APPROVED. • 0 Meridian City Hall November 5, 1979 Meeting called to order by Mayor Joseph Glaisyer at 7:34 P.M. Councilmen present: Richard Williams; Marvin Bodine; Grant Kingsford; Bill Brewer. Others present: Bruce Stuart; Roger Sherwin; Vern Schoen; Burt H. Oliphant; Martin Igo; Cecil Thomas; Claudette Young; Earl Ward; Bob Keller; Barbara A. M. Keller; Evan J. Law; Gary L. Richardson. Minutes of previous meeting were approved as read. The Mayor announced the canvass of votes would be at the City Hall, Wednesday, November 7, 1979 at 5:30 P.M. and invited citizens to attend. Agenda 1 KBBK Conditional Use Hearing Burt H. Oliphant, owner, was present, representing request for a radio station at 1114 Meridian St. Willaims recommended approval if there were no exterior transmitting towers. Oliphant stated that the exterior antenna was small dish type dome which would not interfere with anyone's television or radio. The frequency that they broadcast on is 950 mag., so far above anybody's frequency that there would be no interference. There wereno other comments. The Motion was made by Williams and seconded by Bodine that KBBK Conditional Use for a radio station at 1114 Meridian St. be granted. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. The Mayor welcomed KBBK to the community. Oliphant stated in behalf of KBBK, he would like to extend an invitation to their open house and appreciated being welcomed to the community. Agenda 2 Martin Igo represented both requests and asked that the Council consider presenta- tion of both,as the reason for the LDS application was because of the Winston Moore application. The Mayor and Council did not object. Igo stated that Varselle Weaver was present, representing the LDS Church and their objective was approval of a Conditional Use for 10 acres of land East of the Meridian-Kuna Road on Overland. Winston Moore has asked that the present 10 acre parcel be moved to the east to allow a combination of 21 acres and a planned commercial development in that location. The Church agreed to do this subject to their being able to have the Conditional Use for a Welfare Service Complex which was granted by the City November 1978. In their behalf, Winston Moore has submitted the application, obtained required petitions, and supplied maps. Igo displayed a map of the combined proposals. Moore has purchased the 6 acres which lies up against the proposed on ramp of Interstate. The Church, of approved, will move their project over to the east, on the easterly boundary of the City. He explained the map was architectural conception. Kingsford commented that the only objection from the area residents seemed to be regarding the traffic screening. He questioned access onto Meridian--Kuna Highway. Igo stated that access has not been deleted from this particular drawing, but the understanding from the State Highway was that if the on ramp becomes a reality, the State will have control access of the first 300 feet. The control access would not allow any ingress and egress. Then the State would have limited control over another 150 feet. In that 150 foot limited control area the State would allow one access onto Meridian-Kuna Rd. that would have to be negotiated with the State. If the on ramp does not go through, they would have to take another look at providing an access. Williams asked if the LDS Conditional Use request was the same or if there had been changes. 0 ridian City Hall N 5,1979 Weaver stated the only difference is that the Stake Center (Church Building) will not be located there as originally planned so the service complex will be up closer to the road. The nine items as listed and on file are proposed only. Kingsford questioned the use of back property. Weaver stated this 4 acres would be in grass. Williams stated that there should be a design review and ingress - egress taken into account for the Cope -Erwin property if and when annexed. This parcel lies between the Roho and Winston Moore property on Overland. Igo stated that Vance Cope, as well as the Roho owner, has seen and discussed the concept plan of Winston Moore. Cope has retired and has no intention of a move. They have no control of the property, but have an understanding. The Mayor questioned if there would be any problem with a curb cut if the Cope property is developed in the future. Moore stated he would certainly take that into consideration on the final design. He intended quality commercial development and realizes this piece of land (Cope's) presents a problem of access. Moore stated that they have every intention of cooperating to whatever extent to achieve the goal of a decent intersection, if a curb cut makes sense,it will be there. Williams stated that the State is requesting a 55 foot right-of-way centerline, so there would be 110 foot right-of-way on Meridian-Kuna Highway. Engineer Smith questioned sanitary sewer and domestic water service extension. Igo stated they have been in attendance to the meetings with Mar -Mon, proposing bringing the sewer in the 10 mile route. At this point they do not know what the: Engineering or the cost will be. Smith stated that the City does not want to get locked into development in that area and being served with only one crossing, a dead head line could create problems. Moore stated his only response would be that they will do whatever is appropriate. He stated that Cooknell (Mar -Mon) is considering bringing the extension west of his development and Meridian Greens slightly east of theirs, one or both of those will happen. Williams pointed out the low area and stated the City has not been accepting a pressurized lift station. Cecil Thomas stated the Moore and LDS property drains into Ten Mile. The field drains naturally from the SE corner into Ten Mile, which is 7 feet lower than Nine Mile. Everything east of Meridian-Kuna Rd. drains into Ten Mile, Mayor Glaisyer referred to the letter directed to the Council from Paul Buskey in behalf of residents within 300 feet of development. Moore had no problem with the residents request and most would be incorporated in the design review. Buskey letter on file with these minutes. The Mayor called for Hearing comments. There were none. Gary Richardson and Evan Law were present, representing, Richardson stated their problem was the delay of obtaining a water meter and the City's requirement back flow preventer on the fire line.. He felt it was unecessary to dig up fire main and cap it at the "T". There is a blank flange on the riser inside the building now that they could padlock. The Mayor commented on the serious problem that happened before to the City's water system. The back flow preventers were the conclusion to protect water system. Kingsford stated that the water in the fire line that sits becomes stagnant and tends to come in and out with the pump cycle. This was the reason for the back flow preventer. Richardson stated that anytime there is not a "looping" system and a dead end main, the fire hydrant at the end has to be blown off or there will be stagnant water anyway. The line should be opened up and flushed every six months anyway. Works Superintendent Stuart gave Richardson a copy of meter application with costs. The Mayor, Engineer Smith, Stuart and Kingsford will meet with Rocky Mountain Sprinkler. Smith stated the State of Idaho has mandated that each City have cross connection control enforced in their Ordinances by 1980. Law stated that most back flow preventers are inside building, not in pits. The Mayor stated that the bacteria has been found in the outside pipe also. There was discussion concerning the Smtih Food Kings's fire line. Claudette Young - Spud Hut Beer and Wine Application - 1646 Meridian St. Young explained her business would specialize in potatoes with a variety of toppings. Williams stated that Young should check with plumber as to adequate water supply. There is a separate water meter at this location. Young requested pro -rated Wine and Beer Licenses costs. Attorney Crookston stated there is no provision in the Code. The Motion was made by Kingsford and seconded by Brewer that the Beer and Wine License be granted to Claudette Young, dba Spud Hut and Lounge at 1646 Meridian St. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Myron Gabbert - 1215 E. Fairview. Gabbert explained the location of his Commercial business. There are 4 tennants located in this building at this time. There is a serious problem of the septic tank backing up. Gabbert hired a licensed public works contractor who excavated and found that the septic system drainage had been installed under the ground water table. Nancy Goodell from Central District Health investigated and the only solution that would work would leave the drain field sitting on top of the ground and installation of a pump to pump effluent up to it. The septic system has been renlaced twice in five years. Gabbert requested connection to the City line. He thought he was adjacent to the City and had no objection to becoming annexed and paying the costs of connecting. There is 228 feet frontage on Fairview, the Stewart property is westerly boundary. The Davis, Chastain, Morgan and Stewart Annexation process was discussed. than Citv Hall a 7 (Agenda 8 Agenda 9 0 a 0 5. 1979 It was determined there was quite a distance to connect and the cost may not be feasible. Gabbert stated he had thought the line was closer. Williams suggested that Gabbert contact Davis, Chastain, Morgan and Stewart, the property owners to the west. Ed Brooks Brooks requested input as to use of building located at 804 E. lst. He stated he had several inquiries and is considering a stove retail, there would be no manufacturing. The Mayor stated his biggest problem would be adhering to the Fire and Safety Code and parking. Building Inspector, Schoen, stated most small retail outlets could be feasible, but no manufacturing. The Mayor Read Ordinance #354 B & B Business Park Annexation entitled: AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS: A PORTION OF THE W 1/2 of the SE 1/4 of SECTION 12, TOWNSHIP 3N., RANGE 1W., B.M., ADA COUNTY, IDAHO, TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. The Motion was made by Kingsford and seconded by Bodine that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days, be dispensed with and that Ordinance Number 354 as read,be passed and approved. The Mayor Read Ordinance #355 entitled: AN ORDINANCE ADOPTING THE STANDARD DRAWINGS AND SPECIFICATIONS FOR SANITARY SEWER AND DOMESTIC WATER INSTALLATIONS CONTAINED IN A PAMPHLET COMPILED BY J -U -B ENGINEERS, INC., AND ENTITLED "THE CITY OF MERIDIAN, IDAHO STANDARD DRAWINGS AND SPECIFICATIONS FOR SANITARY SEWER AND DOMESTIC WATER INSTALLATIONS." The Motion was made by Williams and seconded by Kingsford that the rules and provisions requiring that Ordinances be read on three different days, be dispensed with and that Ordinance Number 355 as read, be passed and approved. Williams lauded Gary Smith for the fine job of presentation of the Standard Drawings and Specifications for Sanitary Sewer and Domestic Water Installations. November 5, 1979 The Mayor complimented the Kellers of Bud's Broiler of the appearance of their establishment. Agenda 10 The Motion was made by Brewer and seconded by Kingsford to transfer $70,000 from Account 25 to Account 20 as a loan until the City's final EDA payment is secured. Agenda 11 The Motion was made by Williams and seconded by Bodine to adopt the Employee Personnel Manual which is on file with minutes. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Agenda 12 Department Reports: There was discussion of developments to cease building until water and sewer is approved. Kingsford asked for comments regarding a matter of policy to not issue building permits before the system has been approved. Ward stated his Department has less prcblem than the Water Department. Stuart stated that during the process of building, the builder will break tile and etc. and the contractor protests. He felt the builder should pay for replace- ment. There was discussion as to the responsibility. Schoen stated that he had a request in Settlers Village to build and not put in sidewalks because of weather. Kingsford questioned a policy that would require the water and sewer systems approved before the City issues a building permit unless there is a power, in that nature the City require a performance bond. Stuart stated if they start building before the pavement is in, they damage valve raisers, etc. during construction. Crookston stated the City should stay away from performance bonds. The bonding company pays for the performance, but the City has to have it done. The Mayor stated this matter should be taken under advisement and talk to some developers to see what they would propose. The Mayor instructed the Water and Sewer Commissioners to list all assets from 1975 date purchased, purchase price, how purchased, and description for the auditors. Mayor Glaisyer set 5:30 P.M. November 7th, 1979 to canvass the votes for the November 6th, 1979 Municipal Election and invited the public. The Mayor announced that Rick Orton will be the outside Engineer to inspect the Cherry Lane Golf Course to see if it is in compliance with the City's specifications, plans and in working order. He estimated the cost approximately .$1,500.00. The Mayor felt this would be an unbiased appraisal. Crookston questioned if this would be on a contract basis and if this would be a replacement of the contract with J -U -B. He will research this proposal. Boise Cascade bill was discussed. Williams stated Boise Cascade has been told what has to be done and nothing has been done. They have a 10 inch standby fire line that they have been using and is not metered. The Mayor instructed that the Commissioners meet with Boise Cascade and Meridian Meat and Sausage to work out service charges. Bodine stated that a group would like to go to the school for square dancing with the name of Meridian Recreation. Crookston stated the group was requesting this program be held under the City's Recreation program. Bodine also pointed out that the trailer house at Mountain View Equipment that should be removed as Conditional Use, has long expired. Chief Sherwin was instructed to contact the new occupants. Ward stated that there was a Waste Water 10 week course at BSU for $30.00. Agenda 13 Engineering: Gary Smith recommended payment of General Engineering, Statement No. 11 for services performed from July 20, 1979 through September 21, 1979. There is $1,750.00 pass through charges. The Motion was made by Kingsford and seconded by Bodine that J -U -B Engineering Statement No. 11 in the amount of $3,752.55 be paid. He felt DVY was responsible for service before that time and it must be resolved with DVY. This would be paid out of the users general fund not Construction Fund.
