Boesiger; Larry Sale; Steve Grafton; Bruce Carnahan; Tom Nicholson; Dennis Lee Mv- vim Lo~~k pg~~ Minutes of previous meeting were read sad considered. 1 Mr. Williams stated that is relation to the Franklin Square Subdivision acted upon at the last Council meeting he felt it vas against established City policy to pqy for the sewer connection at a future date when the City trunk line is extended. Mayor Storey concurred. The Motion was made by Richard Williams and seconded by Joseph Glaiayer that the City Council reconsider the Franklin Square Subdivisiom. Motion passed: Williams, yea; Hodine, yea; Kingsford, yea; Glaiayer, yea. There was further discussion concerning newer eonnectiosa: Mayor Storey stated that the Cityr would not xaat to change Ordittaxce or policy and that Franklin Square must come to the City Sewer lines. Carl Ellsworth, J-II-B Fa:ginner, stated that there is as ordinance drafted that addresses charges for those snbdivisioas with unique problems. There was general discussion as to what was resolved with the Franklin Square Sever connection. Mr. Glaisyer stated that he vas worried about the precedent being net for the City to coaaect to the sewer lines. Wayne Crookston, Attorney, stated that Jim Stubblefield should be notified of any changes from what was previously passed by the Council. Richard Williams made the Motion and Marvin Bodine seconded that diaensaioa be tabled until notice could be given to Mr. Stubblefield, Franklin Square. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Wayne Crookston stated that it was proper to reconsider a matter that was is conflict with City policy. After additional discussion, Marvin Bodies withdrew seconding the motion to table the discussiox and Richard Williams withdrew the Motioa. The Motioa was made by Great Kingsford and seconded by Marvin Bodine that the Council drop reconsideration of Franklin Square. Motion passed: Williams, yea; Bodice, yea; Kingsford, yea; Glaiayer, yea. The Motioa was made by Richard Williams and seconded by Marvin Bodine to reconsider Franklin Square Subdivisiox as it pertains to the sewer connection expense for running the sewer line to the main City Sewer trunk lines sad that Mr. Stubblefield be notified that this will be oa the agenda for the May let Couaeil meeting. Agenda 2 Mayor Storey opened the Public $earixg on the City of Meridian Impact Area at 8:00 P.M. The Public Hearing Notice was read. There were no citizen agendas to testify. The Motion wen made by Richard Williams end seconded by Great Kingsford that the Public Hearing be closed. Motion passed: Williams, yea; Bodice, yea; Kingsford, yea; Glaisyer, yea. L~ Meridian City Hall .2. April 17, 1978 Richard Williams discussed the overlap with the City of Boise east of Cloverdale. This area should be singled out as it relates to drainage and waste disposal only. The Mayor had talked to the Mayor of Boise and there wasn't any problems as far as either were coaceraed as to the liaea drawn by the Meridian Planning end Zoning Committee. The Motion was made by Joseph 6laieyer and seconded by Marvin Bodine that the City approve the Impact Area as constructed by Plaaniag and Zoning and that the City Attorney draw up an Ordinance to that effect. Motion passed: Williams, yea; Bodine, yen; Kingsford, yea; Glaiayer, yea. Agenda 3 The Motion was made by Richard Williams and seconded by Marvin Bodine that a Conditional IIee Permit for 39 E. Idaho for a lawyers office, located in the Original Towaaite, be granted. Motion passed: Williams, yea; Bodine, yea; Kiagaford, yea; Glaiayer, abstained. Agenda 4 The next item of busiaeas was the Crestwood Industrial Park agreement to cosaect to City Sewer. The Motion was made by Richard Williams that the Crestwood agreement be tabled for engineering review until the next Couaeil meeting. Motion died for lack of a second. Agenda 5 Deania Lee was present representing Mountain View Equipeat. This coaerae the trailer parked at Mountain Vier Egnipmeat and was ordered by the Mayor to be takes from the table. Ms~yor Storey stated that the trailer had passed afire iaapectioa by Fire Chief, Roger Welker, and that Mountain View Equipment was asking for tro (2) more permits. Mr. William stated that he would like to see the smaller trailer moved sad assurance that they would all be moved by the first of the year. Dennis Lee, Manager, spoke about the problems of Mountain View is moving during the summer months and that they would probably be moved by the first of the year. ~. This movement depended oa finaaciag and they are working with three private cosceras. The Mayor suggested to the Council that a Conditional Use Permit be granted to Mountain View Equipment until January, 19?9. Mr. Bodine questioned Dennis Lee as to possible future requests to use trailers. The Motion was made by Marvin Bodice and seconded by Grant Kingsford to allow v that temporary approval be granted and that the approval be reviewed is January, 197q. Motion passed: Williams, yea; Hodine, yea; Kingsford, yea; Glairyer, yea. Mr. Lae, Manager of Mountain View Equipeat, offered aasiataace of a backhoe in the park tree planti.ag. Agenda 6 Sunaybrook Farms was next diseussed: Larry Sale, J-II-B Engineer, was present represeatiag the First Phase of Snaaybrook Farm. Mr. Sale gave general diacriptions and a critique on the development. Sunnyybrook Farms Phase I requests three (3) variances;(per letter oa File with these minutes) over length of Hlock Two (2); standard variances on street and sidewalk and requested that acceptance be conditional on review of a interim septic agreement with the City oa inspection sad mainteneace pursuant to City policy. Great Kiagaford stated that the City had been denying the four (4) foot sidewalks. Richard Williams stated that he was displesaed that this was submitted iA such as untimely fashion after the agenda was approved. Mayor Storey stated that because of a lack of guidelines oa submission time that is fairness to the contractors that the Subdivision be allowed to go through. Max Boesigpr spoke on preliminary sad final stages. He also discussed sewer hook- ups and concurred with the Council that it is the contractors responsibility. Meridian City Ball .3. April 17, 1978 __._ The Motion was made by Richard Williams and seconded by Marvin Bodine that approval of Sumaybrook Farina Phase I Final Plat be granted with the variances of: Block 2 length of 1,103 feat; all local sad minor streets fifty (50) foot right-of-ways with five (5) foot easements oa each aide; that all units be single family residence and that the developer connect to the City sewer lines at the developers expense when the new Treatment Plant goes oa line, subject to Engineering approval and approval of the City Departments. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Joseph Olaisyer requested a map of Settlers Village Subdivision. Agenda 7 The Metyor read Ordinance No. 323 entitled: AN ORDINANCE PROHIB OF ANY OUTDOOR FIRE IN TBE CITY OF MERIDIAN, ADA COUNTY, IDABO. TBE OPEN BURNING The Motion was made by E3iraat &iitgsford sad seconded by Joseph (ilaisyer that the tales sad provisions of 50-9002 sad all rules requiring that Ordisaaces be rend on three different days be dispensed with sad that Ordinance No. 323 be passed sad approved. Motion passed: Williams, yea; Bodice, yea; Kingsford, yea; Glaiayer, yea. Agenda 8 The Mayor inquired about the status of a pornograpl~ ordinance. The City Attorney stated that this was being worked oa. Richard Willfuws questioned whether the Oardea City Ordinance had been tested. Agenda 9 The next item of bueiseas concerned United Cable Television. A presentation was gives by a representative from United Cable Television Corporation. Mr. Yaa Louck stated that the long legal battles were over. New technological developments will alloy more services to Meridian to include Satelite Transmiaaions, Boma Box Office sad others. Studies chow Meridian is a good market for Cable TV. In the sear future they will make a formal presentation. Agenda 10 Wallace Lovaa, representing the Cherry Village tiolf Course Committee, reported that the tiolf Committee met to consider hiring a greens keeper. They had three interviews sad concluded a first, second and third choice and are requesting Council approval to hire as individual to come oa 30 dap+a before the Course opened, or 60 days if Mr. Baldoclc rill furnish one-half of the wages. Mayor Storey thought it was premature to hire a grease-keeper until things are more settled. 'Phere wen additioaal discussion. Mr. Lovam stated that the average wage rate for greens-keepers is this area is $12,000 per year. A used moxer had been viewed by Mr. Lovaa sad Mr. Bodine at Eagle. Mayor Storey stated, Mr. Lovaa concurred, that the agreement xas for the City to take over after nix moxiags. Another matter had also come up, Mr. Lovan stated, talking as as individual, that there xas a group of people interested is forming a corporation for the p{lrpose of leasing the Oolf Course. They propose building a Club Bouse, Dining Hall, Saask Ban, Locker rooms, Sanwa baths, Hand Ball Courts sad also propose trying to complete the remaining nine holes before the Leavitt Nu-Pacific Phnee II in is operation. The group is in seed of along term lease from the City. Thir:wauld be left open to the public and a 54 year lease obtained. They would have their own equipment and also ester into a net fee for the City plus a par cent of the profit. Richard Williams felt that the idea had merit but had some concern on green fees to keep them in lies with the rest oY the area. Mayor Storey stated that he felt that this may be a problN with committtsg the City to a long term contract. Meridian City Ball .4. April 17, 1978 Agenda 10 Wayne Crookston, City Attorasy, spoke on the issue and addressed some eoacera on (cont'd) ficancing and the City landing its credit, plus the long term leasing implications. Be stated that a lease cannot -e signed in order to get credit. Another aspect is the problem of a City's power to be a lessor, also, whether it would have to be bid. There could be numerons unanswered questions. The City's obligations with Leavitt Nu-Pacific were discussed. Agenda The Mayor discussed the possibilities of putting three 3,000 gallon gas tanks at 12 the new sewer facility. Mr. Bodine suggested gsttiag larger teaks to acaommodats a transport load. Marvin Bodine, Richard Shults, Bruce Stuart sad Gary Green are to develop a presentation for the next Council meeting. Agenda 13 Carl Ellsworth, J-II-B Eagiaeers, Iao., reported that the proposal oa grass seeding xaa completed but queatioaed the Council oa opeaicg the bids before there xas water available. The Motion was made by Richard Williams and seconded by Marvin Bodice that the City open the bids for the seeding project at the park. Motion passed: Williams, yea; Bodine, yea; Glaisyer, yea; Kingsford, yea. Mr. Ellsworth than presented as estimated completfoa for the sewer sad xater project. (Report filed with these micutss) The analysis was highlighted. It appears that the funding situation is ¢olveat. Mr. Ellsworth requested that the Council authorize J-U-B to proceed with awarding Contract to Galsy Coastructioa subject to IDA approval. The Motion was made by Marvin Hodiae and asaoadsd by Richard Williams that J-II-B Engiaeera, Inc. be authorized to axard the Phase III Contract to Galey Coastrnctioc. Mr. Ellsworth discussed the development of special user charges for ucigae sever problems sad queatioaed if J-U-B should develop a rate schedale. Mr. Williams stated that co action should be takes except whsc necessary on a case by case basis. Ageadn 14 Bruce Stuart, Work's Sup't., reported that the fence project vas completed at the aerpark site. Alao, parts of Wells 9 and 10 were sent to Utah to be inspected. There was a leak at Weet Piae and Linder Road. Mr. Ellsworth stated that he had contacted the Company concerned A lawmower for Public Work's was discussed. Mr. Stuart stressed the seed for a sew machine in 13ght of the new park. i Building Inspector Verson Sehoec had ao report. Joseph Glsisyer reported that he brought ont an insurance appraiser and the estimate is approximately 8200.00 to get everything appraised, but he cannot do the appraisal for two xeeks. Patrick Joy reported that he was informed Shat the iasuraac• would remain is effect past the May 15th deadline but that the City would be billed. Mr. Glaisyer suggested that the City extend current coverage for at least oas (1) additional month. The Council gave their approval to Mr. Glafeyer to proceed is acgniriag the necessary appraisal. Mr. Yilliams brought up possible Federal Greats. One Grant is a 304 Icdnatrial Site Selectio= Study. Block Graata were also discussed. BE ZT ORDAINRD BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAk~O: Section 1. SHORT TITLE - The short title of this ordinance shall be known as the City of Meridian Burning Ordinance. Section 2. PURPOSE - The purpose and intent of this ordinance is to eliminate all forms of open burning except those for which alternative means of producing a similar public benefit do not exist. Open burning is sought to be eliminated so that air quality and fire safety goals can be achieved. Section 3. DEFINITIONS - 3.1 Agricultural Burning: "The open burning of plant life grown on the premises in the course of any agricultural, forestry or land clearing operation when it can be shown that such burn- ing is necessary and that no fire hazard will occur. Convenience of disposal is not of itself a valid necessity for burning." Rules and Re ulations of the Control of Air Pollution in Idaho by the Department o Health an We fare, page 28, enacted on October 25, 1972, pursuant to the authority granted by Chapter 1, Title 39, Idaho Code, and Chapter 52, Title 67, Idaho Code. Agricultural burning will not be allowed in residential subdivisions where the subdivision lots are smaller than 1.5 acres. 3.2 Approved Incinerators: Any source consisting of a furnace and a appurtenances thereto designated for distruction of refuse by burning. "Open incinerators" shall mean those burning containers which have been approved and certified by the Idaho Department of Health and Welfare. "Burn barrels" and similar devices are forms of open burning and are not considered to be approved incinerators. 3.3 Board: Means the City Council of the City of Meridian. 3.4 Chief: Means the duly appointed Fire Chief for the City of Merman. "Chief" for the purposes of this ordinance may also mean any representative designated by the chief to fulfill any function under this ordinance. 3.5 Fire District: Means any duly constituted and operating fire distr ct w th n t e boundaries of the City of Meridian. 3.6 O en Burnin Means the burning of any matter in such a manner that the pro ucts of combustion resulting from the burning are emitted directly into the embient air without pass- ing through a stack, duct or chimney. 9Ce CAST FIRST M CRIDIAN. IDANO easAa TELEPNO NE BBS~d401 3.7 Odor: Means the sensation resulting from stimulation of the human sense of smell. 3.8 Person: Means any person, corporation, firm, partner- ship or any~ec~eral, state or local governmental entity. 3.9 Permit: Means the City of Meridian Burning Permit issued pursuant to this ordinance. 3.10 Smoke: Means small gas-borne particles resulting from incomplete-combustion, consisting predominately, but not exclusively, of carbon and other combustible material. Section 4. PROEiIBITION AGAINST OPF.^] BURNING - ^]o persons shall build, ignite, or maintain any outdoor fire of any kind or character, or for any purposes whatsoever, subject to Section 5 below. Section 5. EXCEPTIONS TO OPEN BURNI:]G PROHIBITIO:J - Not withstanding the provisions of Section 4 above, the following types of fires shall be allowed. 5.1 The foll only: yes of fires ma (a) Agricultural burning. (b) Irrigation ditches and fence rows. (c) Fires used for control or alleviation of fire hazard or for weed control when no alternative control method exists. (d) Fires used in the training of organized fire- fighting personnel. (e) Special fires allowed at the discretion of the Fire Chief wherein the fire is to be located. Special fires are fires not falling into Section 5.1(a) through (d) above. 5.2 Fires allowed without a ermit: Fires used for the preparation of food and campfires, un er control of a responsible person, shall not require a permit hereunder. Section 6. PERMITS - 6.1 Contents - all permits must contain the following: (a) Name, address, business and home phone of permittee. (b) Location of proposed burning. (c) Fire district where proposed burning is to occur. (d) Conditions under which burning is to be allowed. The Fire Chief shall develop such conditions as reasonably necessary to provide for safe burning. (e) Signature of issuing officer. AMBROSE. IDAHO 836A1 TELEGNONE 8R8-4481 (f) Signature of permittee. _~ ~ + 6.2 Agricultural burning permits may be issued for the followingg periods of time: February 15 to May 31 or July 15 to Octo er 1~ A permit issued for one time period is not valid for the other time period; however, a permit may be issued covering both periods. Permits for either or both burni::g periods can be issued by the local fire chief or his desiL~nated representative. 6.3 Ditch and fence row burn ermits: May be issued allowing burn ng between Fe ruary 15 and October 15. Section 7. PERMIT PROCEDURES WITHIN FIRE DISTRICTS - Permits for fires allowed to be burned only by permit are to be obtained from the fire district wherein the fire is to be located. Pro- cedures for issuance of this permit shall be established by the City Council. Section 8. APPEALS - Any person denied a burning permit by the fire chief may appeal ct:at decision in writing to the Meridian City Council. Such appeal must be made within thirty (30) days. The City Council shall rule on said appeal within fifteen (15) days of receipt. Section 9. PROHIBITION AGAINST CONTAMINANTS - Notwithstand- ing the provisions of any section of this ordinance, no person shall allow, suffer, cause or permit the burning of materials which emit toxic contaminants or large volumes of smoke, particu- lates or odors (such materials are garbage, rubber, plastics, heavy petroleum products, dead animals, etc.). Section 10. ENFORCEMENT AND PENALTIES - 10.1 Enforcement: The fire chief, or his duly authorized representative a~nc3 any law enforcement officer in Ada County shall have the authority to enforce the provisions of this ordinance. 10.2 Penalties: Each violation of any regulation hereunder shall be a mis emeanor, and for each day said violation shall continue, shall constitute a separate offense hereunder. Such violation shall be punishable as provided in Section 18-113 Idaho. Code. Section 11. AMENDMENTS - The City Council may upon its own motion or upon recommendations of the fire chief, make amendments to this ordinance. Section 12. VALIDITY AND EFFECTIVE DATE - 12.1 Should any section, subsection, paragraph, sentence or clause hereof, or any particular application thereof, be declared unconstitutional or invalid for any reason by a court of competent jurisdiction, such decision shall not affect the validity for remaining provisions of this ordinance. 12.2 This ordinance shall take effect and be in force and effect from and after its passage, approval and publication as required by law.
