Engineer Meridian City Hall May i, 1978 The Heridian City Couaoil meeting xas called to order at 7:45 P.M. by the Mayor, Doa M. Storey. Councilmen present: Williams, Richard; Marvin Bodisne;Grant Kingsford;Joseph Glaisyer Agenda 1 The Minutes of previous meeting xere approved as read. ~~~ The first item M business under old business xas Franklin Square Subdivision. 2 Jim Stubblefield xas present representing Franklin Square. Richard Williams stated that there was a reconsideration on the hook-up charge when Franklin Square comes upon City sewer. Stubblefield stated that there are three alternatives and he didn't nee a problem, going down Franklin, going doxa Ten Mile or connecting to gravity flow. The planned interim system xill carry the development until rush time as Otte of the alternatives are available. If the lift station is in effect !or more than one year the City can defray any cost on connections by recovering equi~ent out of the lift station. Mr. Williams'concexn waa who is going to pay for the ultimate hook-np and put the line in. Jim Stubblefield stated that at some point is time, other developments will bring a line to Franklin Square so there is not a problem. Mr. Stubblefield stated "if xe can work out something with the people ad~aceat to us we would be more than happy to contribute the cost of the force main to their installation of the line or something like that, which rronld be mutually. agreeable, but at this point in time I cannot say that that will happen but if it can that will eliminate the problem totally - if it doesn't xe still have connected to the City sewer by virture of a Forced main to the Phase II connection xhere it intersects Franklin Road." Mayor Storey stated that what concerned the Council is that xe have a resolution that all developers must come to City line. Jim Stubblefield stated that'h+e did address that, we would go to the line with the force main like Franklin Square:' wWe rould prefer not to do that, but if it comes on tap and is reatLy to go, we will do it." "If you would want to give back the equipment I would be happy to make the croasing.w Mr. Williams stated that the City is not is business to make mosey, we ~uat vent to get the connection. Mayor Storey then read the portion of the previous minutes pertaining to Franklin Square. Mr. Stubblefield stated that they had asked that the City increase the fees for the temporary eyatem development if the third alternative was used but the other two alternatives do not require anything by the City. Mayor Storey and Councilman Williams agreed that the first two alternatives would be better. The Council reaffirmed the acceptance of the Franklin Square interim sewer measure. Patrick Joy asked for a point of clarification, "then Mr. Stubblefield is going to connect to the City sewer at his oxn expense?° Mr. Stubblefield stated that this was already the case. ;each The next item of business wen the Conditional IIse Permit at 14 E. Carlton 3 The Mayor read the Conditional IIse Comment sheet (evidence filed with these minutes) The M~ror pointed out the increasing comber of Conditional IIse Permits in residential areas and that they are a means of circumventing an ordinance or policy. It was zoned residential and if the City infiltrates these areas wA are not going along with Planning and Zoning. It is the Councils decision but they are going to have to atop the Conditional IIse Permits somewhere. The Matter xas discussed. a. iI City Hall .2. May 1, 1978 Mr. Fd Joaee of 538 W. Washington was present representing himself. He stated the primary nee of thin Conditional IIae Permit is his own private office. The importance of this is not later profit - he has an office is Boise and all of his staff is from Meridian. Mr. Jones stated that this was his dream to have an office conveniently located to him and that it waa important to him personally. The Mayor restated points of concern on Conditional IIae Permits. Mr. Jones stated that he has submitted plena, he has provided for parking, torn down a potetttial fire trap and is improving the area. The person most affected stated to Mr. Jones that he was pleased with the proposed use eottsideriag other possibilities. The building will be brought up to code. Richard Williams inquired about the basement use and design. There is a kitchen and two rest rooms. As a gesture, the Senior Citizens are looking for a place to use and this may fit into their plans, at least on a temporary basis. Perhaps something could be xorked out with them. Mr. Williams also stated that he is for the Conditional IIae if its limited to a service type organization and not a retail outlet. These types of businesses should be encouraged around City Hall and down Meridian Street because they are fixing up some of the older homes. Light service and limited office space would benefit the City, from the Church down to the railroad orossing corridor. Orant Kingsford agreed with Richard Williams. Marvin Bodine stated that he didn't see anything wrong with the proposed use sad there would be leas traffic than when the Church xas in there. The Motion xaa wade bbr Richard Williams and seconded by Marvin Bodine that the Conditional IIae Permit for 14 E. Carlton be approved with the condition that this building not be used for any retail salsa and that Mr. Fd Jones consider contacting the Senior Citizens for the possible basement use of this building. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; 6laisyer, yea. Agenda 4 The next item of business was the consideration of the Final Preliminary Plat of Settlers Village. Norman Fuller was present representing Settlers Village. Mayor Storey stated that Planning and Zoning had approved Settlers Pillage but they xere making conditions. on xhether they were is condominiums or changing the plans around. The feeling is that any time the plans are changed they must go back to Planning and Zoning. Planning and Zoning cannot state what they want, they only advise the Couacid~. Mr. Fuller stated that there is a lack of @ommunications. He did not ask for Condominium approval, he only asked that at such time s• the City had an Ordinance wan there any objection to selling them as condominium unite rather than rental unite. The Mayor stated that this was preaapposiag and no one could say what xould happen in fire yearn. Mr. Fuller replied that all he is asking for now is approval of the Final Preliminary Plat, if things change ha rill resubmit a sex plan to Planning and Zoning. Mr. (ilaisyer and Mr. Williams inquired as to xhat they were approving. Nr. Fuller explained the approval xas needed originally for Four-plexes on Four-Flex lots. This was discussed. Also discussed xas an alleged mix-up on submission of the Final Preliminary to the Council. Joseph Olaisyer inquired as to the reasons for platting the commercial block by block. Richard Williams stated that he thought the Plat Dome is as residential. The matter of residential - commercial was discussed. Carl Ellsworth of J-II-B Eaginsers eosmented that he and Sumner Johnson discussed this protect before the meeting. Mr. Fuller had always stated at meetings that the zone was Commercial-Residential. He further stated that there are technical matte$e that can be resolved fairly easy. "If you were to approve it, Norman Fuller needs a variance on Block Oae (1) for length and Block Two (2) sad Five (5)." "Sumner wanted to make you aware that he realized the fact that you want Block Ten (10) designated as a park sad they have bean nothing but headaches for the cities that have them„. Hr. IIlsw©rth was sure that Steve Hosac also has received comments from the Irrigation District, Ada County Highway District, Idaho Dept. of Transportation and Dept. of Meridian Citq Hall .3. Maly 1, 1978 Health and Welfare, but they haven't been provided to the City. The rest is technical. As City Eagineere they would rather see concrete pipe as opposed to corrugated metal. If the City approves, variances are needed before Snmaer Johnson can sign. The Fhgineers are not against this development. Block Ten (10) Settlers Village was discussed. Planning and Zoning wouldn't accept without the park. Samall community parka were discussed. Also Commercial-8esidential mix was discussed. Richard Williams stated that he could support Block 1-9 sad 1-10 Commercial sad eonld not support any other Commercial, nor anything other than single familynesidential. Mr. Glaisyer stated that the density level is too high. Further discussion followed. Mr. Fnller stated that cosh incurred were too high for single family units. Mr. Williams stated that he eonld not snpport a 4-Plex on a 6700 egnare foot lot. Mr. Fuller replied that it has been zoned Commercial-Residential for two or three years. Submission and revision of plans were discussed. It was decided that more research is needed. Agenda 5 The next order of business was a Resolution to construct vest Pine. A letter from Ada County Highwaty District was read. Carl ffileworth discussed the Sewer pro3ect in relation to road construction. Ron Cottermaa from Ada County Highxgy vas present end announced that the Weat Pine Bids will be opened the 25th of May and construction will start within 15 datiys. Mr. Williams stated then this is a resolution to go ahead from the City. Work's Supt. Stnart reported that the City has a lot of service water lines that should go in before construction. Mr. Cotterman suggested that the service water liner work be done at the sub-grade level of construction. Richard Williams ixtquired if public wrk'e could meet. this time schedule and Mayor Storey suggested that they look into contracting out the work. The Motion was made by Grant Kingsford and seconded by Marvin Bodine that the City approve the Resolution for West Pine Construction,. Notion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Agenda 6 The vacancy on the Neridian Planning and Zoning Commission because of James Kling's resignation was discussed. Mayor Storey read the letter of resignation from Jim K11ng (on file with these minutes) and stated the vacancy should be filled. Agenda 7 The Boy Scout Tree planting project at the park xas discussed. The trees moat go in Saturday, Hay 6th. The trees are in at the greenhouse. The problems of planting and site preparation was discussed at length. Agenda Report oa: 8 Gas Tanks at the new sewer facility was given by Richard Shuns, Waste Treatment Supervisor. (On File with these minutes). The matter of gasoline for City sae was discussed. It was decided that action at this time was nnappropriate and no change in present procurement wan advisable. Meridian City Hall .4. May 1, 1978 Agenda Fire Chief Roger Welker informed the Council about the minor accident to the QRU Van. 10 He also addressed the problem of enclaves within the City limits of rural lands land-locked in the City. They should be taken into the City by annexation. Mr. Williams stated that this ahonld be adressed and timed with the City adoption of the Comprehensive Plan. Agenda Building Inspector Vernon Schoen reported that he has issued the first building 9 Permit at Cherry Lane Village. Agenda Work's Supt. Bruce Stuart reported that the Well Driller for Service Well #2 was lI at the City Park. A Mower for Public Work's was discnaBed. Mr. Stuart stated that there are some questions on setting meters and what the right of ~ easement for the City consists of. The matter was cleared up by Bldg. Inspector Schoea.in connection to thin, the fencing ordinance was discussed. Agenda 12 Ordinance Number 324 was read by the Mayor entitled: AN ORDINANCE DEFINING A GDDGRAPffiCAL AREA OF CITY IMPACT; IDENTIFYING THE COMPREHENSIVE PLAN THAT SHALL APPLY WITHIN THE UNINCORPORATED PORTION OF ADA COUNTY; IDENTIFYING THE ZONING AND SUBDIVISION ORDINANCES THAT SHALL APPLY WITHIN THE UNINCORPORATED PORTION OF ADA COUNTY; AND ESTABLISffiNG AN EFFF7CTIVE DATE, PURSUANT TO SECTION 67-6526, IDAHO CODE. The Notion was made by Richard Williams end seconded by Grant Kingsford that the rules and provisions of $Q-9002 and all rules requiring that Ordinances be read ~ on three different days be dispensed with and that Ordinance No. 324 be passed ++ad approved. Motion passed: Williams, yea; Hodine, yea; Kingsford, yea; Glaisyer, yea; Agenda 13 The next item of business was a proposed Ordinaaes establishing a permit application fee. The Hayor read the Ordinance (325) and questioned the 820.00 amount; Noise has a 87.00 fee. The matter was discussed. Mayor Storey felt that the fee was too high. Mr. Williams outlined the cost considerations to be covered and felt the proposed fee w96 t00 lOw. Mr. Glaisyer stated that if excess revenue is generated it could be used somewhere elae~for example the Senior Citizens. Mr. Williams felt paperwork sad personnel time should be covered to protect the current residence from tax increases. Procedures sad costa of inspections were discussed. Mr. Stuart felt contractors would do abetter fob and be more conscientious if a fee was imposed. Mr. Williams looked at some other community prices and charges and informed the Council. The Motion was made by Marvin Bodine and seconded by Joseph Glaisyer that the matter of permit application fees be tabled for more consideration. Motion passed: Williams, Yea; Bodine, yea; Kingsford, yea; Glaieyer, yea. Attorney Wayne Crookston clarified this as being .drafted as an application fee. Agenda 14 It was reported that the AIC State Convention would be held July 11th - 14th. The Mayor would like to see the Council members, City Clerk and Assistant, and other Department heads go. Mr. Shults, Waste Treatment Supv. advised the Council that he might be elected as a delegate to the South Western Association of Waste Treatment Operators Convention. The Mayor stated that reasonable expenses would be covered for Mr. Shults. The Motion was made by Richard Williams and seconded by Marvin Hodins that Partial Pay Estimate #7 for Treatment Pleat, tri_M_& Y.Constructioa in the amount of $268,630.87 be allowed. Approximately 49;K Complete. Motion passed: Williams, yea; Hodine, yea; Kingsford, yea; Glaisyer, yea. Phase II Interceptor Sewer Lfns, North American Contractors, project is substantially complete. J-U-B ffigineers is doing the final inspection sox end cleanup, easement releases sad street paving. There will be a change order to relatiy a 10" line. The Pay estimate rellecting 7 1/2~ of the total for retainage fa $25,125.98. The Motion was made by Richard Williams ahd seconded by Marvin Bodine that Pqy Estimate if6 reflecting 7 'YJ6 of total be paid to North American Contractors in the amount of $25,125.98 for Phase II Interceptor Sewer Liae be allowed. Richard Williams stated that North American has been aut3uorized to dump excess yards of fill at the old sewer treatment site for future use. Mr. ELlsworth next stated that there is en advertisement for bid on the park seeding project on May 15th. This has been published but ao contractors have been notified, they need direction. The matter was discussed along with avaiable funds. Marvin Bodine suggested contacting Jim Pwller, working at the Golf Course. The Mayor so directed. Engineering work on the Water Project came to $18,800 with a payment due is the amount of $376.00. The Motion was made by Grant Kingsford and seconded by Marvin Bodine that J-U-B Engineers be paid $376.00 on Water Project. Motion passed: Williaw, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. The ffigineering fee on the City Park was presented for December 10, 1977 to April 22, 1978 to include restroom and seeding proposal, Statement 7k6, $1,997.90. The urban fringe area is realizing, or will realize, development pressure that must be planned for in an orderly manner. CONSIDERATION: The following factors were considered by the planning commission and the city council.. in the establishment of an area of city impact: Section 1. PURPOSE: The purpose of establishing an area 1. Trade area; 2. Geographic factors; and 3. Areas that can reasonably be expected to be annexed to the city in the future. Section 3. GEOGRAPHIC AREA OF CITY IMPACT: The officially adopted geographic area of city impact is shown on the attached map entitled, "Area of City Impact for Meridian, Idaho," said area being described generally as follows: The West boundary being the Ada-Canyon County, line; the North. boundary being Highway 20; the East boundary being Cloverdale until such point as Cloverdale reaches the interstate-Overland area, then in- cluding the Five Mile, Eight Mile and Ten Mile Creek Drainage areas, but in no event shall it extend East past Cole Road or the New York Canal, whichever is closest; and bounded on the South being generally following the Rawson Canal to the point it intersects with the Ada-Canyon County line. Section 4. COMPREHENSIVE PLAN: The comprehensive plan and subsequent amendments thereto as officially adopted by Meridian, Idaho, shall apply to the area of city unpact within the unincorporated area of Ada County, Idaho. Section 5.
