Regular Meeting of the Meridian City Council called to order by Mayor
Grant Kingsford at 7:30 p.m.:

Members Absent: Ron Tolsma:
Others Present: Roy Porter, Gary Smith, Bob Mitich, Wilma Blair, Moe

The Motion was made by Giesler and seconded by Myers to approve the
minutes of the previous meeting held January 19, 1988 as written:
Motion Carried: All Yea:
Mayor Kingsford: I would like to begin by welcoming Scout Troop #17
with us this evening, welcome gentlemen:
Item #1: Request for postponement, Hoalst & Anderson:
Mayor Kingsford: We are in receipt of a letter from Mr. Anderson,
asking that their parking be postponed until the February 16,1988
meeting being as how they had another committment for tonite, I
advised Mr. Anderson that another two weeks would not be a problem.
The Motion was made by Myers and seconded by Giesler to table
Hoalst & Anderson until the February 16, 1988 meeting.
Motion Carried: All Yea:
Item #3: Pre-Termination Hearing: Water/Sewer/Trash Delinquencies:
Mayor Kingsford: You have been informed in writing, if you choose to,
you have a right to a pre-termination hearing before the Mayor and
Council, to appear in person to be judged on facts and defend the
claim made by the City that water, sewer and trash bill is delinquent.
You may retain Counsel. Is there anyone in the audience who wishes
a pre-termination hearing?
Wilma Blair, 1239 West 2nd, Account # 3584. was present:
Blair: I have to pay my taxes and I was wondering if this could be
taken care of on March 1, 1988, if I can I will pay before that.
Mayor Kingsford: The request is that we extend to March 1, 1988, is
there any problem with that?
Council Members: None at all:
Mayor Kingsford: Anyone else from the public who wishes a hearing,
there was no response.

Due to their failure to pay their water bill or to present any valid
reason why the bill has not been paid, their water shall be turned off
on February 17, 1988. In order to have their water turned back on,
there will be and additional fee of $10.00. They are hereby informed
that they may appeal or have the decision of the City reviewed by
the Fourth Judicial District Court pursuant to Idaho Code. Even
though they appeal the water will be shut off.
The Motion was made by Brewer and seconded by Giesler to approve the
turn-off list in the amount of $5,849.40 with the exception of Wilma
Blair in the amount of $48.45:

Item #2: Twayne Walker: House Size Requirement, Meadow View II:
Mayor Kingsford: I see Mr. Walker is now in attendance, would you
come forward and state your request?
Walker: There is one vacant lot left on Fairwood Court in Meadow
View Subdivision #2 it is required to have a twelve hundred square
foot home built on it, the way that lot is situated it presents .a
problem with this square footage. I have a person interested in
this lot but they do not need that large of a home and the homes
on both side of this lot would be close to the same footage as what
we want to build on this lot. I want to know if this could be done.
I have visited with the neighbors in the area and they would like
to see this lot built on. I am talking about 834 square feet home.
Mayor Kingsford: The size again was what?
Walker: 834 square feet, what there is in there is like 900 or 925
square feet homes on both side of that.. Again the way this lot is
situated and it is a flag lot, I can market it if granted a
Variance.
Mayor Kingsford: Our minimum under the Ordinance is 1000 feet and
~ when the Subdivision went in we dropped it down to 900 which is
the minimum there.
Brewer: What is the square footage supposed to be on that lot?
Walker: The requirement is 1200.
Mayor Kingsford: This was the first Subdivision we did under the
requirements and what we did, is it wasn't designated by lot the
square footage requirements, so they built small homes on the big
lots and this is what is left over.
Myers: How big is the lot?
Walker: It is a small one, same as the other last ones that are left
it is a litte wider, but the~~ way it is situated creates a problem.
I have a drawing here to show you what we are looking at.
Brewer: You couldn't see building a t least a nine hundred square foot?

Walker: The person I have interested in it can only afford this 834
square foot home, he is an older person and that is all he needs,
a single man.
Mayor Kingsford: Any other questions or comments of the Council?
Brewer: I do not think I would be opposed to this, we certainly do
not want it to be a trend setter, since it is the last lot in there
and it would get rid of a weed patch and suit the buyers needs to.
Mayor Kingsford: I think we might have a problem on how we do it,
Counselor you might make reference to that.
City Attorney: I see two problems, one we need an appropriate
Variance Request and then I think we have the covenant and restr-
iction problem. I do not know how the covenants read there but
if they do have a restriction from covenants you will have to
handle that also.
Mayor Kingsford: We do have to follow the proper procedure under
our Ordinances. I think maybe you got a feel of the Council's
reaction to this request.
Myers: I have a small problem with going this small, even though
it is 66 feet less than the nine hundred, but if everything got
put together I would not have a problem other than that.
Item #4: Approve the Bills:
The Motion was made by Myers and seconded by Brewer to approve
payment of the bills:

Item #5: Request for Zone Change by Dobaran, Property in Ada Count,~_s•.
Mayor Kingsford: We have a request from Ada County for our comments
regarding.a_.Zone_Change for the Dobaran Property out on Eagle Road,
I have asked the City Clerk to prepare a letter in anticipation
that the Council would agree with me that I will read to you and
see what your thoughts are. The above request has been reviewed by
the City of Meridian and due to the fact this parcel is in our
Impact Area and contiguous with the present City Limits it should
be annexed to the City of Meridian rather than rezoned under the
County. It is also our opinion if development is to occur on this
parcel it should be served with City water and sewer. This property
is just South of Upland Industries property on the East side of
Eagle Road and just North of property that is being considered on
a Conditional Annexation. If it is to be used as an Industrial
Parcel, I feel it should be in the City Limits. If you agree we
have this letter drafted with an area for signature for each of
you.
Councilman Giesler: We have talked about going ahead on this
Conditional Annexation and I think this is a real good idea to
request this parcel be annexed to the City.

Mayor Kingsford: I appreciate your concurrance and if you will sign
this letter as it is passed.
Department Reports:
Mayor Kingsford: Mr. Mitich, Building Inspector, would you like to
come forward, we have a suitably framed certificate from the Inter-
national Conference of Building Officials stating that Mr. Robert
D. Mitich is now a Certified Building Inspector, this Certificate
was actually earned August 22, 1987. I think we should give you a
big hand and you were diligent in pursuing that.
City Engineer: We had a preconstruction meeting last Friday on the
secondary clarifier project and we have a notice to proceed ready
to be sent to the contractor for him to start February 15, 1988.
also a water project on Linder Road, ACHD is going to be tearing
up Linder Road from the railroad north to Pine. They are going to
put curb, gutter & sidewalk along the West side of Westlawn Subdiv-
ision, they will be redoing the roadway and we have some relocation
work to do there.
Councilman Myers: What is the latest on the permanent seating?
Mayor Kingsford: We have an update, they have found another source
the Company that was orginally to furnish them went bankrupt and the
last letter we got about three weeks ago said they would have them
in about ninety days.
Being no further business to come before the Council the Motion was
made by Myers and seconded by Brewer to adjourn at 7:50 p.m.:
