1988 01-05• MERIDIAN CITY COUNCIL JANUARY 5, 1988 Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford at 7:30 p.m.: Members Present: Bill Brewer, Bert Myers, Bob Giesler: Members Absent: Ron Tolsma: Others Present: Members of Scout Troop X320, Roy Porter, Wayne Crookston Earl Ward, Gary Smith, Steve Wherry, Walt Morrow, Moe Alidjani, Bob Mitich, Ray Stites: The Motion was made by Myers and seconded by Giesler to approve the minutes of the previous meeting held December 15, 1987 as written: Motion Carried: All Yea: Mayor Kingsford welcomed Scout Troop #320 who were in attendance at the meeting: Item #1: Swear in newly elected Officials: The City Clerk held the swearing in ceremony for the Mayor, Grant Kingsford, Councilman, Bill Brewer and Councilman, Bert Myers who were elected at the November 3, 1987 election. The Motion was made by Giesler and seconded by Brewer that Councilman Brewer be elected as President of the Council. Motion Carried: All Yea: Item ~2: Bid on Secondary Clarifier for Wastewater Treatment Plant: Mayor Kingsford: The City of Meridian has received the Grant from the State of Idaho for the secondary clarifier and as the Council is aware this was bid some time ago and The Ewing Company, Inc. was the apparent low bidder on the project, the Council needs to take some action at this time. The Motion was made by Myers and seconded by Brewer to award the contract for the secondary clarifier at the Wastewater Treatment Plant to the Ewing ;Company, Inc. in the amount of $311,633.68. Motion Carried: All Yea: Item #3: Pre-Termination Hearing: Water/Sewer/Trash Delinquencies Mayor Kingsford: You have been informed in writing, if you choose to, you have the right to a pre-termination hearing before the Mayor and Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer and trash bill is delinquent. You may retain Counsel. Is there anyone in the audience who wishes a pre-termination hearing? Mr. Ray Stites was present. MERIDIAN:..CITY COUNCIL ~ • JANUARY 5, 1988 PAGE # 2 Mr. Ray Stites, 803 West 3rd account # 480, Mr. Stites was protesting the water usage during the period from October 15 to November 15, 1987 he advised the Council him and his wife had been out of town and there had to be an error somewhere. The Mayor and Council agreed to have this checked out and not turn his water off: The Motion was made by Myers and seconded by Brewer to approve the turn-off list with the exception of Mr. Stites: Motion Carried; All Yea: Mayor Kingsford: Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on January 13, 1988. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, Pursuant to Idaho Code. Even though they appeal their water will be shut off. The amount of the Delinquencies this month is $7,406.97: Item #4: Approve the Bills: The Motion was made by Giesler and seconded by Myers to approve the bills for payment: Motion Carried: All Yea: Item #5: Ordinance #492: Rezone of Johnson Property at 1103 East First: Mayor Kingsford: An Ordinance amending and changing the zoning of certain real property in the City of Meridian which is described as the South half of Lots 10,11, 12, 13, 14 and 15 in Block 1 of amended plat of F.A. Nourse Third Addition to Meridian, according to the official plat thereof, filed in Book 7 of Plats at Page 299, official records, known as 1103 East First Street, Meridian, Idaho and providing an effective date, is there. anyone in the audience who wishes Ordinance #492 read in its entirety? There was no response. The Motion was made by Brewer and seconded by Myers that the rules and provisions of 50-902 and all rules and provisions requiring that Ordin- ances be read on three different days be dispensed with and that Ordin- ance Number 492 as read be passed and approved: Motion Carried: Roll Call Vote: Giesler, Yea: Myers, Yea; Brewer, Yea: Item #6 : P~st_p~iried until later date: Item #7: Transfer Beer & Wine License of E1 Zocalo: Mayor Kingsford: Chief Porter, do you have any problem with this? Chief Porter: No,:everything checked out alright. The Motion was made by Myers and seconded by Giesler to approve the transfer of the beer & wine license of E1 Zocalo. Motion Carried: All Yea: MERIDIAN CITY COUNCIL JANUARX 5, 1988 PAGE #3 Department Reports: Building Inspector: One thing I would like to bring up, the sign situation in town is looking better, but I still have one problem and maybe we could get the Attorney to write him a letter. Mayor Kingsford: I think that might be a good idea, I know the City Attorney has visited with that party but probably a well constructed letter would be worthwhile. I appreciate your efforts on this. City Attorney: Just to report to the Council, that the Summary Judgement Hearing on the Albert verus the City of Meridian and other Cities is scheduled for January 20, 1988 at 3:30 p.m.: A decision should be received within approximately 30 days. Councilman Myers: On the Wasterwater Treatment Report we received a letter from John Roden, who is the Senior Water Quality Special- ist for the State of Idaho, and I thought it ought to be in the record that once again Mr. Ward and his crew have done an outstand- ing job out at the Treatment Plant. I also want to thank the City Engineer for the work he did with Ada County Highway District in getting the signs up at the Golf Course for the pedestrian traffic and I understand in the spring when the weather permits the crosswalks will be painted. Mayor Kingsford: I do not know whether all the Councilman are aware of the fact that the Rural Fire District: purchased a new Fire Truck on which they saved somewhere in the vicinity of $30,000.00. This unit was a truck that Starline Equipment had on hand when they took out bankruptcy and they offered it at this savings. The Rural Fire Commissioners have contacted the City and asked we reimburse them 500 of the cost of this unit as per the agreement we have with them. The 50o amount to $37,758.70, more than this amount was included in the Fiscal 1987/88 Budget-for this purpose. The Motion was made by Myers and seconded by Brewer to reimburse the Meridian Rural Fire District.in the amount of $37,758.70 for one-half the cost of a new fire truck as per the agreement between the parties involved. Motion Carried: Mayor Kingsford: The City of Meridian has approximately $29,950.00 left in Federal Revenue Sharing Funds which have to be expended this Fiscal Year and I would appreciate the Council designating the use of these funds to apply toward the reimbursement to the Meridian Rural Fire District for the new Fire Truck. The Motion was made by Myers and seconded by Giesler that the remaining Federal Revenue Funds in the approxiffiate amount of $29,950.00 be used for the purpose of a one-half interest in a new fire truck which the Rural Fire District has purchased.
