Where adjoining a residential property or district, all repair activities (including, but not limited to, open pits and lifts) shall occur within an enclosed structure. B. Inoperable or dismantled motor vehicles shall be stored behind a closed vision fence, wall, or screen or within an enclosed structure and shall not be visible from the street. Vehicle repair may be allowed as an accessory use, subject to the standazds for vehicle repair, major and minor, in the district where the use is located. B. Inoperable or dismantled motor vehicles shall be stored behind a closed vision fence, wall, or screen or within an enclosed structure and shall not be visible from any street. C. Automotive sales and rental azeas shall be subject to the minimum perimeter landscape requirement of pazlcing azeas in chapter 3, article B, "Landscaping Requirements", of this title. D. In addition to chanter 3, article B, "Landscaping Requirements", of this title, one square foot of landscaping for every fifty (50) square feet of vehicle display area, and one tree for every two hundred (200) square feet of parking area shall be provided. (Ord. 05-1170, 8-30-2005, eff. 9-15- 2005) 2) UDC 11-4-3-38 one square foot of landscaping for every fifty (50) square feet of vehicle display area, and one tree for every two hundred (200) square feet of parking area. Based on staff s calculation, the applicant shall provide a minimum of 432 square feet of landscaping on the site. The applicant is proposing additional landscaping (12' X 50') in the southwest corner of the site to comply with this UDC requirement. 3) No more than siz vehicles shall be parked on the site for the purpose of vehicle sales as shown on the submitted site/landscape plan dated 7/2/08. Alternative Com hp •ance: The applicant is requesting alternative compliance for the 40-foot perimeter landscape requirement adjacent to W. Railroad Street. With the approval of the first CZC on the site for vehicle repair (CZC-04-075), a paving plan showing the on-site pazking lot and alley improvements was approved by ACHD. The applicant proceeded to pave the pazking lot and alley as approved. Now, the applicant wishes to establish a vehicle sale lot on the property. The alternative compliance narrative states the 10-foot landscape strip adjacent to the W Railroad (southwest corner) would impede vehicle approach entering the one way the alley at the rear of the site. The applicant believes the paving is more appropriate than landscaping and requests no landscaping be required. Because the applicant is not proposing any modifications and has complied with the approved paving plan, no additional landscaping will be required at the southwest comer of the site. However, Staff is advising the applicant that additional landscaping is required for vehicle display areas as noted above in the vehicle sales specific use standards. Landscaping shall be provided in accordance with Condition 2 above and with redlines change mentioned in the siteflandscape section below. Site/Landsca ev Plan: The Site/Landscape Plan dated July 2, 2008, is approved (stamped "Approved" on July 14, 2008 by the Meridian Planning Department) with the following redlines: 1) Provide one tree to the landscape in the southwest corner of the site. The approved site/landscape plan is not to be altered without prior written approval of the Planning Department. Elevations: Elevations were not reviewed with this application. Furthermore, no modifications to the exterior of the buildings aze being proposed with this application. Irri ag tion: An underground, pressurized irrigation system must be installed to all landscape azeas per the approved specifications and in accordance with UDC 11-3A-15. Protection of Existing Tom: Any existing trees on site must be protected or mitigated for in accordance with the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction. Any severely damaged tree must be replaced incompliance with UDC 11- 3B-10-C.5. Pazkin~: The proposed parking areas shall be paved and striped in accordance with UDC 11-3C and 11-3B. Project engineer/azchitect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed accessible. Curbing: Per UDC 11-3B-SI, all landscape azeas adjacent to driveways, parking lots, or other vehicle use azeas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water runoff. Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18. Li tin :Lighting shall not cause glare or impact the traveling public or neighboring development and comply with lighting standards as defined in UDC 11-3A-11. Signage: No signs are approved with this CZC. All business signs will require a sepazate sign permit in compliance with UDC 11-3D. Trash Enclosure: The applicant states that trash will be taken to the curb and that a trash enclosure will not be provided on the site. If a dumpster is provided in the future, the dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash enclosures must be built in the location and to the size approved by SSC. Handicap-Accessibility: The structure, site improvements and parking areas must be in compliance with all federal handicap-accessibility requirements. ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit. The project consists of two (2) elements 1) permission to conduct automobile sales at this site, and 2) installation of a paint booth within the existing shop building at this site. The site has been used as an automotive repair facility, as permitted by a previous Certificate of Zoning Compliance and Building Permit. We believe all conditions of the previous applications and permits have been met. The proposed change in use is to allow minor automobile sales at this site. The applicant proposes to place a few [not over six (6)] vehicles for sale, all contained within the existing high solid wood fence, and within the existing paved/concrete surface area. This is indicated on the Site Plan provided herewith. The applicant also proposes to install a paint booth within the existing building, as an interior non-structural tenant improvement. We believe that this is compliant with the applicable zoning rules. We request approval of alternative compliance for one (1) element :the existing pavement at the Southeast corner of the property. This pavement is shown on the Site Plan submitted herewith, and is in compliance with arequest/suggestion by Ada County Highway District. The alley immediately adjacent and to the East of this project is very narrow, and the pavement placed on the Southeast corner of the property facilitates access to the alley. If the area were landscaped in strict accordance with landscaping requirements, the turn into the alley would be quite difficult, and surely result in eventual accident and/or damage to the landscaping at this location. We therefore suggest that the paving is more appropriate 'at this location than would be the landscaping, and respectfully request approval of this element as an alternative compliance with the requirement for landscaping.
