PatJOy - Assessor Department Report September 18, 1978 Meridian Cit Council Meeting was called to order at 7:40 P.M. by Mayor Don Storey Councilmen Present: Richard Williams; Marvin Bodine; Grant Kingsford; Joseph Glaisyer Others Present: Carl B. Storkan; Ben Rice; Vern Pincock; Violet Pincock; Larry Sale; Gene Wright; Del Bolen; Earl Ward; Herald Cox; Bob Hammersly; Bill Russell; Gary Green; Betty Tully; Jim Tully; Wayne Crookston Agenda 1 Minutes of September 5, 1978 were approved as read. Agenda 2 Citizen Traffic Problem on West Washington and Vicinity Sandra Moore, Pat Sheneman and Laurie Scott were present to discuss the situation. Mrs. Moore stated each lady lives on a 45° corner, this is an Ada County Highway problem and they wanted the Council's views and backing to get something done. They have found out from a letter from Mike Silva that they could not install stop signs - there was a problem but it was a police problem. She complimented the Meridian Police Department for their effort in the area. They have been told that they cannot use speed bumps. They were given a Public Right-of-Way application that would give the people the street. They need a $300.00 fee to proceed. Basically, they are asking for help. The problems were discussed and outlined and it was stated children can be hurt. Storey stated that this is not an isolated incidence, the police are working on the problem. The City does not have the streets. Chief Green stated that the thing that will help most is to finish Pine Street, they have an extra radar unit patrolling the area. Glaisyer inquired if Green had met with ACRD and investigated the area. Green stated that alternatives were discussed and the street was stripped. Williams questioned if the police had helped reduce traffic. Scott stated that the kids know when the police are there and they slow down. Storey stated that he was informed by the School Resource Office that a lot of pupils are driving. He stated that the Council will do what they can to help. We will try to hold traffic down. Williams stated that his opinion was that their chances are that they will loose their money. He suggested that they write license numbers down of violators and the make of the car and call the police. Storey stated that they should sign a complaint. The people in his neighborhood do this. Kingsford inquired if signs and announcements at the school would help. Green stated that he had discussed the problem with Gus Hein and they will help with announcements at the school. Storey stated that the City will crack down on speeders and reckless drivers. Moore stated that the Va11eyNews had ran articles on this. The design was not made for through traffic. Storey stated that the City is trying to help and thanked the representatives for coming in. Meridian City Coun Agenda Cable TV: 3 r _. .2. S 18. 1978 Bob Hammersly presented Attorney Bill Russell to also represent United Cable (U.C.) He stated that the Ordinance had been presented and discussed with the City Attorney. Williams statedthat he received his copy Friday and had not had a chance to read it. Russell stated that one thing that happened in the drafting process is that they attempted to update the franchise fee provision, a substitute for Page 18(see evidence) They did not get it to them as soon as they had liked to. This is an amendment to a 1969 Ordinance. He presented the background again. -They are ready to go and what they are asking for is to bring the 1969 Ordinance up to date, technical requirements and standards for F.C.C. Standards. The Franchise rates are increased. That is the thrust of the amendments. One other change is rather than coming to the Council for rate changes in the future they would set up a situation to notify the Council of proposed increases or reductions. If the Council did not refuse those they would go into effect. They could review the rate increases and veto them if they thought they are not in the advantage of the citizens of Meridian. He realized they did not have time to go through them in detail, but there are stringent time constraints. U.C. is getting the financing going so they can start construction. Their finance sources will not release the money untilthe franchises for the cities are passed and clear. If the Council wants more time theywill agree to that. He requested that it be passed on an emergency basis. Storey clarified the Ordinance. Russell stated that Boise should be passing it tonight. Hammersly asked if there were particular questions. It was discussed withthe City Attorney and drafted according to the discussions that were held. Would appreciate the Council passing on it. Williams stated that he did not have any questions because he did not have time to read it. Kingsford stated that it was not in his box when he checked on Friday. Hammersly stated that they were delivered at 4:00 P.M. The matter was discussed. Kingsford inquired what Crookston's comments were. Crookston stated that he had some problems with it, was uninformed about discussions with Fitzgerald. They discussed it for about 45 minutestonight. There are some things that need to be changed pertaining to insurance, bonding and it isn't in a form to be acted upon tonight. Russell stated that these changes are changes in the initial Ordinance, not the amendments, and outlined the U.C. position. Mayor Storey inquired if this was the same ordinance presented to four other cities. Russell stated that it was. Glaisyer inquired if the fee schedule was identical. Russell answered that they were. Williams asked Crookston of what changes he would make. Crookston stated that it should be a Comprehensive amendment. Who has contol of the road, performance bond, ect. Hammersly stated that this is merely an amendment to the ordinance and explained their position. Storey stated that he was in favor of them coming in and gave the history. He recommended that the Council approve it. Glaisyer moved to table. Crookston stated that they received it this morning and has not had time to study it. September 18, 1975 (cont'd) Agenda Russell stated that the problems Crookston has with it comes out of the reading of 3 the Ordinance and interpretation. The clarification he is asking for no one else has a problem with. This puts them in a unique situation of holding up the whole valley to clean up the ordinance for Meridian. There are things that should be drafted theother way. There are some things we would do that would not be advantageous to the City. Russell stated that today you would have a problem getting a 20 year franchise fee due to the fact that ACRD has the roads. Our position is we have an agreement and ordinance that goes back to 1969. We are not going to try to re-negotiate the agreement. He explained the position and their relationship with the City. Hammersly stated that they decided it was impossible to bring cables to all the areas. Those will receive less than Meridian and pay .O5C a month more. They have lived up to theagreement for nine years and is suprised the City wants to re- negotiate the contract. He suggested it would be in the cities interest to pass the Ordinances. Russell argued the point that the City should proceed. Bodine inquired if Crookston wanted to amend the whole Ordinance. Crookston stated that he needs time to study it before he .would have an opinion. Storey restated his support. Kingsford inquired why,if Boise has had it for three readings, have they just received it. Russell stated that a court date and everything broke. loose three and one-half weeks ago. We have no way to line out the old ordinances and people have been lining them out. We have been doing them one by one - there are a lot of hyphens. This has not just been dropped in, Fitzgerald and the Mayor know what has been going on. Williams stated there are two points. One is U.C's going to Clean the ordinance up at one time or another. Russell answered if the City would like us to do that we will. Williams inquired from Crookston an opinion on the City not entering into a contract but adopting an ordinance they can amend. Crookston stated that you cannot arbitrarily change the document. Kingsford seconded Glaisyer's motion to table. The effects of tabling were discussed. Motion passed: Bodine, yea; Kingsford, yea.; Glaisyer, yea; Williams, nay (Agenda 4 Bews Industrial Park (ANNEXATION) Larry Sales was present representing.Bews Industrial. Glaisyer inquired where the covenants were going to come in. Sales stated it was premature. Storey inquired if they were asking for light industrial. Sales stated industrial. Classification of industrial and the process was discussed. Williams inquired of what restrictions Planning and Zoning had placed on their recommendations. Sales was not sure. Joy presented the Planning and Zoning Motion. Sales stated that they could have a "Gentlemen's Agreement" to come in and present these proposals. The contiguous points to the City were outlined. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea 1978 Pat Joy read Ordinance Number 329 entitled: AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS: A PART OF THE NE 1/4 SE 1/4 OF SECTION 7, AND THE W 1/2 OF THE NW 1/4 OF THE SW 1/4 OF SECTION 8, T. 3N., R. lE., B.M., Ada County, IDAHO, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. Richard Williams made the motion to accept Ordinance No. 329 and that the rules and provisions of 50-902 and all rules and provisions requiring that ordinances be read on three different days be dispensed with; that Ordinance #329 as read be passed and approved; seconded by Marvin Bodine. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Vern Pincock (Dairy Farm) Attorney Ben Rice was present representing Mr. Pincock. He stated that their desire was to end the process here and not court. Rice sited Idaho Code 50-222 and outlined the Pincock situation. Mr. Boesiger indicated that he owned the land when he did not. Storey stated that this was Mr Knapp's property bought by Mr. Bolen and then purchased by Pincock. ggRice agreed .tt kkDel Bolen stated he was ownergr iiof 5 acres and had made deal with Pincock. He referred to no one desiring to build a $100,000 home next to a cow corral. Rice stated that there is a problem. FHA is requiringa written statement by the City Council that Pincock has a Grandfather Right on that property, the 5 acres, before they will make the loan to complete the purchase. Storey questioned if a Grandfather Right can be passed down approximately 5 times, and if the City received the right description when the City Annexed Sunnybrook Farms. Rice explained that after the City approved the annexation of Boesiger, the City would then, so long as Pincocks piece is smaller than 5 acres, the City would be able to annex it anyway. Rice again stressed that FHA will not loan Pincock the money without a statement from the City Council stating thathe has the Grandfather Rights. Rice stated further that theywould like to de-annex the 5 acres, if not they would like a letter from the Council to FHA so that Pincock at least can complete his financing.. Crookston stated that the only person to make the decision of de-annexing would be Boesiger, whether or not he had a right to request that annexation. They do have a letter that does say that Boesiger is not the deeded record title holder to that 5 acres, that does not mean that he does not as the contract purchaser, can request annexation. The first step would be to find out why Boesiger included the 5 acre property in his annexation request. There was discussion concerning just which owner was responsible. Storey set a meeting with Attorney Rice, Pincock,.BOesiger and City Attorney for 4:00 P.M. Sept. 19.. • city Counci] .~. Agenda Capitol Development Meridian Park (Annexation) 6 18 Comments were read. Larry Sale spoke representing Meridian Park Estates Subdivision, Ramon Yorgason of Capitol Development INC. They are requestingannexation zoning Residential "A", will develop the property the best they can and according to regulations, and will be supplied with. all City services and utilities; streets built to City and ACHD standards. The Motion was made by Bodine and seconded by Glaisyer that the Capitol Development Annexation be accepted as a "A" Residential. Motion passed: Bodine, yea; Williams, yea; Kingsford, yea; Glaisyer, yea. Sale stated that the Subdivision name being proposed is MERIDIAN PARKS ESTATES. Patrick Joy read Ordinance Number 330 entitled: AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS: THE SW 1/4 OF THE NW 1/4 OF SECTION 1, TOWNSHIP 3 NORTH, RANGE 1 WEST, B.M., ADA COUNTY, IDAHO, TO THE CITY OF MERIDIAN, WHICH PROPERTY IS ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. Sale stated that it is important that the exact name of the Subdivision being proposed is MERIDIAN PARK SUBDIVISION. The motion was made by Bodine and seconded by Williams that the rules and provisions of 50-902and all rules and provisions requiring thatordinances be read on three different days be dispensed with and that Ordinance Number 330 as read be passed and approved. Agenda CONSULTANT REPORTS 9 Carl Ellsworth reported on two items. First item is Engineering Statement for August 17th toSeptember 9th, General Engineering, $186.38. The Motion was made by Kingsford and seconded by Williams that the Engineering Statement be approved. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. The next item was discussion of sidewalks of Cherry Lane Subdivision. Gene Wright clarified that there are sidewalks four (4) foot instead of the five (5) foot requirement as they had requested a variance and was granted, on the original Subdivision. (Cherry Lane Village #lonly). The rest of the Subdivision will have all five foot sidewalks. Second item to be presented by Ellsworth was the financial status of the Park. Ellsworth reported that the City has $21,400 left to spend on the Park if we can get all the items approved that he took off the ledger. The remaining projects are over December 31, 1978 by the Grant agreement. Herald Cox stated that he felt the City would encounter less problems if we would go ahead a get a bid proposal for the balance of this money.
