Bills Meridian Cit Hall Jul 5 19 8 The Meridian City Council meeting was called to order at 7:35 P.M. by Mayor Don Storey. Council members present: Marvin Bodine; Grant Kingsford; Joseph Glaisyer Richard Williams, absent Others attending: Vernon Schoen; Roger Welker; Herald Cox; Bruce Stuart; Richard Shults; Marshall Henries J.E. Stubblefield; Carl B. Ellsworth Agenda 1 The minutes from the June 21, 1978 Council meeting were approved as read Agenda 2 Settlers Village: Restrictive Covenants The Motion was made by Marvin Bodine and seconded by Grant Kingsford that the restrictive covenants for Settlers Village be approved and that the Final Plat be allowed to be signed. Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea Agenda 3 City Policy on Interim Sewer Facilities: Pat Joy stated that he contacted Mr. Ellison from F.H.A. and informed him of the proposed resolution. Pat Joy read the proposed resolution (see evidence) Gene Wright, J-U-B Engineers, Inc., stated that he had contacted Mr. Ellison and he had stated that he had no problem with the proposal except one thing; that the Governmental Unit that takes the system over agrees to run it perpetually. He did not like the phrase that the City absolves itself of all responsibilities, (see point 3). If there was some way to work around that from the F.H.A. standpoint there should not be any problem. He then stated that one problem he has with it; very concerned with the fact that the City is billing the developer for all the costs both direct and indirect. Our understanding all along is that the City would be responsible for the day to day maintenance, power bills and so forth and if anything went wrong with the system, a pump broke down or something like that, it would be the developers responsibility to fix it. The day to day maintenance would be paid for from the monthly sewer charge, because these are totally independent and the City is not treating the sewage ,that those funds should go to the maintenance of those systems. The people are paying for a service they are not really getting, they are being double charged. Joseph Glaisyer stated then maybe the City shouldn't allow anyone to use Interim systems. Gene Wright stated that he thought it was to everyones benefit to allow Interim systems. The matter was discussed. City Clerk Herald Cox stated that the $3.50 monthly charge was not all profit, every year the City has $200,000 to take from those charges. Most of the $3.50 is used to pay bonds. The matter was discussed. Maintenance of the systems was discussed. Superintendent Shults reported that new regulations require pumps must be read ~, about five times per week and reported quarterly to Central District Health. Pat Joy discussed maintenance costs and the time frame for completion of the new facilities. Hook-up fees were discussed. City Engineer Carl Ellsworth inquired if this resolution would cover subdivisions a,]ready approved. s • Meridian Cit Hall 2. Jul 5 1 78 Cont'd Agenda 3 Jim Stubblefield reported on their subdivision, Franklin Square. There is one lift station, an absorbtion field and a battery of septic tanks. When the sewer comes on line that is to be abandoned and they are to connect to the sewer. He stated that they maintain the system for a year and the City takes over maintenance after that. The City paid for the electrical charge for the first year, however if something malfunctioned then it was their responsibility for-the first year. On Northgate they were to do the maintenance for the first year and the City would after the first year. Pat Joy stated that the City Council has not set a policy or accepted maintenance for some of the interim systems;until the City does this, it limits some financing. Because the City hasn't accepted those systems they should be covered by this resolution. The matter was discussed. Acceptance of interim facilities were discussed. The proposed resolution was discussed. Councilman Glaisyer stated that the City is becoming very cost conscious in this budget cycle, we are locked into revenues.: The only way to get more revenues is to cut some of these costs. We are facilitating both the City and the developers by allowing these interim facilities and there is no great fee for the developers to cover the interim cost for a short time of period. The matter was discussed. Mayor Storey stated that if the City is going to spend time and have a man going around inspecting these facilities that the City should be compensated for it. Superintendent Shults stated a rough estimate of expenses for checking these stations is between $60.00 and $100.00 a month. Charges were discussed. Gene Wright stated as a compromise that City delete (it absolves itself; see part part 4 of RESOLUTION) Patrick Joy pointed out that this removes the responsibility from the City. Mr. Wright inquired what would happen to permanent lift stations after one year. The Mayor stated that he supposed that the City would have to maintain them. The Bond issue was discussed. The Mayor instructed that the resolution go to the Attorney to be put in Resolution form. Agenda 4 Jim Stubblefield, Variances on seven (7) corner lots for setbacks; Franklin Square Mr. Stubblefield stated that by City Ordinances there are 20 foot setbacks and it would be better for him as a developer and builder to have 15 foot setbacks from a side street. Canyon County has a 30 foot setback, Nampa has a 10 foot setback. The City setbacks were discussed and the Stubblefield proposal. The Motion was made by Grant Kingsford to allow 15 foot setbacks on side yards in Franklin Square. City Clerk, Herald Cox, reported on the existing ordinance. Vernon Schoen, Building Inspector, discussed the City Ordinances. The Proposal was discussed. Grant Kingsford withdrew his Motion. Councilman Glaisyer stated that he preferred a 20 foot setback. Mr. Stubblefield displayed his new proposed office building. • C~ Meridian Cit Hall 3• Jul 5 1 78 Agenda 5 Pinehurst Subdivision, Preliminary Plat: Comments that were made on Pinehurst Subdivision were discussed. Councilman Bodine moved to table Pinehurst Subdivision,seconded by Joseph Glaisyer. Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea. Agenda 6 Meridian Manor No. 3, Vacation of Meridian Manor No. 2 (Preliminary Plat) The Motion was made by Joseph Glaisyer and seconded by Marvin Bodine to vacate Meridian Manor No. 2 and accept Meridian Manor No. 3• Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea Agenda 7 Fire Department report by Chief Roger Welker: Chief Welker stated that emergency 911 program should be in by the end of the year and that we have an interim agreement with Boise Fire in resolution form. The cost is $50.00 per month for Boise to dispatch and $78.00 for two line per. month. This cost will be City and Rural. Boise will be answering the phone and dispatching with Arden's as aback up. The Motion was made by Grant Kingsford and seconded by Marvin Bodine to approve Resolution $237. Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea Agenda 8 Public Work's Superintendent, Bruce Stuart, had nothing to report. Agenda 9 Building Inspector, Vernon Schoen, had nothing to report. Agenda 10 Chief Welker stated that he had a application fora Bews Industrial Development that would leave enclaves in the City. Mayor Storey stated that he would discuss it with Wayne Crookston. Agenda 11 Councilman Joeeph Glaisyer presented a policy statement. The Motion was made by Joseph Glaisyer and seconded by Marvin Bodine that when Preliminary Plats are submitted that they should include restrictive covenants at the same time. Agenda 12 Pat Joy informed the Council that the application for an Industrial Site Selection.was successful. Y Agenda 13 Condominium Ordinance: Councilman Glaisyer stated that he would like to see more in the Ordinance. The matter was tabled. City Clerk, Herald Cox, informed the Council on what the Boise Policy was. The matter was discussed Councilman Glaisyer requested that it be tabled. Meridian Cit Hall .4. Jul 5 1978 Agenda 14 Mayor Storey stated that the Council had met with the Ada County Highway District and they were receptive to our suggestions. Marvin Bodine agreed. Several things were discussed, including street and alleys. Highway Officials and City representatives will tour the City streets. Agenda 15 City Attorney, Wayne Crookston, stated that Mr. Wetherby had contacted him on the crushed sewer line. Carl Ellsworth stated that the problem was being looked at and the responsibility of the line is still pending. The bills were discussed. Agenda 16 City Engineer, Carl Ellsworth, presented the project pay estimates: Boise River Outfall Schedule A, Galey Construction for $87,439.08 including stored material. Ellsworth recommended approval. The Motion was made by Grant Kingsford and seconded by Joseph Glaisyer that the pay estimate #2 be allowed. Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea. There is another pay estimate from M & Y but there were discrepancies. They will be straightened out and presented at the July 17th Council meeting. Waste Water Treatment Plant Facility Pay Estimate #9 for June in the amount of $168,449.72 for M & Y Construction. Mr. Ellsworth recommended approval. The Motion was made by Grant Kingsford and seconded by Marvin Bodine to allow Pay Estimate #9 to M & Y Construction. Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea Carl Ellsworth stated that M & Y had sent a letter to the City on the amount of retainage (see evidence). Ellsworth's interpretation on retainage is 10~ for first 50% of the project and then 5% can be retained at the option of the City. The disadvantage of not holding the retainage is cash flow and not as much to fall back on if something goes wrong. They are about 68% completed at this time. Mr. Young from M & Y is asking for 5% retainage for the extra project. Ellsworth recommended the City Attorney take a look at the specifications. The Motion was made by Joseph Glaisyer and seconded by Grant Kingsford that the City Attorney take a look at the Contract. Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea. Contract #6, Quinn Robbins has finally obtained all the conditions and easement releases Change Order #4 that is an adjustment of quantities, a deduction of $36.75• Ellsworth recommended approval. Marvin Bodine moved that Change Order #4 be approved, seconded by Joseph Glaisyer. Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea Final Pay Estimate for Phase I, Contract #6 to Quinn Robbins is $10,778.74. Ellsworth recommended approval. The Motion was made by Grant Kingsford and seconded by Marvin Bodine that the Final Pay Estimate to Quinn Robbins be allowed. Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea. Mo r•i rlian (`itv Hall .5. Jul 5, 1978 (cont'd) Agenda 16 Phase III, Galey Construction, Contract #7 June payment, Estimate #2 in the amount of $27,768.47. Ellsworth recommended approval. The Motion was made by Marvin Bodine and seconded by Grant Kingsford that Pay Estimate #2 to Galey Construction be allowed. Motion passed: Bodine, yea; Glaisyer, yea; Kingsford, yea Carl Ellsworth reported that one point under Phase III is plans and specifications were designed to go on the north side of Fairview to get access, time was of essence, just before bid opening the Highway Department decided they wanted the line in the center of the road. The sewer line was redesigned and Galey was asked to quote a change order. They come up with $3,000 more. It will be brought up at the next Council meeting after review. The matter of who is responsible was discussed. Mr. Ellsworth stated EPA has approved all change orders to date. Mr. Ellsworth reported that he has prepared the audit statement and Sumner Johnson is reviewing it. He will go over the change order on Friday with City Officials. Engineering statement for June, 1978 is $15,210.64 for the Construction Phase of the EDA and EPA Project. Ellsworth recommended approval. All equipment purchased must be compatible with the CZTY'S Department of Fire dispatching equipment and all purchases of communications equipment by DISTRICT shall be reviewed by CITY'8 communica- tion~ officer. 6. If DISTRICT requires or provides additional radios or frequencies, DISTRICT shall have the responsibility to obtain all necessary licenses or permits which may be required for the maintenance and operation of such additional radios or frequencies: 7. DISTRICT agrees to have at least one individual Mho will be responsible to take all emergency alarms in the DISTRICT. 8. CITY and DISTRICT shall each comply with all lapis, ordoss and regulations of the Federal Communications Commission or any directions of any public officer given pursuant to law, which shall impose any duty upon either party in the performance of this Agreement. I am concerned that there may be some dissatisfaction due to '` ,. the .fact that .you are the only municipality that has not re- duced total retainage to 5%. I certainly would appreciate knowing if there is some dissatisfaction. I believe we are well ahead of schedule. Your pay record has been excellent and to the best of my knowledge contractor-owner relations ry'' have been good. If there is no apparent reason for the additional retainage being withheld it would be very much appreciated if it could be reduced to 5% across the board.
