Calico Pizza Beer and Wine Transfer - Approved. • Meridian City Hall November 3, 1980 Regular meeting called to order by Mayor Joseph Glaisyer at 7:35 p.m. Councilmen present: Richard Williams, Grant Kingsford, BiTI Brewer, Rick Orton Jr. Others present: Gary D. Minutes of the previous meeting October 20, 1980, were corrected as follows: Page 6, Agenda 6, Paragraph 3, "the Local Planning Act requires that if the City has enacted an area of impact that Planning and Zoning Membership Comprise some Planning and Zoning member who is a resident of area of impact, but outside of the City limits." Attorney Crookston explained that the number of each sector in proportion to the population within the City limits and outside the City limits, but within the area of impact. The minutes of the previous meeting of October 2.0, 1980 were approved as corrected. Agenda 1 Phil Harper - Sheri Lynn Subdivision, Doxo Properties. Harper addressed the Mayor and Council and stated that he would like to change the restrictive covenants on Sheri Lynn Subdivision which is now totally completed. "The streets have been accepted by the Ada County Highway District, we are all finished out there except for some fencing which is being placed now. I would like to change to read from the originals that stated 1,350 sq. ft. to now state 'that all residential buidling erected upon said property shall have a floor area in accordance with zoning and ordinances of the City of Meridian exclusive of garages, carports, patios, breeze- ways, storage rooms, porches, and similar structures' and the reason for this is that there has been placed before the Committee on Planning and Zoning a proposal by the Citizen Advisory Council that would require a staggered square footage which I think the developers could live with. For instance, a 3 bedroom. home would still be required a 1,344 square footage on the majority. As small as a 960, you couldn't build one and pass FHA, so you wouldn't have to worry about that." Harper summarized proposed ordinances, 5% of the homes can be minimum dwelling size, 5% can be 110% of the minimum size, 10% can be 120 of the minimum size, 20% cah be 130% and all other homes shall exceed 140% of the minimum. He stated the ordinance workshop has looked at this and he would like to change the restrictive covenants to comply with that. Mayor: "We cannot adopt something that is not an official ordinance." Harper: "I am aware of that Mr. M~~ror." Williams: "I would agree with Mr. Harper if the Brdinanees were adopted - my feeling would be to wait until the ordinance is adopted to address tliis issue, because I would want to address everyone uniformly. I don't want to treat you any different than some- one else that came in with the same situation.- I know of about four dthers in the same situation that you"re•in Bill, and I don't want to grove you or them any differences in how we vote. I would like to see this. postponed until those ordinances are complete and address them altogEi:her on at:uniform, nondiscriminatory basis." Kingsford: "Are you asking to build on what will be approved?" Harper: "That's correct. We have tentatively got the Subdivision sold to a builder that would want to get one spec home. up fora model. His firs home, I think, could comply with the 1,350. All we are doing, is get it established fbr him so he knows, between now and the end of the year he's going to put up one, and if he can sell a home that size, that's fine - he would have to build the 1,350 presently. But all I'm doing is clarifying this for him now so he can at a later date continue to build in there - that he can go ahead and put up his model home now and then we can go along with our business as well." Mayor: "I have no problem with that. If :'you are asking that once the ordinances are approved, i will go along with that." Harper: "We are saying - when the ordinances are done, he won't have to stop construe- tion and come back in and have a time delay." Merida Hall 2 November 3 1980 Kingsford, addressing the attorney: "Do you have any problem with this Wayne?" Crookston: "I think at this juncture - you really don't have any action for what Mr. Harper's requesting, that he be allowed to do - is conform to the ordinances that will be adopted, after they are adopted. He has to do that anyway." Mayor: "We approved his covenants which require 1,350 minimum - if our ordinances come after that, and it"s reduced lower, he's going to have to have approval to amend his covenants." Kingsford: "What we're doing is granting him the change in the covenants to whatever the City Ordinance would be at that time - it's now 1,350, which later can be whatever is approved." Crookston: "If the amended covenants are to read that square footage requirements of the City of Meridian will be complied with -" Harper: "- that's exactly what I'm stating." Orton: "That would satisfy your request?" Harper: "Yes, that would satisfy the law now and in the future." Vern Schoen, Building Inspector: "His covenants are recorded and I think he has to change that recording before it would be legal." Harper: "At least this would allow the builder to get some foundations poured this year - and may give him a chance to sell some homes that size." D1ayor: "What has been proposed (ordinances) and the numbers you have been given doesn't necessarily mean the Council's going to back it." Harper: "I'm aware of that." Brewer: "I still think of 1,350 sq. ft. as a '2; bedroom home." Orton: "If he amends-:his covenants, records them, doesn't that require action - or that someone has to sign them?" Crookston: "You take a look at the covenants, once they are amended, then approve them at that time, the idea is fine, but you cannot approve until you see what the covenant says." Kingsford: "Can he go through the amending process without this body`s: approval?" Crookston: "I don't think so, it (Sheri Lynn Subdivision) was approved on the basis of the covenants that he submitted. Harper: "But according to state law the majority of landowners of any subdivision cap change the restrictive covenants." Crookston: "That's not,...=a state law, but the covenants can be changed, however, the covenants read they can be changed." Mayor: "That doesn't mean we have to issue a building permit?" Crookston: "No." Mayor: "I don't think we have any problem with what you are trying to do 'Phil-.- I question if we should adopt this before the ordinance is done - because we are not sure right now what the change is going to be." Harper: "If there is no change, then it is not going to change anything, but it would still comply." Mayor: "I suggest you go ahead and get your 1,350 started and once the ordinance is com- plete,drop this (amended covenant) off to us, we will put on the agenda for approval. If we approve it now, we will be saying we don't require 1,350 ft'.°" Harper: "Is there anyway that you could refuse these at a later date? If the City Council adopts the square footage formula that the Citizen., Advisory Committee has pre- sented, and has been through the workshop -iis there anv'-way that you could not accept these at a later date?" Mayor: "No, we don't have to accept them - the City Council makes the decvsa:6h. Citizen Advisory Committee and Planning and Zoning are only advisory committee. City Council wants to change what they recommended, that is their prerogative. Harper: "No, no - let's say the City Council accepts the formula as written - there any problem at all getting this accepted then?" Mayor: "No, not as far as I'm concerned.' You are complying with what we have Harper: "So you say at a later date this will be accepted." Kingsford: "Whatever our ordinances are at that time." The If the now is adopted." M "As far as I'm concerned you don't even have to come, just bring it in and we ayor. , will adopt it." Harper: "Then you won't take any action on it tonight?" Playor: "I don't think we can because we don't have the ordinances." .3. Orton brought up Settlers Village action in regard to smaller unit dwelling and if they (Settlers Village and Sheri Lynn) were about the same legally. There was much discussion concerning the difference. Attorney Crookston explained that Mr. Harper's Subdivision covenants were adopted with a certain standard, which he agreed to; Settlers Village never did have the 1,350 square footage requirement::" Crookston: "If they (Settlers) were allowed to be platted with covenants that had to be approved, that was one of the conditions - 'you bring the covenants to us so we can approve them' - if they come. in and replat and they want to change their covenants, then you have to approve their covenants. The two are not the same as you are talking about something that had a restriction - Mr. Harper's has a restriction, Settlers Village had no restriction. They are in essence two different ideas." Harper questioned the 1,350 square foot policy, stating that them and costing him more money a week in interest alone. Mayor: "Are you clear on what has happened tonight?" Harper: "Yes, I'm clear. If we go ahead and start out there you have to give us a building permit -" Mayor: "Correct." Harper: "And then when you people finally get to your zoning this in and it has to be accepted." Mayor: "As far as I'm concerned." Harper: "What about the rest of you?" Orton: "It's certainly .the way I feel." Harper: "OK, thank you very much." this policy has crippled and our first home is 1350, ordinance, then I can bring Agenda 2 Reynold Schenck ~lariance - located NE corner of Franklin and teridian Rd. Schenck was present to request variance of rear setback on north property line and 10 foot setback on the west and east side of proposed building in Iilliams Addition. Plan was displayed and Schenck stilted he had checked with Ada County Highway District concerning Williams St. There was no record of Williams St. being dedicated. Mayor Glaisyer stated that the Fire Chief is concerned about Williams St. for access. There is a 4 inch water line through the middle of what would be Williams St. _. ~srE=>r" In regard to the Ada County Highway District letter dated October 22, 1980 - Schenck: "I have a problem with deeding them t0 feet of additional right-of-way - I have no problem doing what they ask, but deeding it over is the problem. That comes up to almost 15% of that total piece of property, just handing it over to them - they want 10 feet on Franklin and 5 feet on the other side on Meridian Rd. as a right-of-way. I have no problem with complying with what they want, the sidewalks, the switching station, its the deeding of 15% of my property that's the problem:' Williams: "I think from the standpoint of further development, obviously if they don't get the right-of-way, either Meridian Rd. or Franklin Rd. will never be improved to handle the traffic that will be down there some day. My major concern is not your building to the property line per sae, but I have a feeling that the person owning this land to the north is going to sell the other portion off and we are going to have a 50 or 40 foot right-of-way, whatever Williams St. is - you will have your building here and they will have their building there and there will be a pile of junk in the middle - it will never get improved, or even graveled. I'm concerned about the utilities that are there now, access to those utilities access for fire through the back part of this property, realiz- ing only half of this is your responsibility. I seriously question whether you need to lay a full curb and gutter, a sidewalk - I would hope that this would be somewhat improved for fire, police and utilities." Brewer: "Would you be willing to improve half of it, blacktop up to your building?" Schenck: "And utilize it for parking?" Brewer: "Not and have it open for fire protection. It seems it would be an improvement for the back of your building." Williams: "Maybe parallel parking." Schenck: "I have no problem with that if I could get some parallel parking - that could put about four cars there. Brewer: "You would also have access for trash pick up and not have a mud hole - a nice appearing back building. I would certainly like to see the corner built if we can get together with him, but like Dick, I feel it has to fit into the future." Williams: "I don't see any problem with parallel parking back there - you can parallel park on Franklin or the other street." .~. There was much discussion concerning Ada County Highway District's letter of September 1978, regarding the request to close Williams St. Ada County Highway District states Williams St. was never dedicated and therefore-could not be vacated. Crookston: "As I understand it, the background there is that there was- never a dedicated street. Somehow on a map somewhere back in time, someone did extend Williams St. - on a map - from the back property line of Larry Barnes, westerly to Meridian St. Who did that, I don't know, but everybody got the idea that it was dedicated. There are theories that once it is in use as such, then it becomes a dedicated right-of-way - it's never been used, there is no street through it. As far as the easement, I'm quite sure that the City can claim an easement for the utilities to go through there. As far as who the owner is, you would have to run a title search on it to find out to whose name that property really exists. To my knowledge, there has been no dedication of that portion of the property. The City would have an easement simply because of the long existance of that property for water." Engineer Smith: "I have a copy of Williams Addition, which is the plat adjacent to the piece of property proposed tonight for variances. The description for the Williams Addi- tion starts on the east property line. Williams Ave. is shown in 'light lines' as going across to Peridian St., but this portion of Williams is not included in the plat that did dedicate Williams up to the east property line of this piece of property." Crookston: "That's right Gary, that is where it did come about,was on the plat." Smith: "It's misleading because it does show the lines going through to Meridian St., but it is not part of the dedicated Williams plat. That is probably why they can't find record of any dedication - the. only thing we have in there is a water line that reportedly has an easement." Williams: "How wide would this easement be?" Crookston: "How big is the line?" Stuart: "Four inch." Crookston: "Probably between 16 to 20 feet." Williams: "Who owns the northern property." Crookston: "Lempke owns it." Orton: "Then all the easement in the future would have to come off of Lempke - is that correct?" Crookston: "With a descriptive easement like that, it would be half on each side of the line, wherever that line is." Stuart: "It is on the south side of where the street (Williams) would be." There was more discussion. Brewer: "4lhat the City needs is to end up with a 20 foot easement through there with Schenck sharing half of it." Crookston: "The City has a claim for easement based upon prescription use of that land for public utilities." Building Inspector stated there was no problem with requested variances. Smith: "Is it my understanding that the street will be constructed for width, per Ada County Highway District's requirements without the additional right-of-way request?" Williams: "No, there is no street requirement." Smith: "Excuse me, I mean on Franklin and Meridian." Williams: "There isn't for dedication." Schenck: "There is curb, gutter and sidewalk dedication." Smith: "Do they need the additional right-of-way for that sidewalk, curb and gutter con- struction?" Schenck: "What they ask for was, from where the property line is, to come back 2 1/2 feet with nothing so they can eventually dig up if and when, and then five feet of sidewalk, then 2 1/2 feet of lawn, whatever, with nothing. That's how they wanted Franklin St. laid out. On Meridian St. they just wanted five feet, sidewalk, curb and gutter all tied in, but on Franklin they want ten feet laying out there. I'm willing to put it where they want it." Chief Sherwin: "No objection to proposal as long as sight triangle is clear and access to the back for police protection." Hall .5. November 3, 1980 Playor: "The only right way I know to do this is have Engineer Smith to do a research, get a proper legal description, search out the title and have Reynold and whoever owns the other .half, deed over to us - or give the City a recorded easement." Schenck: "I have no problem with the easement on the back side." The Motion was made by Williams and seconded by Kingsford that the City Council grant Mr. Schenck the setback variances as requested, rear of building against the north property line and a ten foot setback on the west and east side of building, provided: that Schenck comply with Ada County Highway District's requirements as outlined in letter dated October 22, 1980; that the rear portion of the building be no closer than ten feet from the center line of the four inch water line on Williams St; that a twenty foot easement be provided to the City in lieu of right-of-way for utilities, fire and police protection; and an all weather surface be constructed upon City easement at the time df construction." Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. Agenda 3 Harold Wilkins - 707 E. Pine sewer Wilkins was present to request information concerning sewer lines going into the east of his property, can he hook on, cost and if it wouldbeaneighborhood project. Ward: "He has access fairly close. I believe the sewer runs through the 900 block and he is located in the 700 block. I didn't get to measure, but it is a layable four inch line. The cost effective would depend on how Wilkins looks at it and his neighbors' situation. They are having problems with their drainfield - they do not have access to another pro- perty to put in an alternative drainfield, from what I understand, what his question might be, if a line was laid there servicing the property adjacent to him; where would he stand in regard to latecomers charges or other charges such as an eight inch line that would be laid to service that property in that area." Kingsford: "We would have to take a look at this before we could answer his questions." Ward: "Wilkins cannot get into the line at Miss Oliason's as it is too shallow, he would have to go to Phase III. This apparently is going to be a problem coming up more and more in that area. It has high ground water and most of the houses are relatively the same age." There was discussion. The Wilkins' property is a one acre lot, not wide, but deep. The property on the north has indicated putting in multi-family. Mayor Glaisyer stated that the policy has been that they can be on City water and sewer, but fees are all double, and their cost. The City has no latecomers charge at this time. Wilkins: "In other words, unless I could get someone to help me, I would have to lay three or four hundred feet of line myself plus paying the cost of hooking on to it." Williams: "Yes, sir. Hopefully that you can get some of your neighbors to participate. We will provide any assistance we can for you." Wilkins thanked the Council. Agenda 4 Senior Citizen Elizabeth Ryan representing the Meridian Senior Citizens Board of Directors directed a letter dated November 3, 1980 to Mayor Glaisyer and the City Council as follows: "On October 29, 1980, the Meridian Senior Citizens Board of Directors and their Advisory Board voted to request your initiation of a release of up to 3 acres of the property east of the race track and west of the park fora senior citizens center "We will appreciate your earliest consideration of this request and wish to thank you for your interest in our goals." Letter on file with these minutes. Brewer: "I would like to address a few of the items and criteria that was involved in the senior citizens arriving at this request. Primarily, they feel that location, the most important aspect, would be close to a future City Center complex, possibly, and its proxi- mity to the park - the picnic area, horseshoe pits, the existing parking, sewer and water proximity is desireable - these things convinced them the park property would be preferable !~~ . ,. rte,: .. ~ .:.a _.k...i...w~:.w,r:. ._-. .6. Mayor Glaisyer stated there are many things that would have to be worked out with the lease. The Motion was made by Brewer and seconded by Williams to instruct the City Attorney to draw a lease, letting up to three acres of unused portion of the new City park, to be leased to the Senior Citizens Organization of Meridian, for the amount of one dollar, one year lease, twenty options to renew, general intent of the lease with specifics to be worked out at a later date, and legal description to be established at the appropriate time. P1otion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. Agenda 5 Beer, Wine and Liquor 1981 Renewals. The h1otion was made by Kingsford and seconded by Orton that all Beer, Wine and Liquor application for 1981 that have been initialed as approved by the Chief of Police as of this date, be approved with the exception of Bud's Broiler for further review. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. t+1ayor: "Counselor, have you read the letter from Chief Sherwin concerning. bud's Broiler?" Crookston: "Yes, I have." Mayor:. "What is your comment?" Crookston: "I do not have any problems with the letter. Under the ordinance, the owners are to be contacted and told of their review and basically given a hearing. This should be an informal hearing. I think the proper action is to inform Bud's Broiler owners of the possibility of a denial of their licenses, have them come before the City Council and let them speak to this - then if the Council is of mind to deny them after the informal hearing, then they can take whatever necessary action after that." t4ayor: "I will send them a letter to that effect." Agenda 6 The Mayor read Ordinance #382 entitled: AN ORDINANCE AMENDING TITLE VIII, CHAPTER X, ENTITLED RESISTING AN OFFICER OF THE REVISED AND COtdPILED ORDINANCES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, BY ADDING TO SAID CHAPTER A NEW SECTION 9-1005 ENTITLED OBSTRUCTIONS IN THE PERFORMANCE OF DUTY. Chief Sherwin briefed the public by stating, "Basically, if any personal or real property is so placed, or becomes located any place in the City, that obstructs or delays any City employee from performing their duty, that obstruction can be removed at the ownersexpense~' Mayor Glaisyer called for public comment. The t4otion was made by Williams and seconded by Kingsford that the rules and provisions of 50-9002 and all rules and provisions requiring that ordinances be read on three differ- ent days, be dispensed with and that Ordinance Number 382, as read, be passed and approved Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. Agenda 7 Bills were read. The Motion was made by Williams and seconded by Kingsford to approve the bills. P1otion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. Agenda 8 Mayor Glaisyer reported that the money that had been held back by EDA until audit was complete has been received and would need to be deposited to the construction account, then paid back to the 25 and O1 accounts. The Motion was made by Brewer and seconded by Orton to transfer $107,1fi2.54 from construc- tion account - $104,662.54 to the 25 sewer and water account and $2,500.00 to the O1 general fund. Motion Carried: Williams, yea; Kingsford, yea; brewer, yea; Orton, yea. Agenda 9 Engineering: Engineer Smith recommended approval of General Engineering Statement No. 6 from J-U-B Engineers, Inc. for July 21, 1980 through September 29, 1980. The Motion was made by Kingsford and seconded by Brewer that General Engineering Statement No. 6 in the amount of $1,982.19. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. Agenda 10 Department Reports: Brewer reported that Home federal and Savings has removed a portion of the sign that had created some sight problem on the corner of E. First and Franklin. Brewer commended the Police Department for the way they handled the investigation of Pam Johnston's murder. He referred to the legal decision that had been handed down from the court reflects the extremely well handled job. Brewer stated that the street is obliterated with mud in front of Roto-Rooter on W. Franklin. Chief Sherwin stated he would research the problem. Orton questioned if there has been any information on the new lease of the Speedway. There had been no information. If was felt that the Speedway should contact the City about the parking. Williams stated that the City ordinance provides that the septic tank dumping operation and fees will be set by the Board of Appraisers and then passed on to the City Council for approval and implementation. He had recommended a written policy for fees and rules to the Board of Appraisers, which was approved, and submitted a copy to the Mayor and City Council. The Motion was made by Orton and seconded by Brewer that the City Council adopt the fol- owing policy for fees and rules as relates to septic tank dumping operations: 1. Hours: 8:00 a.m. to 4:30 p.m., Monday through Friday. 2. Fees: $0,017 per gallon and will be based upon full load capacity of vehicle dumping. Minimum fee will be $25.00. 3. Dumping will be at a rate of 100 gallons per minute maximum. 4. No dumping of any material other than domestic tanks will be accepted without prior written approval of the Wastewater Superintendent. Violation of this con- dition will terminate access to dumping facility. 5. The City of Meridian will bill monthly for dump charges. Accounts with past due balances will be on a C.O.D. basis until account is paid in full. Motion Carried: Williams, yea; Kingsford, yea; Brewer, yea; Orton, yea. • • ~ i .a. WHEREAS, the City Council and the T"ayor of the City of Meridian, Idaho have concluded that it is in the best interest of said City to amend Title VIII, Chapter X, by adding thereto a new Section 8-1005, regarding obstructions in the performance of duty of a police officer, or city employee, NOW, THEREFORE, BE IT ORDAINED BY THE T7AYOR OF THE CITY OF .TERIDIAN AND THE CITY COUNCIL OF THE CSTY OF T^ERIDIAPI, ADA COUNTY, IDAHO, Section 1.
