DEPARTMEIVT REPORTS : \__ u • MERIDIAN CITY COUNCIL AUGUST 4, 1986 Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford at 7:30 p.m.: Members Present: Ron Tolsma, Bert Myers, Bob Giesler: Members Absent: Bill Brewer: Others Present: Roy Porter, Gary Smith, Kenny Bowers, Bob Mitich, Stan Olsen, Ranon Yorgensen, Joe Simunich,Larry Kaufman, Diana Marcum, Wayne Crookston: The Minutes of the previous meeting held July 21, 1986 were approved as written; Motion by Tolsma, second by Giesler: All Yea: Item #1: Public Hearing: Square footage designation Meridian Park: Mayor Kingsford is there a representive of Meridian Park present? Ramon Yorgensen, developer for Meridian Park, our request is for the designation of the square footage as per the City of Meridian Ordinance for home sizes on this phase of our development. The plat was approved prior to this at the time when the 1350 square footage was in effect. Mayor Kingsford, any questions of Mr. Jorgensen, there were none. I will now open the Public Hearing, anyone present who wishes to testify in this matter? Joe Simunich, Mr. Simunich was sworn by the City Attorney. Simunich, I have one question here, it states in the notice that if granted, may also mean changes in the property use and restrictions, what does this entale? Mayor Kingsford, all we are talking about is the square footage, the designation by lot of the size home that can be built on that 1ot. This would mean that the restriction of the 1350 square foot would be changed. The use would still be residential. Simunich, I have reviewed the plat and there is an irrigation ditch on the East of the.property involved and there is no provisions for the irrigation ditch that is there now. City Engineer, I talked to Mr. Jorgensen Engineer and advised him that they needed to get with the property owner and get this ditch thing worked out. I told him that the ditch needed to be realigned and kept open and he said he would. Simunich, I think in these subdivisions some provision should be made for the conveyance of the irrigation water. Larry Kaufman, Mr. Kaufman was sworn by the City Attorney. Kaufman, just a point of clarification, this notice that was sent out, - this is going to be the minimuims~i'ze of homes that can be built on the MERIDIAN CITY COUNCIL i • AUGUST 4, 1986 PAGE # 2 lots? Mayor Kingsford, Yes, if adopted. Kaufman, who checks that they are built to this size? Mayor Kingsford, the Building Inspector. Kaufman, my concern is that there are previously built some homes that were not 1000 square foot, so a few of them slipped by. Mr. Kaufman was advised that the Council had prior approved the reduction of 100 square feet in the minimiums in the subdivision. Another concern is that there is only one access into this subdivision. Is there any plans to have another access to this subdiviision? City Engineer, if the property to the East does develop the plan calls for a bridge acrass Five Mile Creek for additional access or if the property develops to the South there would be additional access. Mayor Kingsford, anyone else from the public who wishes to comment? There was no response, the Public Hearing was closed. Any comments from the Council? Tolsma, I can see Mr. Simunichs problem, I would like to see that worked out first. Mayor Kingsford, I think it could be approved conditionally on the problem of the ditch being resolved. The Motion was made by Tolsma and seconded by Giesler that the square footage designation on the lots in Meridian Park #z, Phase II construction be approved conditionally upon the irrigation problem being resolved. Motion Carried: Al1 Yea: Item #2: Public Hearing: Annexation & Zoning request by C& O Construction: Mayor Kingsford is there someone present to represent this request? Stan Olsen, upon approval of this request we wi11 submit for a Conditional Use Permit and design review of the project, and I am here basically to answer any questions the Mayor & Council might have. Mayor Kingsford, any question of the Council of Mr. Olsen? Tolsma, all we have before us tonite then, is just the conditional Annex~~ti~n& Zoning? Mr. Tolsma was advised that was so, they would have to come back later for the other items. Mayor Kingsford, opened the Public Hearing, there was no one present who wished to testify on the matter, the Public Hearing was closed. The Motion was made by Myers and seconded by Tolsma to approve and adopt the Finding of Fact and Conclusions of Law as prepared for the Planning & Zoning Commission on the request for Annexation & Zoning by C& 0 Construction. • . . . MERIDIAN CITY COUNCIL • ~ AUGUST 4, 1986 PAGE # 3 Motion Carried: Roll Call Vote: Giesler, Yea: Myers, Yea: Tolsma, Yea: The Motion was made by Myers and seconded by Giesler to have the City Attorney draw a Resolution to conditionally Annex and Zone the property described in the application of C& O Construction. Motion Carried: All Yea: Item #3: Resolution #106: Mayor Kingsford, a Resolution of the City of Meridian, Idaho, providing for the Conditional Annexation and Zoning of Lots 1, 2 and 3 of Block 2, Doris Subdivision, Ada County, Idaho, Is there anyone present who wishes Resolution #106 read in its entirety? There was no response. This is the Michels property. The Motion was made by Myers and seconded by Giesler to approve Resolution #106. Motion Carried: All Yea: Item #4: Pre-Termination Hearing Water/Sewer/Trash De~inquencies: Mayor Kingsford, You have been informed in writing, if you choose to, you have the right to a pre-termination hearing before the Mayor.& Council to appear in person to be judged on facts and defend the claim made by the City that your water, sewer and trash bill is delinquent. You may retain Counse7.: Is there anyone present who wishes a pre-termination hearing? Diana Marcum, 55 East Ada, Account # 60266: Marcum asked for an expla- nation of why the difference in water usage and why her sewer bill for March was higher when she used the same amount of water in June. It was explained to her that we had summer average starting in April. The City Engineer was instructed to investigate this account: Mayor Kingsford, due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on August 12, 1986. In order to have their water turned back on, there will be an additional fee of $10.00: They are hereby informed that they may appeal or_have.the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal the water will be shut off. The Motion was made by Myers and seconded by Tolsma to approve the turn- off list with the exception of account # 60266. Motion Carried: Al1 Yea: Mayor Kingsford, the amount of the delinquencies is $4598.00: Item # 5: Approve the Bills: The Motion was made by Tolsma and seconded by Myers to approve payment of the bil].s: ~ . , ~ MERIDIAN CITY COUNCIL • ~ AUGUST 4, 1986 PAGE # 4: Motion Carried: All Yea: Item #6: Comments on Vacation of 5tate Street: The Council Members are to submit written comments to the City Clerk to be included in a letter to the Highway District. Mayor Kingsford, another item which has been brought to the attention of the Council is that the extension granted Hoalst & Anderson on their parking is up and the Council needs to make a decision on what should be done. It was the consensus of the Council to have this item on the agenda for the next Council Meeting scheduTed for August 18, 1986. Mayor Kingsford, the other item I have is we need to know what the Council decision as far as membership to the APA for budget purposes. There was discussion on this item. The Motion was made by Tolsma and seconded by Myers that the City join the APA for a period of one year at a cost of $600.00: Motion Carried: All Yea: Department Reports: Crookston, I had a request from the County Prosecuters Office to review the Area of Impact Agreements, how shouTd I proceed on this. Mr. Myers, advised he had attended the meeting and it was tabled until the August 18 meeting. Mr. Crookston was advised to be in contact with Councilman Myers on this. Myers, I feel that the City shouTd write a Letter of thank you for the support and effort given the City by Mr. Wayne Forrey. The City Clerk was instructed to write this letter. The Creamery problem was discussed.
