Beumeler, Wayne Crookston, Jim Johnson, Steve Anderson, Members of Scout Troop #129: The Motion was made by Giesler and seconded by Tolsma to approve the minutes of the previous meeting held September 20, 1988 a.s written: Motion Carried: All Yea: Item: #1: Proclamation: Mayor Kingsford read a Proclamation declaring October 24, 1988 as i]NITID NATIONS DAY. Along with this I have been asked to designate a person for this celebration and if the Council will accept and the person will accept that will be Mr. Alan Lance. Council Members concurred with this selection. Item #2: pre-TPm,;nation Hearing: Water/Sewer/Trash Delinquencies: Mayor Kingsford: You have been informed in writing, if you choose to, you have the right to a pre-texmination hearing before the Mayor & Council, to appear in person to be judged on facts and defend the claim made by the City that your water sewer and trash bill is delinquent. You may retain Counsel. Is there anyone in the audience who wishes a pre-tern~ination hearing? There wa.s no response. Due to their failure to pay their water bill or to present any valid reason why the bill ha.s not been paid, their water shall be turned off on October 12, 1988. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal their. water will be shut off. The Motion was made by Tolsma and seconded by Myers to approve the delinquencies as subtr~itted for turn-off . Motion Carried: All Yea: Mayor Kingsford: The amount of delinquencies is $7,895.15. Item #3: Approve the Bills: The Motion was made by Tolsma and seconded by Myers to approve payment of the bills: lotion Carried: All Yea: Item #4: Ordinance #498: Ordinance Amending the Plumbing Code Ordinance: Mayor Kingsford: An Ordinance repealing Chapter 2, Title 2 of the revised and compiled Ordinances of the City of Meridian; and re-enacting said Chapter 2, Title 2, laz~vn as the Plumbing Code; and providing an effective date, is there anyone in the audience who wishes Ordinance # 498 read in its entirety? There was no response. MERMAN CITY COUNCIL • • OC'T'OBER 4, 1988 PAGE # 2 The Motion was made by Brewer and seconded by Giesler that the rules and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 498 as read be passed and approved: Motion Carried: Roll Call Vote: Giesler, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: Item # 5: Resolution #121: Resolution setting fees for Plumbing Permits: Mayor Kingsford: A Resolution of the City Council of the City of Meridian, Idaho, providing for the adoption of a schedule of Plumbing Inspection Fees and Permit Fees, this is the same schedule of fees that the State uses, we will be doing our own plumbing inspections. The Motion was made by Myers and seconded by Tolsma to approve Resolution # 121: Motion Carried:• All Yea: Mayor Kingsford: I see Mr. Steve Anderson, President of the C'ha¢nber is present and he would like to approach the Council regarding the parking/drive-through area at the new Chamber's Visitor's Bureau, I made photocopies of the letter he gave me this noon and distributed them to the Members of the Council. Anderson: A couple of things came to our attention last week concerning the turn- around drive-throes area. The first thing was how shallow the pipe was on Nine Mile Creek, it is only about eight or nine inches under the grass, so our first thought was either building that entire area uP with fill or digging back around that culvert, which is a steel culvert, and rebedding it and putting a concrete cap over it. Also when we began to give sane consideration to drainage , we looked at the existing drain it is not built to the current specifications so we did not feel we could run .our drainage into this drain. What we would like to do at this point is go ahead and get the building up and finished and operational and then stand back and take a look at this whether we really do want aturn-around area. An idea we had the other day is just widen the road for parking. At this point I am not sure what is going to best accanodate the building. Gary, do you have any comments on this? City Engineer: As Mr. Anderson mentioned the pipe is not very deep, there is two ways this could be put in, one with reinforc~nent over the pipe and the other using fill to bring up to the existing level of the road. When we discussed the traffic situation out there, I do not know that during the operational hours of the Chamber Center that there would be that much conflict with parked cars,. however, it appears there could be a problem with traffic going through that area particularly the high school kids during the noon hours,. if there were units parked on both sides of the street. The other thing that could be done is widen the street. I feel there is going to be congestion if parking is along both sides of the street. Anderson: Fran our standpoint it is not wanting to do it, it is just trying to get a better feel as to what is going to be the best way to do it. What I might ask for is let us get operational, let us get a feel for what the traffic is there, working with you and develop a parking or pull off area that is really going to work there. Mayor Kingsford: Any questions of Mme. Anderson? Giesler: I have a question of the City Engineer, you spoke that there would need to be sage reinforcement if the circular drive was put in over the pipe, does that also N~RIDIAN CITY COjA~TCII, • • OCI'ORER 4, 1988 PAGE # 3 have to be done if the street was widened? City F~gineer: If you widen the street you would be up high enough that the reinforc- ment would not be needed and if the circular drive was up to the street elevation the reinforcement mould not be needed as you would be t~Zlking about eighteen inches of fill. Myers: When you are talking about widening the street, are you talking about the full length along the street? Anderson; I believe that would be the best, if the street was widened to'widen it enough so you could easily park and still have two way traffic. Myers: That sound like it might be the best way. Tolsma: I ]me<ni the other day at the ground breaking, my pickup was parked on one side and there was another unit on the other and there was no way two cars could get through there, I think the widening of the street would be the best way rather then the drive. Mayor Kingsford: I am not so sure that if we get the kind of vistors at the vistors center that I anticipate, I am still inclined to think that the circular drive is going to be the best route to go, but I agrc-~ with you maybe we ought to have a little feel for what kind of traffic is there. If we get RV's in there I can see that circular drive being very convenient for those people to cane back out on Franklin and go back to the freeway plus I think it is going to make a lot better looking facility for the Chamber. I expressed to Mr. Anderson my major concern really was to make sure that the Chamber had money to do this down the road, he might speak to that, he reasonably satisfied my concern. Anderson: In the budget we are working on right now, I have already budgeted approximately $6,000.00 for the parking turn-around area so whether we do it in aturn-around or widening the street I think we have set enough money aside for that purpose that we will be able to do it whatever is the best alternative. So at this point I do not see that to be a problem for us. Myers: So at this point you just want to go ahead and build the building and then see what it looks like and then put that in later, it would not make any difference one way or the other? Anderson: No, as far as financing it won't, I just want to do it right. There was more discussion on sane alternative ways to make the circular drive. Giesler: How long a period. of time are you looking at after you complete the building before the parking is done? Anderson: When you are laying asphalt you want good warn weather, so lets say June or July scenething like that. This would be my thought. Mayor Kingsford: What is the Council's decision, I would like to see a nay, yea or table. Department Reports: Police Chief: The past two nights in the downtofnni area specifically the 100 block of Broadway and the 100 block of East Idaho we have nine vehicle break-ins and one stolen vehicle, so don't leave anything valuable in your cars and lock theno~ar they have all be locked and they have broke the drivers window, this has ed between 9:00 and 11:00 p.m.: City Engineer: Back on September 16, I submitted a mew concerning the subdivision platting process, APA has formed a committee consisting of members from each city, the county and the highway district. The main concern was where a time extension Maas requested on a plat, that other agencies involved had some say in case their requirements had changed since orn ~~'T.approval, this was mainly the Highway District concern.If any of you have any questions on this mes~to or comments that you would like passed on to the committee , I will glad to try to answer those questions or pass those cce~enents on. City Attorney: I want to report to the Council that the hearing on the attorney fees issue on the Alpert versus the Cities of Ada County, Boise Water Company and Intermountain Gas Canpany the Court did not find that there. were sufficient grounds to award attorney fees to the Cities or the utilities involved. Mayor Kingsford: Even though we are late, I would like to welcome scene members of Boy Scout Troop #129 that are here with us tonne. Giesler: I would like each of the members of the Council to get with the Department Heads and thank any of the people who helped participate in the City versus the Chamber Whiffle Ba11 Game last week, we did defeat the Qzamber of Ccuenerce. Tolsma.: I met with Mr. Draper yesterday from Hoff Ccenpany, we went through their plant and looked at their facility and viewed what they have done to try and aleviate the noise, we discussed this scene and he was supposed to meet~hi.s week sometime with Chandler's people to look at haw they have controlled the noise in their operation. I am supposed to get back with them next week and find out what they are going to do or how they are going to go about solving the pxob],egn and. what is feasible for .them to do. They said.they_.wa~ated to get the problem alleviated, they did not want the residents cCHnpla~ ri; rig about then. Mayor Kingsford: I had a meeting with the gentlenan that was here at the last meeting and he had some concern that we were dropping the ball, he thinks it is extremely loud there, a number of his neighbors that he has talked to said they thought it was something they had to live with, it bothers then but they had not complained. I think he is on the verge of collecting names on a petition so I think we need to work with Hoff and get that remedied a.s quickly as we can. Brewer: I have some written remarks, I would like to read in reference and in line with my resignation tonne (remarks on file with these minutes), with that I sureni.t my written resignation in hopes it will be effective this date. I thank you all very much. Mayor Kingsford: I will read the resignation letter, I Bill Brewer, President of the Meridian City Council, hereby tender my resignation effective this date. The very best wishes in what ever you take up in the future. Mr. Brewer receieved a standing ovation. Mayor Kingsford: With that I would ask the City Clerk to order an appropriate plaque for the time Mr.' Brewer served. Mayor Kingsford: Council if you have suggestions for replacement of Councilman Brewer that you visit with me and I think that would be appropriate as well for those members of the City and we will try to fill this vacancy on the Council at the next Council Meeting. Myers: That is going to be very difficult to do because Mr. Brewer has done a great job for the City, as well as being a friend. WHEREAS, the Mayor and City Council of the City of Meridian, State of Idaho, have concluded that it is in the best interests of said City to repeal Chapter 2, Title 2 of the Revised and Compiled Ordinances of the City of Meridian and re-enact said Chapter with additional provisions all to be known as the Plumbing Code. NOW, THEREFOR, BE IT ORDAINED BY THE MAYOR AND- CITY COUNCIL. OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: SECTION 1. That Chapter 2, Title 2, Plumbing Code, of the Revised and Compiled Ordinances of the City of Meridian is hereby repealed. SECTION 2. That Chapter 2, Title 2, of the Revised and Compiled Ordinances of the City of Meridian, to be known as the PLUMBING CODE, is hereby re-enacted and shall read as follows: 2-201: ADOPTION OF PLUMBING CODE: There is hereby adopted by the City of Meridian for the purpose of establishing minimum standards of design, materials and workmanship for all plumbing hereafter installed, altered or repaired, and to establish methods of procedure within the City limits, that certain Plumbing Code known as NATIONAL PLUMBING CODE, 1985 EDITION, and • the whole thereof of which not less than three (3) copies have been and now are filed in the office of the Clerk of the City, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date of which this Chapter shall take effect, the provisions thereof shall control the installation, alteration or repairing of plumbing within the corporate limits of the City; PROVIDED HOWEVER, the below stated addition to the National Plumbing Code is also hereby adopted which addition, if in conflict with the National Plumbing Code (NPC) shall overrule said NPC; the addition is stated as follows: A. Box 427 Metidlan, Idaho 83842 Tetephona 8881481 2-203: PERSONS REQUIRED; APPLICATION; ISSUANCE: It shall be unlawful for any person, firm or corporation to place or install in any building any plumbing apparatus or fixture, or to make any alterations or changes in, or additions to any plumbing apparatus or fixtures for such use, without first obtaining from the City Plumbing Inspector a written permit to do such work. Such permit shall state the kind of work to be done and the amount, and shall cover only work so specified. The contractor, person, firm or corporation shall submit a plan of the plumbing system to be followed, if deemed necessary by the Plumbing Inspector. Said permit shall aslo state the location by. street and number of the building where such work is to be done, and shall be valid only for the location stated. Provided, however, that this Section shall not be construed as requiring a permit for ordinary repairs to old installations where the. cost value of such repairs, including material and labor, does not exceed eight dollars ($8.00), but in all cases, the Plumbing Inspector must be notified immediately upon the completion of such work for his inspection and approval. Box 427 McNdlan, Idaho 83842 Telephone 8881481 2-205: INSPECTION REQUIREMENTS: It shall be the duty of the City Plumbing Inspector, or the State Inspector if the City so chooses, to inspect or cause to be inspected any and all work for which permits have been issued within forty eight (48) hours (Sundays and holidays excluded) after time of notice, in writing by the person doing the said work that same is ready for inspection, which will not be considered ready for inspection and covering until all enclosed electrical, steam heating, furnace work and gas fittings are in place. Inspection shall, when necessary, be made two (2) or three (3) times during progress of installation= first when work is roughed in, and last, when work is completed, and it shall be the duty of the City Plumbing Inspector or person qualified and delegated by him and his qualified representative tp indicate inspection of any work by a tag or label which shall state the date and whether first or final inspection has been made and it shall be unlawful for any workman or other person to lath or otherwise conceal any plumbing pipes until such first inspection tag has been placed. A. Upon application for inspection of any plumbing apparatus, or appliances as hereinafter provided, the City Inspector shall after inspection and examination issue a certificate showing the results • • of such examinations and require to be made the necessary corrections. B. If the said City Plumbing Inspector shall find any part of any plumbing apparatus or fixtures in or on any building in the City to have been installed without a permit or not in accordance with the provisions of this Chapter or to be dangerous to life or property, the City Plumbing Inspector shall. have the right and power and it is hereby made his duty to disconnect such defective plumbing and place a seal upon it. He shall at the same time give written notice of such discon- nection to the owner or occupant of the building. After such disconnected plumbing apparatus, or fixtures have been put in the condition required by this Chapter, the seal or seals so placed shall be removed by said City Plumbing Inspector. FOR ME, IT'S BEEN VERY EXCITING TO BE IN A POSITION THAT ALLOWED ME TO KNOW WHAT WAS GOING ON AND HAVE SOMETHING TO SAY ABOUT IT. IN 1979, IT WAS NOT UNUSUAL FOR COUNCIL MEETINGS TO LAST BEYOND MIDNIGHT AS WE DISCUSSED THE NEW GOLF COURSE, A NEW WASTE TREATMENT PLANT, AND INDUSTRIAL PARKS. THOUGH THE INDUSTRIAL PARKS STAND VANCANT DUE TO A DECLINE IN ECONOMY, THEY ARE IN PLACE AND READY TO G0. HUNDREDS OF HOURS OVER THE YEARS HAVE BEEN SPENT WORKING WITH REGIONAL MALL DEVELOPERS STUDYING IMPACT AREA NEGOTIATIONS, CHANGES IN COMPREHENSIVE PLANS AND REVISED ZONING ORDINANCES, AND BUILDING CODES. DURING THE FINANCIALLY HARD TIMES, WE'VE DOUBLED THE SIZE OF OUR WASTE TREATMENT PLANT, , BUILT NEW PARKS, AND, THIS LAST YEAR, COMPLETED THE NEW CITY HALL. MUCH OF THIS CREDIT BELONGS TO EXCEPTIONAL FINANCIAL PLANNING BY OUR FORMER MAYOR, JOE GLAYSIER, AND TO OUR PRESENT MAYOR, GRANT KINGSFORD. I HAVE HAD THE OPPORTUNITY TO SERVE AS POLICE COMMISSIONER, FIRE COMMISSIONER, MERIDIAN'S REPRESENTATIVE ON THE ADA PLANNING ASSOCIATION, AND PRESIDENT OF THE CITY COUNCIL. DURING MY TIME WITH THE POLICE DEPT., I HAD THE DIFFICULT TASK OF ASKING FOR THE CHIEF OF POLICE's RESIGNATION, AND ONE OF MY OFFICERS HAD TO ARREST ME FOR DRIVING UNDER THE INFLUENCE OF ALCOHOL. I CAME CLOSE TO BEING TARRED AND FEATHERED, WHEN WE CONSIDERED CONTRACTING FROM ADA 'COUNTY FOR POLICE PROTECTION. NOW THERE ARE WORKSHOPS GIVING CONSIDERATION TO COMBINING THE ADA COUNTY FIRE DISTRICTS." FROM PAST EXPERIENCE, MY ADVISE TO THE COUNCIL WOULD BE TO TREA'® LIGHTLY HERE. MERIDIAN RESIDENTS ARE INDEPENDENT AND WANT TO MAINTAIN THEIR OWN IDENTITY. r • IT HAS BEEN A PLEASURE TO HAVE THE OPPORTUNITY TO STAND IN FOR MAYOR KINGSFORD DURING HIS ABSENCE. THAT'S AS CLOSE TO MAYOR OF MERIDIAN AS I CARE TO BE. I HAD PLANNED ON COMPLETING THIS TERM IN OFFICE AND THEN NOT RUNNING FOR RE-ELECTION; HOWEVER, MY REASONS FOR RESIGNING AT THIS TIME ARE AS FOLLOWS: I'VE ENJOYED A SUBSTANTIAL GROWTH AS WELL AS A RENEWED INTEREST IN MY BUSINESS. ON APRIL 30, 1987, I MARRIED MY WIFE, JOYCE, AND WITH HER CAME A BEAUTIFUL l6 YEAR OLD DAUGHTER, KENDALL, SO I NOW HAVE A FAMILY LIFE. WE ARE BUILDING A LOG HOME ON LAKE CASCADE THIS YEAR AND I WANT TO BE AS MUCH A PART OF THAT AS POSSIBLE. ALSO, FOR 2 YEARS AND 8 MONTHS, FOLLOWING TREATMENT, I HAVE BEEN A RECOVERING ALCOHOLIC & I WILL BE A RECOVERING ALCOHOLIC FOR THE REST OF MY LIFE. I FEEL MY BUSINESS, MY FAMILY, AND MY AA MEETINGS REQUIRE A GREAT DEAL OF MY TIME, PLUS I NEED MORE TIME FOR MYSELF AND MY NEW WAY OF LIFE. THIS HAS BEEN A WELL BALANCED COUNCIL AND I HAVE ENJOYED AND RESPECTED EACH MEMBER. ALL OF YOU HAVE BEEN GOOD FRIENDS AND I APPRECIATE THE SUPPORT YOU HAVE GIVEN ME. MR. MAYOR, MY SINCERE APPRECIATION TO YOU, TO JACK & LaWANA NIEMANN, THE LADIES OF CITY HALL, AND THE LICENSE DEPT. AND ALL OTHER CITY DEPTS. THANK YOU ALL.
