The Mayor informed the public that the next regular Council meeting would be held January 2, 1979. Past Council action was outlined. Primrose Subdivision - Vacation Reconsideration. Crookston stated that he had tried to get in touch with Attorney Tom Lynville, representing Frank Marcum. He was contacted December 18, 1978 and did not have adequate time to attend the meeting. Crookston stated that he informed Lynville he would .request the Council to table the request. Crookston stated that he had discussed City needs of road access and drainage with Ellsworth. Storey stated that he saw no reason why the Council should allow Marcum to reclaim the parcel. He inquired if the Council wanted to turn the proposal down tonight or table the request. Past Council action was outlined. Mayor Storey read a letter received from John Joines, ACRD (see evidence). Kingsford inquired if the letter was forwarded to the County Commissioners, as he felt it should be. Kingsford inquired if a letter had been sent from the City to the Commissioners. Joy stated that no letter had been sent. Storey stated that the decision is the responsibility of County Zoning and Commissioners and did not feel the City Council should not take any action. Marcum has not cooperated in the development and is opposed to recommending it. Crookston stated that they did not know they were supposed to be at the meeting. The situation was outlined. Kingsford moved to table the reconsideration and Marcum be notified, seconded by Glaisyer. Motion passed: Williams, yea; Bodine, yea; Glaisyer, yea;Kingsford, yea. Ellsworth clarified City interest in 'the Primrose Development access to the west and drainage consideration easements are needed. Thomas Annexation - LDS Church Conditional Use Permit. Clyded Weber was present representing the request. He displayed a site plan for review of the public and council. Mayor Storey inquired if the plans had been changed moving things to the west. Weber stated that it did not effect this property. Paul Bushey presented comment from the floor and stated that he lives in the residential community accross from the development. He read a proposed statement. He felt the statement was representative of the feelings of a number of people in the subdivision. Bushey outlined the area and stated 100% of the people they have contacted approved the statement. "We the undersigned are deeply concerned regarding this development for the following reasons: ~ridian City Hall 2 December 18 1978 lenda LDS Church Conditional Use Permit (Cont'd) "We the undersigned..... " (1) the increased traffic load will not only be a nuisance but will be dangerous for our school age children (2) Our life savings are heavily invested in our homes and properties and the proposed regional welfare center that is to support 46,000 persons and 525 parking spaces would depreciate them since it does not conform to the existing surrounding land use. (3) the proposed development as stated in the VALLEY NEWS, December 6, 1978, is not that which was reviewed by the Planning and Zoning Board, it is not the same in acreage or in purpose. (4) We feel that whatever land use that occupies the acreage in question should participate in proportionately equal or greater tax contribution than the residential community." The Mayor inquired how many had signed the statement. Bushey stated about 20 and explained more had volunteered. He stated representatives of the LDS Church were out in the community and they said they would like to have their names taken off the list that was sent around earlier. He volunteered to answer any questions. Weber stated that they had submitted signatures within 300 feet of the property. He had helped with securing the signatures - the ones he had talked to felt this was excellent and supported it, they are surprised there was a change in feeling from the owners. Bushey restated 100% support and bankers had told them the Church would depreciate the value of their property. Glaisyer stated that he reviewed the survey for the Comprehensive Plan done by APA and brought up the following points. (1) 93% of the citizens in the community desired to be self sufficient and not a bedroom community of Boise. (2) 55% showed they want more industry. (3) 55% desired the regional shopping center. (4) 82% of the survey population base made major purchases outside the City of Meridian, this is a crime. This shows the need for property for the business community. He stated thaC he has no objection to .the concept and supports it but felt that property was too valuable to the interest of the citizens of Meridian. On those grounds he stated that he would have to vote no. Bodine stated that he would have to repeat about the same thing as Councilman Glaisyer He would like to see the development in Meridian but on less expensive ground. Kingsford stated that he did not have objections to it. His preference would be that they be on less expensive ground, .but they own the site and he did not mind if they put it there. Williams stated that the statements were conflicting. Mr. Bushey's statement bothered him - if the people wanted their names removed they should have the opportunity to do it, we need industry but this is an asset to the community. Grain storage and milling proposed was unfavorable. There are problems with it - the City does not want to address, or can address, for example Fire protection and dust. Weber commented that this was in the original proposal when it was submitted to Council. The Mill and storage was deleted. When the signatures were obtained it speci- fied these were deleted under this proposal. They just have not changed the orginal drawing. He explained the rumors that went around. Kingsford inquired what Bushey's group would think in terms of property value if some other type of commercial or light industry would go in there, which the Council feels should go in there. Isn't it likely that would reduce the value of the property? Bushey stated that it might and they want to stay in tune with the City Council. They are concerned what will go in there and outlined some areas of concern. He talked to a member of the LDS Church and was informed two other sites were being considered for the same proposal. Webber stated this was only if this proposal was rejected. December 18 1978 Agenda LDS Church - Conditional Permit (Cont'd) 3 Norman Fuller stated they feel this is best they can hope for, it is designated as a mixed use and this is a logical use for that area. They had no objections. He didn't see how the Council could made any determination because of the tax base. Alain Porter commented on behalf of the proposal. (1) Was suprised about the implication of the change of the proposal since the petitions were circulated; there has been no change except the withdraw) of the grain and mill facilities, (2) Also suprised that any banker would suggest the establishment of one of their churches would reduce the value of property; (3) The commercial enterprises would be up against the freeway, a considerable distance from the residential area, (4) There are no other sites up for consideration at this time. They feel this would enhance the area. Webber explained the proposed layout. Bushey inquired if the article in the Valley News was correct. He outlined the article, its implications, and stated they probably would be more in favor of light industry. Tracy Wright commented he was at the last meeting and also read the article, and didn't feel the article expressed what Dr. Weaver talked about. The principal was in hard times people could go to this facility and use those things. It is not grain storage, it is feed storage for human consumption. It's not put there to compete with other businesses it is strictly for storage in time of need. That is the sole purpose. He explained the advantages on intent of the proposal. The help would be much better than any tax loss, because the L.D.S. Church has a policy that it cares for it's own, any one can get sustenance clothing,food, housing, ect. They are not to accept government welfare but are requested to go to their own Church and receive those commodities - that is the purpose of this particular facility, to take care of the poor, needy and distressed. The article in the paper had left him with a different feeling than he understood from Dr. Weaver. Williams stated that he had talked to Dr. Weaver about this in the preceeding week and asked him to draft a letter concerning his concern on parking. He read the letter from Dr. Weaver (See evidence.) Weber stated that this plan is on file with the City Council. A building permit will be issued later if this project is approved and will be conditioned upon the owner following through and building the complex as .shown, landscaping., buildings included. The permit can be withheld until the owner complies with what has been approved by the Council. There is no danger of the owner trying to change things. Storey stated that he did not feel there was anything to worry about as far as traffic was concerned. He felt the LDS people deserve an answer to get it off the table by the first of the year. Williams moved to allow the Conditional Use Permit for the LDS Church contingent upon their construction of an acceleration - deceleration lane and that sewer and water lines are constructed to City lines as a front end outlay; that there be no grain milling or storage, seconded by Grant Kingsford. Motion passed: Glaisyer, nay; Bodine, nay; Williams, yea; Kingsford, yea.. There being a tie vote, the Mayor voted, yea. Agenda 4 Maleco Trucking (County) requesting reconsideration by the City on comments sent to the County. Michael Milhollin was present representing the request. He stated that application has been made to the County two months ago fora rezone from D-2 to C-3. Three (3) days prior to a public meeting they issued a Staff report. According to the report there was negative comments from City agencies. Based on the comments, County Staff recommended denial. He stated that he was under the impression that the City was seeking light industry and they wished City input to decisions. He submitted the County Staff report for City files. He outlined the trucking firm would employ 200 employees. They operate 125 power units and 200 to 225 trailers. The Company growth is on the upswing and they are looking fora central location to base their operation. He is after direct input on the request. They are after a continuance. Storey stated that he felt it was a good industry, clean and large employer. He questioned any traffic problem with the trucks. Milhollin outlined the business of the firm and stated that one reason they would like to locate there is the proposed Eagle road access to the Freeway. He presented a preliminary drawing and explained the proposal. He presented photos of the current operation. Meridian City Hall .4. _December 18, 1978 Agenda Maleco Trucking (Cont'd) Bodine stated that he did not feel they could vote until Central District Health determined water levels. Milhollin explained problems with comments from City Planning and Zoning to the County. He outlined possibilities of septic systems. Comments from City Fire Departments were outlined. He stated the facilities could be made adequate to Fire District Standards. They would provide acceleration - deceleration lanes into the development. He read the comments from the County Staff analysis on City recommendations for denial (on file in Maleco). He inquired if this was the City's wish. Storey stated that he did not feel the Council could look at it and say just because it is not in the City of Meridian that it is not a good development for Meridian several things have to be considered. The City is only a recommending body. Milhollin requested input from the City Council desiring additional information on this or something other than a flat denial if it is possible. Glaisyer stated that he would like more information on it,something more concrete than what has been presented. Milhollin stated that they need to know what the City wants. Storey stated that the City needs the County comments and wanted to know what the Council wishes are. The Council requested more information. Williams stated that he felt development of that area might be premature. He did not feel it was a bad use for the property, but wondered if the City was jumping out again. Storey stated that this was Commercial area. The Council was in agreement. They would like to table action pending more information. Kingsford stated that fire concerns and what would be carried. Williams inquired what their time table was. Milhollin explained after January 4th they. must have a public hearing and requested a letter from the Council on their consideration in this matter. They will take it before County Planning and ask for consideration or tabling on January 4th. He stated that this is a first class operation, in 1972 they grossed $1.2 million - for 1978 they estimate $8, million. They have outgrown their facilities and need to relocate in a more central location. Williams inquired if they were moving their location. Milhollin stated that he thought their present location will become a satelite facility. Williams stated that a site plan would help him make a determination. Kingsford inquired how large the work base would be here. Milhollin stated it was his understanding that this location would employ around 200 people. Agenda 5 Beer and Wine License - Farmers Club Storey stated it was checked out and accepted by Chief Green. The Motion was made by Grant Kingsford and seconded by Marvin Bodine that the Beer and Wine License for the Farmer's Club be approved. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Meridian Ci' 5. December 18, 1978 Agenda Meridian Race Track 6 Storey stated that the situation at the Race Track at the last meeting with them they anticipated doing some work to bring it as near as they can to the building code. He felt in past years they have done a good job. The racers have quite a little invested and he questioned whether they would be asked if the heights of the stands be torn down because if they do it here they will have to do it all over Idaho. He questioned whether this would happen. It's up to the Council if they want to let the Meridian Racing Association race for another year. He stated that he would like to limit it to one more year. He felt they had plenty of insurance for any accident that could happen out there. Bodine stated the stands were not safe and inquired what they were going to do to strengthen them. Del Gould stated that they keep working on them constantly .and outlined what they do to keep them up. He stated that they carry a $1,000,000 accident policy. Williams stated the racing group has contributed a lot to the community over the last 25 years. His concern was the significance of granting a variance and the long term plan. They should support the Race Track for an orderly wind down. Storey stated that one of the problems is $250,000 wrapped up in cars; recommended that this only go on one more year or year to year and they can phase out. He recommended to the Council that they be allowed to race another year. Kingsford moved to go into .Executive Session and confer with the City Attorney, seconded by Glaisyer. The Motion passed: Williams, yea; Bodine, yea; Glaisyer, yea; Kingsford, yea. Executive Session: City liabilities was discussed. City enforcement of Life and Safety Codes was discussed. The Motion was made by Richard Williams and seconded by Joseph Glaisyer to table the Meridian Race Track question until a study can be done by legal councel. His input to be no later than the January 2, 1979 meeting and possibly sooner. Agenda 7 Enclaves were considered. The Mayor inquired if anyone present wanted a legal description read. No one requested a legal description be read. The Mayor called for comment from the public. Mrs. McFadden stated that she did not feel they should be taken in. They have 10 acres there and have had it for 26 years. It has been farmed and there are no plans to develop it and it should not be taken in until they are ready to develop, which should not be in the to distant future. They have their own sewer and well and do not use any City services. Their neighbor farms the land and they have another 20 acres that they farm. They were not notified of the annexation. Paul Pack stated that they heard about it through the grape vine. He contacted his father, Mr. Pack, the owner, in Hawaii. They have considered several possible ways to develop it, no decision has been reached. They have owned it 22 years. They have about 15 acres and is under contract to be farmed. Mr. Pack has indicated a willing- ness to cooperate but would like to know the plans, zoning, ect. Storey stated that he had talked to the owner an6~as in opposition to being annexed. Williams inquired if adequate notice had been published as required by statute. Crookston stated that it was published in the Va17ey News according to statute of the Land Use. Mrs. McFadden stated that their name was published .but Packs was not mentioned. Crookston stated that the description that is the enclave is the entire parcel - Pack's and McFadden's. Meridian City Hall .6. December 18 1978 Agenda Enclaves (Cont'd) 7 Glaisyer explained to those concerned why they are being annexed for police and fire consideration, Kingsford also outlined the fire considerations. Pack felt they could sign a release for protection. It is not like there are buildings all over it, there is not much protection on bare ground. Kingsford stated a wheat fire would take a lot of fire fighting to protect properties down wind. Williams stated to provide more orderly growth and fairness to all, keep cost down, provide services and continuity in planning, it calls for annexation of enclaves within the City limits.. There are 8 or 9 parcels that should be within the City limits. They are not telling them they cannot farm the area. Pack inquired if there was a farming zone within the City. Willimas repeated it does not state they cannot farm it. Crookston stated that they still have the right to use the property as they have always used it, it will have Grandfather Rights. Pack inquired if it would be taxed as farm land. Storey stated that he was concerned. that the Packs were not notified. Mrs. McFadden inquired if they had to be notified. Storey stated no. The City should notify them and talk it over if they wanted to wait until next Council meeting it was O. K., the taxes made little difference to the City. Fack inquired if it was difficult to rezone after it was zoned. His father had entertained several ideas as far as use. It was discussed. Storey stated that they will be zoned "A" Residential. Cherry Lane was discussed. Kingsford stated that the Comprehensive plan would have to be addressed. Williams stated that the Comprehensive Plan did not have a specific zoning for that area, but says there will not be strip commercial.. Storey inquired if they wanted to go ahead tonight or wait until the next Council meeting. Pack and McFadden stated that they would rather wait. Storey stated it wilt increase the value of the property. Use of the land as farm ground was discussed. Storey stated tabling the request considerations. Kingsford inquired if it would require republication. Crookston addressed republication considerations. It looks like it would have to be republished. Notification of concerned people was discussed. Crookston outlined the problems with notification. Williams outlined those represented at the Planning And Zoning public hearing. Storey inquired from Crookston what he would do. Crookston stated it was within reason,if the Council wanted to wait and go through the process again,to wait on some and go ahead with the others. Storey stated that the others apparently want in anyway. Kingsford stated - or they did not hear about it. Crookston stated that they can attempt to send a notice to everyone, but it is not required by the statute and that is why they did not do it. Sending notices was discussed. Storey stated that he would entertain a motion to table the whole enclave annexation until they are notified. ~/ I • Meridian City Hall .7. Agenda Enclaves (Cont'd) 7 Bodine moved to table the enclave annexation requests. December l8. 1978 Williams inquired if it would need republication and the expense involved. Cox inquired if they continued the hearing to some other date~it would need republished. Crookston stated that if the concern was notification then the City should mail to as many people as they can and republish. Storey inquired if there was a wdy to continue the hearing. Crookston stated that he did not feel it was appropriate where they were not the requesting party. 6odine'.s Motion died for lack of a second. Williams felt that the City has gone through a lot of effort and consideration for a lot of reasons and did not feel a delay by tabling would change the outcome. The Motion was made by Richard Williams and seconded by Joseph Glaisyer that Parcels A through I be annexed to the City of Meridian pursuant to Ordinance 334 and 335. The Motion was made by Richard Williams and seconded by Joseph Glaisyer that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 334 and Ordinance Number 335 as read be passed and approved. Motion passed: Williams, yea; Bodine, yea; Glaisyer, yea; Kingsford, yea. Glaisyer apologized for not notifying those concerned. Agenda 8 Proposed Sewer Ordinance Ellsworth stated that he would like to consolidate all the comments he received from Crookston and Joy. Comments need to be incorporated. Storey had no comments. Ellsworth clarified the last paragraph Page 19. Essentially it says anyone that has sewer available can be charged a monthly user fee. This could cover a vacant home. The issue is the City is reserving capacity for every Subdivision and all platted land. If they do not develop we still have to reserve space at the plant. Williams stated to clarify this issue specify that all platted property to which public sewer is available. By platting they are reserving space for the Plat. Ellsworth stated that it should clarify Platted or developed. The issue was discussed. __..11 Meridian City Hall .8. December 18, 1978 Agenda Sewer Ordinance (Cont'd) 8 Joy inquired if on the BQthaven Subdivision if they would be charged for 180 lots. Would this discourage Platting. Williams stated that if they did not Plat and reserve space it would be a rational reason to deny a Plat if the plant reached capacity. Crookston stated that where they are hooked up or plated and have the facilities there they should be paying for it. That is a logical cut off. Joy questioned the analysis and stated that the capacity in the plant can be used up in theory. Ellsworth stated that only when it is platted or the City approves developments. It was discussed and outlined what the Ordinance called for. Crookston stated that looking at this in reverse you are saying they do not have to pay until they get a service connection. Joy inquired if dry lines are required as a front end outlay on a project and stub-ins come off that dry line, then each stub-in will be charged for a service connection. The legal language was discussed and Ellsworth re-read the paragraph in question. He felt the wording stated"subject to"which did not mean they must be charged. Discussion followed. Ellsworth pointed out the Ordinance states all property owners will come to the sewer. He stated, say 10 or 15 years the treatment plant is getting toward capacity and the City has 300 to 400 vacant lots that are plated. The City is reserving capacity for those Subdivisions when you could be providing it to someone else that wants to develop. The Mayor inquired if the McFadden's will have to go on City Sewer. Ellsworth stated, yea. He stated under the old Ordinance it also stated that property in the City will be sewered. Crookston and Joy presented comments to be incorporated into the sewer ordinance. The comments were outlined and discussed. Ellsworth was instructed to draw up a ordinance with changes. It will be submitted to EPA for approval. Kingsford moved that the Ordinance be drawn up with changes, seconded by Glaisyer. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Agenda DEPARTMENTAL REPORTS 9 Building Inspector Schoen reported he is working with the Fire Marshal. on an Ordinance to cover wood stoves. Agenda 10 Superintendent Ward reported they have received their new truck. Agenda Attorney Crookston reported to the Council that Final Plat's must go before Planning 11 and Zoning. He also reported that there appears to be appropriate authorization to require completion bonds for Plat and Subdivision Ordinances in the local Planning Act. Agenda Senior Citizen Sherman Louderbaugh stated that he had a complaint with businesses on 12 First Street. An elderly citizen was splashed with slush because she had to walk in the road at Ada and Bower Street because of boats on the side walk. There should be an alley way cleared through there so people do not have to walk in the street. Storey stated that the merchandise should not cover the sidewalk. Glaisyer stated that he would get in touch of John JoineS and Chief Green and go out and talk to those in violation. Storey stated that people should be able to get through. Meridian City Hall .9. December 18, 1978 Agenda CONSULTANT REPORTS 13 City Engineer Ellsworth reported that he will be leaving the City in about one month fora new position. In the interim, Dave Curtis and Sumner Johnson will be taking care of the City Engineering. He stated that he had enjoyed working for the City. Ellsworth reported on a Change Order for the Boise River Outfall, Schedule A, Galey Construction. It is a time extension of forty-five (45) days to December 17, 1978 They are essentially completed except for air testing the line. Ellsworth recommended approval of the time extension. Storey instructed Ellsworth to proceed with the bid. He also stated that Dave Curtis is familiar with the City projects and is capable of handling City business. Ellsworth stated Dave Curtis knows what the problems are. Bodine stated that he has checked on a 4,000 gallong Gas tank for the City. It will cost around $2,400 with the proper system installed. The City can keep track of all of its vehicles. Old tanks were discussed. The price includes digging the hole and covering it.
