The Motion was made by Morrow and seconded by Giesler to approve the Findings of Fact and Conclusions of Law as prepared for the Plane;ng & Zoning Conunission on the, proposed amendments to the Comprehensive Plan: Motion Carried: Roll Call Vote: Morrow, Yea: Giesler, Yea: Tolsma, Yea: The Motion was made by Tolsma and seconded by Giesler to have the City Attorney prepare an Ordinance for the Ccanprehensive Plan Amendments: Motion Carried: All Yea: Item #2: Public Hearing: Amended Plat Meridian Place #2, Designation of House Square Footage: Mayor Kingsford: At this time I will open the Public Hearing, is there anyone from the public that would like to offer testimony on this item? James Williams, 1155 East Chateau, Williams was sworn by the City Attorney: Williams: I have a letter from my neighbor and we basically feel the same, we are opposed to building smaller houses there adjacent to our property because it would hurt the resale value of our houses, we actually live in Meridian Place #1 and the m;n;m;um square footage was 1350, we are strongly opposed to 999 square foot house right next to us, right across the street it would be. Mayor Kingsford: Does the Council have any questions of Mr. Willimas, there were none, is there anyone else who wishes to testify? Don Garrett, Boise, Garrett was sworn by the City Attorney MERIDIAN CITY COUNCIL • • DEER 6, 1988 PAGE # 2 Garrett: I own the property on the South side of Chateau, this is farther West than Locust Grove isn't it on Chateau, what is the object of building small houses? Mayor Kingsford: Under our Ordinances we have the provision that allows for a mix of housing sizes, a given percentage can be 1000, a given percentage can be 1100, and a given percentage above that. Garrett: Does anybody know what the average house size is in that area, it is larger than that by a fair amount isn't it? Mayor Kingsford; Do we have a breakdown of what was on the #1? City Clerk: #1 was actually designed with the same thing, most of the hares ended up being larger than the m;n;m;~, Mayor Kingsford: The fact that they have that smaller designation does not mean that they have to be that size, they can always be larger, it just allows them to be built down to that size. Garrett: Ok, I understand that. Mayor Kingsford: Is there anyone else from the public who wishes to testify? David Stucker, 1164 Torrington Court, Stucker was sworn by the City Attorney: Stucker: I live about one block fran where these house are going in and I am concerned because I would like to see the size of the houses in the area stay about the same, I am concerned. that mine is going to depreciate in value if the small ones go in, I am about two to three hundred feet from it, so it effects me, so I would like to go on record that I would like to see them renain pretty close to the same size and there wa.s sane discussion as to what size was out there and I think it is fair to say, I am making a estimate and I don't think there are many or any that are in the thousand foot area out there, none of them look that small. City Clerk: There would only be one allowed in that area: Stucker: I am glad to hear that: Mayor Kingsford: The percentage breaks down so you would only be allowed to have one of those 1000 to 1100 foot units. Stucker: So we are not going to have a string of small ones? Mayor Kingsford: No: Stucker: Well I am glad to hear that. Giesler: How many square foot is your hare? Stucker: About thirteen fifty with two car garage: Mayor Kingsford: These will still have to have two car garage under our Ordinances: Is there anyone else from the public who wishes to testify? Liz Bolts, 984 Claybourne, Bolts was sworn by the City Attorney: MERIDIAN CITY COUNCIL • • DF•~RF•'R 6, 1988 PAGE # 3 Bolts: I have one question, can you tell me if there is going to be any better water systen put in, pumps because we have a lot of problems with pressure, you can be standing in the shower in the middle of the winter and the water goes dawn to a trickle, watering your yard is very poor in the suimier, the pressure will go way up and then it will go way down and I have neighbors that are concerned about this also. Mayor Kingsford: We are aware of the problem, we thought we had remedied a lot of it, what happens is you are right by one of our wells that basically services that, so when it kicks on it sends 120 PSI pressure towards the water tower and that creates a negative pressure for an interval and then when it shuts off the water reverses direction and you have a lag again. The City Engineer might beable to speak to this better: City Engineer: That is basically what happens, we put in a quick closing check valve in that well house here two years ago when we had quite a few canplaints but I hadn't heard of any problems since that was done. Bolts: It is still bad at my house and my next door neighbors and several other people in the area have said are they still going to have to be serviced by the same well and I am also concerned by the small houses being near us. City Engineer: One of the problems with that subdivision is it is kind of isolated from the City, so with the well in the subdivision itself, the use as the Mayor mentioned is back towards town, as that area out there develops the problem will lessen as more users are .served with that well. Bolts: So in other words we just have to wait until there~SLL~re subdivisions in the area: City Engineer: No, no not at all, there is sane other things that can be done, if that valve is not taking care of the problen. Bolts: In the stimmaner time you can turn your water on and it will be fine and ten minutes later it will be out in the street and then later it will be a three foot circle so if you have a sprinkler system you are defeating your purpose. City Engineer: I wasn't aware that the valve had not solved the problem, I will certainly look into it sane more. Mayor Kingsford: If you would r1rs. Bolts, please keep us advised. on that because we do want to try and remedy that problen as much as we can. As development does take place it will improve, what we need to do is get a looped system, so it does not have that direct feedback, there are sane things that are costly but we still want to do then. Anyone else fran the public that would like to testify on this matter? Williams:I have a couple of questions based on what I have heard, there must have been a change since the covenants and restrictions because basically what you are telling me if we have a 999 square foot house that is in violationof the covenants of the subdivision because it states no dwelling shall be permitted on any lot in such subdivision with less than 1350 square feet. Mayor Kingsford: that applies to #1 unless they were amended, I do not know whether they were, you have to renembPS that the City Ordinances are different than the covenants, the covenants apply only to the subdivision and we do not enforce those, we do review then, but we do not enforce those. Is there anyone else from the public who wishes to testify? Terry Botkins, 1362 East Chateau, Botkins was sworn by the City Attorney: Botkins: I would like to go on record as being in favor of changing three of these lots that are designated for hcRne less than 1200 square feet, I would like to see those changed to 1200 square feet, I understand that these homes can be made larger despite the smaller designation, I would rather see a larger m;n;m;um size. Mayor Kingsford: Anyone else from the public who wishes to testify? Lee Brown, 2167 Jericho Way, Brown was sworn by the City Attorney: Brown: I want to go on .record as being opposed to this, I live on the corner of Jericho Way & Chateau, my house is two thousand square feet and this would effect my home value drastically if this is approved. Mayor Kingsford: Anyone else from the public who wishes to testify? John Ball, 1057 East Chateau, Bell was sworn by the City Attorney: Ball: I would like to go on record that my wife and I oppose the allowing of a 999 square foot house basically for the same reason as the rest of the people who have testified it would decrease the value of my place, ours is twenty-two hundred srn~are feet and most of them around there are between sixteen hundred and that, I have another question, on those streets out there on Chateau where they are digging the street up and putting the stubs out for the new lots, are they going to go in there and replace that street or are they going to leave it patched up? City Engineer: That is ACFID's jurisdiction as to what happens there but that street is older than five years in age so therefore they are allowed to dig in the street and they would patch it back to ACfID specifications. Ball: So all we will end up with our there is patches? City Engineer: Until such tune as they seal coat the road, put oil down and some gravel chips, those patches should be installed in such a manner that when you cross them with a vehicle you do not feel a bump and they have to warranty that patch for one year. Mayor Kingsford: Anyone else from the public who wishes to offer testimony? Scott Swanbeck, 944 Claybourne, Swanbeck was sworn by the City Attorney: S~aanbeck: I would like to go on record confirming Bolts comment about the water, it is very poor, I also called an appraiser and asked his comment on the fact of putting lower square footage houses in there and he did confirm back that it would greatly decrease the value of homes in there also I was concerned with the fact that even though there is only one slated for the 1000 square foot size, there will be more houses in future development that will go to that size and from the appraisers comm~ents when you get into smaller houses like that, they are usually starter houses they are built a lot poorer and that they devaluate the area even faster, I was also curious on houses they have already started building in there, I do not know what size 1' MERIDIAN CITY COUNCIL • • DECF~ER 6, 1988 PAGE # 5 it is, it looks like a small house, do you know the size? City Clerk: Over thirteen hundred: S~ranbeck: It is, Ok., I also want to go on record that I oppose this: Mayor Kingsford: Is there anyone else frcen the public who wishes to offer testimony on this? There was no response, the Public Hearing was closed. Council Members: Giesler: We received a copy of all the owners within the three hundred feet, in a case like this do they not have to get their signatures? Mayor Kingsford: Not on an amended plat. Morrow: I have a oouple of ccam~ents, This is really a tough issue, in terms of what you folks have in your subdivision for your houses and your square footages, I think one of the things that may be misunderstood here is this Ordinance and what we are doing here tonite in terms of this amended plat proposition in designating house sizes on particular lots is the origin of that Ordinance was to protect subdivisions such as yours from a onslaught of less than ethical builders that would come in and because of cheap lots and cheap money and cheap houses build houses that were 750 to 850 square feet and then move on out, the thing of it is in terms of the building industry and free enterprise system and those kind of things it is really tough for government to mandate peoples life styles and what they can and can not do, what we have attempted to do in Meridian that by virtue of this Ordinance at least have some protection for your subdivision, we cannot legislate nor should we try to legislate what each house in each subdivision should be, that is not quitehow the system works, but also we have an obligation to make sure that your property .values do not get decimated by some unethical enterprise that ccenes in and build a bunch of real cheap houses, so this is a difficult situation and it is difficult to know how to approach it but I think you need to understand that is basically what is going on here with the amended plat and there are lots of other things that enter into trying to cane to a decision here rather than just protecting your homes. We have made an attempt here in Meridian to protect them best we can. but by the same token we can not dictate to everybody what they are going to build. certainly there are subdivision where a two thousand square foot home or a thirteen square foot home would be considered less than standard and we cannot go into those subdivisions and say you have to all build 2500 square foot homes. Bolts: Brought the fact that there are many houses for sale and some look very bad, dead lawns and etc. Mayor Kingsford: This is something we have no control over: Morrow: I think one of the continents in addressing those kinds of issues you are working with, in many cases those places are taken back and mortgage oca~anies awn those, if you have a very active hcBneowners association in your subdivision you can bring a lot of pressure to bear on those lenders and they will clean those place up and it will help you, in terms of appearance. Giesler: We have other subdivisions where we have allowed this and most of the people do not realize they are that small they do not look out of place when they are mix~1. I think you would be surprised with:~the garage still having to be on there, you really do not notice it like I think you are i-hinking. Mayor Kingsford: I would say this on that issue to, in Meridian in any of the sub- ,~ , MERIDIAN CITY COUNCIL • • DECKER 6, 1988 PAGE # 6 divisions this is the same formula that we use, I would echo Mr. Morrow's comments certainly through covenants and a homeowner's association can bring a lot of pressure to bear there, not only just on the square footage but on the desings and those kinds of things. The Motion was made by Morrow and seconded by Giesler to approve the amended plat for Meridian Place #2. Motion Carried: All Yea: Mayor Kingsford: Despite the fact that we rul~l in the opposite of all the testimony here tonite, I appreciate the testimony, we encourage you exercise some of the things that was suggested here tonite and please keep us advised on the water situation we want to renedy it. Item #3: Pre-Termination Hearing: Water/Sewer/Trash Delinquencies: Mayor Kingsford: You have been informed in writing if you choose to, you have the right to a pre-termnation hearingl~~ore the Mayor & Council, to appear in person to be judged on facts and defend the claim made by the City that your water/sewer a~rcl trash bill is delinquent. You may retain Counsel. Is there anyone from the audience who wishes apre-termination hearing? There was no response. Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid their water shall be turned off on Decenber 14, 1988. In order to have their water turned back on there will be an additional fee of $10.00. They are here- by informed. they may appeal the decision of the City or have it reviewed by the Fourth Judicial District Court, pursuant to Idah Code. Even though they appeal their water will be shut off. The Motion was made by Tolsma and seconded by Giesler to approve the turn-off list in the amount of $6,027.55. Motion Carried.: All Yea: Item #4: Approve the Bills: The lotion was made by Tolsma and seconded by Giesler to approve payment of the bills. Motion Carried: All Yea: Item #5: Approve Renewal of Beer/Wine & Liquor Licenses: The Motion was made by Tolsma and seconded by Morrow to approve the renewal of the Beer/Wine & Liquor Licenses subject to the payment of the necessary fees: Motion Carried: All Yea: Item #6: Ordinance #501: Adoption of the 1988 Building Code: Mayor Kingsford: An Ordinance repealing Section 2-201 of the revised and ccampi3ied Ordinanes of the City of Meridian and re-acting said Ordinance to adopt the 1988 version of the Uniform Building Code and scRne of the appendixes; and providing an effective date,. is there anyone in the audience who wishes Ordinance #501 read in its entirety? Chief Porter: Yes, Bob Rice entered the low bid including a trade-in allowance of $2200.00 for a net bid amount of $11,529.00, after reviewing the bids with Council- man Giesler, it would be my recommendation that we award the bid to Bob Rice Ford. The Motion was made by Giesler and seconded by Morrow to accept the bid received frcen Bob Rice Ford in the amount of $11, 529.00 for a 1989 Ford Crown Victoria. Motion Carried: All Yea: Item: # 8: Moe Alidjani, Sanitary Service: Alidjani: It has been two years as my letter indicates since the last time we came here for negotiation on our rates for the trash service and at this time we would like to open negotiations for an increase in rates just for the cost of living. Our proposal on the residential would be about 6~ increasewhich is for a two year period. so in reality it is like 3a per year. On commexcial there is a variance that variance for each year would be about 4~% depending upon the size of the dumpsters that we handle. Some of the boxes will be up about 8o the reason for this is because after talking to several of our competitors on how they do their charges, scene of the smaller boxes we have it takes as much time to go from point A to B as a larger box does, the only thing different is the amount of yardage in the box. I think in the begining it was not set correctly for the smaller boxes. BFI does not offer anything smaller than a three yard box. For the smaller one you charge about half as much but it takes the sa~ue amount of time to handle.. If you wish to look at our tax return for the last year, this could be made avail- able as well as a financial statement. Mayor Kingsford: I have one question that Councilman Myers asked me to ask, what happened to the dumping fees fran the county, did those go up? Alidjani: Yes, I am not sure of the amount as they went up last February but I would say about 20~ per cubic yard. I will find that answer for you. Mayor Kingsford: I would suggest that probably you do prepare and distribute to the Councilman your profit and loss statement. With that in mind I would like to recc~¢nend with the Council's approval to have Mr.~Myers who is the C~issioner for that departrnent set down with Mr. Alidjani and begin to work out a agre~ient on this that is satisfactory. MERIDIAN CITY COUNCIL ~ • DECENd3ER 6, 1988 PAGE # 8 Morrow: The fellows in the Fire Dep~a.rtment did their usual good job, they got a nice complimentary letter from the City of Boise in ternis of an Ada County Fire and Prevention Program, apparently our guys were kind of heading this up and of course the City of Boise kind of got credit, I guess it is also receiving some National attention in areas other than our state so it kind of points up to how good our people are there. Mayor Kingsford: A point well taken and I certainly want to con4nend the Fire Depart- ment all of then and particular those who have been involved in this program. Tolsma: I have been trying to get ahold of Geeri Davis dawn at Hoff's for the last three working days, he has been in meetings or over at the corporate office, I have not been able to get ahold of him, I am not really sure what they have done, I left a message for him to get ahold of me today before he left but evidently he never came back to the office. Mayor Kingsford: What they told me they had done was to insulate the elbow and the pipe, the City Clerk and I have been trying to listen for that and I have not heard it, I don't know whether they have not been running or winds been the other direction or what. We will stay after them on it. Mayor Kingsford: Council Members., Mr. School Superintendent, Nick Hallett indicated he would like to meet with you around 8:15 for a few minutes, there was an error in the brochure that sent out that also appeared in the Statesman that indicated that the Meridian City Council had as a group came out in favor of the Bond Issue, I think you are all aware of that, he indicated to me that that was a mistake, it did however appear in yesterdays paper, he wanted to comment on that to you directly. NOW, THEREFORE, BE IT ORDAINED by the Mayor and the City Council of the City of Meridian, Ada County, Idaho: Section 1: That Section 2-201 of the Revised and Compiled Ordinances of the City of Meridian is hereby repealed. Section 2: That Section 2-201 of the Revised and Compiled Ordinances of the City of Meridian is hereby re-enacted which shall read as follows: 2-201: ADOPTION OF THE- UNIFORM BUILDING CODE AND THE UNIFORM BUILDING COAL BOOK OF STANDARDS: There is hereby adopted bye-the City for the. purposes of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, including permits and penalties, that certain building code known as the Uniform • • Building Code, 1988 Edition and Appendix 7, Covered Mall Buildings and Appendix 32, Re-Roofing, and Appendix 49, Patio Covers of the Unform Building Code, of which not less than three (3) copies have been and now are filed in the office of the City Clerk, and the same are hereby adopted and incorporated as fully as if set forth out at length herein, and from the date on which this Section shall take effect, the provisions thereof shall be controlling over .the construction of all buildings and other structures-therein contained within the corporate limits of the City. There is also hereby adopted the Uniform Building Code Book of Standards, three (3) copies of which have been and now are filed in the office of the City Clerk; provided, however, that the following exceptions shall apply to the Uniform Building Code Book of Standards: Regardless of the provisions of the Uniform Building code Book of Standards, the City shall not allow gravel to be used for foundations in the construction of any building within the City, and regardless of any of-the provisions of the Uniform Building Code, particularly footings, section 2907(a) General, or of the Uniform Building Code Book of Standards, the City shall not allow wood, treated or otherwise, to be used for footings or foundations. Section 3: This Ordinance shall be in full force and effect from and after its passage and approval as required by law.
