Section 6: CONDITIONS OF PERMIT GRANTED: A permit granted pursuant to the provisions of Section 4 herein shall be subject. to the following conditions: A.• The person to whom a permit is given or granted shall acquire no property or contractual right in and to the street,'' sidewalk or parkway and such permit may be revoked whenever the Council deems it necessary as a proper police measure. B. The person to whom a permit is issued shall comply with all laws, orders and regulations of the City and with any directioi of any public officer, pursuant to law, which s4all impose any duty upon such person, or such person shall at his sole expense obtain all licenses or permits which may be required. C. The person to whom a permit is issued shall indemnify anal' save and hold harmless the City from and for any and all losses,' claims,.actions and judgments for.damages or injuries to persons` or property and losses and expensos caused or incurred by the permittee, its servants, agents, employees, guests and business invitees. In addition, the permittee shall maintain and keep in full force and effect liability insurance in which the City, shall be named as a named insured in amounts established -by the Council. The limits of insurance shall not be deemed a limitation of the permittee's covenant to indemnify and save and hold harm- less City. D. Upon'revoc tion of any permit given or granted, or in case of any disturbance o'r damage1to' pavement, sidewalk or other surface or structure ,:permittee shall, at its own expense, and in the manner required by the City, replace and restore such in a condition acceptable�to the City. The Idaho Division of Highways has undertaken a study to evaluate alterna- tive locations for a connector roadway. In May of 1971, a hearing was held on a proposed highway corridor located between Cloverdale Road and Five Mile Road. The outcome of the hearing was that the location for such a connector roadway should be farther west than the Cloverdale/Five Mile proposal. The present study will take into account the information gathered and the testi- mony obtained at the 1971 hearing. The connector roadway project would include an inter- change with Interstate Highway 80N. A southerly extension of State Highway 69 and the Eagle Road Corridor appears to be a prime location. An arterial highway in this corr- idor would serve a vital north -south traffic demand be- tween Overland Road/I-80N and State Highway 44, and would also provide access to and from the rapidly developing area between Boise, Meridian and Eagle. Additional Inter- state interchange locations to provide service to local roads, in addition to the proposed connector roadway, will also be studied. Storey 728 Meridian Street Meridian, Idaho 83642 Dear Mayor Storey: Progress Report of Agreement with Gem State Pump and Irrigation On April 7, 1975, the City received quotes from five equipment suppliers to provide and install a pump, motor, column, discharge head, base plate and miscellaneous appurtenances as described in speciifcations as issued by the City. The low responsive quote was determined to be $12,520.00 as was submitted by Gem State Pump and Irrigation, Meridian, Idaho. After consideration, the Council accepted the said proposal and awarded the contract to Gem State Pump and Irrigation. Gem State Pump and Irrigation was verbally notified of the decision immediately and asked to proceed accordingly. This was followed by a written notice of award to Gem State Pump and Irrigation on April 15, 1975, and Mr. Saunders, as the Owner, acknowledged and returned the notice on April 17, 1975, with a copy mailed to the City. As you know, in the implementation of the said agreement, items were delivered late and the installation was not completed in a timely and workmanlike manner. Specifically, Gem State Pump and Irrigation agreed to deliver all equipment and materials by May 15, 1975, and further agreed to install the said equipment and material within two (2) ,days. In reality, Gem State Pump and Irrigation never completed the delivery of equipment and material. The order was delivered during the third week of July, 1975, by a pump supplier, namely Aurora Pump of Twin Falls, after several discussions with the City personnel. Shortly thereafter, Gem State Pump and Irrigation did make an effort to install the pump. Unfortunately, that effort was not coordinated, as required.by terms of the agreement with the City, with the Contractor for the construction of the pumphouse. In the process of the installation by Gem State Pump and Irrigation, they damaged the pumphouse and they did not get the pump installed properly. Thereafter, the City or any of its authorized representatives were never able to contact any repre- sentatives of Gem State Pump and Irrigation. We discussed this problem with you and representatives of Galey Construction on July 25, 1975, and it was decided that since exhaustive efforts to get Gem State Pump and Irrigation to complete the pump installation had failed and since an emergency existed, the City's only immediate recourse was to authorize Galey Construction Company, Inc. to complete the pumping installation as a change order to their contract. The well was completed by Galey Construction Company, Inc. and was manually operable by August 11, 1975 and completely operable by September 3, 1975. Have both parties sign an agreement as prepared by the City Attorney, releasing the City of any further obligation, before the check is delivered to either party. 2. As Items 1,2 and 3 have been approved as part of Change Order No. 1 for the City of Meridian Pump and Pumphouse Construction Project between the City and Galey Construction Company, Inc., Contractor September 5, 1975, payment to Galey Construction Company, Inc. for the existing Five Thousand Three Hundred Forty-five and 05/100 Dollars ($5,345.05) retained would follow in accordance with terms of their contract. 3. Prepare a check in the amount of Two Hundred Twelve and 50/100 Dollars ($212.50) payable to Idaho Motor Repair and deliver it after a full release is obtained from them. Storey City of Meridian 728 Meridian Street Meridian, Idaho 83642 Dear Mayor Storey: Well No. 8 and Water Transmission Main Project Cost Summary In response to your inquiries, we have reviewed the Well'No. 8'project and the associated water transmission main construction project and respectively offer the following project cost summary report. In particular, we have corre- lated final costs with original estimates of costs as were developed during early project planning. We have also considered the additional improvements as were authorized to properly utilize Well No. 8 prior to construction of the overall water transmission project. In December, 1974, the project was started with the advertisement for bids for drilling the well. During that period, the total project was discussed and several possible means of funding were investigated..' The predominant feeling at that time was that the City would be able to receive either EDA or HUD grant funds to assist in the financing. A figure of $95,000.00 was used as a preliminary project cost to provide a well, the pumping facilities, a pumphouse and the con- nection to the existing water transmission network in the area;. During the efforts to get outside financial assistance, bids were received and opened for the drilling of the well. In order to allow sufficient construction time to provide a completed facility during the summer of 1975, the well drilling contract; was awarded and con- struction started, still with no commitment for outside funding assistance. The base bid for construction of the well, as accepted by the City, was $43,152.00. This compared very favorably with the Engineer's estimate (as was filed with the City) of $42,869.50. The total construction cost for drilling, the well was itemized on the final contractor pay estimate and was approved by the City in the amount of $44,133.10. The engineering services for the well drilling portion of the project amounted to $3,949.54, or slightly less than nine percent (9%) of construction costs, which is considerably below normal total engineering costs for a project of their size. At this point, alternates for connecting the new well to the City's dis- tribution line network were developed, both with the water transmission mains as would be provided`bry the overall project as was being programmed for the system. An alter- nate was selected by the City, with the Engineer's concurrence, and the decision was made to proceed with a system which included installation of some of the ten -inch transmission.main that had been programmed in the overall project. In summary, this project did cost more than the early preliminary estimate of $95,000.00. The additional expense is mostly attributable to the decision to install the ten -inch transmission portion of the distribution system in this phase of the total water system improvements proposed for the City of Meridian.
