DEPARTMENT REPORTS. • MERIDIAN CITY COUNCIL APRIL 21, 1987 Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford at 7:30 p.m.: Members Present: Bill Brewer, Ron Tolsma, Bert Myers, Bob Giesler: Others Present: Roy Porter, Bob Mitich, Walt Morrow, Kenny Bowers, Bob Wherry, Miriam Barr, Members: -of Scout Troop # 1, Wayne Crookston. The Motion was made by Tolsma and seconded by Myers to approve the minutes of the previous meeting held April 7, 1987 as written: Motion Carried: All Yea: Item #1: Continuation of Public Hearing on Final Plat of Meridian Greens. Mayor Kingsford, the developer was in this afternoon and asked that this be continued until the second meeting in May. He has some problems that need worked out with the Ada County Highway District and needs to meet with the City Engineer before we can have anything finalized on it. The Motion was made by Brewer and seconded.by Giesler that the Public Hearing be continued until the May 19, 1987 meeting. Motion Carried: All Yea: Item #2: Covenants Meridian Greens Subdivision: This was continued also along with the Final Plat. Item #3: Transfer of Beer & Wine License for White Water Saloon: Mayor Kingsford, Chief Porter have you completed an investigation of the applicant? Chief Porter, Yes I have and there was nothing indicated in our invest- igation. The Motion was made by Tolsma and seconded by Myers to approve the transfer of the Beer & Wine License of the White Water Saloon to P & J Inc. Motion Carried: All Yea: Item #4: Request for extension in recording Final Plat on Meridian Manor #5: Mayor Kingsford, the developer did #4 & #5 together, they have completed #4 but have not completed #5 and under the Ordinance the Final Plat has to be recorded within one year after approval with the option of an additional year with Council approval. The Motion was made by Tolsma and seconded by Myers to grant a one MERIDIAN CITY COUNCIL • • APRIL 21, 1987 PAGE # 2 year extension as requested by ,Burt Smith for the recording of the Final Plat on Meridian Manor #5: Motion Carried: All Yea: Item #5: Request for extension in recording Final Plat on Arnie Subdivision: Mayor Kingsford,this is the same situation as item #4: The -Motion was made by Tolsma and seconded by Myers to grant a one year extension in the recording of the Final Plat on Arnie Subdivision as requested by.D'Arlene Stutzman: Motion Carried: All Yea: Item #6: Ordinance # 476: Amending the Water Ordinance: Mayor Kingsford, an Ordinance amending the Water Ordinances of the City of Meridian by repealing Sections 5-101,5-102, 5-104, 5-105, 5-110, 5-111, 5-112,5-113, 5--114, 5-116, 5-117, 5-119, 5-120, 5-122, 5-124, 5-124A, 5-125, 5-126, 5-127, 5-129, 5-120, 5-131, 5-133, 5-134, 5-135, 5-136, 5-140, 5-141, 5-142 in the Water Ordinances of the revised and complied. Ordinances of the City of Meridian and re-enact- ing said Sections to make new additions and corrections, and providing an effective date. Is there anyone in the audience who wishes Ordin- ance #476 read in its entirety? There was no response. The Motion was made by Myers and seconded by Tolsma that the rules and provisions of 50-902 and all rules and provisions requiring that Ordin- ances be read on three different days be dispensed with and that Ordin- ance # 476 as read be passed and approved. The Motion was made by Myers and seconded by Tolsma to approve the summary of Ordinance #476 .for publication purposes. Motion Carried: All Yea: Item #7: Ordinance #477: Amending the Sewer Ordinance. Mayor Kingsford, an. Ordinance amending the Sewer Ordinances of the City of Meridian by repealing Sections 7-501, 7-503, 7-505, 7-506, 7-506A, 7-507, 7-508, 7-509, 7-517, 7-521, 7-527,7-527A, 7-530, 7- 533, 7-536, 7-537, 7-539, 7-543 in the Sewer Ordinances of the revised and complied Ordinances of the City of Meridian and re-enact- ing said Sections, execpt Sections 7-536 and 7-537 to make new additions and providing an effective date. The Motion was made by Miers and seconded by Tolsma to approve the summary of Ordinance #477 for publication purposes. Motion Carried: All Yea: Item #8: Discussion on Precinct Boundry Change -&D esignation of Council Seats: Mayor Kingsford, you have the letter from the City Clerk showing the proposed precinct boundry change, as you know Precinct One has always been a good deal smaller than Precinct Two. We did some research on this and with this boundry change the precincts are within one hundred registered voters of one and the other. I think this would be a good line and fairly easy for the voters to understand. The Motion was made by Brewer and seconded by Giesler to have the City Attorney amend the Ordinance to zeflect--.the boundry change as outlined. Motion Carried: All Yea: Mayor Kingsford, it has been discussed at various times the possibility of filing for Council seat, filing for position, rather than the top two who receive the most votes being elected. This would be as it is done with the Legislative Districts. Certainly there is some trade-offs there but I think it would be better and the public would be better served if we did have a filing by seat. As an example in the upcoming election there are two councilman up for election we could designate one of those as seat A and one as seat B. Is there any discussion on this matter? Brewer, I for one would definitely recommend this, I think it would be good if the person irunning against the incumberant had to file for Seat A_ _ or,__Seat B. There was more discussion on this. It was the concensus of the Mayor & Council to have the City Attorney do some research on this item to insure there were no problems with the establishment of Seat A &. Seat'B and to report back to the Council at the next meeting with his findings and. have the City Clerk contact AIC in regards to this matter. Item #9: Discussion on Mayor & Council Renumeration: Mayor Kingsford, there has been discussion on increasing the Mayor & Council salaries, this has to be done prior to election and does not CITY COUNCIL • • APRIL 21, 1987 PAGE # 4 take effect until the following January. This is the time it has to be done if there is going to be an increase for the next two years. Brewer, I believe, even though the Council hasn't been as busy the last year, I believe we started out behind and taking into consider- ation what some of our neighbors are receiving for serving the public in capacity as Mayor & Council, I believe we are entitled to an increase. Tolsma, as Brewer stated we have not been as busy the last yeaz as in prior years, but I do not know how the rest of the Councilman are, but I spend quite a large amount of time at my establishment discussing City business, a lot of question asking and that sort of thing. Brewer, I would like to offer another comment, I think one reason that the Councilman has it easier is probably that our Mayor spends more time in the office than any Mayor in the past on a regular basis. I think that helps solve many of the problems we have had in the past. Mayor Kingsford, I might make one comment on this, it is not good times, the ecomony is very poor here and generally speaking I would hate to have us looking at a raise here on one hand but on the other hand I have dealt with officials from a number of other cities , those people have an expense account, I go out to various meeting and the Cities reimburse the officials for their expense. I know the Council are at various meeting and do not recieve mileage or any of your expense. I do not know of the Council ever asking for reimbursement except the AIC Conference. I do not believe you should have to pay for public service. I do not tbink you should feel bad about granting yourselves an increase if that is your decision. Myers, it is not the fact that any of us are going to have a full time job on this particular situation but there is like with Tolsma and with the rest of us in the place where we work and in other places where people are always asking question regarding.City business, I would guess if we kept track of the time on a hourly basis we are making somewhat less than the minimum,.:.: wage. I know myself I am not in this for the money, I thought it would be fun to be in a City position. I think we are at the point where we are doing it more as a service and if there was no renumeration in it we would probably still do it, but it would help to have enough to break even sometimes and in view of what some of t surrounding cities are I think we are low. Mayor Kingsford, it is commendable that you put in the time ahead of the meeting to make it possible to shorten these meetings. Do you want to make a decision on this tonite or would you like to defer to a later date? Giesler, I also tend to agree with the gentlemen,. all their points are right. It does take a lot time. I feel an increase would be good at this time and I would make that motion to have the City Attorney make the necessary changes. The Motion was made by Giesler and seconded by Brewer to have the City Attorney make the necessary amendment to the Ordinances to grant a MERIDIAN CITY COUNCIL • • APRIL 21, 1987 PAGE # 5 $100.00 per month increase in the Mayor and Council salary. Motion Carried: All Yea: It was the concensus of the Mayor & Council this would be more feasible than setting up an expense account for reimbursement. Mayor Kingsford welcomed members of Scout Troop I to the meeting. Department Reports: P & Z Chairman Morrow, reminded that the P&Z were going to process some amendments to the Zoning & Development Ordinance and if they had anything that needed changed to bring it to the City Clerk's attention. Mitich, Building Inspector, just to bring it to everyones attention, if they have not looked at the construction report, we are at 480 of what we were last year from January 1 to date. Myers, I would like to report back on the accident that happened out on Franklin Road with the manhole cover, I negotiated a settlement on that and we have paid her and I have a release not saying the City was liable but we were doing on the basis of public relations. The settle- ment was less than five hundred dollars. To follow that up I have written a letter for the Mayor to take a look at as far as sending a subrogation notice to the Ada County Highway District to see if they want to reimburse us for that cost plus the cost of redoing the manhole. I would also like to thank the Police Department for the use of their police car Saturday for the Optimist Easter Egg Hunt. Brewer, for your information I spent a lot of time on the phone today and I believe a mistake has been made in regards to fireworks at the Fairgrounds and I am sure that decision will be reversed at our next meeting. SECTION 3. That Section 5-1021 DEFINITIONS (B), (G), and (T) are hereby repealed. SECTION 4. That Section 5-102, DEFINITIONS, (B), (G), (H), (L), (R) and (T) are hereby re-enacted and shall read as follows: (B) CITY WATER SERVICE LINE: That portion of an individual water service line that runs from its connection with the public water main to, and including, the corporation stop, valve box, and meter that is installed in the service line. It will usually be installed within the limits of the public right of way or utility easement and, after installation, it is to be owned and maintained by the City. (G) MUNICIPAL WATER SYSTEM: Includes all components and facilities of the public water system that are owned, operated, or or maintained by the City of Meridian, Idaho for domestic and other uses. (H) OVERSIZED MAIN: Any water main which is required to have a larger inside diameter than is necessary based on the estimated flow of the service area for which the main is being installed. (L) PRIVATE WATER SERVICE LINE: This is to be the portion of the water service line that runs from the building being served to the point of connection with the City Water Service Line. (Q) SPRINKLER IRRIGATION: Refers to any system for the purpose of watering lawns, gardens, shurbs, trees, etc. as they are normally grown in the out-of-doors or open spaces. (R) SUPERINTENDENT: The superintendent of the City Waterworks is the individual appointed by the City Council to be in charge of, and oversee, the water system; he shall, under the direction of the City Engineer and City Council, have charge of the municipal water supply system. The superintendent's duties shall include but not be limited to, maintenance, operation, supervision and/or inspection of all additions or modifications. The superintendent shall report, on a regular basis, to the City Engineer the condition of the municipal water system. (T) AUTHORIZED WATER USER: Any person making authorized and proper use of the municipal water system and/or the water delivered thereby and who has made application for water service and such application has been granted and has paid for such service, water, and all fees required. An authorized water user may be an owner, his tenant by lease or rental, a developer, etc. (U) UNAUTHORIZED WATER USER: Any person who makes any use of the municipal water system or the water delivered thereby who is not an authorized water user or who improperly or illegally uses the water system, or who causes damage or injury to the system in any fashion. (Ord. -374, 7-7-80) SECTION 5. Section 5-104, CITY AUTHORITY, is hereby repealed. SECTION 6. That Subsection (D) of Section 5-136, UNAVAILABILITY OF MUNICIPAL WATER SYSTEM; PRIVATE WATER SYSTEMS; is hereby re-enacted and shall read as follows: (D) The owner or occupant of any house, building or property used for residential, commercial, industrial, governmental or recreational use, or other purpose, situated within the City which is abutting on or having a permanent right of access to any street, alley or right of way in which there is located a City water line of said City is hereby required to cease using any other water system and at his expense to connect such building directly with the City water in accordance with the provisions of this Chapter, within fifteen (15) days after date of official notice from the City to do so, provided, however, that said. City water is within three hundred feet (3001) of any property line where .said building to be served is located. At such time as the municipal water system becomes available to the property served by the,private water system, and the owner or tenant connects his property to municipal service as required, it is mandatory that the private water supply is not connected or cross connected in any way to the water lines served by the Municipal water system. It is the policy of the City to operate the sewer system and the water system in conjunction,.one with the other, for the mutual benefit of the residents of the City. Additionally, due to the integral nature of the requirement of water to operate the sewer system, violation of the sewer provisions may require termination of water service and to efficiently enforce these sewer provisions, such water termination is specifically authorized and is the policy of the City. SECTION 3. That Section 7-503, SUPERINTENDENT, is hereby repealed. SECTION 4. That Section 7-503, SUPERINTENDENT, is hereby re-enacted and shall read as follows: 7-503: SUPERINTENDENT: There is hereby created the office of a Superintendent of Sewers, who shall, under the direction of the City Engineer and the Mayor and Council, have charge of such works, mains, laterals, trunk lines, treatment plant, connection of service pipes and conduits and all other matters pertaining to the City sewer system. The Superintendent shall report to the City Engineer monthly or as often as required the condition of the sewer system and make such recommendations as the nature of the service may require. SECTION 5. That Section 7-505, USERS LIABLE FOR VIOLALTION, is hereby repealed. SECTION 6. That Section 7-505, USERS LIABLE FOR VIOLATION, is hereby re-enacted and shall read as follows: 7-505: USERS LIABLE FOR VIOLATION: No user of the City sewer service shall permit or allow any person from any other premises or any unauthorized person to discharge sewage into said system and the _permit to connect with sewer system shall be limited to the person and the premises designated in the permit. Any violation of this Section by either the permit holder or an unauthorized person shall be deemed a misdemeanor. Any such violations shall be grounds for the Superintendent to withhold sewer service, without notice of termination of service, and the Superintendent may require the Water Superintendent to terminate water service. That Section 7-506, MAINTENANCE OF LINES, is hereby re-enacted and shall read as follows: 7-506: MAINTENANCE OF LINES: All users of the sewer sytem shall keep their pipe connections and other apparatus in good repair and protected from freezing at their own expense, but no person, except under the direction of the Superintendent, shall be allowed to dig into the street, alley, sidewalk or easement beneath which the lateral and trunk line sewers run or to tap into .any such lateral or trunk line in any manner. Any contractor digging within the limits of the public right-of-way shall posses a valid pulic works contractor's license for that specialty. SECTION 9. That Section 7-506A, POINT OF'LIABILITY FOR MAINTENANCE, is hereby repealed. SECTION 10. That Section 7-506A, POINT OF LIABILITY FOR MAINTENANCE, is hereby re-enacted and shall read as follows: 7-506A: POINT OF LIABILITY FOR MAINTENANCE: All users shall have the responsibility of, and be liable_ for, and shall pay for, all costs and expenses of maintaining their own sewer lines extending from their property until such sewer lines pass the vertical plane of the user's property line or until they reach City main sewer lines, whichever point is reached last. This liability of the user shall include the entire sewer service connection apparatus and plumbing equipment and materials. Thus, the City's end point of liability for maintenance shall be at such point as the City main sewer line connects to the user's sewer service connection, and not thereafter with the user having complete responsibility for the sewer service connection to the City main sewer lines. That Section 7-507, PENALTY FOR TURNING ON WATER, is hereby re-enacted and shall read as follows: 7-507: PENALTY FOR TURNING ON WATER: If any person, after the water has been turned off from the premises on account of nonpayment of rates or other violation of this Chapter or the rules and regulations pertaining to the sewer service, shall turn on or permit to be turned on or use or permit the water to be used, without authority, he shall be guilty of a misdemeanor and on conviction.thereof fined not exceeding three hundred dollars ($300.00) or jailed for a maximum of thirty (30) days, or both, for each offense. SECTION 13. That Section 7-508, CITY NOT LIABLE FOR DAMAGE OR SHORTAGE, is hereby repealed. ,SECTION 140 That Section 7-508, CITY NOT LIABLE FOR DAMAGE OR SHORTAGE, is hereby re-enacted and shall read as followsr. 7-508: CITY NOT LIABLE FOR DAMAGE OR SHORTAGE: The City shall not be held liable for damages to any sewer user or his property by reason of a stoppage or other interruption of his water supply or sewer disposal service caused by scarcity of water, accidents to the works, alterations, additions, or repairs to the sewer or water system or from other unavoidable causes beyond the control of the City. SECTION 15. That Section 7-509, DISCONNECTION FOR NONPAYMENT, is hereby repealed. SECTION 16. That Section 7-509, DISCONNECTION FOR NONPAYMENT, is hereby re-enacted and shall read as follows: 7-509: DISCONNECTION FOR NONPAYMENT: The provisions of this Chapter shall apply to all property within the corporate limits of Meridian, Idaho, including all property owned or occupied by the United States of America, Ada County, and the State of Idaho, AMBROSF, F=tRALD 3CROOKBTON Attomeye and Counedlon P.O. SECTION 17. That Section 7-517, REQUIRED USE OF SEWERS, is hereby repealed. SECTION 18. That Section 7-5178 REQUIRED USE OF SEWERS, is hereby re-enacted and shall read as follows: 7-517: REQUIRED USE OF SEWERS: The owner or occupant of any house, building or property used for residential, commercial, industrial, governmental or.recreational use, or other purpose, situated within the City which is abutting on or having a permanent right of access to any street, alley or right of way in which there is located a public sewer of said City is hereby required to cease using any other method of disposing of sewage, waste or polluted water, and at his expense to connect such building directly with the public sewer in accordance with the provisions of this Chapter, within fifteen (15) days after date of official notice from the City to do so, provided, however, that said sewer is within three hundred feet (3001) of any property 'line of the building to be served or common property line in a multiple'building development. The owner or developer of a new subdivision or development whether subdivided or not shall, at his expense, construct the necessary extensions of the public sewer system to provide public sewer. facilities for each lot or building area in his suddivision= additionally, the owner or developer shall have the responsibility, at his expense, of installing the main sewer line to the boundary in his development which is farthest away from the point at which initial connection is made to the present City sewer main. It shall be unlawful for any person to place or deposit in any unsanitary manner on public or private property within the City, or in any area under the jurisdiction of said City, any human or animal excrement, garbage or other objectionable waste. It shall be unlawful to discharge to any natural outlet within the City, or in any area under the jurisdiction of said City, any sewage or other polluted waters, except where suitable treatment has been provided in accordance with subsequent provisions of this Chapter. SECTION 19. That Subsection (L) of Section 7-521, BUILDING SEWERS AND SERVICE CONNECTIONS, is hereby repealed. SECTION 20. That Subsection (L) of Section 7-521, BUILDING SEWERS AND SERVICE CONNECTIONS, is hereby re-enacted and shall read as follows: (L) The connection of the building sewer service to the public main sewer shall be made by a public works contractor having a valid license for this specialty work. SECTION 21. That Section 7-527, SEWER LINE EXTENSIONS, is hereby repealed. SECTION 22. That Section 7-527, SEWER LINE EXTENSION, is hereby re-enacted and shall read as follows: 7-527: SEWER LINE EXTENSIONS: All proposed extensions of the Municipal sewerage system to serve undeveloped areas within the existing corporate limits, newly annexed areas or areas outside the corporate limits shall comply with the overall master plan for the City's Municipal sewerage system. Costs for all extensions which lie outside the boundary limits of the property for which the extension is requested shall be the responsiblity of that property owner or his agent. Cost for sewer extensions within the property for which the extension is requested shall also be the responsibility of the owner or his agent. Sewer extensions shall be required to extend to the farthest boundary of the development. When it is necessary to install oversized lines as part of an extension, the cost of all oversized lines will normally be the responsiblity of the owner or his agent. However, the City may in its discretion, if it has uncommitted funds in its sewer construction account, participate in a portion of the cost of any oversized sewer lines. Unless a special permit is granted by the City, all Municipal sewerage system extensions into newly developing areas shall be installed prior to the construction of any new streets. . The plans for all extensions to the sewerage system shall be prepared and signed by a registered professional engineer as per the licensing requirements of the Idaho Code. Three (3) copies of the said plans shall be filed with the City. Two (2) copies of the plans shall be filedd with the Idaho Department of Health and Welfare for their review and approval as required by the Idaho Code. In approving a plan for extension to the Municipal sewerage system, the City reserves the right to stipulate other requirements such as a special permit fee, rights of way limits, sequence of construction, time limits for having existing service disrupted, the filing of a performance bond and other similar measures as may be required to protect the public. No work shall commence on any such extension of the Municipal sewerage system until the extension project has been approved by the City. After the construction of any Municipal sewer system extensions, it shall be the obligation of the owner, or his agent, to have a registered professional engineer certify to the City and to the Idaho Department of Health and Welfare that the said system extensions were installed in accordance with the approved plans and specifications on file with the respective agencies.... Following certification by the registered professional engineer and acceptance by the City, the entire extension of the Municipal sewerage system, including the City sewer service lines, shall become the property of the City and it shall be the City's responsibility to maintain and operate the system thereafter. If it is necessary for the City to permit a sewer service connection and/or sewer service line at any time after the extension has been originally accepted by the City, the owner or his agent, shall be required to pay the sewer hookup fee as well as the standard permit and inspection fees as may be established by the City for such purposes. Bbz 427 Merldleli, Idaho 83842 Telephone 8884481 PAYMENT OR CONTRIBUTION OP PROPORTIONATE COSTS AND EXPENSES OP CONSTRUCTING SEWER LINES; CO-OPERATIVE AGREEMENTS, is hereby re-enacted and shall read as follows: (B) Should a sewer user at his own expense construct an extension to the sewer system in a public right of way or easement with prior approval of the City and in accordance with the standards and designs of the City and which sewer line extension has been determined by the City to be able to benefit properties other than the user, the sewer user constructing the extension may request that the City enter into an agreement with the user such that all or a portion of the costs of extending the sewer line will be reimbursed to that sewer user from the connection charges collected under subsection (A) above from those property owners who will benefit from the sewer line extension and who otherwise have not paid or contributed their proportionate share to that sewer line; the City shall not be required to enter into such an agreement and whether or not to enter into such an agreement shall be at the sole discretion of the City Council; provided however, no reimbursment agreement shall have a duration greater than ten (10) years unless the City is a beneficiary of the agreement; no reimbursement agreement shall pay to the sewer user paying for or constructing a sewer line extension more than one hundred percent (100%) of his actual engineering and construction costs, it being noted that in most cases at least some. of the cost would ordinarily be assessed to the sewer user's own property; a reimbursement agreement may provide for interest to be paid to the sewer user; the City shall be entitled, shall charge and shall receive a ten percent (10%) administrative fee for handling the accounting, auditing, and payment of the reimbursement payments made to the sewer user so extending the sewer line and having reached a reimbursement ,agreement with the City; the reimbursement agreement shall be personal to the sewer user entering into it and shall not be assigned without the written consent of the City, which consent w`il not be unreasonably withheld; that the agreement shall be binding on the sewer user and his assigns, successors, heirs and executors and may be recorded as an encumbrance against the property of the sewer user; that the sewer user shall be required to indemnify and hold the City harmless from any and all liability whatsoever until the sewer line has been accepted for maintenance by the City; said lines, after acceptance, shall become part of the City sewerage system and be the sole property of the City. That Section 7-530, SEWER CHARGE APPRAISAL, That Section 7-530, SEWER CHARGE APPRAISAL, is hereby re-enacted and shall read as follows: 7-530: SEWER CHARGE APPRAISAL: If the user or owner disputes a sewer connection fee or monthly user charge, the user or owner may request that the parcel being subject to sewer connection charge, periodic user charge, or other fees as provided for in Section 7-532 herein be appraised and assessed by the Sewer Board of Appraisers for the purpose of establishing the equivalent connection rating, the sewer connection charge, the inspection fee, the monthly service charge or other fees to be charged or assessed to and against such property. In making such appraisement and assessment, there shall be taken into consideration the area of land being served and the amount of flow (Q), the biochemical oxygen demand (BOD), the suspended solids (SS) and any other pertinent components of the wastes that the user is contributing to the system so as to establish, as -nearly as possible, the rate, charge or fee for each property and use on the same relative basis as is imposed upon other like property and uses within the City that has or will receive the sewer service.. This procedure may also be used to determine the initial -charges as set forth herein or to change or modify the initial charges.. SECTION 27. That the first paragraph of Section 7-533, SEWER USER CHARGES AND CONNECTION FEES, is hereby repealed. SECTION 28. That the first paragraph of Section 7-533, SEWER USER CHARGES AND CONNECTION FEES, is hereby re-enacted and shall read as follows: 7-533: SEWER USER CHARGES AND CONNECITON FEES: The monthly sewer user rates for sanitary sewer service in the City are based on gallons of water used as determined by the water meter readings. Residential homeowner's sanitary sewer user charges will be based on the actual water recorded for monthly water meter readings during the period of the year from October 15 to the following March 15. For the following seven (7) month period, the average monthly reading for the period of October 15, to the AMBRbSE, FITZOEAALD &CROOKSTON Attomepsand Counselors P.O. Box 427 Meridlan Idaho iib i Telephone 0654461 following March 15, shall be the basis for the monthly sewer user charge. Provided however, for averaging purposes, the Mayor and City Council may, by a duly enacted Resolution, change the above date of October 15, to November 15, for any particular year if it finds the Fall to have been particularly warm requiring lawn sprinkling to have been necessary past October 15. Also, provided, however, where there is a new owner, a new occupancy, or a change in occupancy, such as in the case of sale or new residence construction or sales of existing residences, between October 15 and March 15, the sewer user charge shall be based on the average residential water use in the City which is six thousand five hundred (6,500) gallons per month unless the owner user can show, by current water meter readings, that his use is less than six thousand five hundred (6,500) gallons. All other users such as commercial and industrial shall be based on their monthly water consumption. The user charges may be reviewed annually. For new residential construction completed during the seven (7) lawn sprinkling months the monthly sewer user charges shall be based on the use of 6,500 gallons per month. Upon failure to pay the same, as prescribed, each user shall pay in addition to the amount due, a fine of one dollar ($1.00) or ten percent (10%) of charges due, whichever is greater. SECTION 35. That Section 7-543, PENALTIES, is hereby repealed. SECTION 36. That Section 7-543, PENALTIES, is hereby re-enacted and shall read as follows: 7-543: PENALTIES: Any person found to be violating any provisions of this Ordinance, other than for nonpayment of a sewer bill, shall be served by the City with a written notice stating the nature of the violation and providing ten (10) days, for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations and if necessary make all corrections and repairs to the system or pay for same if the City has to make the correction or repair. Any person who shall continue any violation beyond the time limit provided for hereinabove in this Section, shall be guilty of a misdemeanor, and on conviction thereof shall be subject to a fine not exceeding three hundred dollars ($300.00) or imprisonment not exceeding thirty (30) days or both such fine and imprisonment for each violation. Each -day in which such violation shall continue shall be deemed a separate offense. Any person violating any of the provisions of this Chapter shall become liable to the City for any expense, loss, or damage occasioned the City by reason of such violation and, for other than non-payment of sewer bill violations, may have their sewer and water supply terminated after the above ten (10) day notice period has expired.
