APPROVED that water bills be paid by customers with water going through their meters, regardless of "onion flavored water." t4eridian City Hall August 6, 1979 Meeting called to order by Mayor Joseph Glaisyer at 7:35 P.M. Councilmen present: Richard Williams; Marvin Bodine; Grant Kingsford; Bill Brewer. Others present: Brad Strawn; Dale Loyd; David J. Dean; Michael L. Frost; Roger Welker; Bruce Stuart; Gary D. Smith; Earl Ward; Dennis Wright; Vern Schoen; Mark Mattefs; Solveig Davis; Katie Kartchner. Allan Marsh; Joe Evans. Minutes of previous meeting were approved as amended. Agenda 1 Hendren Annexation #2 "A" Residential - 20.26 acres, adjacent to Treasu~e Valley Mall and East of Hendren Commercial. Mike Frost, J-U-B Engineers was present, representing Annexation request. Frost requested action on this matter be table until after the City Zoning Ordinances are adopted and so that they will know what to respond to on density. The Motion was made by Kingsford and seconded by Brewer to table Hendren Annexation #2. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Mayor Glaisyer called for hearing on Hendren Annexation #2. No comment. Hearing closed. Agenda 2 David Dean was present, representing Western Recycling. Dean wanted input from the Council upon moving their business into the Wyeth Laboratory Building. He stated that this would be a clean business. Mayor Glaisyer requested that the Building Inspector Schoen work with Mr. Dean and report back to Council. 4illiams suggested that they consider the Fire Zone, as this could cause a problem if not resolved now. Agenda 3 Beer and Wine Transfer, Farmers Club Joe Evans and Allan Marsh were present, requesting the transfer as Evans has leased the building from Don Bennett, the present owner and is eligible for a State Liquor License. Mayor Glaisyer asked for comments. It was the feeling of the Council and Police Chief that additional time is needed for research. The Motion was made by Bodine and seconded by Brewer that the request for Transfer of Beer and Wine License from Allan Marsh, Farmers Club, to Joe Evans be tabled until the next meeting, August 20, 1979. h1otion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. ~~J Meridian City Hall .2. August 6, 1979 Agenda 4 Keystore Pizza Beer License Transfer was requested by Martin Mattefs. There were no objections to this transfer. The Motion was made by Kingsford and seconded by Bodine that the Keystone Pizza Beer License be transferred to the new owners, Martin Mattefs representing. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Agenda 5 Katie Kartchner and Solvei9 Davis were present, requesting a Beer and Wine License for their restaurant business known as the Troll Kettle. There was an error in the signature on the license application and a new application will be presented at the next meeting on August 20th, 1979. The Motion was made by Williams and seconded by Kingsford to table the Troll Kettle application for Beer and Wine License until the August 20th meeting. Agenda 7 The Mayor read Resolution #71, Entitled: A RESOLUTION AUTHORIZING PUBLICATION OF AN ESTIMATE OF THE EXPENSES FOR ALL PURPOSES FOR THE CITY OF h1ERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR BEGINNING THE 1ST DAY OF OCTOBER, 1979, AND ENDING THE 30TH DAY OF SEPTEh16ER, 1980, AND GIVING NOTICE OF PUBLIC HEARING PRIOR TO THE PASSAGE OF THE ANNUAL APPROPRIATION BILL. The Plotion was made by Kingsford and seconded by Williams that the City advertise for bids for construction of the 1979 parking area of the park, opening of bids to be at 2:00 P.M., August 23, 1979 at City Hall. Agenda 10 Engineering; Smith reported that there is a contractor that is ma king. repairs on broken pipe on the Sewer Rehab project. There is a Change Order through Rodding Cleaning Machines. He stated they were doing a good job on repiars. Agenda 11 Smith reported that DVY had submitted a Pay Estimate which he had received at 1:30 P.M. this day and had not been analized. DVY were requesting approximately $102,000.00. He could not recommend payment at this time. Department Reports: The Mayor called for Department Reports. Ward, Waste Water Superintendent, announced that the new Plant went on line the 26th of July, 1979, and only small problems. Attorney Crookston Jr. reported on the Renewal Rider Agreement, Temporary Construction Sites from the Union Pacific Railroad, in the amount of $150.00 with a $50.00 preparation charge. This is to be studied before agreement signed. Chief Sherwin presented Parking Ordinances. Chief Sherwin was commended upon doing a good job in preparing the Parking Ordinance proposal. The Motion was made by Bodine and seconded by Williams to approve preparation and publication of Parking Ordinance. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Meridian City Hall .4. August 6, 1979 Stuart, Public Works Superintendent, reported oh East Carlton Water Line improvement. There was discussion on Latecomer's :Charge. The Motion was made by Williams and seconded by Brewer that the City Attorney be instructed to arepare a Latecomer's Fee Charge in favor of the City. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Mayor Glaisyer presented the State Agreement on improvement of East First Street and Cherry lane intersection Water Line, concern has been put into the agreement. The Motion was made by Williams and seconded by Bodine that the Mayor be authorized. to sign the Agreement with the State of Idaho, Cherry Lane - Fairvew Intersection project. P1otion Carried: lilliams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. There was discussion concerning customer refusal of not paying water bills because of the "onion flavor and smell." It was the consensus that payment should be required for water that flows through the meter. Williams commended J-U-B Engineers Staff and Earl Ward and Staff for an excellent job getting the Waste Water Treatment Plant on line. *Tfie Bills were read. Those present at this meeting. included myself; Mr. Bruce Stuart and Dee from the City Water Department; Mr. Max Boesiger. and his `Engineer Mr. Dean Briggs; and Mr. Jim Rhodes, contractor. 'I was informed by the contractor and developer that the successful testing of this water system had been extremely difficult and time consuming, with corresponding expense. Also, that the contractor was near his end financially and the developer was suffering due to not being able to final close on two homes that are sold but have not been connected to the water system. Apparently, the problem in satisfactorily testing the system exists in the amount of air in the lines that the contractor has not been able to expell through the flushing and .bleeding process. Froa water de- partment reports, the profile of the water pipe, as installed, was up and down creating numerous high points at the pipe joints that will allow accumulation of air which can only be removed through a continual bleeding and flushing process. This air entrapment in the line, with an approximate 0.5~ air content by volume in the water lnself, may be causing the testing acceptability problem. It is not to be ,said, however, that: a leak or leaks ' do not exist in the system. ~'. After the Wednesday morning meeting with the developer, con- tractor, and Water Department, Bruce Stuart and I met with Mayor Glaisyer to discuss the problem. I recommended to Mayor Glaisyer after our discussion, that the following be considered: 1, -Conduct a pressure test on the .total system „less that gortion that has passed, in lengths not to exceed 1000 .feet and see 3f"there is any correlation between the tests regarding volume of pipe and volume of water lost during the test; and,. The contractor conducted the correlation tests with a member of the City Water Degartment present during the day of .Tuly 26, 1979. The results of .the test were given to me Suly 27, 1979 bg Bruce Stuart. Com- paring the volume. of pipe tested with the volume of water lost during the test gives an average percent loss for the three sections tested of 0.47%. It is interesting to note that the air .content of the water is approximately'0.5%,by volume.. The: rorrelating of the test data does create a suspicion that the failuxe of the test is not totally due to water leakage, however, as stated above, i.t cannot be shown that some amount of leakage; is not taking place. If you accept the correlation of the test data as previously outlined and .require the contractor/developer to post a`cash br letter of credit bond, I recommend the following conditions apply to the bond. 1. If leaks do surface during some future time period as determined by you, the procedure for repair should be: a. Water department contacts Mr. Max Boesiger to make .repair, or, b. If Mr. Boesiger cannot arrange to have the repair made, the City Water Department is authorized by Mr. Boesiger to make the repair and invoice Mr. Boesiger for payment of the cost involved, ox, c. If the City is not able to make the repair, the City Water. Superintendent is ~uGhorized by Mr. Boesiger to make arrangements with an independent contractor to make the repairs and invoice Mr. 'Boesiger for paymen$ bf'the costs involved: therefore. "`~ It is also recommended that Mr. Boesiger be involved in the cost of bleeding air from the water lines if the situation arises during use of the water by the future residents of Sunnybrook Farms. No. 2 Subdivision. As a matter of comment, specifications are utilized in order to obtain a good serviceable product that the owner can use for a reasonable length of time without incurring coats of repair that negate the useful- ness of the product. Deviations from the requirements of the accepted specifications should be made only in exceptional circumstances. Among other things, the notice shall bear the date and hour of leaving the same at or upon the vehicle, make of the vehicle, and its license number, the specific Code Section violated and the amount of the fine, instructing the owner or operator of such vehicle to report to the traffic ticket section under the jurisdiction of the City Treasurer's office. The remaining copies or notices herein mentioned shall be filed as follows: One copy shall be retained by the police officer leaving such ticket upon a vehicle, one copy shall be filed with the traffic ticket section of the City Treasurer's office and one copy shall be filed with the Meridian Police Department. (C) When a parking citation is issued to a vehicle as required or permitted by this code, the person responsible for the citation shall, within seven (7) calendar days from the date of issue of the citation, pay to the City Treasurer's office, in the City of Meridian, the amount indicated on the parking citation. (D) In the event the citation is contested, the person shall appear at the Meridian Police Department within the seven (7) day period and sign a document contesting the violation charged. The person will then be assigned a time and date to appear in the Ada County Traffic Court, in the City of Boise, State of Idaho. (E) In the event the parking citation is not disposed of by payment of the prescribed fine, or otherwise as provided by this code within the seven (7) day period, the Meridian Police Department shall cause a warrant of•arrest to be issued.
