The Motion was made by Glaisyer and seconded by Bodine that LaWana Niemann be appointed as City Clerk. Motion passed: Glaisyer, yea; Bodine, yea; Kingsford, yea; Williams, yea. Agenda 1 Meridian Park Subdivision Final Plat Roy B. Johnson was present representing Meridian Park Subdivision Final Plat. Johnson stated that they had resolved everything with J-U-B Engineer, Smith. Smith stated that he had gone over the revised plans and had advised them that the City does not take any responsibility for storm water run-off on the Subdivision streets, that this is handled with the Nampa-Meridian Irrigation District. Johnson stated that the two (2) manholes have been added for 14th and 15th streets that tie into the old subdivision that is proposed to the north. Within a week he will submit a final plat on the exterior Subdivision and will be deleting the manholes. The Motion was made by Glaisyer and seconded by Bodine that Meridian Park Subdivision Final Plat be approved. Motion passed: Williams, yea; Kingsford, yea; Bodine, yea; Glaisyer, yea. Agenda 2 Revised Glennfield Manor Marilyn Olmstead, J-U-B Engineers, Inc., represented the Revised Glennfield Manor Preliminary Plat, located on Linder, north of Cherry Lane. Olmstead stated that lots per acre is 3.9, dwellings per acre is 4.0. Kingsford stated that Sandlewood Drive which will hook up with Meridian Manor !E3 should be checked. Williams stated that there were some problems with street names in adjoining subdivisions, they were not consistent to the east. The Motion was made by Glaisyer and seconded by Bodine that the Preliminary Plat of Revised Glennfield Manor be approved. Motion passed: Bodine, yea; Williams, yea; Kingsford, yea; Glaisyer, yea. Agenda 3 The Mayor read Amended Ordinance No. 338 entitled: AN ORDINANCE AMENDING TITLE 5 CHAPTER 1, WATER SYSTEM EY PROVIDING FOR A MONETARY DEPOSIT UNDER CERTAIN CIRCUM- STANCES: CHANGING THE FEES FOR TURNING THE WATEROFF AND ON; AND PROVIDING AN EFFECTIVE DATE. The Piotion was made by Williams and seconded by Kingsford that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Amended Ordinance No. 338 as read be passed and approved. Agenda Chiropractic Clinic - No representation 4 Agenda Wanda Hepper Addition -Located North of James Court and East of Meridian Manor Add. 5 Keith Loveless, Loveless Engineering, was present representing Wanda Hepper Addition. Loveless stated that they felt this Addition would be filling in gaps instead of leaving gaps. Williams stated that this annexation should wait until the City's Ordinances are completed. There was discussion. Wanda Hepper stated that there is a home and that the property consisted of two (2) acres; next to Blue Heron Lane. Bodine stated that he could not see any problem if all they were asking for was annexation. The Motion was made by Williams and seconded by Glaisyer that the Wanda Hepper Addition annexation request be denied. Motion Carried: Williams, yea; Kingsford, yea; Glaisyer, yea Bodine, nay Agenda 6 Southgate Annexation - Located West of Meridian Street on Overland Road John Cooknell was present representing Southgate Annexation. Cooknell stated that they had some indepth discussion with the Irrigation District and that they have no problems with their designs for tiling ditches to provide water for the neighbors and for storm drain run-off. He stated they have also had preliminary plans for water connections under the direction of Planning and Zoning and sewer connection routes are being reviewed by the City Engineers for the best aspect of the City of Meridian. Williams expressed concern that the shopping center would threaten future development because of the federal non-attainment air quality control zone. Cooknell stated that he had met with the state air quality people and decided to reduce the number of parking spaces to less than 1,000. There was discussion and it was decided that there was insufficient data to accurately analyze the impact on air quality. Mayor Storey stated that the developer would help getting the sewer and water lines across the Interstate. The Motion was made by Bodine and seconded by Glaisyer that Southgate Annexation be approved. Motion Carried: Glaisyer, yea; Bodine, yea; Kingsford, nay; Williams, nay Mayor Storey voted yea, breaking the tie. Agenda 7 Rappleye request of Duplex - Located on lot next to 1435 W. 1st Street Lee Stucker was present representing. Carol Rappleye's request to build a duplex on lot next to 1435 W. 1st Street. Stucker stated that none of the neighbors object to putting a duplex on this lot. He stated that they had obtained eight (8) of the eleven signatures. There were two (2) that did object. Wastewater Superintendent Ward spoke concerning the easement running at the back of the property. The Motion was made by Williams and seconded by Kingsford that the Rappleye request of a Duplex on vacant lot next to 1435 W. 1st Street be approved, contingent upon the granting of an easement to provide proper access back to the sewer line. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Agenda 8 Set-back variance - Randy Cope Located in Meadow View Sub. 111 1531 Kingswood. The Motion was made by Glaisyer and seconded by Kingsford to approve an eight (8) foot Variance, 1531 Kingswood. - Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea,, Meridian City Hall .3. Agenda 9 Annual Appropriation Bill known as Ordinance Number 328. Attorney Crookston Jr. advised the Mayor and Council that the Bill be tabled until the next regular meeting. The Motion was made by Kingsford and seconded by Glaisyer that the Amended Annual Appropriation Bill be tabled until the next regular meeting. Motion Carried: Williams., yea; Bodine, yea; Glaisyer, yea; Kingsford, yea. Agenda 10 Union Pacific Railroad Company - Letter of renewal of License Agreement covering pipeline crossing. Gary Smith, Engineer, stated that he thought this crossing was part of Phase III Sewer and the end of the Boise-Cascade yard. Agreement was tabled until the next regular meeting. Agenda 11 Williamsen Truck Equipment - West of Meridian Street on Overland Road Steve Bowman was present representing Williamsen Truck Equipment. Bowman requested that the Mayor and Council write a letter, as a hody, to the Ada County Zoning approving the zone change from Agricultural to Commercial by May 24, 1979. Glaisyer agreed with Kingsford that the City send a letter to County Zoning. Williams stated that in all fairness to Williamsen Truck that this .should be done. He stated that his comments had been in favor if they agree to accept City services of water and sewer at the site at the inception of a project; and that Annexation would be if they state in writing that they would be willing to come into the City upon the time the time they are contiguous. There was disucssion. Morgan Plant stated that he wanted to know where the sewer was coming in - if it was on his property. He would not commit to requesting annexation until he knew where the sewer line was coming in. Plant stated that he had seen three different routes which would make quits $ difference_doliar wise. Kingsford stated that he would like to see the letter written as a body in favor of the zone change to Ada County Zoning. Williams recommended that a letter be written and directed to the Ada County Commissioners Agenda Proposed Development Procedures. 12 Mayor Storey read the charges for development procedures to be discussed. There was discussion. Willia ms stated that he would like to see an expansion on these fees. Mayor Storey instructed Williams to study and present a policy concerning the charges for de velopments for the next regular meeting. Wastewater Superintendent Ward had no report. At this time Mayor Storey presented Earl Ward with a Certificate for Class III Wastewater Treatment Operator from the Idaho Wastewater Treatment. Ward was congratulated and received applause. Ward was instructed to present Certificates to Fred Putzier and Norma Wingfield as Class I Operators. Fire Commissioner Kingsford explained the need of a backup power for the fire siren. Storey instructed Kingsford and Fire Chief Welker to take care of this matter. Kingsford stated that the City portion would be approximately $600.00. Agenda CONSULTANT REPORT 15 Gary Smith, J-U-B Engineers, Inc., recommended to the Council payment of Pay Estimate No. 10, Interceptor Sewer Line Construction, Phase III to Galey Construction for period of March 26, 1979 to April 30, 1979; in the amount of $36,009.26. The Motion was made by Bodine and seconded by Kingsford that the bill to Galey Construction in the amount of $36,009.26 for Pay Estimate No. 10, Interceptor Sewer Line Construction Phase III be approved. Agenda Mayor Storey read the letter from Fourth District Court from Gordon Lamm stating 16 that the Court that has been held at the City Hall will be discontinued as of May 11th, 1979. There was discussion. Williams stated that there will a large amount of time on the part o£ the officers commuting to the Boise Court (4th District Court on Kootenai St) Storey urged those attending to write the Ada Commissioners in reference to maintaining the license bureau. Agenda The Mayor read Ordinance No. 341 entitled: AN ORDINANCE ANNEXING AND ZONING CERTAIN 17 REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS: THE NORTH 40.00 FEET OF THE NE 1/4 NE 1/4 SECTION 24, TOWNSHIP 3 NORTH, RANGE 1 idEST OF THE BOISE MERIDIAN, THE SE 1/4 SE 1/4 AND A PORTION OF THE NE 1/4 SE 1/4 OF SECTION 13, TOWNSHIP 3 NORTH, RANGE 1 WEST OF THE BOISE MERIDIAN AND A PORTION OF THE GOVERNMENT LOT 3 AND THE GOVERNMENT LOT 4 OF SECTION 18, TO[,iNSHIP 3 NORTH, RANGE 1 EAST OF THE BOISE MERIDIAN, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. He stated that he had 18 enjoyed working with the people of Meridian and felt it is the best City in the State. After almost 27 years Don M. Storey stepped down. President of Council Richard Williams presided as Mayor and personally thanked Storey for the service he has rendered to the City of Meridian. Williams called for a Motion by the Council to appoint the vacancy of the position of the Mayor of the City of Meridian. WHEREAS, The City Council and the Mayor of the City of Meridian, Idaho have concluded that it is in the best interest of said City to amend Title 5, Chapter 1, Water System, of the Revised and Compiled Ordinances of the City of Meridian, NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: Section 1. That Section 5-133 is hereby amended to read AMBROSE. FIT2GERALD & CROOKSTON pTTO qN EYS RNO CO pNSE LO RS as follows: 5-133 REGARDING DELINQUENCY: The City Clerk shall furnish to each property owner, landlord, or his agent on the first of each month a statement of the amount due for water for the preceding month or up to the time that the meter has been read; and if any person neglects to pay his water rent by the tenth day of the month, or shall fail or refuse to pay the water rates charged against him the water user's account shall be delinquent. 6Vater consumers should be notified by regular mail of this delinquency and if the bill is not paid in full within ten days after service of this notification on the water consumer the right to water shall cease and terminate unless the water consumer requests a pre-termination hearing. :Should the water consumer not request. a pre-termination hearing or if an adverse decision is rendered against the water consumer as a result of the pre- termination hearing, the City of Meridian may require the water consumer to pay the delinquent water bill attributable to his own use, plus a five dollar turn-on charge as a condition of receiving water service again. Any water user not using water after the first of the month, or in case a meter is used after the meter has been read, must report the same to the City Clerk and have the water shut off, and if he fails to do so, the full amount for said month must be paid. No allowance will be made for non-use for less than one month. P.11 corrections as to charge and all abate ments shall be made under the direction of the Mayor and Council and shall be certified by the City Clerk, and all water rents must be paid by the owner of the property upon which the same is used an not by the tenants thereof. The City of Meridian, in its delinquency notice to all water con- sumers shall inform in writing all water consumers of their right to a pre-termination hearing, with such hearing to be held with the due process protection described below; and will not discontinue water service to any water consumer prior to a fair and impartial hearing, after timely and adequate notice and an opportunity to con front witnesses, to personally appear with retained counsel to be judged on facts adduced at the hearing and to otherwise be heard and defend the claim made by the City of Meridian, if a pre- termination hearing is requested by any water consumer. The City Council shall make a record of any pre-termina- tion hearing. The City Council shall render its decision in writin giving the reasons for its determination. In decisions adverse to the water consumer, the City Council will inform the water con- sumer of the right to appeal the decision pursuant to the Idaho State Administrative Procedures Act. Provided, however, the City of Meridian shall not initially deny or discontinue water service to any water consumer because of any delinquent water bill on that premises that is attributable to the prior water use of another water consumer. However, any and all unpaid water charges shall be a lien against the property as pro- vided below. Provided further that the City of Meridian shall not initially deny water service to any water user for whatever reasor. without informing the water consumer of the right to a hearing before the City Council on the issue of whether the City of Meridia can initially deny water services. In the case of an initial denial of water service, the City of Meridian is not required to provide water service pending a hearing. However, a hearing upon request of a water consumer initially denied water service shall be held as expeditiously as possible and held in the manner and accordance with the procedures for pre-termination hearings delin- eated above. All delinquent charges or fees, as provided by this Ordinance not paid after the final determination of the delinquent account shall be imposed as a lien against and upon the property or premises against which such charge or fee is levied or assessed; and the Clerk shall, at the time of certifying the City taxes, certify such delinquencies together with all penalties to the Tax Collector of Ada County, and when so certified, the same shall be a lien upon the property. All monies collected by the Clerk under the provisions of this Section shall be paid over to the City Treasurer in the same manner as is required for the payment of other City monies. Section 2. Whereas, there is an emergency therefor, which emergency is hereby delcared to exist, this Ordinance shall take effect and be in Force and effect from and after its passage, approval and publication as required by law.
