M. Councilmen present: Richard Williams; Marvin Bodine; Grant Kingsford; Bill Brewer Others present: Ray Heinzel; Vern Schoen; Roger Welker; Bruce Stuart; Roger Sherwin; Wayne G. Crookston Jr; Teresa Sidener; Charlene Smith; Lillie Vance; Glen Hudson; R. B. Glenn; John Matzinger; Gary Smith, Engineer; LeRoy Atwood. Block 6." Agenda A Stinky hlart Car Lot Ray Heinzel was present, representing his request for operating a car lot at the Stinky Mart on the corner of E. 1st St. and W. Pine. There was discussion as to the process of obtaining a car dealers license using that address since Heinzel claimed that dealers license had been issued at that address from the State August 25, 1976 through December 31, 1977. Crookston Jr. stated that Heinzel, by City Ordinance, still has to have a Public Hearing for operating a car lot, appear before Planning and Zoning and then Council. Grandfather rights have nothing to do with this request now. hlayor Glaisyer stated that the Council will uphold the Counselor's statement. The Motion was made by Kingsford and seconded by Brewer that the special permit required by Ordinance fora car lot operation on the corner of W. 1st St. and W. Pine be denied. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Agenda 1 Crestwood Estates Centre Valley Rezone Request - Shopping Mall - Located S.E. intersection of Linder and Franklin. Glaisyer abstained and turned the meeting to Williams, President of Council. R. B. Glenn, Crestwood, Inc. and John Matzinger, CTM was present, representing rezone request for shopping mall. There was discussion. Williams' concern was fire protection and assurance that landscaping would meet approval. Kingsford agreed that design review would be required to guarantee landscaping. The Motion was made by Kingsford and seconded by Bodine that the Rezone Request of Crestwood Estates Centre Valley be approved subject to design review. Motion Carried: Bodine, yea; Kingsford, yea; Brewer, yea. Agenda Williams turned the floor back to Mayor 2 Char-'lies Catering Conditional Use - Located at 101 W. Pine St. Charlene Smith vaas present, representing Char-'lies Catering Conditional Use requested for 101 4i. Pine. Smith explained they would like to use this residence as a reception center and an area for catered luncheons. Only change would be adding a glassed in porch. Parking was discussed. Smith stated that property parking was approximately 22 and that the school had agreed they could use lot across the street. • ~~ Meridian City Hall .2. June 4 1979 Bodine stated there may be parking problems with neighbors. He also asked about Ada County Health requirements. Smith explained they have heir approval. Seating would stay below 100. There is usually a "come and go" process for receptions. Signatures of neighborhood have been filed with City Clerk. Brewer inquired if there would be catering out. Smith answered there would be few cases. The Motion was made by Bodine to recommend denial. Smith stated that Planning and Zoning had gone through making a decision and if it was denied the home would deteriorate. Chief Sherwin questioned service of beer and wine. Smith stated absolutely not. The Motion died for lack of a second. Williams stated that a Conditional Use Permit should be reviewed annually, suggesting that there be a trial period of one year. If parking was found to be a problem, the Conditional Use Permit can be revoked. The Motion was made by Williams and seconded by Brewer that the Conditional Use Permit request for Char-'lies Catering at 101 W. Pine be tabled until the June 18th meeting, pending study by the Fire Marshall and Building Inspector for Fire and Life Safety Codes Compliance. Agenda 3 Agenda 4 At this time of 8:30 Ray Heinzel stepped to the Council table out of order and stated that he would not be on the agenda June 18, 1979. Linda Albrecht Catering - No representation. Leisman Addition Set-back Variance LeRoy Atwood was present, representing set-back, Lot 1, Block 1 on the corner of W. Pine and Linder. The house is to be taken out. It is 10 feet off Linder and 15 feet off W. Pine. There was discussion. The Motion was made by Kingsford and seconded by Bodine to grant Leisman Addition Set-back Variance and that there will be a landscaping plan to be approved by the Council. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Agenda 5 Hudson-Mitich Annexation #2 "D" Light Industrial Glenn Hudson was present to explain the type of business, general lay-out of storage buildings and proposed Frito-Lay Product building. Five fire hydrants i. -; water and sewer lines are in. Stuart stated that water main would be for fire use only for storage units and it would be up to fiudson to maintain the water main, plus the City would charge for the use of stand-by fire lines. The City would not heed an easement for water lines. Welker stated fire hydrants would be changed to other side of alley way. Brewer asked for a more detailed plot plan landscaping and design of building. Hudson stated there would be more of the mini storage buildings and an attractive Frito-Lay building. The Motion was made by Williams and seconded by Bodine to accept Hudson- Plitich Annexation #2 "D" Light Industrial, subject to review of the roadway access, landscaping plan, planned development review as requested by Planning and Zoning. The Motion was made by Williams and seconded by Brewer that Pay Estimate No. 17, DVY Construction Company, in the amount of $36,790.33 be paid. The Motion was made by Williams and seconded by Bodine to authorize the Mayor to sign the request for reimbursement from EPA regarding the waste treatment facility for $148,511.93. Agenda 8 The Motion was made by Kingsford and seconded by Bodine to authorize the City Attorney to draw up an Ordinance for Planning, Zoning, Subdivision and Other Fees Schedule for the July 2nd meeting, consulting with Councilman Williams. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Williams explained Sewer Easement description document received at City Hall for Cherry Lane Village. Mayor Glaisyer stated that all Departments will begin using a purchase order agreement. Anytime a Department wants something, it will be signed by that Department's Commissioners. Each Department will be assigned a purchase order book which will be controlled at City Hall. Williams invited City Employees to an Open House in honor of Don Storey and Mayor Joseph Glaisyer on June 8th, 5 to 7 to be held at his home, 917 Storey Ave. The Motion vaas made by Kingsford and seconded by Bodine that the meeting be adjourned at 9:05 P.M.
