Johnson; Larry Scarborough; Agenda Minutes of the previous meeting and special meeting were read and approved. 1 Agenda 2 The Motion was made by Joseph Glaisyer and seconded by Grant Kingsford that the Beer License be transferred from The Brass Lamp to Calico Pizza. Motion Carried: Williams, yea; Bodine, yea; Glaisyer, yea; Kingsford, yea. Agenda 3 North West Pillow Products Chuck Nichol. was present representing North West Pillow, located in Bowers 2nd Add. Nichols distributed a letter of attempt to work out problems relating to not complying with Codes and breakdown of cost to bring the building in question up to Code. The letter requested 18 months to comply with 1) Sprinkling system 2) Four hour fire wall and 3) restrooms. This was discussed. ' The Motion was made by Bodine that the Council grant North West Pillow Products 18 months and look into the project periodically. Motion dies for lack of a second. Williams stated that he could see the bind they are in and inquired about the expansion plans. This was discussed. Kingsford inquired if there has been architectural inspection as to the building being sound. Nichol stated that the architect said very little and left him up in the air. Kingsford stated that he would be inclined to second the motion if there was an architect's commitment that the backend of .the building is safe. led Hanson, owner of the building, asked for clarification of an architect's commitment. Kingsford again stated that if North West Pillow Products bring in a structural architects commitment that the building is safe he will second this motion. Hanson inquired if the Engineers report wouldn't be sufficient. Nichol did not have this report with him to present. Hanson stated that Nichol had complied with the first two requirements when he first come before the Council. The structure strength of the building was discussed. The Motion was made by Kingsford and seconded by Williams that a variance be granted to Northwest Pillow Products from the UBC and Fire and Life Safety Codes as stated in the letter by Chuck Nichols dated April 2, 1979, subject to the following conditions: 1) That a Completion Bond be presented 2) The Company will comply with all items requested by the Building Inspector and Fire Marshal by October 1, 1979 except for: a. the sprinkling system b. the four hour fire wall c. the restrooms 3) The Company will comply with the above three items by October 1, 1980 4) In the interim the Company will provide adequate fire extinguishers as defined by the Fire Marshal and will construct the four hour fire wall immediately if the westerly property is developed. 5) The Building Inspector will provide interim reports to the City Council on the progress on October 1, 1979 and October 1, 1980 6) That the Company provide the City a report from a licensed structural Engineer stating the building, on the North side, is safe as to floors, ceilings walls and basement. Motion Carried: Williams, yea; Glaisyer, yea; Kingsford, yea; Bodine, yea Meridian City Hall Agenda 4 Leishman 4-Plex - Located 210 E. Ada Street 1 2, 1979 Gordon Leishman was present representing the proposal which was approved ~s 3 units instead of 4 units by the P&Z Commission. The Motion was made by Glaisyer and seconded by Bodine to accept Leishman's request of a Tri-Plex. Motion Carried: Williams, yea; Kingsford, yea; Bodine, yea; Glaisyer, yea. Agenda 5 South Gate Annexation -(Located West of Meridian Street on Overland.) John W. Cooknell was present representing Mar-Mon Developers, Proposed South Gate Annex. Cooknell presented each member with Vicinity Maps, letter of proposed landscaping commitment, Legal Description of I-80 involved in Annexation of South Gate and 1 Map of proposed Water and Sewer Lines for Southgate Retailers Center for file. Cooknell displayed aerial photographs of the area taken in 1978, Cooknell stated that the Center will be built in two phases. This is Commercial Retail and is not going to bring Children into the schools and it is not going to bring an extra load for City facilities. Cooknell stated that the Center will bring dollars into the community and an excess of 250 employees. The Motion was made by Joseph Glaisyer and seconded by Marvin Bodine to accept the South Gate Annexation. Williams, nay; Kingsford, nay; Bodine, yea; Glaisyer, yea. Motion Carried with the Mayor breaking the tie. Agenda 6 Crestwood Estates Subdivision #3 -Located Southeast Intersection of Linder & Franklin Glaisyer abstained from action. John Matzinger, Engineer and Dave Schmidt, Consultant, were present representing Crestwood Estates Subdivision #3. Gary Smith, Engineer stated that the main concern was the overall traffic pattern and general development plan to the property to the South. The primary problem is extension of streets across Ten Mile Drain. Access was discussed. Basic plan was to have less traffic on and off Franklin and use Linde r. for safety. Fire Chief Welker stated that area to the South should have another entrance way and a large area within the center part of Subdivision that would be very difficult to get into, or turn around, with Fire Truck. The Motion was made by Williams and seconded by Kingsford to approve Crestwood Estates Subdivision #3 Preliminary Plat with the stipulation of regulation of the Fire Marshal being taken in account. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea Glaisyer, Abstain Agenda 7 Cherry Creek Mobile Manor - (Located SW Intersection of Cherry Lane & Linder) Jim Fuller was present representing proposal as owner Mel Cope spoke, representing Jim Fuller, stating that proposal involves 52 Acres of Mobile Home Park, 265 Mobile Home spaces.. City sewer & City water. Mayor Storey stated that caution should be used upon approval of Mobile Home Parks as several have been turned down in past years. Cope distributed a report from the Ada County Assessor explaining the tax base. Lift Station was discussed. Ward stated that he felt that using the lift station of Cherry Lane Village would put undue stress on that one lift station. Ric Orton stated that Fuller plans to include a lift station in the third phase of the development, approximately 3 to 5 years. The first two phases would be in the gravity portion and the third phase would include the portion that has to be served by gravity.to the lift station and then up and out. Meridian Citv Hall Agenda Cherry Creek Mobile Manor (Cont'd) 7 3. 2 Orton explained that the lift station would be maintained and operated by the owner of the Park (Fuller) As soon as the trunk line comes up Black Cat Road through Ten Mile Creek, across Fuller's property, then the lift station would be abandoned. Orton explained the water system plan. Plan is from Comprehensive Plan - calls for minimum 6" lines with 10" lines extended on a quarter section line, deadends for extension later on. Hydrant and Valuing locations have been set up that meets the wording of the Comprehensive Plan. The Mayor read from the comment sheet. Police and Fire protection was discussed. Cope stated that he didn't see that it would be any problem with a Mobile Home Park this size compared to a Subdivision the same size, and that they shouldn't be treated any differently. Jack Yoho introduced himself as representing residents of Cherry Lane Village and presented a petition that read as follows: "We the undersigned residents of Cherry Lane Village object the plan of establishing a Trailer Court or Mobile Home Park south of this Subdivision on Cherry Lane. The City of Meridian and the Developers have established a very Comprehensive and a high standard Subdivision in the required covenants which are on record. This Subdivision and Golf Course with it's high standards has made Meridian an inviting place to consider for residence. The development of this Trailer Court so close to the Subdivision and Golf Course will detract from the desired goals of the City of Meridian and the residents of this Subdivision." Yoho stated that there are 12 families presently occupying the Subdivision. Eight families have signed, the remaining four have not been contacted because of the ti::~e frame. The Motion was made by Glaisyer that the request be denied. Williams assced upon what basis. Glaisyer stated that one thing the City has a moritorium on Mobile Homes, we have to wait until the ordinances are complete, there is a group that is opposed to it that was not realized before and the other comments that were made indicates disapproval. Lift station was discussed. Flotion `.hat the request be denied was seconded by Kingsford. Motion Carried: Glaisyer, yea; Kingsford, yea; Williams, yea Bodine, abstained Agenda 8 Cherry Creek A!!nex Rezane to Commercial - S/4i Intersection of Ten Miie and Cherry Ln. The Motion wd5 made by Glaisyer and seconded by Williams thai; the the rezona requn.; from Residential to Commercial, approximately 9.2 acres in Cherry Creek Annexation, with design review. Motion Carried: Bodine, yea; Kingsford, yea; Williams, yea; Glaisyer, yea Lift Station was discussed. Orton explained that there is a plan for the waste in this section is in the same drainage as Cherry Lane Village. Yoho inquired if this proposal include the storage units,(just the corner) Discussion was that there would not be any reason for a lift station. A Lift Station would not be required on this commercial property. ridian City Hall .4. Agenda Meridian Park Subdivision #1 - Final Plat 9 Roy Johnson, Engineer and Gary Crandall, Developer was present representing Subdivision. Johnson explained that Meridian Park Sub. #1 consists of approximately 88 lots and is located on Linder Road, about 1/2 mile North of Cherry Lane; they have all Central services. Trunk line, 12" line, water connections and landscaping was discussed. Sewer lines discussed. No restrictive covenants have been made but can be brought for approval at any time as explained by Joe Osier. Mr. Osier stated the restrictive covenants were not brought up for Preliminary but this is a new owner at this time. Ward stated there were no problems as far as his Department Johnson stated that he had no problems with working with any of the .City's Departments, and as far as fire hydrant locations and such to meet standards, he would set down with them and work these things out. The Motion was made by Kingsford and seconded by Williams to table Meridian Park Subdivision #l, Final Plat, pending submitting restrictive covenants and the Department Heads view. Storey instructed Johnson to get with the Engineer, Fire Chief and Stuart Agonda Terra Subdivision - Plat and Plan Review West Idaho Street Roy Johnson representing. Lots are 4-Plex lots approved by Council, Central Water and Sewer. Williams questioned 8" line (sewer) running along the back and that jogs over to another existing manhole. Gary Smith stated that there was a problem with the dedication of the right-of-way through Gem Estates (to the left). The Motion was made by Williams and seconded by Glaisyer that Terra Subdivision work out sewer plans before reviewing at next Council meeting. Agenda 11 John Haraburda - not present Ron Later - not present Mayor Storey explained that Ron Later is proposing a Fruit processing plant in the warehouse behind the Creamery building. He stated that this is one of the hardest effluents to process. All Councilmen agree the fruit processing plant would be unfavorable and should came before the Council. Agenda 12 ENGINEERING Gary Smith presented three (3) Bills and recommended approval. The Motion was made by Bodine and seconded by Williams that Pay Estimate #9, Boise River Outfall Pump Station, from 2.20.79 to 3.27.79, DVY Construction, in the amount of $7,081.05 be :approved. Motion Carried: Glaisyer, yea; Bodine, yea; Kingsford, yea; Williams, yea. The Motion was made by Williams and seconded by Bodine that Pay Estimate #16, DVY Construction Co., Sewer Treatment Facility, from 2.20.79 to 3.27.79, in the amount of $12,601.80. Motion Carried: Williams, yea; Kingsford, yea; Bodine, yea; Glaisyer, yea. The Motion was made by Kingsford and seconded by Bodine that Pay Estimate #9, Galey Construction Company, Phase III Interceptor Sewer Line, from 12.25.78 to 3.25.79, in the amount of $88,174.77 be approved. Motion Carried: Glaisyer, yea; Bodine, yea; Kingsford, yea; Williams, yea. Meridian City Hall .5. April 2, 1979 Agenda Mayor Storey read letter from Bill Sacht, Idaho Department of Transportation, asking 13 for a letter the City stating that the new Interchange will not adversely affect the City's core area. The Motion was made by Williams and seconded by Bodine that the City write Idaho State Transportant that the Interchange would not adversely affect the City's core area. Motion passed: Bodine, yea; Glaisyer, yea; Kingsford, yea; Williams, yea. Agenda DEPARTMENT REPORTS 14 Kingsford called upon Fire Chief Welker to comment on the State Firemen's School. Welker explained that four (4) Fireman are to go to this Training School. Storey stated he could/nothing wrong with that. see Stuart, Work's Department, inquired if the pumps should be fenced. He reported that the 10" water main that he ties into in Settlers Village will only be 31" deep. Building Inspector, No report Waste Treatment, No report Acting Police Chief reported on adopting Ordinance increasing fee for removal, tow-in and storage of junk vehicles. Agenda 15 The Mayor read Ordinance No. 337 entitled: AN ORDINANCE AMENDING TITLE VIII Chapter 18, Entitled Police Regulations of the Revised and compiled ordinances of the City of Meridian, Ada County, Idaho, by increasing the fifty Cent fee for removal, tow-in and storage by the City of Meridian of junk vehicles to two dollars. The Motion was made by Williams and seconded by Glaisyer that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 337 as read be passed and approved. REMOVAL, TOW-IN AND STORAGE BY THE CITY OF MERIDIAN OF JUNK VEHICLES TO TWO DOLLARS.. WHEREAS, The City Council and the Daayor of the City of Meridian, Idaho have concluded that it is in the best interest of said City to amend Title VIII, Chapter 18, Section 8-1810,' Removal of Junk Vehicle, NOW, THEREFORE, BE IT ORDAINED BY THE I~.AYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. Section 1. That Section 8-1810 is hereby amended to read as follows: 9-1810: REMOVAL OF JUNK VEHICLE: If said junk vehicle, vehicles or parts thereof are not removed within the tine so fixed, the Police Department or Building Department may cause said junk vehicle, vehicles or parts thereof to be re- moved and the actual costs of removal or tow-in charge and a storage of two dollars ($2.00) per day for so long as the same is in possession and custody of the City shall be charged to the owner. In the event said junk motor vehicle, vehicles, or parts thereof are not claimed by the lawful owner, then and in that event the same shall be sold according to law. Section 2. Whereas, there is an emergency therefor, which emergency is hereby declared to exist, this Ordinance shall take effect and be in force and effect from and after its passage, approval and publication as required by law.
