The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for this site. This CZC does not approve the relocation of the ezisting garage. A Conditional Use Permit is in process to move the garage closer to the ezisting home. If this CUP is not approved, the applicant will need to remove the garage from the site. Occupancy will not be granted for the shop until either the CUP is approved, or the garage removed. _ a ~ecific Conditions for Li t Industry Use , C 11-4-3-25~ 1) All mechanical equipment emissions; shipping and/or delivery; or other outdoor activity areas shall be located a minimum of three hundred feet (300') from any abutting residential districts, or the use is subject to a conditional use permit. 2) The application shall identify how the proposed use will address the impacts of noise and other emissions on adjoining residential districts. More specifically, the following adverse effects shall be mitigated through setbacks, buffers, sound attenuation and/or hours of operation: a. Noise, odor, or vibrations, or direct or reflected glare detectable by the human senses without the aid of instruments. b. Radioactivity and electric or electromagnetic disturbances that unduly interfere with the normal operation of equipment, instruments, or appliances on abutting properties. c. Any other emission or radiation that endangers human health, results in damages to vegetation or property or which exceeds health and safety standards. d. In the event that the director determines that the applicant cannot adequately address such impacts, the use shall be subject to conditional use approval. Site Plan: The Site Plan prepazed by Litzinger Construction, on 2/28/2008, is approved (stamped "Approved" on July 3, 2008 by the Meridian Planning Department) with the following changes/notes: 1) All off street parking areas and driveways shall be improved with a compacted gravel base, not less than four inches (4") thick, surfaced with dustless material, including, but not limited to, asphalt, concrete, pavers, bricks, or recycled asphalt (UDC 11-3C-SB.1); 2) All parking and loading areas shall provide proper drainage of surface water to prevent the drainage of such water onto adjacent properties or walkways (UDC 11-3C-SB.2); 3) The drive aisle shall be a minimum of nineteen (19) feet wide (UDC Table 11-3C-5); 4) All parking areas shall provide on site turnaround in accord with the Meridian fire department standards (UDC 11-3C-5A.7). Other than the above-mentioned changes, the approved site plan is not to be altered without prior written approval of the Planning Department. Landscaping: The Landscape Plan prepazed by William Kerwin, is approved (stamped "Approved" on July 3, 2008 by the Meridian Planning Department) with the following changes/notes: 1) Provide 2 additional trees on site for alternative compliance to the 5 foot landscape buffer along the. eastern perimeter of the driveway. Other than the above-mentioned changes, the approved landscape plan is not to be altered without prior written approval of the Planning Department. No field changes to landscape plan permitted; prior written approval of all material changes is required. Prior to final inspection and sign off for this project, a written certificate of completion shall be submitted to the Planning Department, prepared by a landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, aze in substantial compliance with the approved landscape plan. Elevations: The Elevations prepared by Litzinger Construction (Sheet A-1, dated 11-26-07) aze approved with no changes from the Planning Department. Irri aga~on: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with UDC 11-3A-15. Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Pazks Department Arborist (Elroy Huff, 8.88-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced incompliance with UDC 11- 3B-10-C.5. P~ The proposed pazlcing azeas shall be paved and striped in accordance with UDC 11-3C and 11-3B. Project engineer/architect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed accessible. Curbing: Per UDC 11-3B-SI, all landscape azeas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Stom1 water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Li tin :Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance with UDC 11-3D. Trash Enclosure: All dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap-Accessibility: The structure, site improvements and parking azeas must be in compliance with all federal handicap-accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACRD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is unlawful to use or occupy any building or structure until the Building Official has issued a certificate of occupancy. A certificate of occupancy or temporary certificate of occupancy is obtained from the Building Department (208) 887-2211 after inspections are complete and the field inspection record is returned to the Building Department. Plan Modifications: Except for the changes mentioned above, the approved Site/Landscape Plan stamped "Approved" on July 3, 2008, and Elevations, and aze not to be altered without prior written approval of the Planning Department. No significant field changes to the site or landscape plans aze permitted; prior written approval of all changes is required.
