Agenda 1 Mayor Glaisyer announced that the City Council has come to the decision concerning the Cherry Lane Golf Course. Wallace Lovan has submitted the 1979 budget, proposed budget, lease agreements, letters of committment from Financial Institutions, and contracts for employment. Glaisyer stated that the City Council was ready to take the position of endorsing Wally Lovan to maintain and run the Golf Course for the upcoming season. The Motion was made by Orton Jr. and seconded by Williams to accept the material submitted to the City by Wally Lovan and along with the Mayor and Council's endorsement, submit to Mr. Leavitt and request his concurrance and if there are any other side issues that Mr. Leavitt contact Mr. Lovan directly. Mayor Glaisyer stated that with the power invested to him, he vetoed Ordinance #361 with the reason being that Rainey -Kuhl Annexation will be an undue burden upon the Police Department. He had no qualms with the actual use of the property, proposed use of the property, but he felt the Police Department and the City does not need another bar that causes undue hardship. Until the _property has availability for City water and sewer facilities on site, the City should not extend its police powers. ... 1,. Meridian Citv Hall February 19, 1980 Foley, Attorney for Rainey -Kuhl stated that he was concerned with AIC rules that any veto must be at the next following meeting after approval, also the reason for veto in writing. He felt this was not the correct procedure. Mayor stated that the City's Ordinance will go first and foremost. Crookston Jr. stated that the Mayor can veto, but if he does not act within a certain period of time (10 days), the ordinance is vetoed automatically. If the Council chooses to override the Mayor's Veto, even though the Mayor does not sign the Ordinance automatically becomes a law. The Motion was made by Brewer and seconded by Orton Jr. to override the Mayor's Veto of Ordinance 361. Motion Carried: Kingsford, yea, Brewer, yea, Orton, yea, Williams, nom. Mayor Glaisyer abstained from reading Ordinance #362. Agenda 3 Kelly Parker Rezone Hearing David Jensen was present, representing Parker and Valley Dairy Supply rezone of 903 E. 1st from "A" to "C" Commercial. Jensen presented a letter of intention of improvement to property with a retail dairy equipment store, block or steel, 30X50, light traffic, only one vehicle. (Letter on file with minutes.) There was discussion in favor of this improvement by all memebers. The Motion was made by Williams and seconded by Kingsford that the Kelly Parker Rezone from "A" Residential to "C" Commercial, located Lots 16 and 17, Block 2, Bowers First Addition, be approved with the stipulation that Valley Dairy Supply present a design review,before building,to the City Council. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. Agenda 4 Custom Builders - W. Idaho. Gene Wright, J -U -B Engineers, Inc., was present to request release of putting in curb and gutter on the opposite side of street from Custom Builders Tri-Plexes. The project involves two tri-plexes by developer, Dick Martens. One of the conditions of curbs and gutters across the street, which dead ends in a cul-de-sac at this proposal. Wright stated they did not feel this was a fair requirement. There was discussion concerning the benefits of building properly and offsite improvements in the City of Meridian. Wright felt this improvement was up to ACHD and could see no reason that the developer should come to this cost. It was determined that the water service line was put in "in a round -about fashion" because the owners of the property at that point of time would not grant an easement. Stuart was not sure at this time if the service would be adequate. 0 0 Meridian City Hall .3. February 19 1980 There was more discussion as to whose obligation the curb and gutter on the north side of the cul-de-sac. The Motion was made by Orton Jr. and seconded by Kingsford that the Council approve Custom Builders Final Plat proposal, subject to street, curbs and gutter and water system improvement by the builder of the development as discussed here tonight. Motion Carried: Kingsford, yea, Orton Jr., yea, Brewer, nom, Williams, nom. The Mayor broke the tie by voting yea. Agenda 5 Steve Bowman - Williamsen Truck Equipment Variance request. Bowman requested that the stipulation that Williams Truck Equipment not be allowed temporary water and sewer system,be removed. Their intention is to begin building immediately and will build an adequate temporary system with dry lines so that they will hook on when the City systems are available. Bowman stated they have every intention of hooking up to City sewer and water and they have expressed this in recent meetings and letters. Santa Clara has the same deadline as far as Bowman knew. John Cooknell representing Gateway South Association stated that they will meet with Nampa -Meridian Irrigation's Attorney and they are drafting an agreement to allow a crossing of the water line on Eight Mile 'and the final document is then presented to the BOR. The Nampa -Meridian and BOR makes their final site inspection. The hearing process of BOR on Ten Mile Drain takes approximately two months. They are aiming to have this completed before the water table rises. The permits for the Interstate crossing have not been obtained yet. Cooknell stated all parties involved in the Gateway South Association are now in the process of signing the agreement (Association) and Willaimsen Truck Equipment has verbally agreed to do the same. Bowman stated he is absolutely committed to hook on immediately when services are available. Rich Terrill, President of Chamber of Commerce, spoke asking the Council to grant variance of the stipulation of temporary water and sanitary system for Williamsen Truck Equipment and Santa Clara Plastic, although Santa Clara is not before the Council at this time, providing that they hookup to the City system within the two year period. Terrill stated this development would be a benefit to the City and the Chamber felt the City would not be setting a precedent as this is a certain situation at a certain time. The Motion was made by Brewer and seconded by Williams that the Counicl grant a variance with a stipulation that Williamsen Truck Equipment be hooked up to City sewer and water by January 1, 1982, or prior to that if it comes available. Agenda 6 Attorney Wayne Crookston, Jr. - Gem Estates. The matter of Gem Estates, brought to the City Council by Dave Reeves, 777 W. Pine, is being studied regarding 4-Plexes. Crookston requested that it be tabled until March 3, 1980. Dave Reeves stated that he had no objection to the postponement. 0 I Meridian City Hall Agenda 7 Meadowview #2 - Final Plat 19,1980 Mike Milhollin, Engineer and Mr. Montee, owner, were present, representing Final Plat request. Montee, now the owner, explained that he had picked this up after the Preliminary Plat approval approximately a year ago. The Mayor stated that he believed the plat had been approved with N.W. 10th St. as a through street and connecting with Delmar. Steve Hosac spoke concerning the redesign of the Preliminary Plan. There was discussion and disagreement between the Mayor and Council aid the developer and Engineer concerning the approval of the Preliminary map with the street changes. The block and lot numbers had also been changed since Preliminary approval at the request of the County Engineer. Mayor Glaisyer stated that at this particular stage, this plat was not acceptable to the Fire Department. For fire and police protection, it would be for the best interest to redesign a through N.W. 10th St. There was discussion,and a workshop with Department Heads before the March 3, 1980 meeting,was advised by the Mayor. The Motion was made by Brewer and seconded by Kingsford that the Final Plat Meadowview #2 be tabled until march 3, 1980. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. Agenda 8 Barney Property - Noteboom Annexation, North of Cherry Lane. Wayne Forrey, J -U -B Engineer, and Kent Barney, owner, were present to request input on their patio home subdivision concept plan.. Forrey described the concept: residential structure, large lots divided into half with one half of the unit going to the smaller lot, and fee simple. The zoning is "A" Residential; unique shape, 170 feet wide by 1330 feet deep. Adjacent to Meadowview #2 and Cherry Manor on the East and Leisure Lane on the West, the area to the West is unplatted and one acre a tates. Two story duplex structures, lots are 80' wide X 120' deep. Units are about 1300 sq.. ft. per unit, 100 sq. ft. of patio plus a single car garage. Units 1, 2 and 3 are in various configurations to reduce the vision impact. Property will allow only one street (N.W. 11th) and development on one side (east side), rear yard setback would be approximately 60 foot setback, the front from 20 to 30 foot setback, side yard 15 feet between units. Full improvements would be made, the ACHD approves. There was discussion concerning the small patio size, the west adjacent area, water stub outs and parking. The density would be 6.36 upa. Also there was concern for street study for length and fire protection, possible landlocking and two car garages. Agenda 9 Meridian Place Subdivision #1 Earl Harmon was present to request permission to get Building Permits on lots for multi type structure intermixed with single family for Meridian Place Subdivision #1. Councilman Orton abstained. Harmon reviewed previous action and the approval of developing in three (3) phases. The intent at that time was single family dwellings and density of 3.42 in the particular 20 acres in question tonight. (#1) Harmon pointed out the proposed density for that area was R-8 (map referred to is not official, but proposed.) There was discussion concerning split lots, covenants indicating a new lot line would not have to have the Ordinance setback, and the 1350 minimum sq. ft. Harmon stated the price range would be approximately $80,000 to $100,000 for duplex. He stressed quality and the attitude of smaller economic dwellings. Engineer Smith stated that Federal Housing Administration and VA require re - platting if there is split duplex lots. idian City Hall .5. February 19, 1980 Agenda 10 Schoen, Building Inspector, stated that in Harmon's covenants for Meridian Place #1, the 1350 sq. ft. would hold true for each unit, The Mayor's concern was to require minimum square footage and/or a dollar price on the quality if a ower house, to keep up a balanced community housing upgrade. There was discussion concerning the size houses and quality, subsidized housing. Harmon asked that the City allow them (Meridian Place #1) to build the sized house that can sell, not being restricted to the 1350 sq. ft. each unit, and they will put the quality in the building of the house. This matter is to be placed on the March 3rd agenda. B & B Business Park Sewer System - W. Franklin Harold Briscoe was present to request permission to connect to sewer line a Franklin Square across Franklin Rd. from the Meridian Glass proposal, Mayor Glaisyer explained the policy of coming to City Water and Sewer and going South requires a pressure lift - it is not a gravity flow, Briscoe stated the expense would be too great to connect from as far as Huico, 2000 feet away. Engineer Smith explained Phase III intent to serve this land, but it is unknown at this time how much of the line is owned by Boise Cascade, which would be a closer connection. The land to the south and west can be sewered by the extension coming up Ten Mile. To cross Franklin Rd. and dump into a manhole would be a last resort. It was the feeling of the Mayor and Council that B & B Business Park make the effort to obtain an easement from adjacent property owner. Agenda 11 Department Reports: Building Inspector Schoen, reported that the property owners in Noteboom Annexation, Woodland, Inc. and Matlocks had been informed that their business operation is noncomplying with "A" Residential. There has been no attempt on their Dart to comply with City Ordinance. These properties were "A" Residential in the County before Annexation to the City in December 1978. Schoen stated that quality homes should contain: two (2) car garages, two (2) baths, cedar siding or brick, shake roof, fireplace and a heat pump. Chief Sherwin reported that a crime analysis shows that the largest percent of crime in cities stem from the low priced housing. Attorney Crookston described the procedure of City Ordinances. He suggested that the Mayor and Council should direct the Attorney to draw up an Ordinance after a favorable hearing. At the next regular meeting the Ordinance would be presented for the Council's consideration. Crookston was directed to obtain a recorder for meetings to record and transcribe meetings. The Attorney also suggested that there be a public notice for a Preliminary Plat to legally notify adjacent property owners, or perhaps a letter of notification. Crookston brought up the AIC Attorney's meeting at McCall March 12, 1980. Registration fee is $10.00 for two days. The decision will be made at a later date. Stuart explained the process of "junking out" old meters and the Mayor directed that he proceed in the manner to get the highest price for surplus. Agenda 12 The Mayor read Ordinance #363, False Reports entitled: AN ORDINANCE AMENDING TITLE 10, CHAPTER 10, OF THE REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN. (Meridian Cit 0 .6. He suggested the preparation of a standard cost sheet. The general requirement should still be the 5/8, but there are several who would be willing to pay the cost of the 3/4 meter. Agenda 14 Engineering: Engineer Smith presented J -U -B Engineering Statement, December 7, 1979 to January 26, 1980. The Motion was made by Kingsford and seconded by Brewer that J -U -B Engineering Statement, December 7, 1979 to January 26, 1980 for general services in the amount of $3,558.12 be paid. Bar screen grate $673.17, Tolsma Repair. Safety signs, Bonneville Industrial Supply Co. $100.80. The Motion was made by Kingsford and seconded by Williams to pay the bill for bar screen grate from Tolsma Repair from the Construction Fund in the amount of $673.17. Smith reported on the progress of two projects, final payment on Boise River Outfall and Phase III Sewer, both to Galey Construction. He has drafted a letter of response to DVY on the primary secondary clarifier for review by Jim Coleman and Sumner Johnson. It is their recommendation that no retainage be released to DVY Construction until the matter is totally resolved.
