Rennison, Jo Taylor. Minutes of previous meeting were approved as read. Computer bids P1ayor Glaisyer opened the bids and read to the public the bids for a computer as follows: 7:31 p. m. The Mayor read Ordinance #377 entitled: AN ORDINANCE SETTING FORTH THE TOTAL AMOUNT OF MONEY NECESSARY TO BE RAISED FROM TAXES ASSESSED ON THE TAXABLE PROPERTY WITHIN THE CITY -0F MERIDIAN FOR THE YEAR BEGINNING OCTOBER 1, 1980 AND ENDING SEPTEMBER 30, 1981. Mayor Glaisyer called for public comment. There were no comments. The Motion was made by Kingsford and seconded by Williams that the rules and provisions of 50-9002 and all rules and provisions requiring that ordinances be read on three different days, be dispensed with and that Ordinance Number 377, as read, be passed and approved. The Mayor read Ordinance #378 entitled: AN ORDINANCE MAKING AN APPROPRIATION OF MONEY FOR ALL THE NECESSARY EXPENSES AND LIABILITIES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR COM- MENCING THE FIRST DAY OF OCTOBER, 1980, AND ENDING THE THIRTIETH DAY OF SEPTEMBER, 1981, THIS ORDINANCE BEING KNOWN AS THE ANNUAL APPRORIATION BILL, AND DECLARING AN E~AERGENCY. The Mayor read Ordinance #379 entitled: AN ORDINANCE REPEALING TITLE 8, CHAPTER 1, ENTITLED 'ANIMALS ESTRAY, POUNDMASTER' AND TITLE 8, CHAPTER 6, EPTITLED 'DOGS' AND ADOPTING A NEW CHAPTER ON 'ANIMAL CON- TROL OFFICER, ANIMAL REGULATIONS AND LICENSING', WHICH SHALL BE KNOWN AS TITLE 8, CHAPTER 1, OF THE REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN. Mayor Glaisyer called for public comment. Councilman Orton requested a summary. Chief Sherwin summarized the updating, requirement of animal vaccine, current day fines, and setting forth the age of dog licensing. The 1Aotion was made by Brewer and seconded by Williams that the rules and provisions of 50-9002 and all rules and provisions requiring that ordinances be read on three different days, be dispensed with and that Ordinance Number 379, as read, be passed and approved. Agenda 3 The Mayor brought the Council up to date in reference to Settlers Village covenants stating he has met with the representatives, Bob Helgerson, APA, a member of FHA, contractors, and the conclusion of that meeting was that the plat will be revised to bring in the exact number of units and type. They wall be tabled until a later meeting. Agenda 4 Engineer Report Gary Smith reported that during construction of W. Pine Ave., west from Linder Rd, all the survey monumentations were removed, not referenced and not replaced. This amounts to considerable amount of work. He had talked to Ron Cotterman, ACRD and Cotterman had stated this was a state sponsored project, and would be thejr respon- sibility. Information is available to reset the markers, but an expense. Piayor Glaisyer instructed this report of removal of monuments be thoroughly checked before any other action. Williams suggested contacting the Attorney General's office if this should require action. The Motion was made by Orton and seconded by Williams to authorize Street Commissioner Brewer to demand re-establishment of monumentation W. Pine Extension and Linder Rd. Agenda 5 Construction Bills The Motion was made by Williams and seconded by Orton that the freight bill from Instru- mentation Specialties Co. in the the amount of $32.09 be paid from the Construction account and that funds be transferred from the Water/Sewer account to the Construction account. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. The Motion was made by Williams and seconded by Ortoh that the bill from Ambrose, Fitzgerald, Crookston and F1cLam in the amount of $208.00 be paid from the Construction account; that portion of $194.00, DVY Construction be credited against DVY retainage, and that there be transfer of funds from the Water/Sewer account to the Construction account. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. Meridian City Hall .3. September, 2, 1980 Agenda 6 Orton reported on the transaction between BSU and City Park baseball fence. Lyle Smith, 6SU athletic director, has stated they would accept certain sections of outfall fence now that there is a need while constructing a multipurpose building. The complete fence and scoreboard was donated to the Storey Park baseball diamond by BSU some time ago. The BSU project will be approximately three years, the dismantling and replacement would take about three days work, the cost of a new smaller fence approximately $600.00. Orton stated there are funds budgeted to cover this. There was no objection from the Council. Agenda 7 Other Business Mayor Glaisyer stressed the need fora Planning and Zoning member. Bernie Wilson, Valley News Times Editor was introduced. The Motion was made by Kingsford and seconded by Williams that the meeting recess at 8:00 p.m. Motion Carried: lilliams, yea; Kingsford, yea; Brewer, yea; Orton, yea. At 8:20 p.m. the meeting was called to reconvene by Mayor Glaisyer. Councilman Orton addressed the Council and members of the public stating that it was a great deal of pleasure to present a Certificate of Appreciation to August Hein Jr, Troop #1 for the work on the softball infield in Storey Park. Orton explained that Hein in pursuit of an Ea91e Merit Badge, led Troop #1 to the layout of the infield, excavated the sod and topsoil out of the infield area, sterilized the ground, brought in sand, loam and tilled in, and then cleaning up the area after this project. Hein introduced Scout Troop #1 and stated they had helped with this project and thanked the adults who had helped. He stated that he and the Troop had put in almost 200 man hours and appreciated the opportunity of the project. Troop #1 is sponsored by American Legion Post #113. Mayor Glaisyer presented August Hein Jr. with a Certificate of Appreciation in behalf of the citizens and the Mayor and Council. The Mayor stated that it was an honor to have Hein and Troop #1 in our community and wished them the best of luck. The Motion was made by Brewer and seconded by Williams to pay the bills. Nea'_ Eagar File 664-7745 Subect: Meeting with Meridian City Council Relevant•to Approval of Proposed , Amendments to the Bethaven Subdivision Preliminary Plat On July 21 ,1980 Lee Stucker. and myself attended the Meridian City Pre-Council meeting to ask the Council's approval of revisions to the preliminary plat for the Bethaven Subdivision. Our request was stated in a letter to the Mayor and Council dated July 17, 1980. Councilman Rick Orton excused himself since Tudor Engineering Company, his employer, is Lee Stucker's engineer. Those present were Mayor Giaisyer; Councilmen Williams, Kinaford and Brewer. Gary Smith, the City Engineer, and Lawana ?vTeimar., the City Clerk, were also .present along with Lee Stucker and myself. Mayor Glaisyer pointed out that this matter was before the Council unof`icially since the City is without a subdivision ordi- nance until the mcratorium oa land development is lifted. While in force the moratorium forbids official action by the Council on preliminar;. or final plats. This was felt to include our rec_ruest for plat a.°aendmerts. I pointed out that the detention pond for storm runoff had - been originally designed oa a land parcel owned by LRS Corporation that lays East of the subdivision and South of Cherry Lane. The sale of thi::; land to the Fig-st Church of Christ forced the pond to a location inside the subdivisior. and sreatdd'. a need to revise part of the subdivision layout. I pointed out *_hat Sheryl Drive, between Beth Way and Leroy Way had been shifted South. A cul de sac m to the interior of ''.lock :'_5 now enters from Beth Way instead of Sheryl Drive. I also poi:aed out that a stub strut East o£ Be*_h way could be replaced by a sewer easement since the church now owned the property to which the sti:b street led. The :Mayor asked if the proposed revision changed the subdivision density and it was pointed out that there would be no change. Gary Smith as'ced why c're cul de sac bulb was to the right. I pointed out it worked out best for t:he a.r.rangement of lots. I pointed out that we proposed no manholes outside the right-of-way. There w3.^_, ;got a positive °°yes" or "no" from the council members on this Point. 'The question of access to the .land parcel owned by LRS Corporation, East of Eethaven and South of the church property, was discussed. It was suggested by Council members that tine stub street remain. for the sewer Line and also for access to this property. This plan received favorable comment from all Council members. After some discussion the Mayor and Council members agreed they could take no official action, but when the moratorium is lifted, they wil_ crfici.ally approve the plat with the revisions we proposed if the stub street was not replaced with a sewer easement. They said they would compare the plat we submit after the moratorium is ~ifted with the revised plat used for this meeting and if the plats compare as discussed, they will officially approve the amendments to the plat at that time. The term "DOG" as used in this ordinance, shall include either a male or female member of the canine family. B. The term "OWNER" as used in this ordinance, is meant to include any person owning, keeping, harboring, or otherwise responsible for such animal. 8-110 INTERFERING WITH ANIMAL CONTROL OFFICER: It shall be unlawful for any person to; a. hinder or interfer with in any manner, the animal control officer while enforcing any of the provisions of this chapter, or; b. recover or attempt to recover possession of any impounded animal, in any manner contrary to the provisions of this chapter. 8-112 LICENSE REQUIRED: It shall be unlawful for any person to own, harbor, keep or possess a dog which is more than six months of aae within the City of Meridian without first procuring a l~rense therefor as provided by this ordinance; provided, however, that the provisions of this ordinance shall not apply to any person visiting in the City of Meridian for a period not exceeding thirty (30) days, and owning or possessing a dog currently licensed, and bearing the license issued by another municipality or other licensing authority. 8-114 COLLAR, TAG: Every dog shall at all times wear a substantial, durable collar, to which shall be securely attached the required license tag. 8-116 LICENSES, FEES, EXPIRATION: All dog licenses issued within the City of Meridian shall be valid only in the calendar year issued and shall expire December 31st of that year. The owner or person having charge of any dog, except as provided for in this ordinance, shall ma!:e application to the City of Meridian fora dog license and pay an animal license fee as follows. A. Non-neutered male dogs $10.00 B. Non-spayed female dogs $10.00 C. Neutered or spayed dogs $ 5.00 D. A charge of three (3) dollars shall be made for each lost license tag reissued by the city. A certificate of neuter or spay issued by a veterinarian or the Idaho Humane Society shall be required to be presented at the time the 1'cense is applied for in o~°cer to secure the 1Scense rate fora r,cutered or spayed dog. 8-118 RABIES VACCINATION: The owners of all do?s required to be licensed under this ordinance, shall present to the City of Meridian Licensing Department, prior to being issued a dog license, a valid rabies vaccination certificate issued by a licensed veterinarian. A rabies certificate shall be conBidered valid within the following guidelines. A. Within one (L} year from date of issue when the do9:vaccinated; was less than one year old. B. Within three {3) years from date of issue when the dog vaccinated, was one (1) or more years of ace. 8-120 IMITATION LICENSE TAGS: It shall be unlawful for any person to allow any dog owned, kept or harbored by him to wear a license tag issued for another dog or to wear any imitation of the license tag issued by the city for that year, or any tag marked on p': ate or collar similar to that required by the city at that time and calculated to deceive. 8-122 OWNERSHIP RESTRICTION: No person or establishment may at any one time own or license more than three (8) dogs at any single location within the jurisdic- tion of this ordinance unless otherwise authorized by law or ordinance. This provision shall not apply to a litter of puppies under six (6) months of age and keo± and housed with the mother. 8-124 RUNNING AT LARGE PROHIBITED: It shall be unlawful for any dog owner to allow or permit any dog, whether licensed or not, to be or remain upc^. the streets or alleys of Meridian, or in any public place in Meridian, or upon any other premises without the consent of the person in possession of such other premises, unless: A. Such dog be in custody of a person and controlled by a leash r.ot exceeding six (6) feet in length, or unless; B. Such dog be confined in a motor vehicle. 8-126 IMPOUNDING OF DOGS: It shall be the duty of the Animal Control Officer to impound any dog found running loose within the city limits of Meridian in violation of the provisions of this chapter. A. The Animal Control Officer shall cause notice to be served within forty-eight (48) hours, either in person or by mail upon the regis- tered owner of any dog wearing a valid license impounded under the previsions of this chapter. B. Any dog, either licensed or unlicensed, impounded under the provisions of this chapter, not redeemed within five (5) working days, is declared to be a public nuisance and shall be disposed of in a humrwe manner. 8-128 IMPOUND FEES: Any person recovering possession of any dog. impounded under the provisions of this chapter, shall in addition to obtainir.n a license for such dog, if the dog is not then licensed, pay an impound fee as follows: First impoundment 315.00 Second impoundment 325.00 Third impoundment 350.00 Fourth & subsequent impoundments $75.00 In addition to the impound Fee, a board fee of two (2) dollars per day shall be charged. 8-130 VOLUNTARY DISPOSAL OF DOGS: The Animal Control Officer, at the request of any resident, shay: pick up and dispose of any deg owned or under the control of that person. The charge for this service shall be the sum equivalent to that incurred by the city for the disposition as that animal, but in no event less than five {5) dollars. This fee shall be paid at the time such animal is picked up. 8-132 DOGS RUSHING AT PERS01!S: Any owner or keeper of a-dog that rushes at any person, on a public right of way; lawfully on any property,public or private; any postal utility or city employee during the course of their employment; or any cyclist or motor vehicle,shall keep such dog confined or tethered in such a manner as to prevent such actan by said dog. 8-134 3ARKING OR HOWLING DOGS: It shall be unlawful for any person to permit a dog in their custody or under their control to bark, howl or otherwise create a disturbance to any neighbor. 8-136 FEMALE DOGS IN HEAT: Each female dog, when in heat, shall be penned or enclosed in such a manner as to preclude other dogs from attacking or being attracted to such female dog in such a manner so as to create a public nuisance. 8-138 CRUELTY TO ANIMALS: A. No owner shall fail to provide his animal(s) with sufficient food, proper shelter and adequate veterinary care when required. B. No person shall beat, torment, overwork, or otherwise abuse any animal. C. No person shall abandon any animal. D. No person shall place or cause to be placed, any dead animal on public or private property without the consent of the owner or person in charge of the property. 8-140 POISONING OF ANIMALS: It is unlawful for any person by any means to make accessible to any animal, with intent to cause harm or death, any substance which has in any manner been treated or prepared with any harmful or poisonous substance. This paragraph does not prohibit the lawful use of poisonous substances for the control of rodents and insects in furtherance of the public health. 8-142 INJURED OR DISEASED DOGS, DESTRUCTION: Any dog impounded hereunder and suf- fering from serious injury or disease, may be humanely destroyed at the discretion of the Chief of Police or the Idaho Humane Society, Inc. 8-144 PROCLAMATION OF MAYOR: The mayor of the City of Meridian is hereby authori<~d and empowered to issue a proclamation upon order of the Council whenever the prevalence of rab~'es in said city and vicini±y deems it neces- sary calling attent'on of the pub'•ic to the necessity of ~emply;ng with the provisions of this chapter relat~re herein. 8-146 RABIES: It shall be unlawful for the owner or keeper of any dog to permit such dog to run at large within the limits of the city, during the prevalence of rab-;es in the said city, or after the issuance of a mayor's proclamation as providr_d in 'phis chapter. 8-148 gUARANTINE: A. It shall be unlawful fora person to own, keep or harbor any dog afflicted with rabies. B. It is hereby made the duty of any owner of a dog showing symptoms of rabies, or of an unvaccinated dog which has bitten any person causing an abraision of the skin, to surrender the dog for con- finement at the Idaho Humane Society, Inc., or to a licensed vet- erinarian, fora minimum of ten (10) days. If such dog shall be determined free of rabies, the same shall be returned to the owner upon payment of the regular fee for keeping dogs impounded. If such fee is not paid, the dog shall be subject to disposal as pro- vided by iaw. At the discretion of either the Idaho Humane Society, Inc., the Health Department, or the Chief of Police, the quarantine of a dog may be upon the premises of the owner, or the person in charge of such dog, if the dog is securely confined, kept from con- tact with other animals and is submitted to a veterinarian for exam- ination at the owner's expense to determine whether or not the dog is rabid. 9-150 ANIMALS RUNNING. AT LARGE: That no horse, mule, cow, calf, steer, bull, swine or other domestic animal shall be allowed to run at large, or to be herded in any of the streets, alleys or public places within the corporate limits of the City of Meridian or upon any private premises therein, except those of the owners of such animals, unless when being driven through for shipment or other purposes, the owner or owners of such animals first obtain permission of the owner or owners of such private premises, or his or their agent or the occupant thereof. Any animal found in violation of this section, is subject to impoundment with impound fees equivalent to the cost incurred by the city, but no less than the impound fee schedule in this chapter. 8-152 LIABILITY FOR DAMAGE TO PROPERTY: The owner, harborer or keeper of any animal that does damage to property of another shall be liable to the owner of the property damaged for the damages and costs of suit. In the prosecution of actions for such damage, it is not necessary for the plaintiff to show that the owner, harborer or keeper of such animal had knowledge of the fact that such animal was doing damage to the property. 8-154 DEAD ANIMALS: It shall be the duty of the Animal Control Officer to remove or cause to be removed, the carcass of any dead animal found in any public place within the city limits of Meridian, and properly dispose of same.
