1988 09-20t A G E N D A MERIDIAN CITY COUNCIL SEPTEMBER 20, 1988 ITEM: • MINUTES OF THE PREVIOUS MEETING HELD SEPTEMBER 6, 1988: (APPROVED) 1: APPROVE TRANSFER OF BEER & WINE LICENSE FROM PAUL'S FOODLAND TO ALBERTSON' S STORE # 164 : ~A1-'PROVID) 2: DEPARTMENT REPORTS: • ~ MERIDIAN CITY COUNCIL SEPTEMBER 20, 1988 Regular N~eeting of the Meridian City Council called to order by Mayor Grant Kingsford at 7:30 p.m.: Mr~nbers Present: Ron Tolsma, Bert Myers, Bob Giesler: Membexs Absent: Bill Brewer: Others Present: Roy Porter, Walt Morrow, Marjorie Moon, Steve Anderson, Mark Freeman, Wayne Crookston, Gene Strough: The Motion was made by Tolsma and seconded by Myers to approve the Minutes of the previous Meeting held September 6, 1988 as written: Motion Carried: All Yea: Item #1: Transfer of Beer & Wine License frcen Paul's Foodland to Albertson's Store #164: The Motion was made by Myers and seconded by Tolsma to approve the transfer of the Beer & Wine License as requested: Motion Carried: All Yea: Department Reports: Mayor Kingsford: For the Council's information, myself, the City Attorney and Mr. Freeman representing the Q~amber of Cce~¢nerce along with Mr. Anderson, President of the Qaamber have been working for a period of scene time on the Lease Agreement between the City and the Cl~nber on the land at the park for the Chamber Office and the Vistors Center, we have more or less narrowed that down to my satisfaction obviously the Council has not had a chance to review it and their Council is not present with us at this point maybe we will move through :the Depari~nent Reports and cane back to this. Councilman Members if you have not been approached, you may have noticed the rather pointed challenge from the Chamber of Commerce on a whiffle ball game after the ground breaking, we need to enlist you for this as well as your spouses. After the game there is a picnic and I would urge you all to support that. Mayor Kingsford alp introduced Marjorie Ruth Moon the Publisher of the Valley News. City Attorney: It has ccs~te to the attention of the Zoning Adminstrator as to how the Council wishes~to proceed on the Day-Care enforcement, I need. to make inquiry as there has been one cca~laint and we need scene direction on how the Council wishes us to proceed in that matter. Mayor Kingsford: As a rule violations of the Zoning Ordinance we have waited for a ccanplaint ,and .then taken action on t11at ccenplaint, we are obviously aware of a number of those as a result of the Public Hearings and we would then need direction frcen the Council on how to proceed. There was discussion on this matter. Giesler: I believe as hard as everyone worked on that and they voiced their opinion in different hearings it would be my feelings that we should write then the letters MEKTDIAN CITY COUNCIL • SEPTEN~ER 20,.1988 PAGE ~ 2 and let them know that they are in violation of our Ordinances and that they have been for score time and that we would expect them to ccxnply with the Ordinances. One suggestion ,was that we proceed as we had in the past. There was more discussion, (Tape on file) The .Motion was made by Tolsma and seconded by Giesler to instruct the City Clerk with the help of the City Attorney to draw up letters to those people who are in violation of the Ord.uzance on Day Care: Motion Carried: All Yea: Mayor Kingsford: I see the Counsel for the Chamber is now here, I have advised the Council of what has been canpleted as far as the Lease Agreement is concerned, do you have copies for the Councilmen? Freeman: I have to,apologize Mr. Mayor, I have three copies, Freeman handed these to the Counci]men. Mayor Kingsford: I~ might be appropriate if the City Attorney could brief the Council on this agreement, I would hesitate to ask the Council to make a decision on this tonne unless they feel comfortable with it. An alternative could be the Council could authorize the Mayor & City Clerk to sign this agreement upon their review. The City Attorney briefed the Mayor & Council on the different aspects of the Lease Agreement by paragraphs. Mayor Kingsford: Any questions of the Council? Giesler: Unless I missed it, on the maintenance, I know the City is to maintain the restrooms but on landscaping? Mayor Kingsford: W~ have, I guess you would say a gentlenans agreement certainly we could enter into a contract if needed, I had told the Chamber as long as that area is open and our mowers can go around it, we would have no problem with our guys moving but if there was other things needed we would not be able to do that. The Motion was made by Myers that the Mayor & City Clerk be allowed to read the the Lease and execute same: Motion died for lack of second. The Motion was made by Giesler and seconded by Tolsmda that the Mayor & City Clerk be authorized to excute the Lease Agreement with the Chamber of Cr~rce after the Council M~smbers have had time to read the doc:unent and avis~l them that every thing is as it should be and also that there is no problem with going ahead with the ground breaking as scheduled. Notion Carried: All Yea: Steve Anderson, Cl~nber President presented Mayor Kingsford with fifty dollar bill which was payment bf. the lease._for a fifty year period. Steve Anderson, President of the Chamber: I would like to make a couple of comments first I am not sure that you have all seen the rendering of the building that is planned for this location (Rendering of the Building was displayed) what started as .' MERIDIAN CITY CAUNCIL • • SF.P'T'F'.MRF.R 20, 1988 PAGE # 3 a fairly hobble beginning for a chamber home has grown a little bit, especially over the last couple years, the visters bureau has been added and then the public rest- rooms have been added, so what started as a project that could have been built for maybe $30,000 or $35,000 has grown tremendously, I suspect time we get it all done we are going to have a cost of $60,000 to $65,000, we are going to make several public attemrts to cane up with a number of dollars because we are about $25,000 short. I want each of you to know that as we might call each of you independently for sane help. There is one thing I would like the Council to consider and maybe you could relay your thoughts to the Mayor after you have reviewed the lease and that concerns water & sewer hookups since what we are trying to do here is a benefit back to the ca~rninity and a service, if you might think you could waive that hookup fee, I think it would be appreciated fran the CYiambPxs standpoint, certainly where we have the public restrooms there. Again many thanks fran the Chamber for your tremendous cooperation, we are looking forward to having this done as soon as possible. Mayor Ringsfordh: Mr.Anderson, on behalf of the City I would like to c~nerid the Chamber and the working relationship we have had and it is certainly the kind of thing we are working toward in Meridian a.s well. Department Reports Cont'd: Tolsma: I have a gentleman out here who would probably like to make sane carsYtents about our noise problem down there at Hoff's Building: Gene Strough: Mainly I would like to know what progress is being made to control the noise problem at the Hoff Plant. Mayor Kingsford: City Clerk can you update us on that? City Clerk: The City Attorney was to do same ..research on this and Councilman Tolsma did you ever meet with these people? Tolsma.: I was supposed to meet with Mr. Draper & Mr. Hoff ],ast week and when one was available the other one wasn't. so we have tentatively put it off until next week when they are both available. Mayor Kingsford: Have you seen any improvenexit, I understand they have done some thing? Strough: Yes, they have there is a slight improvement but the noise level in my back- yard at certain times would be impossible to carry on a normal conversation, inside the family room you have to turn the TV up just to hear it, all this depends on wind patterns. Last week was particular bad. There was additional discussion on this: Mayor Kingsford: Councilman Tolsma, I have talked to Mr. Hoff and it's not something they are not interested in getting remedied so if you would not mind, I would.like'to appoint .you to be the liaison and get the thing ironed out, I know they are interest- ed in doing it to. Corncilman Tolsma agreed to do this. Mayor Kingsford:.
