Hoalst, I am here to request an extension of the parking requirements that we had at our office at 1434 Meridian Street. We feel we have provided adequate parking with the use of the Church Parking lot across the Street. You have in your file from Pastor Roberts a letter that asks us to continue to use their parking lot for safety reasons to prevent people from short cutting. through their lot. This has worked out very well for parking for our employees. This has not caused any traffic..- problem. With our long range plans in which we planned on building a office complex going through to East First Street. This being the case if we were to put a blacktop parking area in it would have to be torn out when we expand. So what we are asking is that the Council grant an extension on the on site parking. Giesler, Did we approve the parking across the Street at the church, I do not remember , it seems we had some concern as there was not a crosswalk at this location. Mayor, when. the last extension was granted I don't believe we approved or disapproved the parking at the church. I know there was some concern about not having a crosswalk. Myers, have you had any traffic problems there at a11, addressing the Police Chief? Chief, to my knowledge we have not had any ,pedestrian problem there. Myers, rather than having to grant all these extensions, it might be better to redo the Permit and take the parking out, or substitute the parking across the street. Mayor Kingsford, I think you have a problem in doing that as under the Ordinances a commercial building. has to have a certain number of park- ing spaces based on the square footage. I think you would be setting a precedence if you allowed parking from a different enitity to satisfy that provision. Any other comments of the Council? MERIDIAN CITY COUNCIL • • AUGUST 18, 19.86 PAGE # 2 Brewer, in the long range plans, Mr. Hoalst said this would have to be torn out, I do not think that should have any bearing on the issue now, if a parking lot was built and served you for ten years it would be worth while whether it was torn up or not. I hate to keep renewing and renewing it, to me that kind of sets a precedence that we have to deal with, with other people. I have set here with_ the hopes that each time you came forward that you would be ready to pursue taking care of the parking problem. We are kind of setting a precedence with dealing with you the way we are, even now and I think we have been really lenient on the issue. Hoalst, if there was not adequate parking in the area then there would certainly be the need to build it. We do not feel it has created a traffic hazard as we have room for our customers to park at our location. Brewer, I am sure it has not created a traffic problem, in going back over the history of this, I have a problem about the fact you were exited about getting the job done and now it appears you are going to a long range plan and you do not want to do the job at a11, as far as furnishing your own parking. There was more discussion on this item. Mayor Kingsford, I might make a suggestion, I suggest that we grant a one year extension and a definate must be arrived at and Mr. Hoalst & Mr. Anderson have to come in and in some format express what. they are going to do and get. that approved. The Motion was made by .Brewer and seconded by .Giesler. that Hoalst & Anderson be granted a one year extension from-this date and during that time or at the end of that time Hoalst & Anderson come forward with a definate plan for their on site parking. Motion Carried: All Yea: Item #2: Tenative Budget: Mayor Kingsford, Resolution #107 authorizing publication of an estimate of expenses for all purposes for the 1986/87 Fiscal Year and setting a Public Hearing date prior to passage of the annual appropriation bill. The total amount of the budget is $3,441,861.00. I think the Council should be aware that the substancial increase, portions of ,that have put in construction account over a period of time for a new City Hall and part of that is from a construction fund. that.. has been in existence since 1977 that will be used for additions to the sewer plant. The Motion was made by Giesler and. seconded by Tolsma to approve Resolution #107 pertaining to the tentative budget. Motion Carried: All Yea: Item # 3: Resolution #108: Mayor Kingsford, Resolution #108 is a resolution for. the Cond~:t~.:or.~.l Annexation of the C & O Counstruction property located North of Cherry MERIDIAN CITY COUNCIL ~ • AUGUST 18, 1986 PAGE # 3: Plaza. The Motion was made by Tolsma and seconded by Myers to approve Resolution #108,Conc~itzonal Annexation of the C & O Construction property. Motion Carried: All Yea: Item #4: Appointment of New Member to EDC Board: Mayor Kingsford, Mr. Morgan Edwards has resigned from the EDC Board and I have approached Tom Hammond to replace him. I would like to nominate him for this position, this term expires March, 1989. The Motion was made by Myers and seconded by Giesler to appoint Tom Hammond to the EDC Board to fill the term vacated by Morgan Edwards. Motion Carried: All Yea: Item #5: Update on Letter of Credit for Eagle Road Mall Site: Mayor Kingsford, the letter you have came in today, I do not know whether you have had time to read. it, it is a little confusing. I visited with the individual from First Interstate and Marv Gibbons who is representing a developer in California. What they are proposing and what I told him I would ask the Council to do tonite is to extend their ability to preform through the first meeting in September. What they are proposing doing instead of a letter of .credit is they are setting up an escrow account with escrow instructions basically that meet the contract we had prior to this, the only thing that would be changed would be the developers name, Price Development would be eliminated and it would be Claremont & Pacific Development. The Motion was made by Brewer and seconded by Tolsma to grant Claremont Development Company & their development partner until the first Council meeting in September to work out and complete an escrow agreement on the the development agreement for the Eagle Road Mall Site. Motion Carried: A11 Yea: Department Reports: City Attorney, we appeared in Court today on the-Amyx situation and the trial date was vacated due to other trail being scheduled at the same time and now a new date will have to be set. Mayor Kingsford, the next meeting will be held on Tuesday, September 2, 1986 due to Monday being a Legal Holiday. Mayor Kingsford, we also need a motion by ,the Council to approve the schematic drawing for the new City Hall and to proceed with the design development of .this project. The Motion was made by Myers and seconded by Brewer to approve the schenatic drawings and proceed with-the design development of the new City Ha11 project. Motion Carried: All Yea: . . It was explained that this was according to the Zoning &. Development Ordinance and a variance would be required to remove this provision. The demand we have for parking there seems to be served with the space we now have. Most of the work we do is by appointment so we do not have a bunch of traffic at one time. Brewer, I would like to elude to the orginal agreement again but I have talked with Mr. Anderson and we have to rememberthat they are start- ing out a new business not an existing business and I believe they feel they are not financially able to make that improvement at this time. I will go along with the rest of the Council on this. Tolsma, I have a question, are we going to have a problem later on if we grant this? Mayor Kingsford, my view is everything the Council does has a precedence setting nature and I think this is possibly of, that nature. Brewer, I might make one more statement, Mr. Anderson if you should get an extension tonite we want to know your sincerity as far as completing that project ar~d putting a parking lot as orginally planned. Anderson, we feel the requirement stands, it was a condition of our approval, we would just like a little more time to complete, it presents no problem there with that, if things grow the way they have the last year, I think another year would be about right. The Motion was made by Brewer to extend the requirement of the parking lot for one more year. Motion died for lack of second. The Motion was made by Giesler and seconded by Brewer to transfer the beer and wine license of the Farmers Club from Pat Rogers to Authur Moore: Motion Carried: All Yea: Item #3: Audit Report: Mayor Kingsford, I would like to defer this item until the next meeting. We visited with the auditor tonite and believe it would be in the best interest of the City to haee an explanatory note added to the report. The Motion was made by Breuer and seconded by Giesler to table this item until the February 3, 1986 meeting. And are pleased to this. Phis is a protection to us and th® children of the neighborhood, as it had become quite dangerous, as many people were cutting across the southeast corner, either coming off Elm Street thru the Parking lot, or coming off Meridian Street and onto Elm Street at a very fast rate of speed. 'Phis endangered many children, who play there almost daily on 7,~~.r• skates, bicycles and tricycles. None of t'~ose children are m®mbers of the Church. Also a number of times some of the adult m®mbers working here or walking by narrowly missed being hit. This had been reported to the police, who tried, but it is very hard to stop this kind of action. On July 29, 1986, Mr. Rohwer received an interoffice correspondence from George Telford, Vice President/Manager of the commercial banking department for First Interstate Bank of Idaho, N.A. in that interoffice correspondence, Mr. Telford acknowledged that the request for bank credit accommodations presented on behalf of the Cora Campbell Allen Trust and the Howard E. Allen Trust appeared to be a bankable request. Mr. Telford requested a review of a "rough draft" of a letter of credit arrangement and the terms and conditions that attached to the letter. In addition, the Bank would anticipate the pledge of the real property owned by the trust estate and the land must appraise for a minimum of $750,000. In discussing the terms and conditions to attach to the letter of credit with the developers of the property, guarantees, assignments, first rights of refusal, substitu- tions, and various other matters were discussed. It became clear to us as trustee, that it would be easier, quicker and more consistent with the development agreement if the developer would obtain the letter of credit or other ° •~ • August 18, 1986 Page Two • suitable collateral consistent with the development agree- ment. This would avoid the restriction of the real property being pledged as collateral and would eliminate numerous conditions of concern to us as trustee. It is our understanding that the developer will offer an escrow acceptable to the city of Meridian in lieu of the letter of credit. The escrow appears to be more consistent with the development agreement while still providing the adequate collateral and assurance to the city of Meridian for the performance of the development agreement. Therefore, if the escrow is acceptable to the city of Meridian, the trust department will no longer pursue the letter of credit.
