Minutes of previous meeting January 21, 1980 were approved as read. Leo Edward Miller was present, representing Leavitt-NuPacific Co. in reference to any announcement of decision of the Council regarding Mr. Lovan and Cherry Lane Recreation, Inc. Mayor Glaisyer stated that Plr. Lovan would not be in attendance, but had been requested to gather and present additional budget material to the City Council. This would be forwarded to Mr. Miller or to Mr. Leavitt when received from Mr. Lovan. Agenda 1 Custom Builders, West Idaho Ave. Gene Wright, J-U-B Engineers, was present, representing Dick Martens, Custom Builders. Wright reviewed Marten's approval to build a tri-plex on two lots. Approval was made to split a lot and the decision that platting not required, but must be recorded. Wright explained the placement of curb, gutter and sidewalk in front of the tri-plex proposal. W. Idaho ends in a cul-de-sac, or more of a half finished turn-around. The opposite side of the tri-plex proposal is paved, but has no curbs, gutters or sidewalks. Wright stated at the time of approval, Custom Builders was to provide a temporary turn-around for the Fire Department and City Engineer requested placement of curbs and gutters on opposite side of W. Idaho (to the north). Wright stated that the developer did not feel it was fair to be forced to put approximately 80 feet of curb on the opposite side of the street, this is not related to his project at all. He felt this would be the Ada County Flighway District's responsibility and the people that live there. There is no drainage problem, the cost approximately $h00.00. Wright made the request ih behalf of Custom Builders for relief of the requirement of placement of curbs and gutters opposite of tri-plexes on north side of W. Idaho. There was discussion and review of street plans. Attorney Crookston Jr. advised the Council that the enforcement of the curb and gutter placement would depend on what point of time the north side temporary turn-around was approved. This may have been developed prior to City requirements of curbs and gutters. Williams stated that Lots 1 and 2 of Herby Subdivision should be followed up as to time of development. Kingsford felt that Custom Builders should not be responsible as the north side still has a portion of the turn-around as a front yard. Orton stated that the street improvement requirements had been made at the time of Custom Builders proposal and like all requirements o.F ^ity water, sewer, fire and streets should be followed up. Wright responded by stating that Custom Builders had agreed to continue the curb & gutter on the south side of the street as a valid extension of his development, but again they have never been required to improve the opposite side of a street. The Motion was made by Orton to recommend approval with the requirement of curb and gutter extension from Custom Builders Development to and excluding the south side of W. Idaho. The Motion died for a lack of a second. r~ There was discussion concerning the property owners responsibility. Meridian City Hall .2. February 4, 1980 The Motion was made by Brewer and seconded by Williams to table the request of Custom Builders for relief of placement of curb and gutters opposite of their proposal until February 19, 1980 meeting. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton ,yea. Wright was granted permission to present Final Plat for Custom Builders at the February 19, 1980 meeting. Agenda 2 Mar-Mon Developers - John Cooknell John Cooknell and Joel Petty were present to bring forth water and sewer line extension plans formed by Gateway South Association to serve Annexations south of the Interstate. Cooknell displayed the routing and defined in detail that has been worked out with City Departments. (Plans on file with City Clerk.) Cooknell explained this was a very difficult and expensive project, but the method to achieve this alignment result was an Association formed by the landowners involved, which is principally a private LID. Cooknell stated that if this program meets the approval of the Council, they will put the project to bid within the next week and a half. The water and the sewer lines will be bid as separate entities, separate contractors to allow them to work at their own speed. The major problem will be the boring under the freeway. The permits have been acquired. Cooknell explained that the City will have to make the request crossings. The design is no problem. Easements are approximately 50% complete. The easements were rough drafted by the attorney for the Association, then the City Attorney worked out the final draft. Joel Petty, Blakely Engineers, stated that BOR will not go into any agreement with any developer, it must be with the ditch comoany or the entity that owns the facilities. The City will receive the paperwork for application to be sent to BOR. This was referred to as a contract between three entities prior to construction. Cooknell stated the test holes were dug so that the contractor could determine the materials before bidding. The plan now involves getting the lines across the Interstate, from there it will be the individual owners responsibility. There was discussion concerning the 12 inch loop line. Smith stated that a real requirement in the future would be to loop back into the system. Petty stated that in the master plan (south side) where the line ends, have them pay a portion in a bond like Ada County does, and then when water is available on the other side (north),'they would put up the other half of the boring in-a bond and it would be constructed at that time. Engineer Smith stated that the land west of the City will not sewer back to the east so it will require getting the sewer into that area (Linder Rd.). The Policy in the past is looping the lines, providing on the half mile and basically when you run out of water, you plant a well. Another possible location for the loop would be to the east. Smith stated he has no concerns with P1ar-Mon plans at this time, but does with the Plant and Williamsen properties as far as extending services to them, as to whether they should come back to the east or go to the west. It is feasible that they can be served from this system. Cooknell asked for two things from the Council. 1) Some format of consideration of this program in a positive manner in crossing the freeway. 2) Some assurance that the proper documents from BOR that the City will support the crossing of the canals. Petty stated the City must first approve- the concept of the plan and Plampa Irrigation approval of the plan, then the City has to apply to the BOR for this contract. Then it takes 30 to 120 days to get it back. Meridian City Hall :3. February 4, 1980 The Motion was made by Kingsford and seconded by Orton that the City pf Meridian approve the concept plan of Mar-Mon for sewer and water line extension. The Motion was made by Kingsford and seconded by Brewer to authorize .Mayor Glaisyer to sign the documentation with Bureau of Reclamation. Motion Carried:. Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea, Cooknell displayed concept plan of the Mar-Mon center. This will be coming in for design review as soon as the tenants review their leases and prescribe how their building envelopes should look. The Mar-Mon Development is dealing with the State now concerning the 55 foot right~of~way. The traffic control is being worked out with Ada County Highway District and the State Highway. Agenda 3 Carl Raasch Rezone application. Williams expressed concern that the same may happen as in the past, the City has endorsed this type of application and yet when they are contiguous, there is no effort on their part for annexation. He was not in disagreement with the request, but felt there should be a formal expression of future annexation by Idaho Motor Repair. The Motion was made by Kingsford and seconded by Brewer that the Mayor be authorized to endorse the approval of Carl Raasch Rezone application, known as Idaho Motor Repair, southwest corner of E. Fairview and Locust Grove. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. Agenda 4 Impact Area Agreement R'scussion. Mayor Glaisyer announced there would be an Impact Area Agreement workshop with the Meridian Planning and Zoning Commission and the City Council February 13, 1980. The Mayor asked for comment from the public. There was none.
