The Motion was made by To7.sma and seconded by Myers to approve the
minutes o~ the previous meeting held September 2, 1986 as written:

Item #1: Ordinance # 468: Ordinance amending Ordinance #~451 & 458
Latecomers Ordinance:
Mayor Kings~ord, I wi11 ask the City Attorney to give the Council
Members an update on this Ordinance.
Attorney Crookston, after the meeting held in regards to the extension
of the water and sewer across the freeway, I reviewed the latecomers
Ordinance's on the water and sewer mainly for two things, one that
they could enter into an agreement for reimbursement for themselves,
that if they used City monies to complete this extension that the
City could then be the benificiary of a~.atecomers agreement, another
thing was that the latecomers agreement couTd be a joint agreement and
a provision which allows for interest or charge for current const-
ruction costs for the line. There is no set rate of interest or
set rate for construction costs.
Mayor Kingsford, are there any questions of the Council? There was
no response. An Ordinance of the City of Meridian repealing sections
5-124A and 7-527A of the revised and compiled Ordinance of the City
of Meridian; amending Title 7, Chapter 5, of the revised and compiled
Ordinances of the City of Meridian, entitled sewer use, by the addit-
ion thereto of a new section which sha11 be known as Section 7-527 A:
Payment or contribution of proportionate costs and expenses of const~-
ucting sewer lines; co-operative agreements; and amending Title 5, C~apter
1, o~ the revised and compiled Ordinances of the City of Meridian,
water use, by the addition of a new section which shall be known a
Section 5-124 A: Payment or contributuion of proportionate costs and
expense of ~wn~~.ru~~~.in~off-site water lines; co-operative agreements;
and providing an effective date; Is there anyone in the audience who
wishes Ordinance #468 read in its entirety? There was no response.
The Motion was made by Brewer and seconded by Tolsma that the rules
and provisions of 50-902 and a11 rules and provisions requiring that
Ordinances be read on three different days be dispensed with and that
Ordinance ~ 468 as read be passed and approved:

Item #2: Escrow Agreement on Eag1e Road Mall Site:
Mayor Kingsford, I had a call from Marv Gibbons at about 5: 50 p.m.
and he had some bad luck he totaled his car coming down Highway 55
and will not be able to attend tonite, I advised him the Council
willing we would continue this item until the next meeting.
The Motion was made by Myers and seconded by Brewer to continue this
item until the October 6, 1986 Meeting:

Item #3: Water & Sewer Extension across the Freeway:
Mayor Kingsford, this is the subject of the Special Meeting held last
Wed.z~esday, just a few thoughts, the extension at this time has some
goocl implication for us, we have a major user which is building out
there, this is an opportunity we have not had before as a certain amount
of the cost would be funded now, this is Western States Equipment.
Pursuant to other discussions I have had there is no doubt in my minc~
that there will be at least one other development over there. I have had
some assurance from the City Engineer that the Treatment P1ant if we were
to redirect the money budgeted this year for a Secondary Clarifier that
this could be delayed for another year. I have every confidence that we
will be able to budget next year to complete that secondary clarifier.
We have a opinion from our former Auditor and a certain amount of
advise from Bond Counsel that the money we saved from the refinancing
of the Bonds can be used for construction. Some of the owners have
not yet committed themselves to this project, if we obtain a11 the
owners we will not be spending a large sum of money, the amount wi11
depend on how many agreed to participate. Under the Latecomers Agree-
ment we will be reimbursed for what we spend. Are there any questions
or comments from the Council?
Myers, how soon would this project be starting?
Mayor Kingsford, as soon as the irrigation water goes out it is my
understanding, we have some drawings that shouTd not need a great
deal of updating, the project will have to be done sometime during
the time the irrigation water is out, after October 7.5 and completed
by April 15.
Gi~sler, what is the dollar amount we are looking at?
Mayor Kingsford, it depends which developers help us out and which
formula we use, if we use the formula advanced by JUB Engineers, you
get into the larger land owners their share is greater. This is what
we do not know now we know we have one party. The latest estimate
for the project was around $400,000.00. Western Equipments share
was around $70,000.00 and Van Aucker's was the same.
Councilman Brewer, this looks like a real chance and a real investment
in Meridian's future to have this opportunity, one that I have not seen
before in my time on the Council. Also I think it is an opportunity to
give some of the developers a vote of confidence that we have not been
able to do prior. If that secondary clarifier can be put off another

year, I think we should take advantage of this opportunity to make this
investment to the City of Meridian.
Mayor Kingsford, I might just add, it certainly is not an easy decision,
we have no assurances, one developer has said he does not think it is
timely for him to pursue something like this at this time. There is no
guarantee certainly that going to the latecomer's agreement that the
City will recoup their investment. It is a risk we are taking to bet
on the future of Meridian. Personally I think the reward factor is in
our favor.
Councilman Brewer, even though it might seem like a bold step, I think
we have to do that sort of a thing once in a while and i feel good about
the step.
Councilman Giesler, 2 feel about like Councilman Brewer and the time I
have been on the Council there have been a number of times there has
been concern on the South side of the Interstate and i feel with the
opportunity we have now we really ought to consider this project.
Mayor Kingsford, during my tenture we have had several people, one at
a time during the last nine years that wanted to develop something over
there, but we have never had occasion where we have two or more to put
together a proposal like we have today, and I think that is very critical
we could let this time get away from us if we do not act.
Brewer, our next step in this process is to amend the budget?
Mayor Kingsford, no we do not have to amend the budget, all we have to
do is the money we budgeted for the secondary clarifier we redirect that
to this project.
The Motion was made by Tolsma and seconded by Myers that the funds
budgeted for the secondary clarifier be redirected to funding the
extension of the water and sewer across the Interstate.

within the County they reside.
Myers, the impact meeting is to be Thursday night.

attached to the property and shall be personal to the Applicants
or any Developers; that the above terms and conditions shall
survive the passage of this resolution and any annexation and
zoning ordinance;
Section 4. That it is the intent of ~his Resolution that
Lots 1, 2 and 3, Block 2, Doris Subdivision be conditionally
annexed and zoned by means of this Resolution and that final
annexation and zoning would not occur until such time as an
Ordinance is passed and approved by the City Council.

The Baard of Commissioners of the Ada County Highway District will hold a public
hearing in accordance with Section 50-1306(A) of the Idaho Code to consider the
vacation of above listed public right-of-way on Thursday, August 21, 1986, at
7:30 p.m. in the office of the Ada County Highway District, 318 East 37th Street,
Boise, Idaho 83714. The applicant has requested subject vacation to facilitate
construction of the new school administration building (to be used temporarily
as an elementary school) at the corner of State Avenue and Meridian Street.

SECTION 2: That Title 7, Chapter 5, of the Revised and
Compiled Ordinances of the City of Meridian shall be amended by
the addition of a new section which shall be known as "Section
7-527 A° and which section shall read as follows:
PAYMENT OR CONTRIBUTION OF PROPORTIONATE COSTS AND
EXPENSES OF CONSTRUCTING SEWER LINES; CO-OPERATIVE
AGREEMENTS:
(A) Notwithstanding any of the provisions of this Chapter,
- Sewer Use, any person, firm, partnership, corporation
or association or property owner who has not otherwise
paid for, or contributed proportionately toward the
costs and expenses of constructing a sewer line,
whether that construction has been performed by the
City, a local improvement district or a private entity,
or a combination thereof, and who subsequently desires
to connect to the City sewer system, shall be required
~ to pay, in addition to the required connection charges
of Section 7-535 and the monthly user charges of
Section 7-533, an additional connection charge which
shall be known as an °Eight (8) Inch Diameter Sewer
Line Equivalency Fee" which sha17. be computed as

1. For lots used, or to be used, for residential
purposes which front on an installed sewer line the
assessment shall be made and based on one of the
following parameters for a maximum lot depth of one
hundred ten feet (110'):
~(a) Existing sewer in paved street with service
connection and service lines
installed--$0.25/square foot of lot area; or
(b) Existing sewer in paved street without
service connection or service lines
installed--$0.18/square foot of lot area; or
(c) Existing sewer line in gravel street with
service connection and service lines
installed--$0.12/square foot of lot area; or

2. For each lot, parcel or tract of land exceecling a
standard residential building lot having a maximum
depth of one hundred ten feet (110') or used or to be
used for purposes other than residential, the charge
shall be fixed and determined by the City Engineer and
the Sewer Superintendent based upon considerations and
factors of, but not limited to, the benefits derived,
the type, character, amount and quality of discharge
into the sewer line aad the proportionate costs and
expenses, in then current dollars as determined by the
City pursuant to the Engineering News Record (ENR)
Construction Cost Index, of engineering and
construction of the sewer line, and any interest being
paid to a sewer user pursuant to a reimbursement
agreement entered into pursuant to paragraph (B) below.
(B) Should a sewer user at his own expense construct an
extension to the sewer system in a public right of way
or easement with prior approval of the City and in
accordance with the standards and designs of the City
and which sewer line extension has been determined by
the City to be able to benefit properties other than
the user, the sewer user constructing the extension may
request that the City enter into an agreement with the
user such that.all or a portion of the costs of
extending the sewer line will be reimbursed to that
sewer user from the connection charges collected under
subsection (A) above from those property owners who
will benefit from the sewer line extension and who
otherwise have not paid or contributed their
proportionate share to that sewer line; provided
however, no reimbursement agreement shall have a
duration greater than ten (10) years, except as
provided below; except as provided directly below
pertaining to interest and increased costs of
construction no reimbursement agreement shall pay to
the sewer user paying for or const~ucting a sewer line
extension more than one hundred percent f100$) of his
actual engineering and construction costs, it being
noted that in most cases at least some of the cost
would ordinarily be assessed to the sewer user's own
property= a reimbursement agreement may provide for
interest to be paid to the sewer user or may provide
for reimbursement based upon increases in the costs of
construction from the time the extension was
constructed until the fee paid under paragraph A is
received all as determined by the City under the ENR
Construction Cost Index; the City shall be entitled,

shall charge and shall receive a ten percent (10$)
administrative fee for handling the accounting,
auditing, and payment of the reimbursement payments
made to the sewer user so extending the sewer line and
having reached a reimbursement agreement with the City;
the reimbursement agreement shall be personal to the
sewer user entering into it and shall not be assigned
without the written consent of the City, which consent
will not be unreasonably withheld= that the agreement
shall be binding on the sewer user and his assigns,
successors, heirs and executors and may be recorded as
an encumbrance against the property of the sewer user;
that the sewer user shall be required to indemnify and
hold the City harmless from any and all liability
whatsoever until the sewer line has been accepted fo~
maintenance by the City; that all sewer lines once
accepted by the City for maintenance shall thereafter
become part of the City sewerage system and be the sole
property of the City. No reimbursement agreement shall
require the City to make any reimbursement payment
unless the City receives funds pursuant to paragraph
(A) above.
(C) The City, itself, on its own behalf, may construct an
extension to the sewer system and enter into a
reimbursement agreement with itself as set forth in
paragraph (B) and any sewer user connecting to said
sewer line extension shall be charged the Eight (8)
Tnch Diameter Sewer Line Equivalency Fee set forth in
paragraph (A) above. A reimbursement agreement which
provides that the City is reimbursed may have a term
greater than ten (10) years.
(D) The City may enter into joint agreements with other
sewer users for the extension and construction of
sewer lines. Both the City and the sewer user or
users entering into the joint agreement for sewer
extension and construction may enter into reimburse-
ment agreements allowed pursuant to paragraph (B)
above.

extension, plus considering any interest being
paid pursuaat to paragraph (B) below, shall be
divided by the total front footage of property
adjacent to the off-site main.
2. The above determined front-foot cost shall be
multiplied by the lot, parcel or tract front
footage, adjacent to the water line, of the
applicant connecting to the extension.

(B) Should a water user at his own expense construct
an extension to the water system in a public
right-of-way or easement ~ith prior approval of the
City and in accordance with the standards and designs
of the City and which water line extension has been
determined by the City to be able to benefit properties
other than the user, the water user constructing the
extension may request that the City enter into an
agreement with the user such that all or a portion of
the costs of extending the water line will be
reimbursed to that water user from the connection
charges collected under subsection (A) above from those
property owners who will benefit from the water line
extension and who otherwise have not paid or
contributed their proportionate share to that water
line; provided however, no reimbursement agreement
shall have a duration greater than ten (10) years
except as provided below; except as provided directly
below pertaining to interest and increased costs of

construction, no reimbursement agreement shall pay to
the water user paying for or constructing a water line
extension more than one hundred pereent (100~s) of his
actual engineering and construction costs, it being
noted that in most cases at least some of the cost
would ordinarily be assessed to the water user's own
property; a reimbursement agreement may provide for
interest to be paid to the water user or may provide
for reimbursement based upon increases in the costs of
construction from the time the extension was
constructed until the fee paid under paragraph A is
received all as determined by the City under the
Engineering News Record Construction Cost Index; the
City shall be entitled to charge and shall receive ten
percent (10$) administrative fee for handling the
accounting, auditing, and payment of the reimbursement
payments made to the water user so extending the water
line and having reached a reimbursement agreement with
the City; the reimbursement agreernent shall be personal
' to the water user entering into it and shall not be
assigned without the written consent of the City, which
eonsent will not be unreasonably withheld; that the
. agreement shall be binding on the water user and his
assigns, successors, heirs, and executors and may be
recorded as an encumbrance against the property of the
- ~ water user; that the water user shall be required to
indemnify and hold the City harmless from any and all
liability whatsoever until the water line has been
accepted for maintenance by the City; that all lines
once accepted by the City for maintenance shall
thereafter become part of the City wates system and be
the so].e property of the City.
(C) The City, itself, on its own behalf, may construct
an extension to the water system and enter into a
reimbursement agreement with itself as set forth in
paragraph (B) and any water user connecting to said
water line extension shall be charged the additional
conoection charge set forth in paragraph (A) above.
A reimbursement agreement which provides that the City
is reimbursed may have a term greater than ten (10)
years.

(D) The City may enter into joint agreements with
other water users for the extension and construction of
water lines. Hoth the City and the water user or users
entering into the joint agreement for water extension
and construciton may enter into reimbursement
agreeements allowed pursuant to paragraph (B) above.
