IDAHO, FOR THE FISCAL YEAR BEGINNING THE 1ST DAY OF JANUARY,
1976, AND ENDING THE 31ST DAY OF DECEMBER, 1976, AND GIVING
NOTICE OF PUBLIC HEARING PRIOR TO THE PASSAGE OF THE ANNUAL

Dear Mayor Storey:
Our department has reviewed the NPDES monitoring reports submitted by
the City of Meridian for October, November, and December. It appears that
Meridian has violated its permit for both quanity and concentration of DOD
and suspended solids discharged in each of the three months.
When a violation of Meridian's NPDES permit occurs, Part II.A.2 of the
permit requires that within five (5) days the City submit to the EPA regional
administrator and the State the following information:
a. A description of the discharge and cause of noncompliance.
b. The period of noncompliance, including exact dates and times; or,
if not corrected, the anticipated time the noncompliance is expected
to continue and steps being taken to reduce, eliminate., and prevent
reoccurrence of the noncomplying discharge.
This description of noncompliance must be submitted immediately. If you
have any questions concerning this matter, please contact me.

67.654AREAS OF CITY IMPACT — NEGOTIATION PROCEDWr. (a) The
governing board of each county and each city therein shall, prior to Januar, 1977, adopt
by ordinance following the notice and hearing procedures provided in section 67-6509,
Idaho Code, a map identifying an area of city impacrwithin the unincorporated arca of the
county. By mutual agreement, this date may be extended to January 1, 1975. The
ordinance identifying an area of city impact shall also provide for one of the following:
(1) Application of the city plan and ordinances adopted under this chapter to the area of
city impact; or
(2) Application of the county plan and ordinances adopted under this chapter to the area
of city impact; or
(3) Application of any mutually agreed upon plan and ordinances adopted under this
chapter to the area of city impact.
Areas of city impact, together with plan and ordinance requirements, may cross
county boundaries by agreement of the city and county concerned if the city is within three
(3) miles of the adjoining county.
(b) If the requirements of section 67-6526(a), Idaho Code, are not met, the county
commissioners for the county concerned, together with three (3) elected city ofricials
designated by the mayor of the city and confirmed by the council, shall, within thirty(30)
days, select three (3) city or county residents. These nine (9) persons shall, by majority
vote, recommend to the city and county governing boards an area of city impact together
with plan and ordinance requirements. The recommendations shall be acted upon by the
governing boards .within sixty (60) days of receipt. If the city or county f;,ils to enact
ordinances providing for an arca of city impact, plan, and ordinance requirements, the city
or county may seek a declaratory judgment from the district court identifying the area of
city impact, and plan and ordinances requirements. In defining an arca of city impact, the
-following factors shall be considered: (1) trade area; (2) geographic factors; and (3) areas
that can reasonably be expected to be annexed to the city in the future.
(e)' If areas of city impact overlap, the cities involved shall negotiate boundary
adjustments to be recommended to the respective city c6uncils_ If the cities cannot reach
agreement, the board of county commission.rs shall, upon a request from either city, within
thirty (30) days, recommend adjustments to the areas of city impact which shall be adopted
by ordinance by the cities following the notice and hearing procedures provided in section
67-6509, Idaho Code. If any city objects to the recommendation of the board of county
commissioners, the city shall, within sixty (60) days from receipt of the recommendation,
seek a declaratory judgment from the district court adjusting the areas of city impact.
(d) Areas of city impact, plan, and ordinance requirements shall remain fixed until
both governing boards agree to renegotiate. In the event the city and county cannot agree,
the judicial review process of subsection (b) shall apply. Renegotiations shall begin within
thirty (30) days after written request by the city or county and shall follow the procedures
for original negotiation provided in this section.
(e) Prior to negotiation or renegotiation of areas of city impact, plan, and ordinance
requirements. the goveming boards shall submit the questions to the planning, zoning, or
planning and zoning commission for recommendation. Each -commission shall have a
reasonable time fined by the governing baud to make its recommendations to the governing
board.

Pine Street, Meridian, Idaho
This project proposes widening Pine Stroe_t in Moridinn, Idaho Form
Meridian Road to U ndor Road, a distance of one mile. The widening would
provide for two traffic lanes with suliic-lent width for parallel_ parking=
on both sides of the stroot. A sidewalk would be provided for the full
length of the project on one side.. ConrreLe curb And qutter would he
provided on both sides for the full length of the pro.'ject.
Locally, Pine Street carries a high volume of Lralfic. The Meridian
High School is located near the intersec Lion of Pine Street and Linder Road.
The intersection of Nine Street .and Meridian Road is in the downtown busi-
ness area of Meridian. 'Ihe purpose of this project is to improve safety and
convenience of vehicles; and pedestrians moving along this street.
A five foot strip of add k iun& right-of-wav along the north side of
the westerly half mile of the project, and a Qve foot strip of additional_
right-of-way of approximately one quarter mile in length on the south side
of the project, will he required.
We recoumend application for clearance of this project as a non -major
action.

PUBLIC NOTICE
Notice is hereby given that a public meeting will be held
Tuesday, March 15, 1976, at the hour of 7:30 p.m., of said day at
City Hall in Meridian, Idaho, for the purpose of receiving public
comment and discussion of the Proposed Facilities Plan for the City
of Meridian, Ada County, Idaho. Said Facilities Plan discusses the
alternatives available for collection and treatment of sewage from the
City of Meridian and vicinity. Included is a draft Environmental
Assessment of the potential impact of the various alternatives presented.
The draft Facilities Plan including the Environmental Assessment, maps
and other pertinent data will be available for public inspection at
City Hall in Meridian, Idaho.
Interested persons and the public in general are invited
to attend and be heard at such meeting.
