The minutes of the August 20th regular Council meeting and Snecial meeting
August 28th were approved as read.
Agenda
1 Meridian Bowling Lanes Beer License Transfer and Liquor by the Drink Application
Joe Evans and E. J. Quintieri were present, presenting request of transfer of
the Meridian Bowling Lane's Beer license from Quintieri to Evans. All State
licensing had been obtained and approved.
Quintieri stated that they expect 95% of the catering to be their own patrons.
The lounge is strictly for convenience of the bowling patrons.
Chief Sherwin stated there should be periodic review.
The Plotion was made by Bodine and seconded by Kingsford that the Beer License
Transfer from Quintieri, dba P•?eridian Bowling Lanes, to Joe Evans and the
Liquor by the Drink License be approved.

2 Country Terrace 1omeowners
Mayor Glaisyer stated that there was nothing to discuss as far as the City was
concerned, referring to the petition presented by the homeowners opposing
Annexation. The City Council has no authority whatsoever if the homeowners
do no want to the annexed.

David Hansen representing Country Terrace Homeowners stated that they were
here protesting Country Terrace 41ay being made a through street. Hansen
stated they felt the reasons for this through street were basically unfounded
and not in their best interests.
Glaisyer again stated that if in future when they desire Annexation, this problem
will be discussed.
Hansen stated that perhaos the aetition submitted has been misinterrunted. "!%~e
are not opposed to Annexation, we are opposed to Annexation if the services are
not available, and paying the $1,000.00 and service fee two or three years
prior to use of services. Once the services are there, we would have no
objection to Annexation."
Hansen o,uestioned if and when Meridian Greens is approved and goes ahead, would
Country Terrace Way be extended.
Hansen stated that they feel it is not fair to have the street pushed through
and that the lots were sold in Country Terrace with the understanding it was
a Closed Subdivision.
Glaisyer stated that the problem should be taken up with their Engineer as the
Subdivision was approved with a temporary cul-de-sac and a street would go
through Peridian Greens. Also the Subdivision was aporoved contingent that
it would be annexed to the City of Peridian.
Hansen displayed copy of the plat of Country Terrace as it now stands. He
maintained it shows a temporary cul-de-sac with a walk path or golf path to
connect with the future subdivision.
William stated that it shows a 50' right-of-way, thus platted as a street,
not as a pathway. The temporary cul-de-sac was platted not to be closed off.

Gary Smith, City Engineer, stated that Meridian Greens was approved, subject
to access being made from Country Terrace to Meridian Greens, or that street
continuing on through.
Hosac stated,"that is correct. The whole problem has arisen as the result of
coming before the City Council and having that modified from a street connection
to a pedestrian easement and my understanding that we were given approval of a
20 foot wide pedestrian access in lieu of the street. The City Council has no
record of my impression of approval."
Mayor Glaisyer stated that the City Council is right in staying with a through
street and not a pedestrian path.
Willaims stated that he had researched minutes of the last two years and he
could not recall any discussion regarding the approval of a pedestrian path.
Smith stated that when he and Sumner looked at the two plats, one above the
other, the platted street of Country Terrace #l, that is to continue to the
South, and shown as Country Terrace Way, could create a through street
situation from property to the South of Country Terrace #1; as opposed to
connecting Country Terrace with a turning street at the point of the cul-de-sac
into and through the first block of Peridian Greens. Smith stated this item
for consideration.
The P1ayor stated, then actually there would be more traffic flow with Country
Terrace going South than going back East.
Smith felt that the turn could be moved to the South, far enough and the
street could be turned to the East and not endanger a lot that has been
built upon.
Hosac stated that,"J-U-B designed Preliminary Plan of Country Terrace and
that design showed street layout as now built." He stated that design
did not show any future street layout and that Plat was approved (Preliminary)
by Planning and Zoning and City Council at the time (not this Council). They.
proceded to design this project and brought it in for final aparovals. Hosac
stated that,"when they went to Sumner Johnson for final approval on that plat,
Johnson questioned a future extension of this street. Our answer was that it
was not on the Preliminary Map and there has never been anything said about it.
Hosac stated Johnson replied, "he didn't care that it hadn't been on the
Preliminary Map, and he didn't care if it had been approved by both Planning
and Zoning and City Council without an extension, but if they were going to get
his signature on this plat they were going to show a street to the South, whether
they liked it or not." Hosac stated,"we gave in to Sumner and agreed to show
the future street extension to the South, figuring in my own mind that it would
never be built. Ede put the street on there because he (Sumner) made them do it.
We could have gone to an Attorney and gone back and said this wasn't on the
Preliminary that was approved, you have no right to do this, but to get the
plat recorded, we added the street to the South:-that was before Meridian Greens
designs were being done. Then P1eridian Greens came along having a major collector
street, l0 feet wider than any street existing in Country Terrace, that goes
straight South within 100 feet of this Easterly boundary (Country Terrace boundary)
it's a 60' right-of-way, no turns, curves or anything on it. The only reason
that Sumner illegally required us to extend this, was his desire to see a
connection of this Subdivision to furthur project South and his point was well
taken, it's good design to do that. However, it was a requirement he personally
placed upon us that he had no right to do. If I had stood my ground at the time,
we would all be a lot better off today on this situation as far as I am concerned.
Nevertheless, when the P~eridian Greens design was done, it provided a major
collector street running 100 feet from this boundary, barely 220 feet from nearest
street, and it goes all the way, three times as far in depth, all the way South
to Victory. On the basis we did have that North/South connection, there was no
point in building that street, and in addition, if we did build that street, we
would end up with a double frontage on the lots along here (boundary), which is
very undesirable, if not against Ordinances. I should have stood my ground with
Sumner, but didn't, and it's going to cost us time and money to have this thing
(street connection), that Sumner insisted upon, deleted from this plat. We have
recently filed the necessary form and $400.00 check to have this future right-of-way
deleted from the plat to get rid of double frontage situation because it has no
need whatsoever."

liosac continued, "when we originahly designed the Preliminary Map for
Meridian Greens, we did have a desire to tie these two projects together.
We did show a street connection between the two projects on the original
Preliminary Plat. After further going into the design, it became apparent
that the street connection was not needed, the people that lived in project
did not desire the connecting street, so we came back to the Council on
July 17, 1978, which I remember very well, as well as Carl Ellsworth, bringing
Meridian Greens Preliminary Map which had been approved. We asked the Council
if we could delete the full street connection and replace with a 20 foot wide
pedestrian easement. I left that meeting with the impression that we were
given Council approval for that change. No one seems to feel we were given
this approval. Minutes show that it was discussed, but evidently there was not
a formal motion. Hosac stated that, "I represented not only Meridian Greens
Project, but Country Terrace. I regretted not asking for formal motion from
Council at that time because this Council is not willing to understand that
this was what happened. As a result of that happening, we made the modification
(pathway), brought it back into Council and it was refused. Although Sumner
is objecting to not having a street connection now, he approved our final
Meridian Greens Plan without that street connection. It wasn't until this
City Council objected, that Sumner changed back and said the street should be
through there. We have a letter in our files with that approval, with the
pedestrian easement in place." (Not presented.)
Hosac stated,"the people in Country Terrace don't want the street through,
I did not agree with the arguments of having the street through, other
subdivisions have longer streets and only one access, more homes, etc."
Hosac presented letter from Sumner Johnson dated Play 2, 1979 (see letter
on file with these minutes ), claiming deletion of the right-of-way.
Smith commented that Summer's Play 2 letter was a statement, just stating,
"apparently it is this developers intention to vacate that portion of
Country Terrace Dr. that would create this double frontage situation."
Smith also stated that in Summer's January 15, 1979 letter there is no
mention of vacation, only mention that Country Terrace Way would create
a double frontage situation. He did not advocate vacation.
Hosac maintained,"Item P1o. 2 on the Engineer's letter, April 18, 1979 did
advocate vacation:' He stated that;"Sumner Johnson spent two hours with
Milholl'in.:arid.`I in my: office and gave ':.us- final approval on the plans
with pedestrian easement, but changed his mind after Council objected.

stubbed over to Country Terrace." He was reprimanded by the Mayor for
language used while giving his interpretation. Hosac stated,'1'"I !'acted::
in good faith and I ask that the Council make their decision, that i h2we
it designed either way.°
Mayor Glaisyer stated that no one is forcing these people (Country Terrace),
he worked with the Homeowners Association in good faith, and he is still
standing with the Council in good faith. This serious situation has not
been easy for the Council either.
Hosac stated that, "when we came in and asked for pedestrian easement
in lieu of connecting street, I was not trying to put something over on
Sumner, I told the Council that Sumner probably wanted the street to o0
through. They, (Council) had told us, fine. Don (Mayor Storey), chuckled
and said, well we don't always do what Sumner wants oh this Council. If
the street has to go through, I will have to do some replatting. The best
way to get this replatted is to file a plat for the flat (Country Terrace #2)
and include the end of the cul-de-sac as every lot line will change in
order to put the street through."
The Mayor commented that at that particular time, that he had met with Sumner
and Hosac, the Council had stopped all Annexation of residential developnerlt.
There was discussion on Annexation of additional residential developments.
Bob Chapin, owner of Lot 1 in Country Terrace next to where Country Terrace
lJay would connect. Chapin stated that there was a wasteway of ditch water
that would interfere with construction of street construction as well as
being built on a curve, drop about 20 feet, and going through rock and gravel.

He objected to the portion that would go through his property.
Williams displayed the Tentative Plat as of December, 1977. It was determined,
by Hosac, that Chapin's lot would pick up area in his lot. Hosac stated
he and Sumner had worked out a method where they could tie the street with
the intersection correctly. Chapin questioned actual distance of frontage
being 313 feet and suggested this be checked if they are planning to put in a
road.
Mayor Glaisyer stated that he respected what the homeowners are saying, but
he also has an obligation to what his people are saying, such as the Fire
and Police Departments and the Engineer. The Mayor asked if Sumner had signed
Final Plat.
Hosac stated, "Sumner was ready to sign Final Plat of Meridian Greens, subject
to Council approval." Hosac again referred to a letter from Sumner stating,
"Sumner was not specific and he tries not to be specific, that is the way he
is, but this May letter was basically approving the project. After that, it
came to City Council and Council rejected the Final because of the connecting
street being omitted."
David Hansen stated that the homeowners do not feel Annexation of Country Terrace
#1 is beneficial at this time. He stated vahen services are available,they
would submit to Annexation.
Attorney Crookston, Jr. clarified Annexation of Country Terrace, stating there
were two ways to annex. (1) annex by request,which is the procedure that is
being talked about. (2) or the City can annex at their pleasure if less than
5 acres, or it is larger than 5 acres and it has been subdivided into smaller
plots.
Hansen stated he wanted to make it clear on the record, "we realize the advantage
of being part of the City of Meridian, the advantage of being annexed, and the
benefit of sewer and water. The only problem we see is being annexed without
services being available. Once the service is available, Annexation will be no
problem."
The Mayor stated that the concern with the people here, is the cul-de-sac. He
still has to respect what the Department Heads, Fire, Poli e, Ambulance,
Engineer say. Unless those people change their attitude~~hen this Council
votes to not have that cul-de-sac extended to Meridian Greens, he is going to
stand by on what has been said so far.
The Mayor asked that the Council not make a decision at this time. He stated
that Hosac has a legitimate piece of evidence that there may have been a 20
foot easement. .That is, if it has been approved by Sumner Johnson.
Hosac stated that the Map on file is the Final Plat. (Map so marked with this
date.)
Hosac stated, "number 1, if the Council, through whatever future meetings, holds
firm on Country Terrace Way stubbing out there, we have it designed that way.
We have got to have a way to get this street platted, extended to connect.
Also, so we can tell the people where their lot lines are and determine what is
going to happen on remaining lots. If the street is going to have to go through
and the Country Terrace residents do not want to be annexed, then the solution
is to go ahead and annex just the new Preliminary Map (Country Terrace #2),
and then the recording of that will delete the old right-of-way and provide
for new right-of-way and establish all proper new lot boundaries at end of
cul-de-sac. Even if we record this Plat, we cannot develop this (#2 ), down
here until sewer and water is available because of ground water problems."
The Motion was made by Kingsford and seconded by Bodine to table Country Terrace
#2 for future study and the next regular Council meeting.

PLACES, DESIGNATING THE REGISTRAR AND DEPUTY REGISTRARS, AND ORDERING THE CITY
CLERK TO GIVE NOTICE OF SUCH ELECTION.

approved.

CITY OF MERIDIAN, ADA COUNTY, IDAHO, BY THE REPEAL OF SECTION 1-702, AND THE
ENACTP1ENT OF A REPLACEh1EPJT THEREOF.
The Motion was made by Williams and seconded by Kingsford that the rules and
provisions of 50-9002 and all rules and provisions requiring that Ordinances
be read on three different days, be dispensed with and that Ordinance Number
350 as read be passed and approved.

8 Department Reports:
Mayor Glaisyer reported on meeting with Chief Sherwin and School Superintendent,
Gus Hein about the problem of littering in the Dark. They discussed closing the
park for maintenance work from 11:00 A.M. to 12:00 noon, also gates.
Works Superintendent reported that three (3) gates,4 feet high, would be $1,002.00
Bodine recommended steel gates be priced.
Kingsford commented that a much bigger problem would be created by closing the
park to the High School lunch period. He felt it was better that they be in
the park littering, than drag racing all over town. There could be better
control at the park.
There was discussion.
Steve Hosac came back into the Council chamber at this time.
Bodine felt the park was being destroyed and closed campus might be the answer.
There was discussion. 4Jith the many students who leave for work study and jobs
having closed campus would not be feasible.
Steve Hosac interrupted at this point and asked fora clarification on the
Motion to table. (Country Terrace ~2)
The Motion was made by Williams and seconded by Bodine that the Annexation of
Country Terrace #2 and Preliminary Plat be tabled until September 17, 1979,
pending meeting with the Engineer.
The Ftayor stated that Hosac was out of order and called for the Motion before
them.

It was the feeling of the Council that they could not justify closing the
park completely. This is to have furthur study.
There was discussion and Stuart was instructed to investigate steel gates.
Mayor Glaisyer instructed Vern, Grant, Earl and Bruce to meet and streamline
the Building permits. He stated he wanted the sewer, water and building permits
paid all at once.
Ward reported he is waiting for an appointment with Boise Cascade to discuss
sewer use charges. Then there will be an update report on the businesses to
finalize sewer problem.
Building Inspector, Schoen, reported 157 new homes and 72 new apartment units
so far this year. Total for August Buildings is 49.
Mayor Glaisyer instructed the Attorney to begin to summarize Ordinances.
Engineer,Smith, respectfully requested that the minutes be typed out word for
word and that he be allowed to take his copy to Sumner prior to any meeting
that is set up.
Chief Sherwin requested paving at the dog pound.
The P1ayor instructed Sherwin to work out the paving around the dog pound with
Bodine, keeping it minimum.
The Motion was made by Bodine and seconded by Kingsford that Chief Sherwin be
allowed to go to Nashville, Tennessee to Pianagement School for Chiefs of small
Police Departments put on by International Association of Chiefs of Police,
contingent on obtaining a grant, with cost to City being $250.25.
Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea.
Williams requested a resoluton study be made on hook-up fees for sewer and
water on schools. Questioned how schools coming in should be charged.
Gary Green was reported to have called the City Clerk and notified her he
would no longer do Janitor services for the City Hall. Pam Wallace will take
over services for the same fee of $200.00 a month.

Jim Eggleston, Country Terrace #1, commented that as homeowners, they do
not feel it is realistic to think that two short h0 foot access streets
would be blocked in case of emergency.
The Motion was made by Kingsford and seconded by Williams that the meeting
be adjourned at 9:25 P.M.

AN ORDINANCE ADSENDING TITLE I, CHAPTER 7, ENTITLED THE COUNCIL OF
THE REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN, ADA
COUNTY, IDAHO, BY THE REPEAL OF SECTION 1-702, AND THE EN ACTDIENT OF
A REPLACEMENT THEREOF.
WHEREAS the City Council and the Mayor of the City of Meridian,
Idaho, have concluded that it is in the best interest of said City
to amend Title I, Chapter 7, Section 1-702, for the reason that
State Statute 50-702 does not require councilmen to be elected from
wards or precincts,
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
Section 1. That Section 1-702 is hereby repealed.
Section 2. That Section 1-702 is hereby replaced by the addition
to Title 1, Chapter 7, of the following section:
1-702 Two Councilmen Elected At Each Election: At each
election hereafter, there shall be elected two councilmen
for a term of four years, or until his successor is elected and

L4HEREAS, the City Council and the Mayor of the City of Meridian,
Idaho, have concluded that it is in the best interest of said City
to amend Title IX, Chapter 6, Section 9-607, General Requirements
of Subdivisions,
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF MERIDIAD7, ADA COUNTY, IDAHO:
Section 1. That Section 9-607 is hereby amended by the addition
thereto of the following section to be known as 9-607(5), which
shall read as follows:
9-607(5) Tiling or fencing of irrigation .ditches, laterals
or canals.--A11 irrigation ditches,. laterals or canals,
exclusive of natural waterways, intersecting, crossing or lying
adjacent and contiguous to an area being subdivided shall be
covered, or if not feasable, then fenced with an eleven (11) guage,
two (2) inch mesh chain link fence, or other construction equiva-
lent in ability to deter access to said ditch, lateral or canal,
at least six (6) feet in height and securely fastened at its base
at all places where any part of said lands or areas being subdivides
touch either or both sides of said ditch, lateral or canal. The
City may waive the requirement for covering or fencing such ditch,
lateral or canal if it finds that the public purpose requiring such
will not be served in the individual case. Any covering or fencing
program involving the distribution system of any irrigation district
shall have the prior approval of the affected district.
No subdivision plat shall be approved where the subdivision is
arbitrarily or artifically laid out to avoid being adjacent to any
irrigation ditch, lateral or canal to which it would otherwise be
naturally adjacent or which it would otherwise naturally include,
Section 2. WHEREAS, there is an emergency therefor, which
emergency is declared to exist, this Ordinance shall take effect
