The Motion was made by Myers and seconded by Giesler to approve the minutes of the previous meeting held July 21, 1987 as written: Motion Carried: All Yea: Item #1: Findings of Fact and Conclusions of Law on Variance Request by Robin Prindle: The Motion was made by Brewer and seconded by Giesler to approve the Findings of Fact and Conclusions of Law as prepared on the Variance request by Robin Prindle: Motion Carried: Giesler, Yea: Myers, Nay: Tolsma, Yea: Brewer, Yea: The Motion was made by Brewer and seconded by Giesler to approve the Variance from the 35% lot coverage as requested by Robin Prindle: Motion Carried: Brewer, Yea: Tolsma, Yea: Giesler, Yea: Myers, Nay: Item #2: Public Hearing: Rezone Request by Bonnie Kelso: Mayor Kingsford: Mrs. Kelso would you like to come forward and advise the Council what you are planning on doing, You will also need to be sworn and I will open the Public Hearing at this time. Bonnie Kelso was sworn by the City Attorney: Kelso: My proposal is to put an antique at my property located at 1403 East First Street if the rezone is granted. We plan to put in a circle driveway in front of the house and landscape on the street side of the circle. Mayor Kingsford: Any questions of the Council? Giesler: Will there be items out in the yard? Kelso: No, definately not. Myers: Did you have any problems with the City Engineers comments, mainly the parking and such? Kelso: There would be parking to the North side of the house, there is thirty three feet there. MERIDIAN CITY COUNCIL • • AUGUST 4, 1987 PAGE # 2 Brewer: As I remember this is the same property that was a day school a few years back and the parents entered that property and went to the back and turned around and came back out, is it your intention to put a circle drive aroung the house? Kelso: If it is required, yes, if not required, no. Brewer: Knowing the traffic on that street, I think a circle drive is a must, to have ingress and egress on one entrance on East First Street is just about impossible. Kelso: There is room in the back to turn around and go back out, there is half an acre there or there is room to make a complete U around the building. Mayor Kingsford: Any other questions of the Council? There wer none. Is there anyone in the audience who wishes to comment on this request? There was no response, the Public Hearing was closed. The Motion was made by Myers and seconded by Brewer to approve the Findings of Fact and Conclusions of Law as prepared for the Planning & Zoning Commission. Motion Carried: Giesler, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: The Motion was made by Myers and seconded by Giesler to have the City Attorney prepare an Ordinance on the rezone of the property located at 1403 East First as requested by. Bonnie Kelso: Motion Carried: All Yea: Item #3: Public Hearing: Rezone request by DKDG and Variance on the house size of the lots rezoned: Mayor Kingsford: At this time I will open the Public Hearing, do we have a representative in the audience, if so would you come forward and state your name and be sworn: Don Hubble was present, Hubble was sworn by the City Attorney Hubble: Our proposal is to rezone a protion of Settler's Village Subdivision presently zoned Commercial to R-8 Residential, We are asking for Lots 4-7 Block 1 and 4-7 Block 2. We have since then submitted Covenants for these lots which are very similar to the amended covenants on the balance of the Settler's Village Subdivis- ion. The only Variance we are asking for is in regards to the house sizes, we would like to vary from the requirements of the Ordinance on the percentages to allowing a minimum of 1100 square feet on all the lots. I believe that the balance of the Settler's Village had a minimum of 1080 square feet. They fully intend to build larger than that but wanted to use that as a minimum. Brewer: This is not downgrading the precedence that Settler's Village has already set then, as far as square footage is Concerned? Hubble: No ERIDIAN CITY COUNCIL • AUGUST 41, 1987 PAGE # 3 Mayor Kingsford: The Variance you of different sizes, you are asking square feet? CJ are asking for is from the percentages that they could possibly all be 1100 Hubble: That is correct. Present plans are not to go that small but they would like this if this is the market. Mayor Kingsford:: Mr. Hubble are you familiar with that Ordinance on the square footage, the percentages, you would have a problem with that? Hubble: I am somewhat familiar with the percentages, I think the main problem is, is designating which lot would have which size house on it, they are to be designated up front and that is the primary concern as to which lot would be designated for the larger homes. Brewer: My thoughts are, this being the entrance to Settlers Village, which is a nicely developed subdivision, it would be good to keep that same scale rather than to have a whole bunch of small homes lining the entrance to the subdivision. Mayor Kingsford: Along with that the lots are bigger than those in the rest of the subdivision. Hubble: The plans are to have larger homes but they would like to have this just in case something happens to the market and maybe there is some other condition you can put on that such as design review and if the first few homes they build are 1300 square feet the mix would just occur naturally. Brewer: Why cannot we just leave it, then if you get into trouble you can come back to us. Myers: I think that would be a better way, then we would not have the problem of someone building four 1100 square feet houses in there and there are four lots left and you cannot sell for anything but four more of the same size. Mayor Kingsford: I would like to see the Council giving them some flex- iblity, if that is a concern to moving those around because those lots are all basically the same size and there are not that many of them. I would not have a problem with moving them around but staying with our mix. I think if we start saying we will grant everybody 1100 square feet then we just as well abandon that part of our Ordinance. Mayor Kingsford: Anyone else from the audience who wishes to offer testimony on this request, if so would you come forward and be sworn. Steve Michels, Michels was sworn by the City Attorney: Michels: I came tonite for two reasons, number 1, we have a seven foot strip of property here which in the orginal platting of Settler's Village was quit claim deeded to us, we recently offered our property to the Post Office as a potential building site and in a title search we found out the description on that seven feet was incorrect, we went to Mr. Hubble being he was the agent for DKDG Properties and asked to get this clarified, there is no problem as far as the description or MERIDIAN CITY COUNCIL . • AUGUST 4, 1987 PAGE # 4 getting it done, the problem is it just has not got done, the second thing is irrigation tile that used to go into Settler's Village during the construction phase of Settler's Village it was broken and if a proper headgate is pulled it boils up on our property and then floods across Settler's Village to Jericho Road. I brough this to the attention of Norman Fuller two years ago and also sent him a letter from Settlers Irrigation that this problem need taken care of, I also talked to Mr. Hubble about this so he is aware of this problem. My situation is if in fact it is rezoned and sold off who do we go to to get the problems resolved at a later date. I have no problem with the rezone as long as we get the strip of property quit claimed and the tile repaired. I would like to have this put into the record and have that as part of the criteria prior to rezone or prior to issuance of building permits. Mayor Kingsford: Anyone else from the public who wishes to offer testimony on this request, if so would you come forward and be sworn: Kevin Keyt: Mr. Keyt was sworn by the City Attorney: Keyt: I have a number of concerns, one being water, we have a problem in the subdivision with the pressure fluctuating and if we increase the load on that it is going to enhance that problem, the other is that Fuller has an empty lot out there that we would like to see him build on, we have talked about that and talked to the City about the potential fire hazard the weeds are six to seven foot tall, it is a concern how this is going to be marketed where there is an empty lot and two empty houses that are an eyesore. He did an illegal subdivision on this corner lot and we would like to see it sold so I would like to know as a resident of that neigh- borhood what I can do to insure that what is built there is what you recommend against what was done prior. Mayor Kingsford: These lots are not in the ownership of Mr. Fuller and they will have to build what we require, we have spent some°time and effort on trying to remedy the water problem out there and are still trying to resolve the problem. The City Engineer explained to the Mayor, Council & Public what was being done to eliminate this problem. Keyt: One other question, how do you enforce covenants? Mayor Kingsford: They have to be inforced by the residents through a civil process, the City does not enforce them. Mayor KIngsford: Anyone else. from the Public who wishes to offer test- imony? There was no response, the Public Hearing was closed. Council Members you have Findings for the Rezone and will have to request Findings for the Variance. The Motion was made by Brewer and seconded by Giesler to approve the Findings of Fact and Conclusions of Law as prepared for the Planning & Zoning Commission on the DKDG Rezone Request: Motion Carried: Giesler, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: The Motion was made by Tolsma and seconded by Myers to have the City MERIDIAN CITY COUNCIL • • AUGUST 4, 1987 PAGE # 5 Attorney prepare an Ordinance rezoning the property as requested by DKDG Properties with the stipulation that the irrigation tile and the seven feet on the East side of the property be resolved. Motion Carried: All Yea: Mayor Kingsford: Mr. Hubble, do you still want to pursue the Variance knowing that it could be disapproved and there will be costs involved in the preparation of the Findings of Fact? Hubble: Yes: The Motion was made by Brewer and seconded by Giesler to have the City Attorney prepare Findings of Fact and Conclusions of Law on the Variance Request for house square footage as requested: Motion Carried: All Yea: Item #4: Covenants for DKDG on lots in Settlers's Village: The Motion was made by Myers and seconded by Brewer to table the covenants until the next meeting when the Rezone Ordinance will be ready: Motion Carried: All Yea: Item #5: Public Hearing: Request for Annexation & Zoning by Rich Allison: Mayor Kingsford: At this time I will open the Public Hearing, Mr. Allison would you come forward and be sworn and explain your request to the Council: Rich Allison, Allison was sworn by the City Attorney: Allison: I am requesting that my property located on East Pine, which is approximately five acres be annexed and zoned. The request is for the front 110 feet to be Limited Office and the balance be Zoned R-8: The property is currently surrounded by County Zoning R-1, R-8 and IL across the street. The property directly South is currently in the City Limits, there is sufficient water and sewer to the site for development. Tolsma: Do you have any problems with ACRD requirements or the City Engineers comments? Allison: I have none: Mayor Kingsford: Anyone else from the public who wishes to offer test- imony on this request? There was no response, the Public Hearing was closed. The Motion was made by Brewer and seconded by Myers to approve the Findings of Fact and Conclusions of Law as prepared by the City Attorney for the Planning & Zoning Commission on this request: Motion Carried: Giesler, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: MERIDIAN CITY COUNCIL • • AUGUST 4, 1987 PAGE # 6 The Motion was made by Giesler and seconded by Tolsma to have the City Attorney prepare and Ordinance for the annexation & zoning of the Rich & Toni Allison property as requested in the application: Motion Carried: All Yea: Item #6: Public Hearing: Request for Rezone by Hartwell, Spencer, Butterfield, and Shearer: Mayor Kingsford: I will now open the Public Hearing, do we have a spokes- man for the group, if so would you come forward and be sworn. Mr. Dennis Butterfield, Butterfield was sworn by the City Attorney: Myers: Have you read the City Engineers remarks and do you have any problem with them? Butterfield: I was wondering if that had to be finalized here or can that be done after the zoning approval? Myers: normally we include these as a condition of approval unless there is a problem with them. Mayor Kingsford: Mr. -Butterfield, all of these properties at this time are not asking for a change of use, you are asking for a change of zone, each issue is different so you are asking for a change of zone so that as the change of use is desired they can develop it, is that right? Butterfield: As far as I know the other three properties are not planning on doing anything at this time except make it useable for a commercial venture in the future: I want to house my plumbing company in a building on the back of my lot. Brewer: I will read the City Engineers recommendation so you know what we are talking about. Mr. Brewer read the comments. He is making a point that all of the owners will know that when they want to develop they will be required to have these items. Butterfield: I understand but my customers will not come to my property, We probably will park a personal vehicle there and take a truck. M4yor Kingsford: Anyone else from the public who wishes to offer test- imony on this application? Mrs. Hartwell: These restriction concerning the commercial area, do not apply until a commercial venture goes in, is that true? Mayor Kingsford: Until you decide to change use of that property every- thing will remain as it is today. Mayor Kingsford: We have received a letter dated August 3, 1987, with regards to this issue we are entering into the record as being opposed to blanket rezoning of the properties. This letter is from E. Faye Brewer Buchanan. Is there anyone else from the public who wishes to offer testimony on this request? There was no response, the Public Hearing was closed. Motion Carried: All Yea: Item #7: PUblic Hearing: Request for Conditional Use Permit by Terry Fairchild, Engine Distributors: Mayor Kingsford: At this time I will open the Public Hearing, is there anyone from the audience who wishes to offer testimony on this request? If so would you come forward and be sworn. Betty Raynor: Raynor was sworn by the City Attorney. Raynor: We are requesting a Conditional Use Permit for Terry Fairchild to do business at the old Larry Barnes property on East First Street as Engine Distributors, he will have off street parking, he will have screen- ing for the back portion of the lot and he will conform to the City Ordinances. Myers: Do you have any problems with the City Engineers comments? Raynor: No problems. Tolsma: What about that concerned citizens commnets about blocking Williams Street, will there be cars parked out there? Raynor: It will not be blocked: Mayor Kingsford: Anyone else from the public who wishes to offer test- imony? There was no response, the Public Hearing was closed. The Motion was made by Myers and seconded by Giesler to approve the Find- ings of Fact and Conclusions of Law as prepared for the Planning & Zoning Commission on this application: Motion Carried: Giesler, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: The Motion was made by Tolsma and seconded by Myers to approve the Conditional Use Permit for Terry Fairchild, Engine Rebuilders for the property as stated in the application: Motion Carried: All Yea: Item #8: Pre -Termination Hearing: Water/Sewer/ Trash Delinquencies: Mayor Kingsford: You have been informed in writing, if you choose to you have a right to a pre -termination hearing before the Mayor & Council to appear in person to be judged on facts and defend the claim made by the City that your water/sewer and trash bill is delinquent. Due to their failure to pay their water bill or present any valid reason why the bill has not been paid, their water shall be turned off on August 12, 1987. In order to have their water turned back on there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idah Code, even though they appeal the water will be shut off. The Motion was made by Tolsma and seconded by Brewer to approve the turn- off list of the delinquent users: Motion Carried: All Yea: Mayor Kingsford: The amount of the delinquencies is $6,780.75: Item #9: Approve the Bills: The Motion was made by Myers and seconded by Giesler to approve payment of the bills: Motion Carried: All Yea: Item #10: Request for Lot Split by Ron Van Auker: Mayor Kingsford: Councilman you have had a request for a lot split on the Van Auker property across the freeway, they came to us today and asked if we would give consideration to this as they have a prospective purchaser for this property. Dennis Clark from Ron Van Auker, basically what we are doing is splitting off two acres from this one parcel, Clark showed the Mayor & Council on a map which parcel this was. The Motion was made by Brewer and seconded by Myers to approve the lot split for Ron Van Auker as requested. Motion Carried: All Yea: Item #11: Air Quality Ordinance Amendments:Ordinance #484: The Motion was made by Myers and seconded by Brewer to table this Ordinance until the August 18, 1987 meeting. Motion Carried: All Yea: Mike Twitchell from the Air Quality Board was present and explained the proposed changes to the Mayor & Council: Mayor Kingsford .wLik2comed Scout Troop #190 who were present at the meeting: Department Reports: Myers: What does the Mayor & Council want to do as far as the Southwest Plan that we have been asked to comment on. MERIDIAN CITY COUNCIL • • AUGUST 4, 1987 PAGE # 9 Mayor Kingsford: If any of the Council Members have any comments on this I suggest you get them to Mr. Myers and that Mr. Myers keep us informed on this issue and I would suggest that at that hearing our concerns are registered. Brewer: Once again I would like to discuss the property at 1103 East First, belonging to Mr. Jim Johnson one of our Planning & Zoning Members, some time ago at one of our meeting the Council asked our City Attorney to write a letter to Mr. Johnson. In visiting with our City Attorney he said he had not done this, I think our City Attorney feel in a awkward position, I think Mr. Johnson is remi-sa in putting our Attorney in this position, I know at least a year ago Mr. Johnson agreed at that time to probably take steps for a rezone on that property and he continues to ignore our requests. They are continuing to run a day to day yard sale at this property and actually it is a continuation of the business on the inside of the build- ing. They have illegal signs leaning up against the trees & the State Highway signs. They have rope and electrical wire strung between trees about neck high which is very dangerous if someone is out in the dark. I want to see something done about this property. I think that sitting in this position or on the P &Z Commission we need to set an example not take an advantage of the situation. Myers: What are the steps to eliminate all the stuff outside there? Mayor Kingsford: Chief, if you would, I think we have some handle on those areas in the right -a -way, lets site them on that.Cbunseilax would you clarify your position on this, you do not feel comfortable in writing the letter? City Attorney: I received direction from the Council, I talked to you and advised I would not write him a letter but would talk to him personally, I did talk to him and he advised he would take care of the situation, he would get the people to clean it up and in the near future he had plans to rezone the property and possibly use this property for his own office. It is a little uncomfortable because he is on the Commission. The was discussion on what should be done on this issue, Councilman Myers suggested he talked to him and report back at the next Council Meeting. Mayor Kingsford: I certainly agree with Councilman Brewer, lets pursue this diligently, Councilman Myers you talk to him and Counselor I think the letter needs to be written, if you are not comfortable in writing the letter we need to get someone else to do it. Exceptions to the use and bulk regulations of this Ordinance shall be only by Conditional Use. 2. BULK: All new buildings and structures shall conform to the regulations established herein for the district in which each building shall be located except as other wise permiteed in this Ordinance by Conditional Use. 2-406 C SINGLE NON -CONFORMING LOTS OF RECORD In any district in which single-family dwellings are permitted, a single-family dwelling and customary accessory buildings may be erected on any single lot of record (see definition of lot of record) at the effective date of adoption or amendment of this Ordinance, notwithstanding limitations imposed by other provisions of this Ordinance. Such lot must be in separate ownership and not of continuous frontage with other lots in the same ownership. This provision shall apply even though such lot fails to meet the requirements for area or width, or both, that are generally applicable in the district, provided that yard dimensions and requirements other than those applying to area or width, or both, of the lot shall conform to the regulations for the district in which such lot is located. 6. That the above section 2-406 C is interpretted to mean that an existing lot of record need not comply with the area and width requirements of the Zoning Ordinance but must comply with "yard dimensions and requirements other than those applying to area or width, or both," which thusly means compliance with lot coverage restrictions; however, the section and 2-405 C, quoted , do evidence an intent to allow previously existing lots to built upon even though they may not meet all of the current requirements, so long as a conditional use or variance or other such waiver is granted by the City. 7. That the following provisions of Section 11-2-419, Variances, of the Zoning Ordinance is noted which is pertinent to the Application: 11-2-419 A GENERAL The Council may authorize in specific cases a variance from the terms of this Ordinance as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this Ordinance would result in unnecessary hardship. No non -conforming use of neighboring land, structures or buildings in the same district and no permited or non- conforming use of lands, structures or buildings in other districts shall be considered grounds for issuance of a variance. Variances shall not be granted on the grounds of convenience or profit, but only where strict application of the provisions of this Ordinance would result in unnecessary hardship. A variance application does not go to the Commission unless directed by the Council. 8. That the specific requirements regarding a variance that must be evidenced and found by the City Council are as follows: 11-2-419 C FINDINGS A variance shall not be granted unless (as a result of a public hearing) the Council makes a statement of supportive reasons based directly on the evidence presented to it which supports conclusions that the mentioned standards and conditions of this Ordinance have been met by the applicant and unless all of the following exist: 1. That strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the owner, subdivider or developer because of unusual topography, other physical conditions or other conditions which are not self-inflicted, or that these conditions will result in inhibiting the achievements or the objectives of this Ordinance. 3. That the granting of the specified variance will not be detrimental to the public's.welfare or injurious to other property in the area in which the property is situated. 4. That such variance will not have the effect of altering the interest and purpose of this Ordinance and the Meridian Comprehensive Plan. 9. That the provisions of Idaho Code, Sections 67-6530, 67-6531 and 67-6532, are noted in that a shelter home is treated as a single family dwelling; that Section 67-6532 (c) states "No local ordinances or local restrictions shall be applied to or required for a residential facility which serves eight (8) or fewer mentally and/or physically handicapped persons and is supervised as required in Section 67-6531, Idaho Code, which is not applied to or.required for a single family dwelling in the same zone"; that it is concluded that Sections 67-6530 through 67-6532 evidence a strong legislative intent and purpose to allow shelter homes in residential areas. 10. That it is concluded that the comments in objection to the variance other than as noted in Paragraph 12 of the Findings, irrelevant to the issue and were not a basis of denying the ication. That it is specifically concluded that the pertinent bjections to the application, as noted in Paragraph 12 of the Findings as to the lot being too small for -the structure and the argness being out of place in the subdivision, are not really elevant since a house with 2,025 square feet of living space and 1,350 square foot garage, for a total structure size of 3,375 quare feet, could, under existing ordinances and without a conditional use or variance, be constructed on the lot in uestion. 12. That it is concluded that since the Applicant desires o build 2,686 square feet of living space and have no garage, and since a residential structure, including living space and garage, of 31375 feet could be constructed on the lot, that the variance is not so much directed to lot coverage but to the use of allowable garage space for living.space; that the size of the structure and lot coverage is not so much the issue but the actual use of the space contained in the total structure; that the variance is thus really a request to use what legally, without a variance, could be used for garage space to be used for living space and is really not a lot coverage issue. 113. That many homes in the City have had garages coverted into recreation rooms or extra living space; that such has not normally been associated with convenience or profit but for necessity due to an expanding family or for just extra "leg room"; that if a family had a 2,025 square foot home and a 675 AMBROSE, FITZGERALD &CROOKSTON Attorneys and Counselors P.O. Box 427 Merldlan, Idaho 83842 Telephone 888-4481 foot garage on a 5,500 square foot lot and wanted to convert the garage to an additional bedroom or a recreational room, it is unlikely that adjacent home owners would object to such a conversion, at least there have been no such complaints come to the present City Council and such or similar conversions have occurred. 14. That while there may be a side benefit of profit, economic gain or convenience to the Applicant, such may be the case in most if not all variances; that the real issue is using space that could be used for a garage as living space, and such is concluded not to be a significent economic issue. 15. That it is concluded that the objections to the Application were really based on the use of the structure as a shelter home and those objecting did not want elderly or handicapped people in their subdivision= that since a 31375 foot structure could be built on the lot, objections to a 2,686 square foot structure are not concluded to be too significant, particularly in light of the legislative intent regarding shelter homes. 16. That regarding Section 11-2-419C it is specifically concluded as follows: a. That there are special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would clearly be unreasonable when a total structure of 3,375 square feet is allowed. b. That such variance would not have the effect of altering the interest and purpose of this Ordinance and the Meridian Comprehensive Plan or the legislative intent and purpose of Idaho Code 67-6530 through 67-6532. 17. That it is specifically concluded that this matter has been difficult to decide as it has put two reasonable and just goals at odds: one, a requirement that all single-famiy dwellings should be surrounded by open air and space to improve the standard of living of the occupants, and two, a reasonable social goal of integrating the elderly, mentally retarded and physically disabled into serene family residential surroundings and live a "normal" life; that it is believed, however, that the latter goal should control particularly where the only real variance requested is to be able to use allowable "garage space" for living space and the motivation for the objection was based on the use of the property for a shelter home. 18. That it is concluded the Application should be granted provided the Applicant continues to meet the requirements of the Department of Health and Welfare for a shelter home as it is concluded their determination as to whether he has shelter home license controls the City determination as to whether Section 67-6530 through 67-6532 apply to him and control the Zoning.
