DEPARTMENT REPORTS: • L� MERIDIAN CITY COUNCIL MARCH 16, 1987 Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford at 7:30 p.m.: Members Present: Ron Tolsma, Bert Myers, Bob Giesler: Members Absent: Bill Brewer: Others Present: Kevin Robertson, David Hegg, Dave Sherman,,Giennie Sleight, James Shearer, Dale Bates, Ralph Madden, Mr. & Mrs. Charles Liggett, Mary Wilson, Jesse Wilson, Moe Alidjani, Gary Smith, Kenny Bowers, Bob Mitich, Walt Morrow, Bob Wherry, Wayne Crookston, Members of Scout Troop #1: The Motion was made by Giesler and seconded by Myers to approve the minutes of the previous meeting held March 2, 1987 as written: Motion Carried: All Yea: Mayor Kingsford welcomed the Members of Scout Troop #1: Mayor Kingsford, we have one item that has been added to the Agenda and will dispose of it first, Members of the Senior Citizens have asked to be on the agenda and make:a__proposal for the City to enter into a Grant request. Glennie Slieght was present and advised the Mayor & Council they are requesting the City of Meridian to make application for ICBD Grant for the Senior Citizens. The total amount would be $10,000.00 of which $5,000.00 would be matching funds. This would be for miscellaneous items for the Center. Mayor Kingsford, any questions of the Council? I would recommend that we endorse this request. I understand that the Senior's are going to prepare the Grant themselves. The Motion was made by Myers and seconded by Tolsma that the City apply for a Grant for the Senior Citizens. Motion Carried: All Yea: Item #1: Public Hearing: Request for Conditional Use Permit by Mary Wilson: Mayor Kingsford, I will now open the Public Hearing, is there anyone from the Public who wishes to offer testimony? Mr. Charles Liggett, Mr. Liggett was sworn by the City Attorney. Liggett, I am opposed to this permit, as I bought my home in there as residential property , I own lot #9 and am opposed to a business in there. If I had wanted to live next to a business I would have bought in business district. This will just open it up to something else. MERIDIAN CITY COUNCIL* is MARCH 16, 1987 PAGE # 2 Mayor Kingsford, anyone else from the public, Mrs. Wilson would you like to speak to this? Wilson, was sworn by the City Attorney. Wilson, Mr. Liggett was the only person in the 300 foot radius that objected to my petition and as I understand it his home is for sale. I believe this shoild have some bearing on the permit. My buisness I do not even like to call it a business, it is a very limited pre- school program. It will run 22 hours in a session, probably 9:30 in the morning until 11:00 when most people are working. If the response is good enough I may have an afternoon session but I want to limit the program, very definately, I do not want it expand, I have a 3h year old at home and I want to be a mother more than anything else. If the response should be good enough I would certainly move to a comm- ercial location. We bought in the subdivision because it is a nice place to live and we do not want to inhibit that in any way. I know there is a number of women in the subdivision that are babysitting that actually incurrs much more traffic and extended hours than what I am proposing. By the fact that there is a circular drive in front of the home and has a niced fenced yard, it is a high board fence, the program only allows for the children to be out of the house for about fifteen minutes. Wilson displayed pictures for viewing. This is a very limited pre-school program. Mayor Kingsford, as I read.the request..you._are renting the home? Wilson, no, we bought the home, we began the process before we closed on the home. Mayor Kingsford, any questions of the Council? Giesler, it was brought up at the P&Z Meeting about the covenants in the subdivision, are we concerned about these in what decision we make? Mayor Kingsford, we can grant something we are allowed to grant under the City Ordinances, if their covenants restrict this, then that would be a civil action the residents would have to take. Giesler, in the application it states 2h hours per day, if it did go into the afternoon would that require coming before the Council again? Wilson, the reason I put the 2h hours in the application, I was not really informed as to how to make the application out. I made the application to the best of my ability and if there is some problem with that, we discussed this quite at length at the P&Z meeting and they did not feel there was any problem with that. Giesler, the acutal time involved would be 2h hours in the morning and 23-2 hours in the afternoon, five days a week, that would be the maximium? Wilson, it would never go more that that. MERIDIAN CITY COUNCIL• • MARCH 16, 1987 PAGE # 3 Giesler, is that the way you understood it Mr. Morrow? Morrow, P & Z kind of felt that one ok was basically ok for all. Mayor Kingsford, I am sure that a major concern of Mr. Liggett is If it --goes 22 hours and then 22 hours in the afternoon do you get into more, where do you break. Wilson, no way, if the response was good enough I would go 22 hours in the morning and 22 hours in the afternoon, I would limit it myself. It could be the response would be so that it would only be two morn- ings a week, so it could be much less than what is planned but I would never go more than the two sessions. Gielser, could the Council approve that maximuim time? Mayor Kingsford, very definately, if you did go in the afternoon what would your hours be? Wilson, it would be 1:00 to 3:30 , not after 3:30: Mr. Liggett, it says 22 hours, not 22 hours in the morning & 22 hours in the afternoon, what she said is true my home is up for sale, but I do not care about a business within seventy.five or one hundred feet of_ me. I own the largest lot in that subdivision. If it brings down my property value then I do have a legitimate complaint and I can not see why if a person wants to have a business they can not go out into the business sector. Myers, concerning this afternoon session, the only reason you would do this would be if you had over the limit for the morning session? Wilson, I would have no more than fifteen children in a session, it would be a different group if I had it in the afternoon. Myers if you had seventeen you probably would break it up into two groups? Wilson, yes, I won't have more than fifteen. I would rather have about twelve and I would have one of the mothers helping me. Mayor Kingsford, one thing that has come up since you filed your appl- ication is the Legislature did pass a Day Care Licensing' Bill. Wilson, this would have no effect on me, it is not a Day Care, it is just a 22 hour pre-school program. Mayor Kingsford, anyone else from the public who wishes to testify? There was no response, the Public Hearing was closed. Council Members do you have any more questions? Gielser, I have one other question, as far as the parking, how do we consider a sufficient amount of parking for dropping the children off? I guess it would be just dropping them off and then on their way. Mr. Smith do you have any comments on that? MERIDIAN CITY COUNCIL • • MARCH 16, 1987 PAGE # 4 Smith, I do not think there is anything in our Ordinance about this type of request, the Ordinance speaks to schools, there is nothing that addresses this type of activity. It would depend on whether the children came from within the neighborhood or from outside. If they all came from the outside you could have 15 cars in there at one time. Wilson, it would be in a fifteen minute period, the circular drive would accommodate_ parking for sire cars. off street parking.Hopefully most of the children will come from within the subdivision. Tolsma, the fifteen children you would have in the morning and the afternoon, are they totally different groups? Wilson, yes, and there may not ever be an afternoon group depending on the response I obtain. Mayor Kingsford, have you read the comments that came from the City Engineer? Wilson, Yes: Mayor Kingsford, if I might make a couple of comments, first off I would like to commend you for coming in, I know we have a certain number of people that run similar or maybe even more without ever making application to the City. I do think Mr. Liggett that there is a need for Conditional Use Permits however in the past in my own thinking that it has been my policy that certainly those people in the subdivision have a right to privacy and if people objected I have a problem approving what is requested. Counselor is there need for additional findings with the testimony heard here tonite? Attorney, I think that there is, I also want to address the 2h hour situation, technically the application is for a 2h hour pre-school and I think that is all that can be granted unless you want to make it a situation where to grant the 2h for which ever one she wants, the a.m. or p.m. because that was not specified and then if she wants to go further she could come back before the Councilonly with additional notice to obtain approval for the additional session. Mr. Liggett, what is this going to do to our covenants that we have in our subdivision? The reason I bought in the subdivision is that it states in there that no business are allowed. Mayor Kingsford, we cannot enforce your covenants, we might be able to approve this type of request, we have a provision in our Ordinance that we can grant a Conditional Use Permit in a R-4 Zone for certain purposes, the fact that we can grant that permit does not mean that she can operate if it violates your covenants, you stillhif�ight toy recourse though your covenants. That is a civil action you can take and it can be enforced if -the covenants read that way. Wilson, everyone else within that area was very positive about this and were very helpful,again that is only one objection out of the twenty eight resident I had to obtain signatures from. I think this should be considered. MERIDIAN CITY COUNCIL• • MARCH 16, 1987 PAGE # 5 Mrs. Liggett, how could she say everybody agreed to this? Mayor Kingsford, she is speaking to the residents that had to be notified under our Ordinance, anyone within three hundred feet. Giesler, one more question, if they do have to come back for the additional 2h hours if it does come to that, then would people be notified of her change? Attorney, that is up to the Council, whether they want to propose that, that is my recommendation. That is up to the Council to either grant one session or two sessions. It would be my recommendation that if you do limit it to one session at this time and she does desire to have two session that, technically she should be required to go through the whole process again but if you want to waive that and have her come back before the Council you can do that on whatever terms you deem appropriate and if you did, I would suggest that you serve notice. Myers, I am concerned about the Engineers note about the water and sewer hookups, this is something that has to be done if we approve the request? Mayor Kingsford, that has been the policy in the past, when Conditional Use Permits have been granted. The Motion was made by Myers and seconded by Tolsma to have the City Attorney prepare new Findings of Fact and Conclusion to include the additional testimony. Motion Carried: All Yea: Item #2: New City Hall -Project: _ Mayor Kingsford, Mr. Shearer would you like to come forward and make a recommendation. Shearer, it is our recommendation as Architects based on discussions with the Mayor and City Clerk that the Council award the contract based on the base bid minus alternates #1 & #2 to the low bidder of that total which is Ewing Construction, Co. This gives a project cost of $525,730.00: The Motion was made by Tolsma and seconded by Giesler to accept the Ewing Construction Company bid less alternates #1 & #2 for the new City Hall: Motion Carried: All Yea: Item #3: Dave Sherman, Chamber of Commerce President: Discussion on ease of property at City Park for new facility: Sherman, one of the main goals of the Meridian Chamber of Commerce for several years has been building and construction of a permanent office location which would benifit not only the Chamber but the City of Meridian and the businesses of the City. One of the proposals we have MERIDIAN CITY COUNCIL • MARCH 16, 1987 PAGE # 6 discussed over the past years has been a location at Storey Park. What I would like the Council to do at this time is discuss this location and if that location meets with the Council approval that the Chamber of Commerce be authorized to work with the City Attorney, the City Engineer and any other appropriate Council Members to work out a suitable location as well as the final lease for the property. I have provided the Council with a skelton lease that will give some ideas as to how the lease could be structured. Mayor Kingsford, I would certainly like to endorse that proposal, I think it is appropriate -spot and if I may I would like to appoint a member of the Council. and the City Engineer to work with the Chamber on researching the best location and working on the legals and so forth. Councilman Giesler agreed to participate along with the City Engineer in working with the Chamber on this project. Item #4: Ordinance # 472: Change of meeting Date: Mayor Kingsford, An Ordinance amending the time and place of meetings of the City of Meridian by repealing Section 1-704 of the revised and complied Ordinances of the City of Meridian and re-enacting said section to make the change in day, and providing an effective date, Is there anyone in the audience who wishes Ordinance #472 read in its entirety? There was no response. For the record this is for changing the day of the Meridian City Council meeting from the first and third Monday -of each month to the first and third Tuesday of each month and retaining the 7:30 p.m. time. The Motion was made by Tolsma and seconded by Myers that the rules and provisions of 50-902 and all rules and provisions requiring that Ord- inances be read on three different days be dispensed with and that Ordinance Number 472 as read be passed and approved: Motion Carried: Roll Call Vote: Giesler, Yea: Myers, Yea: Tolsma, Yea: Item #5: Ordinance #473: Adopt New Plumbing Code: Mayor Kingsford, An Ordinace amending the Plumbing Code of the City of Meridian by repealing Sections 2-201 through 2-208 of Title 2, Chapter 2, of the revised and complied Ordinances of the City of Meridian and re-enacting Section 2-201 to adopt the Uniform Plumbing Code, 1985 Edition, and providing an effective date, Is there anyone in the audience who wishes Ordinance #473 read in its entirety? The Motion was made by Myers and seconded by GieslerXhat the rules and provisions of 50-902 and all rules and provisions requiring that Ordin- ances be read on three different days be dispensed with and that Ordin- ance Number 473 as read be passed and approved: Motion Carried: Roll Call Vote: Giesler, Yea: Myers, Yea: Tolsma, Yea: MERIDIAN CITY COUNCIL• • MARCH 16, 1987 PAGE # 7 Item #6: Dave Hegg: Grant Funds: Hegg, Mr. Mayor & Council I presently live in Boise and am a student at BSU and also doing some work for various organizations on a part time basis, I am interested in applying for a Community Development Block Grant from the State of Idaho, the amount of the Grant would be $750,000.00. These funds would be used to acquire the old school building located on East Carlton, the price there is approximately $200,000.00, the remaining funds would be used to refurbish the building for low cost housing units where people would pay rent based on a percentage of their income. I think there would be 25 to 30 residential units, part of the space would be used to provide what I call a learning center where there would be a computerized facility available for use by the people in the community at modest fees. We hope to keep the building pretty much as is and the gym would be for use for the community also. I am willing to do all the paper work for the application of the Grant. Mayor Kingsford, any questions of the Council or any comments? Myers, are you going to be involved in the remodeling of the property as such or are you doing it with someone else? Hegg, I am not a contractor per say, I would be a developer in the process. Mayor Kingsford, I have some real reservations, Mr. Hegg in regards to additional low income housing, 1980 HUD survey showed Meridian being 260 low ,moderate income whereas the rest of Ada County was 12 I suspect that has adjusted some since 1980 but I have some.real concern about us increasing that percentage. I have always been very willing that we have our share but have some real concern about our having a real high percentage. Giesler, I intend to agree with what you just stated, also that build- ing might work good for something like that but do not feel that is a real good location for that type of use. I have some real problems with this at this time myself. Mayor Kingsford, I guess I should commend you for your thinking, I would like to see the building refurbished but I have a problem with additional low cost housing at this time. The Motion was made by Giesler and seconded by Myers that the City of Meridian disapprove of this application for a Grant. Motion Carried: All Yea: Item #7: Reappoint Wally Lovan to the EDC Board: Mayor Kingsford, I would like to recommend that Wally Lovan be app- ointed to the EDC Board for an additional three year term, Mr. Lovan has agreed to this appointment. The Motion was made by Myers and seconded by Tolsma to appoint Wally Lovan to the EDC Board for an additional three year.. term.
