DEPARTMENT REPORTS: • MERIDIAN CITY COUNCIL SEPTEMBER 1, 1987 Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford at 7:30 p.m.: Members Present: Bill Brewer, Ron Tolsma, Bert Myers, Bob Giesler: Others Present: Roy Porter, Earl Ward, Gary Smith, Walt Morrow,Bob Mitich, Kenny Bowers, Wayne Crookston, Sue Stover, Julie Stutts, Steve Wherry, Darlene Seamons, Brent Alger, Dennis Nieslen, Jim Hall: The Motion was made by Myers and seconded by Tolsma to approve the minutes of the previous meeting held August 18, 1987 as written: Motion Carried: All Yea: Item #1: El-Ada, Inc: Mr. Jim Hall was present from E1-Ada, Inc., Mr. Hall gave the Mayor & Council a brief description of the different programs they were involved in and passed out a questionere to the Mayor & Council to be completed and returned to El-Ada, Inc. Item #2: Public Hearing: 1987-88 Fiscal Year Budget: Mayor Kingsford: I will now open the Public Hearing, is there anyone in the audience who wishes to offer testimony on the 1987-88 Budget? There was no response, the Public Hearing was closed. Item #3: Ordinance #488: Annual Appropriation Ordinance: Mayor Kingsford: An Ordinance making all appropriation of money for all necessary expenses and liabilities of the City of Meridian, Ada County, Idaho for the fiscal year commencing the first day of October, 1987, and ending the thirtieth day of September 1988, this Ordinance known as the Annual Appropriation Bill, and declaring an emergency, is there anyone in the audience who wishes Ordinance #488 read in its entirety? There was no response, the estimated total revenue for the fiscal year is $3,142,815.00 with the estimated expenses being $3,142,815.00: The Motion was made by Brewer and seconded by Myers that the rules and provisions of 50-902 and all rules and provisions requiring that Ordin- ances be-read on three different days be dispensed with and that Ordin- ance Number 488 as read be passed and approved: Motion Carried: Roll Call Vote: Giesler, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: Item #4: Amended Ordinance #486: Allison Annexation: Mayor Kingsford: This amendment was necessary as the portion of Pine Street along this property was omitted from the original Ordinance, An Ordinance amending Ordinance #486 which Ordinance annexed and zoned Lot 6 of East Side Addition to Meridian, Ada County, Idaho and providing an effective da.t~,is there anyone in the audience who wishes Amended Ordinance #486 read in its entirety? There was no response. MERIDIAN CITY COUNCIL • • SEPTEMBER 1, 1987 PAGE #2 The Motion was made by Myers and seconded by Tolsma that the rules and provisions of 50-902 and all rules and provisions requiring that Ordin- ances be read on three different days be dispensed with and that Ordin- ance Number 486A as read be passed and approved: Motion Carried: Roll Call Vote: Giesler, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: Item #5: Resolution #115: Proclaiming General City Election: Mayor Kingsford: A Resolution proclaiming general City election,to be held November 3, 1987, designating the polling places, designating the Re~gistrar%aatid Deputy Registrars and ordering the City Clerk to give notice of such election, is there anyone present who wishes Resolution read in its entirety? There was no response. The Motion was made~_.by Tolsma and seconded by Myers that Resolution #115 be passed and approved: Motion Carried: All Yea: Item #6: Pre-Termination Hearing: Water/Sewer/Trash Delinquencies: Mayor Kingsford: You have been informed in writing, if you choose to, you have a right to a pre-termination hearing before the Mayor & Council to appear in person to be judged on facts and defend the claim made by the City that your water, sewer, and trash bill is delinquent, you may retain counsel. Is there anyone in the audience who wishes a pre-termin- ation hearing? Darlene Seamon, representing Wesley Worchester, Acct #5326, 1216 W. 12th Avenue was present and felt there was something wrong with the amount they had been charged. The Mayor & Council asked the City Engineer to investigate this account and the water would not be turned off at this time. Mayor Kingsford: Is there anyone else present who wishes a hearing? There was no response. The amount of the turn-off list this month is $7,833.05: Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on September 9, 1987. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City review- ed by the Fourth Judicial District Court pursuant to Idaho Code. Even though they appeal the water will be shut off. The Motion was made by Tolsma and seconded by Myers to approve the turn-off list with the exception of Acct# 5326: Motion Carried: All Yea: Item #7: Approve the Bills: The Motion was made by Tolsma and seconded by Myers to approve the;~mills: Motion Carried: All Yea: MERIDIAN CITY COUNCIL • • SEPTEMBER 1, 1987 PAGE # 3 ITEM #8: Transfer of Beer & Wine License: Arthur Moore, Farmers Club to Shirley Rae Hardy, The Main Event: Mayor Kingsford: Chief Porter, do you have any problem with this transfer? Chief Porter: I have checked this out and can find no reason why the licenses should not be transferred: The Motion was made by Tolsma and seconded by Giesler to approve the transfer of the beer & wine license from Arthur Moore dba The Farmers Club to Shirley Rae Hardy dba The Main Event: Motion Carried: All Yea: Department Reports: Mayor Kingsford: As the Council is aware we are in the process of apply- ing for Grant Funds to help defray the cost of the secondary clarifier at the Sewer Department, which the City Engineer is preparing. It has come to my attention that we need a resolution or a motion authorizing the filing of the application and authorizing the person identified as the official representative to act on the applicants behalf. The Motion was made by Myers and seconded by Giesler to apply for Grant Funds for the Secondary Clarifier including all understandings and assurances contained therein, and directing and authorizing the City Engineer as the official representative of the City of Meridian to act in connection with the application and to provide such additional information as may be needed. Motion Carried: All Yea: Brewer: In regards to the Seconds on First, I think we have some loose ends to clean up there, Sue Stover was kind enough to come down and meet with.,, the Council tonite, a few days after Tom Woodwards article and our legal notice she invited me over and we discussed her position. She had been served and talked to the Mayor who seemed under the conditions willing, to give her some time and work with her, I gave her the same impression but we felt because she had been legally served perhaps the Council its- self should take some action on this. In order to give her some peace of mind and comfort as far as her stability there until either Mr. Johnson get a zone change or she finds property to relocate, she was put in a bind, I still find that very regretful, I think we are all aware of the circumstances that brought it to that,. it was a blatent lack of commun- ications between all the parties involved, the Mayor talked about two or three weeks and I had no problems with that, that may not be long enough she has moved her business entirely indoors with the exception of maybe one or two pieces which I did not think we would have any problem with, she has moved her sign I would suggest if it takes her two to three months under the conditions, I would not have any problems letting her continue at that location, however I understand that Mr. Johnson has finally applied for a rezone, so something timely maybe happening. Motion Carried: All Yea: Brewer: We have had neighbors to the South of me that have had continued problems with the Phillips 66 Service Station. I am going to just mention their names, Brent Alger, Dennis Nielsen and then also the people in the Ambrose Building to the West of the Phillips 66, they have all made for- mal complaints. I think I will let those people elude to what the compl- aints are. Brent Algers, 120 East State, I live across the Street, North of the Phillips 66 Station, since the present party that is operating the Stat- ion has been there we have had problems with vehicles parked in front of our house either unlicensed or a fictitious display, I am certain of it, because any time you find a license plate hung on a pickup with a nylon stocking and the licnese plate setting on the bumper the plate in all probablility does not belong to that vehicle. As of late there are three different semi's that have been parking either in front of our house or in front of the renters house and across the street, one semi quite often parks out on First Street in front of the station and makes it very difficult and dangerous for traffic leaving State Street onto East First, it blocks the vision from the South . Not my point of view but the neighbor across the street says they have parked in the alley so they can not use the alley, that alley is supposed to be a one-way alley and they have had cars parked in front of their house as well. Dennis Nieslen, 1012 East First, I have had patients complain to me, about two weeks ago they had a Jeep with a camper parked right at the corner of East State and East First and it was blocking the view of people coming out onto East First from my business. It was right at the corner they were parked in a yellow zone plus partially in my driveway. It stayed there about ten days and I finally went over and complained to them and it was finally moved. After that one left they parked another one in the same place and I called the police and it was towed away. Today I drove by there and counted nineteen cars parked around their business,I imagines a couple of them are their employees but one of them was parked on the sidewalk in front, two other vehicles were parked between the sidewalk and the road, I feel it really looks like a junk yard and I think in the middle of town that should be clean- ed up. Brewer: We can just add to that the Ambrose people are supportive of these comments and even though they did not come they wanted their feelings to be noted. This has been an ongoing problem ever since he moved in and I know the Police Chief has had to visit them on more than one occasion. Mayor Kingsford: City Attorney, do you think anything from your office might be benificial, do you have any recommendations? City Attorney: I will look into the violations they have and see about civil action proceedings, not leaving out criminal violations as .well. MERIDIAN CITY COUNCIL ~ • SEPTEMBER 1, 1987 PAGE # 5 Mayor Kingsford: We appreciate your coming forward and making a complaint, and we will certainly work to get something done to eleviate the problem. Mayor Kingsford: Two meeting ago the Juvenile Center was before the Council and to update the Council on this they asked to use this building after we vacate it, I have talked to the County. Commissioners in that regard and talked to the owner of the building over where they are at. In visiting with Mike Johnson last Friday he indicated to me either we have it at City Hall or it goes back to Boise, in talking to Judy Peavy today she indicated that they were still looking at funding although I do not give to much hope for that, I would like to get the Councils feeling in regard to that, if they won't stay in that building which I would prefer, what is your feeling about the City providing them space, I think it would be my recommendation that we don't necessarily put them in here but that we make an office available in the new build- ing for them short term.. rather than trying to maintain this building. We have one extra office in the new building located next to the pre- council room. Brewer: I totally agree as far as locating them over there but you are not giving up the additude that hopefully funding will come about? Mayor Kingsford: No, I guess I would like to get a sense of the Councils feeling if it come to that. It is your desire to keep them in Meridian is it not? It was the consensus of the Council that this should be kept in Meridian, preferrably where they are presently located. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MERIDIAN, IDAHOr THAT: SECTION 1. The general city election will be held in and for the City of Meridian, on the 3rd day of November, at which time there will be elected a mayor and two (2) councilmen to serve for a term of four years, or until the election and qualification of their successors. The information we collect will be used in developing our work program for 1988. The Needs Assessment process includes gathering data from low-income participants in El-Ada programs, officials in agencies providing services to low-income people and elected public officials. We would like the opportunity to meet with members of the Meridian City Council and explain this process, answer questions about E1-Ada's programs and distribute the questionnaire to the members present. Members can complete the form and mail it back to E1-Ada. We realize the demands on the meeting time for a government body. The process described above takes between 15 and 45 minutes depending on the number of questions raised. We would like to complete this process by September 15th. If your secretary could contact either Bev Elliott or myself at 345-1914 we will schedule the time most convenient for the Meridian Council. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: Section 1. The amount of money derived from funds or sources created by law for the specified purposes in this Ordinance Provided is hereby appropriated for such purpose and no other. • • (3) Section 4. The City Clerk of the City of Meridian is hereby-. authorized, upon presentation of proper vouchers approved by the Mayor and City Council of the City of Meridian as provided by law, to draw his warrant on the funds above stated and against the app- ropriation as made in the preceeding sections of this Ordinance, in favor of the parties entitled thereto. Section 5. That this Ordinance be, and the same is hereby designated as "THE ANNUAL APPROPRIATION BILL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR OF 1987-1988." Section 6. WHEREAS, there is an emergency therefor, which emergency is declared to exist, this Ordinance shall take effect and be in force from and after its passage, approval and public- ation as required by law.
