1 Bill Brewer reported that the sealed bids fora backhoe and pressure sewer
cleaner were opened at City Hall on September 13, 1979 at 2:00 P.M. and 2:30 P.M.
The Motion was made by Williams and seconded by Kingsford that the backhoe bid
from Idaho Tractor, Inc. in .the amount of $24,123.00 be accepted.

Flexible Pipe Company fora pressure sewer cleaner in the amount of $14,388.00,

Agenda
2 hleridian Business Industrial Park Preliminary Plat - located 516 E. Franklin.
Al h1arsden representing and Winston Moore, owner were present.
Marsden displayed Preliminary Plat combination development which includes a
Warehouse development, Industrial development and a Business Park with a bank
and restaurant corner. The project is 46 acres, small business in front, large
buildings in back, not retail and semi warehouse functions.
Marsden stated their intent is to develop a good design that the City of Meridian
can be proud of. Landscaping along Franklin and along the canal area was displayed
as creating a good image from Franklin Rd.
Marsden stated the first phase will begin this fall, hopefully. The intent of the
project is to be developed over several years. They do not know how the lot
layout will be at this time, as the warehouse development requires flexibility in sizes.
Marsden presented the Mayor and Council Recommended Conditions of Approval (on file
with these minutes). He stated that they desire to submit a Final Plat without
lots deleted, if Preliminary is approved tonight. They intend to come back in
the future, exactly identifying the lot lines where needed. The County has
approved this type of flexibility. This is described in Item 3, Development Plan,
Recommended Conditions of Approval.
Marsden stated that they are very willing to meet the Fire Chief's requirement of
an access paved easement on Lot 12 to Bower St. He stated that the Ada County
Highway District requires access every 300 feet on Franklin Rd. It was recom-
mended by Planning and Zoning that these access points be limited, but Marsden
explained the basis for circulatioh and the need for the accesses.
Larry Leasure, representative of the Business Park stated that the type of
marketing is similar to West Park Industrial - total underground utilities,
landscaping clean type industry, warehousing area in back, etc. Pumice Products
is to the east, so the Park's larger industry would be in that area.
The Mayor questioned if there wil} be landscaping on the easment to Bower St.,
Lots 11 and 12, and is there an acceleration on Franklin.
Leasure stated that the easment, or access, to Bower is being proposed and
agreed to working with the Fire Department to their satisfaction. The land-
scaping was not extensive in this easement area. Lot 13 and Lot 14 needed some
type of screen. He stated that they definitely will have covenants at the time
they bring in Final Plat.

Leasure stated that they have been asked by Ada County highway fora gradual
deceleration on Franklin and access to be every 300 feet, The overall frontage
of Park is over 2,000 feet.
Grant and Williams both stated that the Covenants should be turned in with
Preliminary Plat.
Bodine stated he would like to see Covenants.
Leasure stated that Covenants are not normally required on Preliminary Plat.
Chief Sherwin stated that the accesses in larger quantities prevent traffic
backup.
Williams stated that we are trying to encourage some type of industrial development
and as this is a 47 acre pro3ect, is would take some period of time. He was in
favor of moving ahead contingent upon receiving the Covenants prior to any
development of the property and submission of the Final Plat.
Brewer agreed and stated that after studying access distance on Franklin, had
to go along with Preliminary Plat Design. He did not oppose.
Ward questioned the access to some of the easements to Lots 6, 7, 14 and 15.
Marsden pointed out 18" lone and stated they will maintain these lines. There
would be easy access off of a parking lot or something like that.
The Motion was made by Williams and seconded by Kingsford that the City Council
approve Meridian Business Industrial Park Preliminary Plat contingent upon the
submittal of the Covenants prior to Final Plat and emergency vehicle access in
the vicinity of Lot 12 to Bower St.

Williams requested that copies of the maps be presented to the City Clerk and
also for the developer to investigate putting in street lights.

3 Country Terrace
Steve Hosac and Mike Milhollin were present, representing.
Mayor Glaisyer requested that Williams report on the meeting that was held
Thursday.
Williams stated that the meeting was with Steve Hosac; Mike Milhollin; Grant
Kingsford; Gary Smith, City Engineer; Sumner Johnson and himself to discuss
Country Terrace and Meridian Greens Subdivisions. The Plats were brought out
from Country Terrace; the Final Plat of Country Terrace is recorded on the books
of the Ada County Recorder's Office shows that there is a street that loops back
from what is now a cul-de-sac and continues south for about 300 feet. There was
some discussion about the platting of Meridian Greens and what approval had been
given for vacating, or not having, a street going from Meridian Greens to Country
Terrace. The records of the City Council minutes do not reflect any approval,
in our opinion, of going to a pedestrian right-of-way. He stated that it was the
position of the Engineer that the City has required heridian Greens to have an
access back through Country Terrace and that the cul-de-sac was platted as a
Temporary cul-de-sac for the continuation through to Meridian Greens. This
basically was the City's position as they left the meeting.
Kingsford stated that the discussion led to there being a public access easement,
right-of-way, or quick claim deed of some fashion, basically a triangle in Country
Terrace that would connect up that street.
Smith commented that basically this was the outcome. The dedication of that
strip of land between Country Terrace, Country Terrace Way, future extended
roadway, and Meridian Greens, that that dedication be accomplished prior to the
City signing off on Meridian Greens' Final Plat #1.
Hosac stated he had discussed with some of the Country Terrace homeowners, namely
Dave Hansen and Bob Chapin and wife, and told them they (Hosac Brothers) had made
every effort they could to represent their viewpoint and to bring that viewpoint
to the Council. He felt they had every opportunity to express their views and
recognize what the Council's decision is all about. He stated he had recommended
to the homeowners that they make the best of decision and live with it and that

although it was not what they wanted (street extension), that there would be
some benefits deraved One benefit was that Country Terrace residents would
have direct access to Golf Course. He felt this would be the strong point,
Hosac apologized to the ~dayor and Council for the emotions displayed at the
previous meeting. He again stated they would try and live with the situation
and they are going to dedicate, ore provide and easement to the City, of a
"triangle shapd'piece of property and they are working on that right now.
Williams related to where the intersection would come. into the main street of
Pleridian Greens. He stated that is was highly acceptable that the intersection
be moved north to make a "T" intersection, but would be Hosac's decision. This
may alleviate some of the traffic that would come through.
The P/ayor called for comments from Country Terrace Homeowners.
Mr. Eggleston questioned the depth of a cul-de-sac in the City of Meridian.
Smith stated he believed 450 feet.
Hosac stated the Country Terrace cul-de-sac is approximately 250 to 300 feet.
Eggleston questioned the depth of Meridian Business and Industrial Park cul-de-sac.
The Mayor answered the question Eggleston was eluding to by stated when Meridian
Business Park comes to the Council for Final Plat they will request a variance
and a common variance is a 1000 foot length block which is commonly done. 4dhen
the Engineers have the basic facts, they will at the time, request a variance.
Smith stated that the Pleridian Business and Industrial Park cul-de-sac is
approximately 360 feet.
Williams pointed out that there was not lot approval and the fire Department's
request of access off of Bower in Pleridian Business and Industrial Park, the
street may not be a cul-de-sac when it is finally approved.
P1rs. Eggleston questioned how the Fire Department or emergency calls come through.
Welker stated the calls come by radio dispatch from Boise.
Eggleston stated she had talked to a Boise Paramedic and found out that with the
new section maps it is not often they miss a street in responding for emergency.
Welker stated that the section map could cover half of Country Terrace and half
of Meridian Greens. The size of the Meridian Fire District cover 64 square miles.
Williams stated the largest rural Fire District in the State of Idaho in an urban
area.
Jeanne Eggleston maintained that Country Terrace is not likely to ever have the
problems of being located in emergency.
Bodine stated that there are other people that service the area from Boise who are
definitely not familiar, pointing out that the volunteer QRU people also come and go.
Eggleston expressed concern of safety of children and stated that their home was
purchased to avoid such a through street.
The Mayor expressed appreciation to the Country Terrace Homeowners for their concern.
He stated he felt the Council had acted with great consideration in making their
decision, and are doing a service to the emergency people. When there is a life on
the line, he as Mayor must stand by his conviction that this street must go through.
Kingsford commented that the emergency vehicles were not the only consideration.
City Ordinance requires that the property not be landlocked and that was the
original contention. The City Attorney advised that there must be access to
adjacent property and it is necessary the City live with it.
The Motion was made by Kingsford and seconded by Brewer that the Council deny
the request of Country Terrace Homeowners to maintain the cul-de-sac.

The Motion was made by Kingsford and seconded by Williams that the Council approve the
Final Plat of Meridian Greens #1 subject to dedication of public right-of-way through
Country Terrace and posting an acceptable performance bond to the City of Meridian
for completion of the Golf Course.

The vacation of an additional right-of-way as shown on the existing Country Plat
that is recorded and. goes south was discussed.. It was the advise of Attorney Cr9okaton
that proceedings should be started for the legal vacation by Hosac.
Country Terrace Annexation #,2
Hosac representing Hosac Brothers.
This parcel lies below the rim of Country Terrace #1 - approximately 6.3 acres.
Hosac stated that Meridian Greens will be ready to go and if Country Terrace #2
could be annexed it would solve platting problem. They would like to no ahead and
get the area platted with sanitary restrictions on the plat so they would not
develop until the sewer is there.
Hosac stated that the Gountry Terrace #1 residents desire annexation when the services
are available. He again requested Country Terrace #2 Annexation.
Mayor Glaisyer commented that Annexation #2 would then create an enclave.
Williams stated that the Council has held off on residential annexations and that
he could understand Hosac's point, the vacation process is go8ng to take the same
amount of time as the platting process. His concern. was of the well lot. As this
area grows there will be a need of another well, larger than the one now there.
Kingsford agreed on the well lot and commented that the flat area must not become
a weekd patch.
Hosac stated that the well Was not located to the best advantage, they have no
problem with a new well drilled and used by the City. A site in Meridian Greens
where the main water line would come out would be better. What they intended to do
with the existing well lot is to eliminate, when the services are there, entirely and
make that part of two lots. That could only happen when services-- are there.
The easement would be eliminated when the well no longer necessary.
Annexation request involvement was discussed. Any land that Hosac Brothers do not
own cannot be considered unless the people request annexation. The Publication was
for Country Terrace Subdivision as a whole (#1 and #2).
The Piotipn was made by Williams and 2nd by Kingsford that Country Terrace Annexation
be denied.

Bob Chapin questioned if his property, Lot #1 of Country Terrace #1, will be eliminated
from the re-submittal of plat by Hosac. The answer was if he desired and how that
plat is resubmitted is up to the developer.
Engineer Report:
Gary Smith, City Engineer, recommended approval of Partial Pay Estimate #9, Galey
Construction, Boise River Outfall line. They are at completion of that project
with exception of a slight disagreement on a bid item that hasn't been resolved between
the Engineer and contractor. Smith recommended that the City retain approximately
$8,000.00. Height on a manhole and defuser section is the problem. Total recommended
amount is $13,777.79.
The Motion was made by`Kingsford'-and seconded by 4Ji1'Tiams that Gaffey Construction
Partial Pay Estimate #9 be paid in the amount of $13,777.79.

Smith recommended payment of J-U-B Engineers Inc., Sewer Project Statement No. 29,
9940 complete for EPA and EDA costs during construction phase, charges to date total
$17,157.65.

Project Statement FJo. 24 in the amount of $17,157.65 be paid.

6 Department Reports:
Police Chief Sherwin reported that Frank Capshaw from Ada County Highway had called
requesting the Council feeling upon elimination of angle parking downtown, to conform
with Ada County. Angle parking is now on East Broadway and East 2nd.
Street Commissioner Brewer will look into this.
Attorney Crookston, Jr. introduced Val hlcLam, a new Attorney Associate. He stated
that Val would be doing some work for the City.
Workshop for the City Industrial/Commercial Site Study Grant was announded to be
held at 6:00, O.J's Restaurant, Sept. 18, 1979. Jeff Lamy, of Business Economics, Inc.,
is to conduct workshop.
Bodine reported on park project. Kent Ellis, Kean Recreation Co., will help
assembling of playground equipment.
Williams stated that a letter had been sent to the APA Board from the State of Idaho
concerning the Eagle Interchange. The letter expressed desire to not have the
Eagle Road Interchange but move down to Five Mile. Williams asked for support as
the Eagle Road Interchange is a very high priority in the Meridian Transportation Plan.
Agenda The Mayor read Ordinance Number 352 entitled: AN ORDINANCE VACATING A PORTION OF
7 PRIMROSE SUBDIVISION, FILED FOR RECORD IN ADA COUNTY, IN BOOK 25
OF PLATS, PAGE 1576.
The Motion was made by Brewer and seconded by Kingsford that the rules and provisions
of 50-9002 and all rules and provisions requiring that Ordinances be read on three
different days be dispensed with and that Ordinance Number 352 as read be passed
and approved.

8 The Attorney stated that the bad debts totaling $135.70 for the year 1979 can be
certified with the County Assessor or Recorder and they take care of the rest of it.

RECOMMENDATIONS
1. Streets:

a. Curb, gutter, and paving are required throughout the sub-
division or as specified by the Ada County Highway District.
Detailed construction plans and specifications must be
approved by the Ada County Highway District prior to con-
struction.
b. Provide and dedicate 50 feet of right-of-way for loop road
and cul-de-sac with 5 feet road easement on both sides.
c. Provide 36 feet of pavement and curb, back to back, for
loop road and cul-de-sac or 30 feet of pavement without
curb with borrow pit on both sides of road.
d. Submit street names for public dedicated streets.
e. Place street name signs at all intersections.
f. Stop signs are required at all street intersections with
Franklin Road.
g. Eliminate acceleration and deceleration lanes on Franklin
Road.
h. Maintain a minimum of 300 feet between access points on
Franklin Road for access to development.
Utilities:
a. Submit a letter of acceptance for water service from the
City Engineer prior to recording the final plat.
b. Submit a letter of approval of sewer and water facilities
by the Regional Health and Welfare Environmental Services
Office prior to recording the final plat.
c. Installation of service utilities to comply with requirements
determined by the public utilities providing service.
d. Submit a letter of approval of the drainage plan by the Ada
County Highway District and the City Engineer prior to
recording the final plat.
e. Existing sewer line shall have a 20 foot easement and shall
be shown on the plat.
f. Modifications made in alignment to the Hunter Lateral shall
be approved by the Nampa-Meridian irrigation District.
g. Approved fire protection facilities to be provided to comply
with the requirements of the Meridian Fire Department.

Development Plan:
a. Industrial, warehousing, restaurant, bank and business
park uses as delineated on the development plan are allowed
as part of the preliminary plat approval.
b. The size of parcels for the industrial and warehousing
uses can be modified to reflect site size needed to
accommodate the proposed uses, The final plat need not
be submitted until all parcel sizes have been determined
either through sales or two years from October 1, 1979,
which ever occurs first, Building permits will be issued
for individual lots so long as a metes and bounds descrip-
tion and map is submitted to the Building Department.des-
cribing the parcel and its location in relationship to the
approved preliminary plat and street system.
Amenities and Restrictions:
a. The on-site and street landscaping as shown on the preliminary
plat design plan is approved in concept and detailed land-
scaping plans must be submitted for each parcel when re-
questing a building permit.

WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to vacate a portion of'Primrose Subdivision, '

City Clerk, LaWana Niemann, opened the sealed bids fora backhoe and were
read as follows:
RM Machinery $26,375.00
Johnson Equipment $25,361.36
Mountain View Equipment $26,881.00
Idaho Tractor, Inc. 824,123.00
Idaho Tractor, Inc. was the apparent low bidder but the City reserved the right
to review bids. Public Work's Superintendent Bruce Stuart will review and
announced that the bid accepted would be announced at the regular Council
meeting, September 17, 1979, 7:30 P.M.
City Clerk, LaWana Niemann, opened the sealed bids for a sewer cleaner at 2:35 P.M.
and read as follows:
Flexible Pipe Company $14,388.00
Arrowhead Machinery Co. $16,171.50
Flexible Pipe Company was the apparent low bidder but the City reserved the right
to review bids. Wastewater Superintendent Earl Ward announced that the bid
accepted would be announced dt the regular Council meeting, 7:30, September 17, 1979
Bids were recorded and clo$ed at 2:45 P.M.

AN ORDINANCE VACATING A PO£.TION OF PRIMROSE SUBDIVISION, FILED
FOR RECORD IN ADA CO?JNTY, IDAHO, IN BOOK 25 of PLATS, PAGE 1576.
WHEREAS, the City Council and the r?ayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to vacate a portion of Primrose Subdivision,
PdOW, THEREFORE, BE IT ORDAINED BY THE ?s~?YOR AND CITY
COUNCIL OF THE CIiY OF ME RI DIAIQ, ADA COUI~ITY, IDAHO:
Section 1. That pursuant to Section 50-1306 A, specifically,
and Title 50, Chapter 13, Idaho Code, generally, the City of
Meridian, having he ].d the required hearing and it appearing
that proper notice of said hearing was given,_hereby vacates
that portion of Primrose Subdivision according to the official.
plat thereof filed in Book 25 of Plats, at Page 1576, records
of Ada County, State of Idaho, described below; however,
reserving unto the Plat the below described. reservations in the
description:
A tract of land in Block 4 of the Primrose. Subdivision in
the N 1/2 SE 1/4, Section 14, T, 3N., R. 1Fd., B.M., Ada
County, Idaho, more particularly described as follows:
Commencing at the Southwest corner of the Primrose Subdivisio.
according to the official plat thereof filed in Book 25 of
Plats, Page 1576, on file in the office of the Ada County
Recorder, Boise, Idaho, thence N. 0°35'54" E. 470.83 feet
along the Westerly subdivision boundary to a point marking
the Southwest corner of Lot 7, Block 3 of Primrose
Subdivision; thence S 89°11'36" E 386.08 feet to-a point
marking the Southeast corner of Lot 7,-Block 3; thence
S. 0°33'54" W. 25.00 feet to a point~ma.rking the Northeast
corner of Lot 1, Block 4; thence N. 89°11'36" W. 220.00
feet to a point marking the Northwest corner of Lot 1
Block 4; thence S. 0°33'54" Ld, 4.45.68 feet along the Westerly
boundary of Lots 1 and 2, Block 4 to the Southwest corner

RESEPVING THREREFROM the Westerly 20.00 feet of the above
described parcel, the Southerly 20.00 feet of the above des-
cribed parcel, and the Easterly 5.00 feet of the above des-
cribed for utility and drainage easements;
ALSO RESERVING THEREFROM the Northerly 30.00 feet of that
portion of the above described parcel lying betcaeen the Wes-
terly subdivision boundary and the said Westerly boundary of
Lots 1 and 2, Block 4, for public right of way;
ALSO RESERVING THEREFROM the Northerly 25.00 feet of that
portion of the above described parcel lying adjacent to and
Northerly of the Northerly boundary of said Lot 1, Block 4.
