1987 12-01• A G E N D A MERIDIAN CITY COUNCIL DECEMBER 1, 1987 ITEM: MINUTES OF PREVIOUS MEETING HELD NOVEMBER 17, 1987: (APPROVED) 1: REQUEST BY ROBERT DAVIS TO CONNECT TO CITY WATER SYSTEM AT 1035 EAST FAIRVIEW AVENUE: (APPROVED) 2: PRE-TERMINATION HEARING WATER/SEWER/TRASH DELINQUENCIES:(TURN-OFF APPROVED) 3: APPROVE THE BILLS: (APPROVED) 4: APPROVE RENEWAL OF BEER~'WINE AND LIQOUR LICENSES: (APPROVED) 5: DEPARTMENT REPORTS: ., • • MERIDIAN CITY COUNCIL DECEMBER 1, 1987 Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford at 7:30 p.m.: Members Present: Bill Brewer, Ron Tolsma, Bert Myers, Bob Giesler: Others Present: Steve Wherry, Wayne Crookston, Robert Davis, Walt Morrow, Moe Alidjani, Wayne Skiver, The Motion was made by Myers and seconded by Tolsma to approve the minutes of the previous meeting held November 17, 1987 as written: Motion Carried: All Yea: Item #1: Request by Robert Davis to connect to City Water at 1035 East Fairview Ave: Mayor Kingsford: I see Mr. Davis is present, would you come forward and advise the Council about this request. Davis: I have owned the property at 1035 East Fairview for several years and at the time I purchased this property there had been an agreement with the property directly to the West that we could share a well for water, there was never anything in writing, just a hand shake agreement between the prior owners, the other property has changed hands and they have closed the business there and had the power shut off, therefore I do not have any water and even though it.is very expensive to bore under Fairview Ave to connect to City water, I have no choice as the property I own is to small to allow drilling of a well. It is either that or letting the property just set idle and deteriorate. Brewer: With the expense involved, I think the Council could maybe due something about the required double fees. Giesler: I feel that this could cause a problem as in the past we have not waived the extra fees. The Motion was made by Myers and seconded by Tolsma that the City grant Mr. Davis approval to connect to the Meridian City water at 1035 East Fairview Avenue upon payment of the required fees under the Ordinance's of the City of Meridian: Motion Carried: All Yea: Item #2: Pre-Termination Hearing: Water/Sewer/Trash Delinquencies: Mayor Kingsford: You have been infordmed in writing, if you choose to, you have the right to a pre-termination hearing before the Mayor and Council to be judged on facts and defend the claim made by the City that your water/sewer and trash bill is delinquent. You may retain Counsel. Is there anyone in the audience who wishes a hearing? There was no response. Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their s MERIDIAN CITY COUNCIL • DECEMBER 1,. 7.9 8 7 PAGE #2 water shall be turned off on December 9, 1987. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal o~-have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal their water will be shut off. The Motion was made by Myers and seconded by Tolsma to approve the turn-offs. Motion Carried: All Yea: Mayor Kingsford; The amount of the delinquencies this month is $9,285.55: Item #3: Approve the Bills: The Motion was made by My ers and seconded by Tolsma to approve payment of the bills: Motion Carried: All Yea: Item #4: Approve renewal of Beer/Wine and Liquor Licenses: Mayor Kingsford: I visited with the Police Department this afternoon and they advised that everyone was in compliance. The Motion was made by Tolsma and seconded by Giesler to approve the renewal of the Beer/Wine and Liquor Licenses upon receipt of the necessary fees for these licenses. Motion Carried: All Yea: Department Reports: Brewer: In the past, while dealing with the property located at 1103 East First across the street from my property, I made some comments that maybe Mr. Johnson was using his position as a Planning & Zoning Member to not comply with the Ordinances of the City of Meridian as far as having the property either rezoned or obtaining a Conditional Use Permit. In an effort to improve our relationship, I would at this time like to publically apoldgize to Mr. Johnson for those comments that were made. Mayor Kingsford: I think the rest of the Council and myself were somewhat amiss in not being more involved in this and more or less leaving it up to Councilman Brewer: Being no further business to come before the Council the Motion was made by Myers and seconded by Giesler to adjourn at 7:45 p.m.: Motion Carried: All Yea: T mm~c+~m . Fairview Avenue, Meridian, Idaho Par X0675 of NW4NE4 Sec 7 3N 1E X8644342 Dear Mayor and City Council Memberss Application is herewith made for City water connection for the above referenced property. This property not being in the City limits requires your special approval for hookup. In the past this property has drawn water from the adjoining property commonly known as State Street Subaru. This facility has recently been closed with the power and water having been turned off. This creates an emergency situation and your prompt action on this matter is of essence. I further recognize that City policy requires a double hookup fee for property not in the City limits. Since we must auger under Fairview Avenue, the cost involved in this connection will be somewhat extreme. I would, therefore, ask any consideration possible on these fees. Without City water to this property it becomes uninhabitable and unsightly. I am sure you will agree that this is an undesirable situation for all parties concerned.
