Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford
at 7:30 p.m.:
Members Present: Ron Tolsma., Bert Myers, Bob Giesler:
Others Present: Moe Alidjani, LValt Morrow, Gary Smith, Kent Hauck, Eric Hauck, Rob
Prindle, Don Campbell, K. Beumeler, Ann Peterson, Wayne Crookston, Gene Strough,

The Motion was made by Tolsma and seconded by Myers to approve the minutes of the
previous Meeting held October l8, 1988 as written:

Mayor Kingsford: The first thing this evening which will vary from the Agenda is
I would like to make a recommendation for the Council's approval of an appointment
to fill the vacancy on the Council. For the Council's infornlation I met last week
with the five individuals who had expressed an interest in this vacancy, first off
I would say publically that I am very pleased and proud to be a menber of a City
that has people that are interested in that number and all of then I ~rould say
extremely qualified, highly qualified individuals, after spending probably four
hours with those individuals, a tough decision, I have decided on a ncenination
for the vacant seat on the Council, I will present that-name to you at this time,
Walt Morrow, who is currently Cha.~rman of the Planning & Zoning.
The Motion was made by Giesler and seconded by Tolsma to approve the Mayor's
recc~rtnendation that Walt Morrow be appointed to fill the vacancy on the Council
created by the resignation of Bill Brewer, this teen will be until the next
election.

Mayor Kingsford: Mr. Morrow would you come forward and be sworn by the City Clerk:

Mayor Kingsford: I might say that in addition to all the candidates being extremely
qualified, I did receive both written correspondence and telephone calls and
personal supports for each of the candidates, not just a few but several for each
of them again I am very pleased and proud to be in a con4rnuiity that has that kind
of interest in the Council. Welccane aboard Mr. Morrow:
Mayor Kingsford: The next item is that the Council Members need to decide upon a
Council President, Mr. Brewer having vacated that position.
The Motion was made by Myers and seconded by Giesler to nominate Mr. Tolsma to
serve as Council President:

Item #1: Fence & Burm at Crestwood #3: Tabled at-last Meeting:
Mayor Kingsford: At the last meeting I assigned Councilman Giesler to look into
this and if he would update the Council at this time.

Giesler: I ask the City Engineer to take scene measurements out there for us, we are
concerned right now of where Ada County is going to be requiring the curb be put
along Franklin Road, the developer is rernl;red to install this within a two year
period from April 1, of this year, we would like to have another measurement to
go by using the curb height. We need to know how much difference that is from the
property itself. Their Engineer is obtaining those figures and getting then to
us and as of yet we have not received them, I would expect we ..~~uld have those
within the next few days, at that time I think we could go ahead and finish this
thing up and be able to make a presentation, I tai®ux~#ht we would have that ready
tonite but this other measurement could be very important. So with that if no one
has a problem with it, I would ask that it be tabled again until the next meeting.
Counci]man Morrow: I~have a question, how cane the design on the outside is not the
same as the other phases one & two, why is it different? I am not familiar as to
how it got to be a burn in the first place.
Giesler: The burin was put in before my time, fran what I can cane up with the burn
basically was not going to be there originally, in the original plan, the dirt was
piled there when t'were doing the necessary developing, the streets & utilities,
that the burin would be removed when the project was cce~leted for development, it was
not, they did cut it dawn a foot or foot and one-half, at this point the figures we
have it is five feet, one inch above the property, therefore actually the burns is
in accordance with the Ordinance, there is no problem with the burin, we do have
a problem putting the fence on top of the burn.
Morrow: V+~ien the Crestwood concept was approved originally was there sane means of
continuity in terms of how Franklin Road was to be done the rest of it, did we approve
stipulations that said the rest of it was going to be like the first phase?
Mayor Kingsford: As far as I know, that was never approv~7.and neither was the burin
approved. I think there was sane assucmpti.on that merle would be carried forward but
reviewing the minutes, no. The burin was never approved, to support what Mr. Giesler
said the berm was just excavation, all of which has not been removed. It is like
many other project, we have had znul.tiple owners thro~h the develo~enent .

Item #2: Request by Cherry Zane Baptist Church, Temporary Building for Classroom:
Mayor Kingsford: Which one of you gentlemen wish to speak to this request, v~uld
you cane forward and state your name?
Dan Campbell, Pastor of the Cherry Lane Baptist Church, we are requesting that we
be able to put a temporary structure back behind our Church, we submitted a drawing,
I assume you gentlemen have all had a chance to look at it, it would be for the
purpose of providing extra roans for Sunday School Classes, we are growing, we are
outgrowing our present structure, in order to provide the financial base to be able
to build addition space that would seat sanerahere between 300 & 350 people next year
we need the Sunday School space, we are requesting that we be able to place a
temporary structure behind our church and it will be out of the site of anyone
driving by.
Mayor Kingsford: You are asking for a period of twelve months?

Campbell: Yes, and at the end of twelve months if we have not in fact ccsnpleted our
building-that we are hoping to start building here within the next six months, we will
probably come back before you.
Myers: is this going to be a regular mobile home back there, the wheels still on it or
is it going to be on a foundation?
Campbell: It will have a block foundation under it and be set up to be stabilized,
it will be scxnething that will be filled with people, we are going to pardon it
off to make three different classrooms.
Tolsma: Will this unit be hooked to water and sewer?
Campbell: No, just classroom space only.
Mayor Kingsford: I would caution you that the fire department get involved to make
certain the exit are adequate and that sort of thing.
Campbell: It is a manufactured unit and if I am not mistaken there are three exit.
It has been renevated to be used as a classroom, it is a structure that our associat-
ion allows different churches to rent from therm for classroom space.

building for a period of one year to be used as a classro~n:

Mayor Kingsford: I see we have a Boy Scout here, we would like to welcome you to the
meeting, he was frcan Troop #28:
Item # 3: Pre-Termination Hearing: Water/Sewer/Trash Delinquencies:
Mayor Kingsford: You have been infornned in writing, if you choose to ,you have the
right to a pre-terntination hearing before the Mayor & Council, to appear in person
to be judged on facts and defend the claim made by the City that your water/sewer/
trash bill is delinquent. You may retain Counsel: Is there anyone in the audience
who wishes a hearing? There was no response, due to their failure to pay their water
bill or present any valid reason why the. bill has. not been paid, their water shall
be turned off on November 9, 1988. In order to have their water turned back on,
there will be an additional fee of $10.00. They are .hereby inforned that they may
appeal or have the decision of the City reviewed by the Fourth Judicial District
Court pursuant to Idaho Code. Even though they appeal their water will be shut off.

Mayor Kingsford: An Ordinance repealing Section 11-2-409 of the revised and ccsnpiled
Ordinances of the City of Meridian and re-enacting-said Section 11-2-409 with additions:
and providing an effective date, is there anyone frcan the public who wishes Ordinance
#499 read in its entirety? There was no response:

of 50-902 and all rules and provisions rern~iring that Ordinances be read on three
different days be dispensed with and that Ordinance #499 as read be passed and
approved:

Item #6: Amended Ordinance #498: Plumbing Ordinance:
Mayor Kingsford: An Ordinance repealing Section 2-201 of the revised and ccenpiled
Ordinances of the City of Meridian and re-enacting said Section 2-201 with changes,
and providing an effective date, correct me if I am wrong Counselor but this had to
do with the fact that we invertantly adopted the National Plumbing Code instead of
the Uniform Plumbing Code, this amend that where we are using the Uniform Plumb-
ing Code. Is there anyone in the audience who wishes Amended.Ordinance # 498 read
in its entirety? There was no response:

Department Reports
Tolsma: We will proceed with this noise problem at Hoff's.
Mayor Kingsford: I did visit with Mr. Strough prior to the meeting tonit~ and he
presented the Council with a petition with roughly an additional one hundred
signatures, Mr. Tolsma has been in contact on several occasions with the Hoff
people, I am going to make every effort to get ahold with Harvey Hoff and talk
to him this week, I understand they are having a Ccg~zy meeting next week as they
do every month and I want to visit with him before that. It is my understanding
they are starting to insulate the blower pipes, we will keep after them and get
the problem resolved. I would like to thank Mr. Strough publically for his
perseverance on this issue.
City Clerk: I sent each of you a letter about the upcoming Legislative Dinner
Meeting scheduled for December 14, AIC needs to know who is going to be in attend-
ance at this dinner meeting, I need this as soon as possible.
Mayor Kingsford: I would urge all of you that can to attend.
Mayor Kingsford: One item I have is the second annual VIP Howl is this Sunday and
they need to have the names of the people who are going to be there so he can
program the ccanputers. They need these tomorrow.

Myers: I just happened to think, Friday Hite is the stew feed over at the Senior
Citizens Center from 4 to 7, which is a fund raiser for the new C17amber/Vistors
Center at the City Park.
Mayor Kingsford: For the Council's inforniation, I did write letters to those
citizens who were interested in the Council position, with the appointment of
Mr. Morrow we are going to-have to have an additional Planning & Zoning MembPx
so at the next meeting I will be reconanending someone for that position. I would
take names on that if you have scsnebody in mind. Three of the citizens interested
in the Council were also interested in the Planning & Zoning CceYSrtission.

AN ORDINANCE REPEALING SECTION 11-2-409 OF THE REVISED AND
COMPILED ORDINANCES OF THE CITY OF MERIDIAN AND RE-ENACTING SAID
.SECTION OF 11-2-409 WITH ADDITIONS; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Mayor and City Council of the City of Meridian,
State of Idaho, have concluded that it is in the best interests
of said City to repeal Section 11-2-409 of the Meridian
Ordinances and to re-enact said section with changes effective as
set forth hereinafter;
NOW, T$EREFOR~~ BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1. That Section 11-2-409, is hereby repealed.
SECTION 2. That Section 11-2-409 is hereby re-enacted
and which shall read as set set forth in Exhibit "A" attached
hereto and incorporated herein by this reference.
SECTION 3. EFFECTIVE DATE: WHEREAS, there is an
emergency therefor, which emergency is declared to exist, this
Ordinance shall be in full force and effect from and after its
passage, approval and publication according to aw.

shall take effect, the provisions thereof .shall control the
installation, alteration or repairing of plumbing within the
corporate limits of the City; PROVIDED HOWEVER, the below stated
addition to the Uniform Plumbing Code is also hereby adopted
which addition, if in conflict with the Uniform Plumbing Code
tUPC) shall overrule said UPC; the addition is stated as follows:
A. Buildings Moved From One Location To Another: When
a building is moved from one location to another the
service entrance shall be inspected and made to conform
to the requirements of the current edition of the
Uniform Plumbing Code.
SECTION 3. EFFECTIVE DATE: WHEREAS, there is an emergency
therefor, which emergency is declared to exist, this Ordinance
shall be in full force and effect from and after its passage,
approval and publication according to law.
