not release the applicant from any previous requirements of the other permits issued for this site.
1) The applicant is requesting to cover 3,796 square feet of outdoor storage area to the east of the existing
structure. In addition to having inadequate parking, the current site does not comply with the UDC's
requirements for landscaping. However, UDC 11-3B-2Dl states that for additions less than twenty five percent
of the existing structure or developed area, no additional landscaping shall be required. The existing building
is curTently 17,509 square feet, this would allow for an additional 4,377 square feet (25%) before Arnold
Machinery would need to comply with certain landscaping requirements. The proposed exterior alteration is
3,796 square feet (approximately 22% of the allowed addition before landscaping is required). Arnold
Machinery is allowed no more than 581 square feet of future addition before landscaping requirements come
into effect.
2) The Meridian Planning Department has determined the on-site parking a non -conforming use. The current
parking lot does not provide an adequate number of stalls per the gross floor area nor does it comply with
Meridian's current landscape parking requirements. UDC 11-1114 states non -conforming uses msiy continue
as long as the use remains lawful and is not expanded or extended. A non -conforming use may be extended to
occupy additional land area only throughthe approval of a conditional use permit. Furthermore, no existing
structure containing a nonconforming use may be enlarged, extended, constructed, reconstructed, moved or
structurally altered except through the approval of a conditional use permit or the use of the structure is
changed to a conforming use. The applicant is proposing an exterior alteration to cover 3,796 square feet of
existing storage area on the east side of the building. Because the storage area is less than 25% of the existing
structure and because it is considered uninhabitable space, Arnold Machinery is not required to add
additional parking or come into compliance with perimeter landscaping. However, the parking lot and
landscaping on the site are non -conforming; therefore any future expansions of the site shall be subject to the
requirements of the UDC 11-111-4 and UDC 11-311.
3) Site plans show the material underneath the, storage canopy to be gravel. UDC 11-3C-5111 states that
parking areas, driveways, etc. shall be improved with a compacted gravel base, not less than four inches thick,
surfaces with dustless material, including but not limited to, asphalt, concrete, pavers, bricks, or recycled
asphalt. In an email communication dated June 18,2008, Meridian Planning was assured that the area would
be strictly storage in nature and no vehicles would be parked or stored in that area. Arnold Machinery will be
required to submit for a CZC prior to paving this surface if parldng or driving vehicles in this area is planned.
Site/Landscom
!_&. The Site/Landscape Plan prepared by BRS Architects, dated June 2008 (revised July 10, 2008),
labeled SD -1, is approved (stamped "Approved" on July 23, 2008 by the Meridian Planning Department) with no
changes. Landscaping on the site currently exists and changes are not proposed with this CZC application. The
existing landscaping shall be retained and protected during the construction period.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree
Preservation section ofthe City's Landscape Ordinance. Per UDC 1 1-3B- 10, coordinate with the Parks Department
Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to
construction. Any severely damaged tree must be replaced in compliance with UDC 11 -3B -10-C.5.
Elevations: The Elevations prepared by BRS Architects, dated June 2008, labeled EL- 1 are approved with no changes
from the Planning Department.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved
specifications and in accordance with UDC 11 -3A- 15.
Parking: Project engineer/architect shall certify that the number and size of handicap -accessible spaces conforms to
the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA
and signed accessible. As mentioned above, the current parldng lot is a nonconforming use. Any enlargements
or improvements to this use will require Arnold Machinery to comply with the standards set forth in the
Unified Development Code.
Fencin : Current site plans show existing chain-link fencing along the east, north and south sides of the building to
screen outdoor service and equipment areas. Per UDC 11-3A-12, outdoor service and equipment areas shall be
incorporated into the overall design of buildings and landscaping so that the visual and acoustic impacts of these
functions are fully contained and out ofview from adjacent properties and public streets. Per UDC 1 1 -3B -5K chain-
link fencing with or without slats does not qualify as a screening material. Armold Machinery has opted to screen
storage area from Overland road through a combination of shrubs and. vinyl or cedar fencing.
Curbin : Per UDC I I -3B-51, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must
be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm
water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11 -3A-1 7. Sidewalks shall be constructed prior to
occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3: 1, shall be fully vegetated, and shall be
designed in compliance with UDC 11 -3B-1 1 and UDC 11-3A-1 8.
Lightin : Lighting shall not cause glare or impact the traveling public or neighboring development and
comply with lighting standards as defined in UDC 11-3A-11.
Signyge: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance
with UDC 11-313. 1
HandicWAccessibil : The structure, site improvements and parking areas must be in compliance with all federal
handicap -accessibility requirements.
ACHD Acce"ce: All impact fees, if any, shall be paid prior to the issuance of a building permit If any changes
must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City
of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occppan : All required improvements must be complete prior to obtaining a Certificate of Occupancy.
All changes *in* occupancy need to comply with the requirements ofthe Building Department. It is unlawful to use or
occupy any building or structure until the Building Official has issued a certificate of occupancy. A certificate of
occupancy or temporary certificate of occupancy is obtained from the Building Department (208) 887-2211 after
inspections are complete and the field inspection record is returned to the Building Department,
Plan Modifications: The approved Site/Landscape Plan stamped "Approved" on July 23,2008 and Elevations are not
to be altered without prior written approval of the Planning Department. No significant field changes to the site or
landscape plans are permitted; prior written approval of all changes is required.

Thanks for the update and email prompt. I went out to the site and took a bunch of photos, but we're having
trouble getting the photos off of the camera. I'll get you the photos tomorrow. In short, the site plan you have is
very accurate. Paved where shown and graveled where shown. The only difference is that the area under and
nearby the proposed canopy is recycled asphalt.

Hi Joe,
I am just emailing you to provide you with an update and my email address. The site itself has some
non -conforming issues (which do not really affect this current project). However, if the company is
planning on using that storage area for vehicles and are planning on driving around in that area
and/or parking vehicles in the storage area, the existing gravel shown will not be in compliance in
our code. Arnold's would be required to pave that surface (LTDC 11 - 3C- 5B 1).
If Arnolds Machinery is just planning to use that area truly as storage, the gravel would be allowed to
remain. If this is the case please send me a revised narrative explaining what will be occurring on the
premises. Thanks for all your hard work. Feel free to call if you have any questions or concerns.
