Meridian City Council The Meeting was call to order at 7:30 P.M. by Mayor Don Storey 2, 1979 Councilmen present: Richard Williams, Marvin Bodine, Joseph Glaisyer and Grant Kingsford Others present: David L. Curtis; Frank E. Marcum; Carl B. Ellsworth; Michael L. Milhollin; Tom Grote; Glenn Green; Wayne S. Forrey; Glen Hudson; LeeROy Nelsen; Gary Murgoito; Roy Doan; Larry Smith; Jim Wolf; Chet Ward; Dan Campbell; Steve Anderson; Bill Brewer; Roger Welker; Earl Ward; Vern Schoen; Bruce Stuart 1 Minutes of the previous meetings were approved as read. 2 Primrose Subdivision (Vacation Reconsideration) Frank Marcum was present on the request. The Mayor read a letter from Central District Health (see evidence). Easements were discussed. Ellsworth stated five (5) additional feet on the easements are necessary to meet City Ordinances. Kingsford inquired if this meets with the policy on access to adjacent property. Ellsworth stated yes and outlined areas of access recommended by City Engineering. A 20 foot drain easement is necessory, an additional 5 foot is necessory in addition to the 25 foot ease- ment in existance. Any and all condition set by the ACHD and Central District Health must be met. Marcum explained the history of the parcel and C.D.H. requirements. It was pointed out that the City had no plans to run water and sewer lines to the development. Williams stated the test holes requirements could not be met until high water table can be measured. The problems were discussed. William stated until the easements are given he could not recommend approval. Kingsford stated if it meets engineering criteria, ACRD requirements, C.D.H. requirements and easements are provided he could support the proposal. The parcel zone was discussed. City and County vacation jurisdiction were outlined. Kingsford moved that the city recommend vacation of the parcel subject to requirements from ACHD and C.D.H. and that easements for streets, water, and sewer lines, seconded by Williams. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Agenda 3 Malco Trucking {county) consideration on rezone. Mike Millhollen was present representing the request. He explained the submitted letter and plan. He presented a letter from the developer; he read the letter. He stated they are asking for a recommendation from the Council to the Ada County Zoning Commission to allow the zone change. Development of the parcel was discussed and outlined. Williams stated he had talked to personel from May Trucking; it is a good proposal he felt development along the front appears to be strip commercial. He could support the request if the front is not strip commercial. Strip commercial was discussed. Kingsford stated the strip commercial bothered, him but the rest of the plan looks good. Bodine felt it looked good Glaisyer agreed. Williams moved the City recommend approval of the rezone to C-3 with no strip commercial fronting Overland recommended by Bodine. Motion passed: Williams,yea; Bodine, yea; Kingsford, yea; Glaisyer, yea Agenda 4 Meridian Race Track, Del Gould was present representing the races, he inquired what the City has found out as far as requirements were concerned. City Hall .2. 2, 1979 14 15 Williams read an opinion submitted by the City Attorney (see evidance), Interpertation of the letter was discussed and clairified by Crookston. Welker stated he would like to study the letter. Williams inquired if the racers had a rehabilitation plan. There was discussion on decisions to be reached, appeals possible and actions that could be instituted. No decision was reached. Bethaven (Preliminary Plot), Lee Stucker was present representing the request he stated, it was approved by P&Z. It will be developed by stages not all at one time. Kingsford inquired if covanents were submitted, Stucker stated he had outlined a rough draft could be submitted. Ellsworth stated that possibly there should be another exit to the west. Stucker outlined theadjoining property to the west and didn't know what their plans were. Williams stated the City needs additional fire equipment and is concerned about fire protection. The proposal does not comply with minimum size for building. He didn't feel confortable approving it at this time. Stucker replied on building sizes he felt there should be some smaller than 1350 sq. ft. Some people do not need or want 1350 sq. ft house. He explained his position. Glaisyer stated the minimum square footage is an attempt to increase the quality of the housing. The community has a lot of houses that are 900 sq. feet or 1,000 sq. feet. The 1350 figure is to increase the quality of the housing. Stucker stated holding a small percent of their housing at this size doesn't jeopardize the City. It was discussed. Williams stated his concern for fire protection and the need for a station and trucks. He requested amenities before approval. He felt the citizens now in the City should not have to pay for fire protection for the new homes. Kingsford agreed. The Mayor requested a motion to table. It was discussed. Kingsford moved to table until a formula is developed to provide funds for fire protection seconded by Bodine. Stucker inquired if there was a time table for the study. Glaisyer stated it is being worked on. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea Williams Stated the restrictive covants should be submitted. Storey stated it is mandatory. Agenda 6 Taylor Subdivision, Bruce Stuart was present representing the request. Storey stated because of location he recommended the council approve it as C. Commercial. Glaisyer moved to rezone the parcel to -C- commercial with design review by council before and building permit is issued. Seconded by Bodine. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea Agenda 7 Doxo Properties (Preliminary Plat) Wayne Forrey was present representing the request. The location was outlined. Access to other properties was discussed. Ellsworth inquired why they didn't go straight thru. Forrey explained because of P&Z recommendations. i Meridian City Hall .3. January 2, 1979 lgenda 7 Williams read the comment sheet. Bodine pointed out there were no amenities to the City. Williams stated the same type of questions applied to this subdivision as to Lee Stuckers. Glaisyer moved to accept the preliminary plat on Doxo subdivision seconded by Kingsford. Glaisyer, yes; xingsford, yes; Williams, No; Bodine, No;. There being a tie vote the Mayor voted yes. ~.genda 8 Motion to authorize City Clerk to borrow funds to pay obligations of construction projects (Water-Sewer). The Mayor outlined the need for the funds. Ellsworth outlined the cash flow, there is a request in to EDA for $174,000 it has left settle. There is another request for $110,000 to EDA. EPA is retaining 10~ they have paid 80~ Engineering preparing a letter for an additional 10~. They have reviewed the ordinance thier are two items they wanted added to the Ordinance. (1) A copy of how the user charge system was developed be on file with the City Clerk for public inspection. When the Ordinance is adopted it will generate 10~ about $350,000. The paper work should be completed this week. The City is looking at borrowing for about one month. EDA is about 83~ complete treatment Plant is about 95a paid. The only large prodject left is Phase III, around $300,000. Bodine moved to auth~~QQ~oibz~e the City Clerk and Mayor to borrow funds for construction obligations up to ~.~O,OIXOseconded by Kingsford. He presented a statement of the company qualification to inguage in Muncipal Engineering (see Evidance). He explained the Engineering agreement and work order billing process. The work would be done on a time and material base he recommended a portion of time each week where the engineer is located in City Hall and has appointed schedual to conduct city business. The Mayor outlined the Engineering situation. City Engineer Ellsworth presented has report. Boise River Outfall pump station change order, for $345 to lay blocks in a stock bond vs a running bond. Change order # 4 Boise, River Outfall. Ellsworth recommended approval. Williams moved to approval change Order #4 Boise River Outfall Pump Station seconded by Glaisyer Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea; Boise River Outfall Schedule A pay estimate #8, for December, $11,983.62 the project is at 95$, all they have left is a air release valve and line test. Ellsworth recommended approval. Glaisyer moved to allow Boise River Outfall Schedule A, pay estimate #8 for December for $11,983.62 be approved seconded by Bodine. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea; Ellsworth stated the pay estimate could be with held for 30 days. Wastewater treatment Plant pay estimate #14 for December; for $4,319.04 to DVY Construction. Ellsworth recommended approval the project is 95~ complete. Williams moved to allow pay estimate #14, December, for $4,319.04 seconded by Bodine. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea; Ellsworth stated there may be problem with meeting the completion date of Feb 2, 1979 they are going to send a letter. It looks doubtfull that they will meet the date. City Hall 4. 19 Agenda 10 Agenda 11 Interceptor Sewer Line Phase III pay estimate #8, December, for $209,209.05, the project is 83~ complete by dollars spent. Ellsworth,t~ncommended approval. Glaisyer moved to allow Interceptor Sewer Line Phase III pay estimate #8, December, for $209,209.05 seconded by Bodine. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea; Engineering Statement 26, December, for $10,614.37 Ellsworth recommended approval. Bodine moved to allow the December Engineering Statement 26 for $10,614.37, seconded by Williams. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea; Ellsworth reported they have advertised for bid the pipe needed at the Park the bid opening has been set for January 17th at 4:30 p.m. at the City Hall. A Quorum of the council is needed. The Mayor expressed the City appreciation for~Carl Ellsworths service over the past few years. Glenn Hudson inquired about his annexation request. Cox explained the process. City Attorney Crookston reported Coleen Eggert had inquired what was happening with the latecomers' charges. He inquried what the City position was. The Mayor outlined possible alternatives. Kingsford inquired if it had already been authorized. Crookston stated his understanding was repayment was never clarified. Williams stated if it can be worked out to meet bonds requirements the City should take advantage of the researched. The latecomers' charges were discusse. Kingsford moved to instruct the City Attorney to contact Levit NuPacific and if they accept all associated costs in developing a latecomers' charge. The City Attorney is instructed to proceed in the development of a latecomers' charge seconded by Bodine. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea; The Mayor inquired about recovery of the flags. The matter was discussed. The Mayor read a letter from ACHD on the traffic light for Meridian and Cherry Lane. (See evidence) Fire Chief Welker discussed future planning for Fire protection. The City needs a program for outlining future needs. Agenda 12 Superintendent Stuart reported. Franklin Square is after acceptance for the water system, There are items not completed. Williams stated it will not be accepted until the ordinance are complied with.
