Cherry Lane Village #3, Preliminary Plat. (see evi- Gene Wright was present representing the request. He outlined the development( Bence ) Williams inquired if sidewalks would be set back on major streets. Wright clarified no. that Gary Smith outlined the Council needs to clarify standards or variance/will be required on most subdivisions. ACHD standards are 36' back to back, curb dimensions. City Ordinances call for 37'. Welker stated that his concerns with short radius Culdesac. Tt was discussed. Don Leavitt pointed out that you cannot turn the trucks around in any of the Culdesacs and they are shallow for backing out of. Wright pointed out changes in road design from the Master plan. They have exits evenly spaced on Cherry Lane. Williams inquired what Planning and Zoning recommended. Joy clarified that they recommended approval, granting variances. The Motion was made by Joseph Glaisyer and seconded by Richard Williams to approve Cherry Lane Village #3, Preliminary Plat with the requested variances. Motion Carried: Williams, yea; Glaisyer, yea; Kingsford, yea. Leavitt outlined the next nine holes for the Golf Course is dependent on the sale of the properties. He was in hopes that this summer things would move. The possibility of Late Commer Charges was discussed. Nu-Pacific will spend around $450,000. Crookston reported it has been discussed. It is necessary to protect the bonds; no money can be rebated. A late commers charge would have to be upfront, based on some formula. Leavitt inquired if Crookston had worked out an allocation process. Crookston stated that the solution to the problem will be determined by what formula is used. Leavitt volunteered Engineering to help resolve the situation. North West Pillow, Tabled 3/5/79 by request. Attorney Bill Donovan was present representing the request. He outlined the letter sent to Inspector Schoen and Fire Marshal Voss of changes they are proposing for improvements. They need something that is economically feasible. He felt that they are meeting the intent of the law, if not the letter of the law. Storey stated that he felt it was upgrading the building into a usable piece of property. Safer than standing empty. The City needs to use common sense, probably 90% of the businesses do not meet Codes but they are Grandfathered. Crookston stated that the situation is that they are remodeling and there are certain requirements that must be met to remodel. If they would not have remodeled they would have grandfather rights,when they started the process they must bring the building up to Code. .: y Meridian City Hall .2. March 19, 1979 Agenda North West Pillow (Cont'd) Mayor Storey stated that this leads to buildings not being remodeled. Provisions in the law allowing exemptions were outlined. Crookston continued, and stated that there is some latitude given to the people who enforce the Code and ultimately the City Council has latitude. Glaisyer inquired from Schoen if these corrections meet the spirit of the law. Schoen stated their use is not permitted in Fire Zone 1. There will have to be a variance from the Fire Zone. Second, there are too many other Code violations. The Mayor stated that this would discourage remodeling and the building in question should be used productively. The Motion was made by Glaisyer and seconded by Williams that the request for a variance from the Codes for North West Pillow be denied. Motion Carried: Williams, yea; Glaisyer, yea; Kingsford, yea Agenda 4 Cherry Lane Conditional Use Permit for an Office Complex Cecil and Kim Cherry were present representing the request. Kim Cherry outlined their proposal. They are requesting a Conditional Use Permit for a seven (7) building complex. Planning and Zoning has recommended approval contingent on traffic study and design review. Cherry outlined information obtained from ACRD. Williams stated that he wanted to see 4th Street developed across the property to ACHD Standards. He outlined the situation and stated property to the south will have to continue the road when they develop. Storey stated that those living on the west previously requested that the road not be completed. Glaisyer stated that he felt it needed rezoned. Storey stated that it would take about eight (8) weeks. A Conditional Use Permit for the Complex was discussed. Williams stated that this is similar to the Leishman Con:~itional Use Permit. It is more restrictive because it specifies what can go in there. If they have Commercial it would open it up. Light Commercial was discussed. Alternative types of zoning were discussed. Parking was outlined. The Motion was made by Glaisyer and seconded by Williams to approve a Conditional Use Permit until the property can be rezoned, for a Office Complex in the LDS Annex- ation on West Cherry Lane between West 3rd and West 4th with design review. Motion Carried: Williams, yea; Glaisyer, yea; Kingsford, yea K. Cherry inquired if the study requirements of Planning and Zoning have been met. Williams stated that Planning and Zoning requirements must be met. Agenda Reverend Pete Michaelson representing the Optimist Club was present and requested 5 the City Council pass a proclamation designating May 1 through May 7 as "Law Enforcement Week". This is supported by the Optimist International. He explained the request. "Law Enforcement Week Proclamation" (Cont'd) 1979 "WHEREAS, the problems of crime touch and affect all segments of our society under- mining and eroding the moral and economic strengths of our communities and their citizens, and WHEREAS, there is still a reluctance on the part of many citizens to involve them- selves in actions to insure the protection, rights and well-being of their fellow citizens, and WHEREAS, Optimist Clubs and their members co~iinue to sponsor and support programs aimed at combatting crime and disrespect for law through year-round efforts; now therefore be it RESOLVED, that I, Don M. Storey Mayor of Meridian, Idaho proclaim the week of May 1- 7, 1979, as RESPECT FOR LAW WEEK and ask all citizens of Meridian to join with the Optimists in carrying the message of respect for law to other citizens, and by example, exercise responsible citizenship." The Motion was made by Kingsford and seconded by Williams to declare a Proclamation that May 1 through May 7 be declared as "Law Eforcement Week". Motion Carried: Williams, yea; Kingsford, yea; Glaisyer, yea Acting Chief Scarborough reported the State has passed a new law on impounded autos. The result is that the City has to maintain it's own wrecking yard. The City can keep the impounded vehicle a designated period of time and procure a title to sell the vehicle. They need a place to store those picked up. Ward stated that he could store some at the Old Plant until arrangements can be made at the new plant. It was discussed. Williams stated that he hoped this encouraged the Police Department to keep the streets clear of junked cars or abandoned vehicles. Ward reported on a meeting with John Palmer, ACHD, requesting pre-construction meetings on subdivisions. There apparently is a problem on compaction requirements for roads in Cherry Lane Village #2. Storey stated ACRD is responsible for all roads inspection. Williams inquired why they called Ward and thought it was a problem between ACHD and the Subdivider. Ward stated compaction over sewer lines might effect the City. William stated that he appreciated them calling and encouraged Ward or Smith to attend any meetings but violations of compaction. ratios is monotored by ACHD. It was discussed. Storey inquired if there were any projections on Plant completion. Ward stated possibly May. Crookston presented an Ammended Ordinance 335 to correct the legal description The School District has requested the City Attorney present to the Council a request to look into a future acquisition map for school sites. Some questions need to be answered from the State Attorney General's Office, they need the City to request the opinion from the Attorney General. Kingsford requested clarification. Williams stated to a large extent this has been included in the Comprehensive Plan. ~ The City becomes this vehicle for acquisitions. ' r~, L- Crookston explained. Storey stated it is a far-fetched proposition to commit future Councils. It looks like another government agency digging for more studies. Crookston summarized the request for an Attorney Generals opinion. The Mayor instructed Crookston to request the opinion through a letter. • • 4. March 19, 1979 Agenda Attorney (Cont'd) 8 Williams inquired on the status of the new sewer water fees. He also inquired about impact fees and instructed Ida-Ore be contacted. Agenda Engineering 9 Gary Smith reported another water leak repaired by Traylor Construction. A letter needs to be sent to Miller Construction for the Idaho Construction bill. He presented a letter from North American Contractors. They procured two easement releases on Phase II Sewer Lines. They are finished except for connecting Phase II to the existing trunk lines. They have requested the City release, all but $500.00 of the retainage. The estimated cost for the connections from Traylor Construction was $1,750.00 to make the connection. Easements are from Mr. Duram and Mr. Huskey. Smith recommended retaining $2,000 and release the remainder. The Motion was made by Glaisyer and seconded by Kingsford to retain $2,000 of the retainage for North American Construction and release the balance. Motion Carried: Glaisyer, yea; Kingsford, yea; Williams, yea. Smith reported on a manhole on the Duram property. A consensus from those involved of 6" above ground was secured. However, one manhole happened to fall adjacent to an access road. The manhole doesn't allow him access. The manhole could be lowered or an extension on the pipe in the Creason Lateral. The estimate for lowering the manhole was $625.00, to lay the pipe $470.35. Smith recommended putting the pipe in. The Motion was made by Kingsford and seconded by Willimas to allow the placement of the pipe. Motion Carried: Kingsford, yea; Glaisyer, yea; Williams, yea Smith presented Engineering statements for General Engineering and the Construction project. General Engineering Statement $6, 1979 for November 20, 1978 through February 20, 1979 for $2,142.99. Construction Project Engineering Statement #27, dated 3.19.79 for $7,568.76. This increases EPA costs to 93% complete. EDA cost to 90% complete. The Motion was made by Glaisyer and seconded by Kingsford that Engineering Statements #6 and #27 be allowed. M., ADA COUNTY, IDAHO, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO.
