DEPARTMENT REPORTS: • • MERIDIAN CITY COUNC~L FEBRUARY 3, 1986 Regular Meeting of the Meridian City Council called to order by Mayor Grant Kingsford at 7:30 p.m.: Members Present: Bill Brewer, Bert Myers, Bob Giesler: Members Absent: Ron Tolsma: Others Present: Todd Devine, Roy Porter, Ryan Bateman, Steve Wherry, Lee Nelson, Kenny Bowers, Gary Smith, Bob Spencer, Tom Cole, Wayne Crookston, Ronda Lowe, Mikki Wofford, Michelle Harris The Motion was made by Myers and seeonded by Giesler to approve the Minutes of the previous meeting held December 16, 1985 as written: ~U r~~ ~ Motion Carried: All Yea: Item #1: Transfer of Beer License from Lee Nelson to Crow Company, Inc: Mayor Kingsford, Chief Porter do you have any problems with this? Porter, I have checked this out and have no problems. The Motion was made by Brewer and seconded by Giesler to approve the transfer of the Beer License from Lee Nelson to Crow Company, Inc: Motion Carried: All Yea: Item #2: Application for Wine License by Crow Company, Inc: Council was advised that the State License had been issued for Crow Company, Inc: The Motion was made by Myers and seconded by Brewer to approve the Wine License for Crow Company, Inc.: Motion Carried: Al1 Yea: Item #3: Pre-Termination Hearing Water/Sewer/Trash Delinquencies: Mayor Kingsford, this is to inform you in writing, if you choose to, you have the right to a pre-termination hearing, before the Mayor & Council, to apprear in person to be judged on facts and defend the claim made by the City that your water/sewer and trash bill is delinquent. You may retain Counsel. This service will be discontinued February 11, 1986 unless payment is received in full. Is there anyone in the audience who wishes to be heard? There was no response. Due to their failure to pay their water bill or present any valid reason why the bill has not been paid, their water shall be turned off on February 11, 1986. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal, the water will be shut off. MERIDIAN CITY COUNCIL • • FEBRUARY 3, 1986 PAGE # 2 The Motion was made by Myers and seconded by Brewer to approve the turn- off list: Motion Carried: All Yea: Mayor Kingsford, the total amount of the delinquencies amounts to $6282.80: Item #4: Approve the Bills: The Motion was made by Myers and seconded by Giesler to approve the Bills: Motion Carried: Al1 Yea: Item #5: Approve the Audit Report: Mayor Kingsford, this was tabled at the last meeting for the purpose of making one correction as to how the funds received on the Revolving Loan Fund Grant were displayed, this has now been corrected. Are there any questions of the Council? There was no response. The Motion was made by Myers and seconded by Brewer to approve the Audit Report for the Fiscal Year 1984/85 as prepared by Grant Thornton & Co. Motion Carried: All Yea: Item #6: Request by Todd Devine for Ice Cream & Hot Dog Stand at Phillip 66: Mr. Devine was presence to present his proposal to the Council: Devine, I would like approval of the Council to build an 8x12 ice cream hot dog type of stand at the station on East First Street, similar to the one that is set up at Smiths Food King, it would be basically for ice cream milkshakes and frosted root beer. It will meet all of the building code requirements and also all of the Department of Health requirements. Mayor Kingsford, the property now is in our Old Town Zone and the Zoning Adminstrator had some problem approving this as under the old Ordinances it was Commercial Zone. Therefore it was thought that the Council should decide whether to approve this under the old zoning or have a Conditional Use Permit under the new zoning. It is similar to the Snow Cone at Smiths with the exception that that is Commercial Zone and this is Old Town. Crookston, under the old Ordinances this would be allowed when we passed the new Zoning Ordinances that made that area Old TownZone any change of use no matter what required a Conditional Use. We at a later date passed an amendment that allowed upon the Councils approval if the Zoning Admin- istrator wants it approved if something was of such a nature that was allowed under the old Ordinance he could either approve or request that the Council make a decision on this. Myers, are you going to have running water in this? Devine, it would be a self contained system. CITY COUNCIL • • FEBRUARY 3, 1986 PAGE # 3 Brewer, I have a problem with this, from the standpoint of what he is planning to sell it becomes a restaurant where you do have to have on site toilet facilities. Devine, it would not be something you would be able to enter, it woulcl be something you would walk up to, there would be no seating. Brewer, a drive-in, where are you proposing to set this on the property? Devine, the building would be set on the North side of the present building and would be set back from the Street. Brewer, you are prepared to meet all the codes and health standards? Devine, anyth.ing that has to be done to meet Building Dept. requirements, will be done. Brewer, from what I can see you are looking about 20 to 30 thousand dollars, are you prepared to do that? Devine, if that is what it takes to do it, I do not think it will be quite that high. Brewer, you make reference to the sno-cone shack down at Smith's, they are selling sno-cones out of a little very professional prepared hutch, they are not working with food items you are proposing to sell, this to me is going to be a drive-in restaurant, so therefore you are going to have to meet all the codes, it is not going in on skids as far as I am concerned, you are going to have to put in foundation and make literly a drive-in restaurant there. Devine, I do not think so, according to the Department of Health, the items I have spoken to which I wish to vend and I have spoken to, I do not need a foundation and can be built on skids, it is very similar to, we are going to in fact one of the items is the Italian Ice along with the Ice Cream. It is not a drive-in restaurant g~~~ay as the Burger Den, it is basically ice cream, this will be eighty percent basically of the offering. Brewer, lets make reference to our Building Inspector, still as far as I am concerned it is a drive-in restaurant, the materials you are going to be handling and everything, granted you may be abiding to the Health Dep- artment requirements but we have our own building code, electrical, etc. and I would like to ask him how he feels about these initial drawings. Mitich, you would have to ask for a Variance for building on skids, the Code does not address a building on skids they have to be on a foundation. the rest of it, it is a rough drawing as to what is there so I can not tell much about it. Devine, when we submit for the actual permit after we get beyond this point, it will meet all of the Building Codes. Whatever the requirements are we wi11 meet. I do want to point out though so you do not get the wrong idea this is basically going to do the same thing as the building though a bit larger, not that much though as the building that is setting on Smith's. Building will be professionally designed and professionally made. Devine, ~ can ' say at this time, I am definately sure at this time I will have hershey's ice cream, milkshakes, root beer floats, mug root beer and cokes, that is basically what we are going to market, I had compilated the polish sausage type thing and after talking to the Health they said I must have the self contained water and that which I would definately have. Brewer, due~the fact this is located in our Old Town area, I would like to see a great more detailed drawing pertaining to plumbing, electrical and the building itsself, I would like to table this for a given period of time, at least for a month so this information can be presented to the Council and we have time to look over it. Giesler, so we do not set a precedence on something like this that might come before us later on I would like thi~_~_~ea come before us with the new Ordinances rather than the old ones, I think it should be handled that way, they were passed. Myers, I do not have a problem with Ice Cream and Ice but do with the sausages as you have to have something to cook on there. Devine, the sausage thing we talked about is not cooking it would be a micro wave type of item. I can guarantee and you might have that for the record, there will be no cooking facilities nersay, there would be a micro-wave oven. Gary Smith, City Engineer, I think the parking should also be addressed. The Motion was made by Brewer and seconded by Giesler to table this matter until the March 3, 1986 meeting. Department Reports: Crookston, City Attorney, The Mayor has asked me to review the Insurance Pool that is in the process of being establish~d through the Association of Idaho Cities and give a report to the Council. Crookston made a presentation of this program to the Council explaining the procedures and coverages that would be provided as well as the costs involved in the City of Meridian becoming a member of this Insurance Pool. It was the cons~sus of the Mayor and the Council that Mr. Bert Myers be appointed to study this proposalfurther and report back to the Council. Crookston, I asked the Mayor to approve of the expense I made as the City Attorney attending a seminar for the Association of Idaho Cities Attorneys, The fee was $75.00 for a ten hour seminar. I also asked the MERIDIAN CITY COUNCIL • + FEBRUARY 3; 1986 PAGE #5 Mayor if I could bill the City for the 10 hours spent there and I am basically asking that this be approved. I am required to go to CLE seminars and this qualifies as 10 hours of this required time. There was discussion by the Mayor & Council on this item: The Motion was made by Brewer and seconded by Giesler to approve the $75.00 expenditure for the seminar and approve the billing of the City for one-half or five hours of the time spent: Motion Carried: Al1 Yea: Mayor Kingsford, I would at this time like to welcome a member of Scout Troop # 82 who is present tonite: Chief Bowers, as you know we have retired all of the numbers on our Fire Trucks and I would like to present Mr. Brewer, Fire Commissioner, with the plate off of the Meridian City Fire Truck: Brewer, I would like to see the time limit on the portable electric signs enforced, some of these have been up for as long as one year. I believe the City has some type of policy on these and believe it should be enforced. This is a ninety day time limit and they should be obtaining electrical permits when installed, we should be able to follow the time by these permits.
