1984 10-04! !, MERIDIAN CITY COUNCIL OCTOBER 4, 1984 Special Meeting of Meridian City Council called to order by Mayor Grant Kingsford at 7:30 P.M. Members Present: Bill Brewer, Ron Tolsma, Bert Myers, Bob Giesler Others Present: Mr. & Mrs. Oren Mayes, George Wendt, Gary Smith, Bob Spencer Wayne Crookston. The purpose of this Special Meeting was a Public Hearing on the Meridian Impact Area. Mayor opened the meeting for Public Testimony. There was no response. Public Hearing was closed. The Motion was made by Brewer and seconded by Tolsma to have the City Attorney prepare the Findings of Fact and Conclusions of Law and the necessary Resolutions and Ordinances as required to adopt the Meridian Impact Area. Motion Carried: All Yea The Motion was made by Myers and seconded by Brewer to adjourn until such time as the representatives from.JUB Engineers were present to conduct the workshop on the Water & Sewer Rate Study, this occured at 7:35 P.M. Motion Carried: All Yea Mayor Kingsford reconvened the meeting at 8:00, P.M. Mr. Chuck Larson was present from JUB engineers to explain the computations and recommendations contained in the Water & Sewer Rate Study prepared by his firm. Mr. Chuck Larson also answered any questions from the Mayor & Council. It was the concensus of the Council that they would need to digest this report further before any action was taken. The Motion was made by Myers and seconded Tolsma to adjourn this Special Meeting of the Meridian City Gouncil at 9:25 P.M. Minutes of the last Regular Meeting held September 17, 1984 were approved as written. Minutes of the Special Meeting held September 24, 1984 were approved as written. Item #1. Discussion of Air Quality Ordinance. Mr. Dell Tredinnick from the Air Quality Board was present to answer questions from the Council and the Public. Mr. Tredinnick handed out to the Mayor and Council copies of the rules and regulations governing this program. Councilman Myers, is this program self-supporting? Mr. Tredinnick, this program was funded under a 100% grant but should be self-supporting from the sale of stickers after it has been in effect for a time. Myers, will you be staying here or moving to a different place to set up this program? Tredinnick, this program is scheduled to run for three year~ and I will be here throughout this time. Councilman Tolsma, are these rules and regulations unchangeable for the three years? Tredinnick, no the rules are set up so if any problems develop they can be changed. Councilman Giesler, do you have any figures on the percent of adjustments being made? Tredinnick, the data has not all be entered as yet and some of the ~.nspection stations are making adjustments and not marking these ~djustments on the forms, we hope to have some good data by the end of January. Wayne Crookston, City Attorney, at the top of page seven of the sample ordinance is this crossed out or underlined? Tredinnick, this is crossed out. 2 . ' • • Crookston, on page 14 does this appl~ to the ordinance and how.would this work, if Meridian adopted would they have their own board? Tredinnick, there would be only one board, set by Ada County, on which Meridian would have members. This Board would be equal reprsentation. There was more discussion (Tape on File) Mayor Kingsford advised that a motion was necessary to instruct the Attorney draw up a Ordinance covering the Air Quality and recommended the Council proceed with this. The motion was made by Giesler and seconded by Brewer to have the City Attorney prepare the necessary Ordinance that fills the needs of the City of Meridian to adopt the Air Quality Ordinance. Motion Carried: Brewer, Yea, Tolsma, Yea, Giesler, Yea, Myers, Nay. Item #2. Request for hookup to City Sewer by Jim & Sherry Witt at 300 North Linder Road. Mr. Jim Witt was present to represent this request. Mr. Witt stated they were having problems with their septic system and would like to hookup to the City Sewer which runs in front of their property on Linder Road. He advised the Council that he had checked on the cost of extending city water and that it would be 14 to 15 thousand dolla~s to extend to their property, but that he would be willing to put a meter on his well. Mayor Kingsford; Mr. Witt you realize the hookup fee is double and the monthly charge is double when you are not in the city limits. Mr. Witt; Advised that he had been informed of that. Motion was made by Myers and seconded by Tolsma to approve the request of Jim & Sherry Witt to hookup to the city sewer with a double hookup fee. The double average monthly sewer charge based on 6,500 gallons water usage. Motion Carried- All Yea (ITEM #3)- Pretermination Hearirig- W/S/T/ Delinquincies. Mayor Grant Kingsford Read; This is to inform you in writing if you choose you have the right to a pretermination hearing at 7:30 p.m. Sept. 4th, 1984 before the Mayor and Council, to appear in person to be judged on the facts and defend the claim made by the City of Meridian that your water/ sewer / trash bill is delinquent, you may retain council. This service will be discontinued .~2c~:.~ _29 , 1984 unless payment is received in full. Mayor Kingsford asked if there was anyone present who wished to have a hearing. No One Was Present. 3 ., • • • Mayor Kingsford Read; due to their failure to pay their water bill or present any valid reason why the bill has not been paid, their water shall be turned off on dcbj:. ~U,1984. In order to have their water turned back on there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City be reviewed by the Fourth Judicial District Court, pursuant of Idaho Code, even though they appeal the water will be shut off. The total amount overdue was $4,555.65 The motion was made by Giesler and seconded by Myers to approve the turn off of the delinquent customers. Motion Carried-Al1 Yea (ITEM #4)- Bills Motion was made by Tolsma and seconded by Giesler to approve the Bills. Motion Carried- All Yea Mayor Kingsford stated that the council needed to approve the purchase of Lot 9 0~: By The Lake at Cherry Lane Subdivision for a price of $17,000 which has been negotiated with the owner. The motion was made by Tolsma and seconded by Myers ~o approve this purchase. Motion Carrried- All Yea Mayor Kingsford complimented the Valley News and Mr . GaPy--Sfia€f~~-=for the oustanding job they were doing and a~ked Mr. Shaffer to pass this on to Mr. Wherry. Therefore being there no further business to come before the council the motion was made by Myers and seconded by Tolsma to adjourn at 8:05P.M. Motin Carried- All Yea. I1. DEFINITIONS A. "Emfsslons Mechanic" means a person who has: 1) Quallfied by passing a wrttten and practlcal examinatlon of an Emisslons Mechanic Tralning Program. 2) Successfully demonstrated the abiiity to operate, callbrate and maintatn the requlred analyzers. 3) Has been t~ssued a itcense as an "Emtsslons Mechanic". ' B. ~~A(r puality Board" go~rerntng body of the Automotive lnspectlon and Read~ustment (AIR) Program. C. "Audlfi Gas" means the gas spectfled by the Atr Quality Board to be used for AIR Program station audlts. D. "Au#omotive Inspectlon.and Readjustment Program~~ (AIR) (s the program established by Ada County and Boise City to reduce carbon monoxtde leveis in the Ada County carbon monoxide non-attainment area. E. "Calfbratfon Gas" - are gases of manufacturers~ specifled con- centration whtch are used as references for establlshing or verifytng the calibrat(on curve of an exhaust gas analyzer. F. ~~Certlftcate of Compiiance" - ts that sttcker which certifies annual compl(ance wfth the program. This stlcker is to be affixed to the lower left front windshield. G. ~~Emisstons Mechanic Training Program'~ ls a formal pnogram offered through vocational education, the aduit education system or private instttuttons whlch have been revlewed and approved by the A(r Qualtty Board. H. ~~Em(sslon Test~~ - The annual analysls of the percent carbon monoxtde (CO) emttted from a motor vehtcle at Idle. I. '~Model YeaN~ ts the year shown on the motor vehlcle registratlon. J. "Test Gas" - Authorized AIR Program gas used in weekly analyzer span procedure as described ln Section IV.I. K. '~Motor Vehtcle~~ - As defined by the Idaho Code. -1- i y • • L. "Statton Stgn~~ - The official public destgnatton of an AIR statton. III.EMISSIONS MECHANIC LICENSE A. Applicattons for License Applicatlons for Itcense as an Emissions Mechanics shall be flled with the AIr Quality Board, 650 Matn S#reet, Boise, Idaho 83702. Applicattons for the Em(ssions Mechanics LTcense shall be completed on forms provided by the Alr Quailty Boerd. B . Fees 1. Fees for Emisslons Mechanlc Llcense shall be due upon Issuance or renewal. Payment must be made wtth a check or money order drawn to the Air Quality Board. ~ 2. The fees for the tnitlal and yeariy renewal of the Emissions Mechanic~s License shall be established by the Atr Quality°Board. C. Requirements For issuance Of An Emissions Mechanic Llcense An applicant must demonsfirate the knowledge and skili necessa~y to per- form an emtssions test and adjustment of motor vehlcle engines to manu- facturers spectfications. Such knowledge and skill will be shown by passing:. 1. A written or oral Emtsstons Mechantc~s quallficatlon test given In accordance with an approved training program that tests the applt- cant~s knoaledge ot the followtng: a) Operatlon and purpose of emissions control systems. b) Relationship of HC and CO to tim(ng and carburetton. c) AdJustment of motor vehicles to manufacturers~ spectfications. d) Operatton of an exhaust gas analyzer, tncluding the perfor- mance of a test gas span. Note: If an orat exam is gtven, a written Ifst of answers must accompany the test answer sheet. Use of an interpreter for non-English speaking applicants ts to be provlded by the applt- cant. 2. A test covering the rules~and regulatlons governing the AIR Program. -2 - . . • • 3. A performance test that demonstrates the appltcant~s skill in the performance of the ttems Ilsted in ~a~ through ~e~, below. The performance check sheet signed by an instructor of an Emissions Mechanic~s tralning program is requlred. a) V(suai Inspectlon of the requlred emission control equlpment for 1984 and newer vehlcles. b) pemonstratlon of sktll in the proper analyzer use, care, matntenan.ce, and test gas spanning. c) Demonstration of ablltty to conduct the emissions test and necessary repairs. d) Demonstratlon of abfltty to adjust the engine system to manu- facturers~ speciftcations. e) Demonstration of ablltty to properly use Atr Program data and statlon log book forms. D. Approval Procedure. Applicattons submitted to the Alr Qual(ty Board wtll be revtewed. A check wtit be made to tnsure the mechanlc has successfully passed the Em(ss(ons Mechanlc tratn(ng program. Applicants meeting the requlre- ments of Sectton C wlll ~ tssued an Emissions Mechanic~s Ltcense by the Atr Quallty Board. Appllcants not meettng the requtrements of Section C wlll be denied an Emisstons Mechan(c~s Ltcense. E. Transfer of Emissions Mechanic Ltcense. 1.. The Emiss(ons Mechanfc must notify the Alr Quallty Board in writing within five (5) days, when he/she beglns employment at another Automottve inspect(on and Readjustment Program Statlon or (s no longer employed as an Emisslons Mechanic. 2. The AIR Program statlon must notify the Atr Quallty Board in writing five (5) days after employtng an Emiss(ons Mechanlc who transferred his/her Emtss(ons Mechanlc~s License. F. Lapse of Emissions Mechantcs License 1. It is the responsiblltty of the Em(ssions Mechanic to pursue relicensing. 2. A person to whom the Air Quality Board has Issued an Emisslons Mechanlc~s License and who does not make appitcatlon for renewal pr(or to exptration shall be deemed to have forfetted the satd License and shall be required to pass the Em(sslons Mechan(c~s ' ` Qualtflcatton Test, reapply and remtt the applfcation fee lf a new License Is requested. -3- a . • • G. Requaltficatlon Requirements for Emissions Mechanlc 1. Emfssions Mechanics shall be required to requal(fy if the Air Qualtty Board determines it is necessary to update their technical quaitffcations. 2. The Air Quallty Board wtll mall a not(ce to the Emtsslons Mechanlc~s AIR Program station address spectfiytng requtrements and training schedule. H. Revocation of Emissions Mechanics Llcense The Alr Quality Board has the authortty to suspend or revoke the Emtss(ons Mechanic~s License and require the surrender of the Ltcense upon showing by the record that: a) The Emisslons Mechanic denled the issuance of a Cer#Iflcate of Compltance to a veh(cle which at the ttme of the inspec- t(on was ln such condition that it complled wlth the Ordi- nance.or Rules and Regulations for Issuance of a Certlficate of Compl(ance. b) The Emissions Mechanlc issued a Certificate of Compllance for a vehicie which was in such condition that it dld not at the time comply wtth the ordinance or Rules and Regulatlons for the tssuance of a Certtficate of Complfance. c) The Emisslons Mechantc caused a Certiflcate of Compltance to be issued wlthout an Inspectlon, and required adjustment.s or d(agnosts having been made in accordance wlth Sectlon VI.F. Emisslons Test Procedure. d) The Emissions Tests are not betng performed In accordance with the Ordlnance, Rules and Regulations, and Alr Quality Board policy. 2. Upon findtng that an Emisstons Mechanic has vlolated any provlsion ot H 1(a through d), the Atr Quality Board wtll Immedtately suspend the Emisstons Mechanfc~s Ilcense. The Alr Quality Board will tnvesttgate the violation and prepare a summary report. The Board wtil revlew the report and nottfy tn writing the Emisslons Mechanic of the Board~s dec(ston. LICENSING OF AUTOMOTIVE INSPECTION AND READJUSTMENT PROGRAM STATIONS A. General t. No person or enterprise shall in any manner represent any place as an Automotive Inspect(on and Read~ustment (AIR) Program station unless such statton is operated under a valid AIR Program statfon Ilcense. 2. No license for any AIR Program station may ~ assigned, trans- ferred or used by other than the original applicant for that specifitc statlon. 3. Appl(cations for Iicense as an AIR Program statton shait be made on forms provided by the Atr puallty Board. No Itcense shali be Issued uniess the Air Qual(ty Board finds that the faclllt(es, tools and equtpment of the applicant comply with the requirements set forth In Sectlon IV. C, Requlrements for Licenstng of an AIR Program Statlon. a) Appltcants may choose to limit the performance of Emtsslons Tests to a particular fleet of motor vehicles, make or model, type of vehicle or iist of customers. b) Shouid the AIR Program Station elect to Itmft the performance ofi Emisstons Tests, the station representative must indicate on the application form, the type of motor vehicle or fleet that applicant wlll test. The AIR Program Statlon may be requlred to furnlsh the Air puallty Board with spec(al reports describtng the statlon~s emisstons testtng procedures. c) Should the AIR Program Station destre to expand the em(ssions test(ng servlce to Include new vehlcle types or additional fleets, the AIR Program Station must notlfy the Alr Qualtty Board in wrfting five (5) days prior to performing em(ssions tests on the additlonal motor veh(cles. B. Fees 1. Fees for the tnittal and yeariy Itcense renewal shall be estab~lished by the Air Qualtty Board. 2. Fees for Issuance or renewal of the AIR Program station Iicense shall be due upon Issuance or renewal. Payment must be made wlth a check or money order drawn to the Atr Qualtty Board. C. Requirements for Ltcensing of an AIR Program Station 1. No Itcense to operate an AIR Program station will be issued unless the appltcant ig located at a permanent location and can demonstrate.the abiltty to perform the emtsslons test,.the ~ prescribed adJustments and have ready access to the necessary replacement parts. • ~ -5- • • 2. No I(cense to operate an AIR Program station wlll be issued uniess the facility employs at least one Ond(vidual who has been Issued an Emissions Mechanlc~s Ltcense as prescribed in Sectlon III, Emiss(ons Mechanic L(cense. 3. No Iicense to operate an AIR Program stat(on wlll be issued unless the factlity has an analyzer that meets the 1974 Caltfornia Bureau of Automotive Repalr requlrements and the requirements of Subsectfon 207(b) of the Federal Clean Air Act. 4. The tollowing tools, equlpment and supplies shall be avatlable for ~performance of the emisslons test and for the repatr or adjustment ot vehicies whlch exceed thelr CO percentage standard. a) Equtpment required to perform em(sslons tests: 1) Alr Qualtty Board approved gas analyzer w(th a copy of the manufacturers~ (nstruction, maintenance and calibra- tlon manuai. The manual accompanying each analyzer shall contain at least the following: i. A copy of the Caltfornta Bureau of Automotive Repatr, Department ot Consumer Affalrs, State of Californta Certlftcate of Approval; fi. complete analyzer technical descriptlon; Iit. analyzer functlonal .schematlcs; iv, analyzer modei number; v. analyzer operating ma(ntenance to Include periodtc recommendatlons, I.e. da11y, weekly, monthly and procedures for maintalning sample system Integrtty; vi. analyzer caltbratlon instructfons; vii. analyzer service schedule identlfytng the items needtng malntenance and the procedures to be followed by the purchaser. D. Analyzer Environment. The analyzer must be kept In an environment which complles with the manufacturers specificattons. E. Approvai Procedure 1. Appllcat(ons recetved by the Air Quallty Board wlll be revtewed for completeness and• an Inspection of the facility wlll be per- tormed. An inspectlon ~eport wlli be prepared for the Atr Quallty Board~s revtew. ~ 2. Statlons recelvtng a Itcense as an AIR Program statlon shall operate the factltty according to the requirements and procedures contained in this handbook and all other rules and regutatlons promulgated by the Alr Qualtty Board.. -7- . • 3. Statlons which meet the requirements of Sect(on IV(C) will be granted an Afr Program Station License and issued an AIR Program statlon sign. The station stgn and Air Pragram Station Ltcense shall be posted in a conspicuous place, readily visible to the public. The Station s(gn and Itcense shall rematn the property of the Alr Qualtty Board. 4. Stations not meet(ng the requtrements of Sectton IV(C) wlil be denied an AIR Program Statlon L(cense. F. Lapse of Air Program Station Ltce~se 1. It is the responsiblllty of the licensee to pursue reltcensing. 2. A statton to whfch the Alr Quallty Board has Issued an Alr Program Station Llcense and which does not make an appllcation for renewal of the Atr Program Statlon License prior to the expiration date shali be deemed to have forfelted the Iicense. The statton wtll be requtred to reapply (f a new Air Program Statlon License Is requested. G. Revocation of AIR Program Station License 1. The Atr Qualtty Board has the authority to suspend or revoke the Station L(cense and requt~e the surrender of the License Certtflcate, AIR Program Stat(on stgn and unused Certificates of Compllance upon showtng by the record that: a. The s.tatlon Is not open and avallable to perform em(sslons tests as Indlcated in the statlon Iicense application. b. The Air Quallty Board determtnes that the statton has vidlated any provtslons of this Handbook or any rule or regu- lation properly promulgated for the operatton of an AIR Program statlon. c. Such station is not equtpped as requlred; such statton Is not operating from a locatlon for which the Itcense was tssued, emissions tests are not being performed in ac~ordance wtth appllcable laws, rules and regulattons or the statlon Is allowing the emisstons tests to be performed by an emisslons mechanic who does not have a current Ltcense. 2. A report describing the vlolatlon wtll be prepared and submitted to the Air Qual(ty Board. The Board wlll notlfy the AIR Program statton 1n wrtting of the reasons and Justification for iicense revocatlon. The statton representatlves may request a heartng within five days of written notiftcatlon at whtch tlme the Itcen- see may present evldence, call witnesses and be represented by counsel. Within ten (10) days after written notiftcatton or hearing the Board shall notlfy the IicenSee in writtng of Its decision. . -8- • H. Analyzer Specittcatlons ~ 1. No emissions test required by the AIR Program shall be per- formed unless the type of (nstrument used for measuring the exhaust gases from motor vehicles meets Californta Bureau of Automottve repair standards 1974 and the requirements of Sectton 207(b) of the Clean Alr Act. Coptes of the March 26, 1981 List of Cal(fornla Bureau of Automotive Repatr (BAR) approved ana- lyzers may be obta(ned from the Adm(nlstrator, Alr Quallty Board, 650 Maln, Botse, Idaho 83702. 2. Stations ustng analyzers that meet BAR 74 but do not meet the requirements ofi Sectlon 207b of the Clean Atr Act wlll not be approved as AIR Program stations. 3. Stations possesstng analyzers that meet BAR 74 and 207b requtre- ments which have gone out of productlon and for whtch repalr parts are not readlly available will not be approved as AIR Program sta- t(ons. 4. A manufiacturer not Ilsted on the Californla Bureau of Automotive Repair Approved Analyzer Llst may request the app~oval of an instrument for use in AIR Program stattons. The manufacture may request approval from the Air Quallty Board, 650 Main Street, Boise, ID 83702. AIl manufacturers maktng appllcatlon shall fur- n(sh the followtng: ~ a) Instructlon manuals that describe the operation, maintenance, callbratlon and quallty control procedures of the analyzer. b). Technical speclflcations tncluding schematlcs, design charactertstics, photographs and a prtce tlst which tncludes the base prtce for each modei and the pr(ces of optional accessortes. c) The results of Independent testing whlch demonstrates that exhaust gas analyzers of the model tor whlch approval Is requested meet the minimum criterla contalned In Section IV, H.5. d) Documentation showtng that such analyzers can be approved for use by the State of Callfornla accord(ng to the Cailfornla Bureau of Automotive Repair Exhaust Gas Analyzer ~ec(fications whlch became eftective tn 1974 (BAR 74) or 1980 (BAR 80) or-by an agency whose minlmum standards meet or exceed the specttications of BAR 74 and Sectton 207b of the Clean Atr Act. e) Guarantee that such exhaust analyzers w(11 meet, or dtd meet when originally sold, the mfntmum criteria to be approved for use In AIR Program stat(ons. -9- • • 5. Performance and Deslgn Standards For Exhaust Gas Analyzers The foliowing shall establish the m(nimum criteria for approval of exhaust gas analyze~s which are to be used in AIR Program sta- ttons: a) Accuracy - The hydrocarbon and carbon monoxide sectton of the exhaust gas anal.yzer shall each have an accuracy of + 3 percent of full scale. - b) Warm-Up Ttme - The exhaust gas analyzer shall reach stabllized operation within 30 minutes from power-on at amblent temperatures of 70°F (21°C) and 110°F (43°C) and wtthtn 60 minutes from power-on at ambtent temperatures of 35°F (2°C). c) Humidity Operating ~ange - The exhaust gas analyzer must pro- ' periy operate in environments up to 85 percent relative humidity (non-condensing). d) Interference Effects - The tnterference effects of non- tnterest gases, particulates and normal water vapor shall not be greater than ±1 percent of ful) scale durtng normal opera- tion. e) Power Requirements - The exhaust gas analyzer shall operate on 115 voit alternating current (VAC), 60 hertz or dlrect current (DC). The exhaust gas analyzer shall perform to the - stated standards with voltage fluctuations of +~p_percent. f) Repeatabiltty - The exhaust gas analyzer repeatability shali be wlthin +2 percent of full scale during five (5) successive samples of the same gas source. g) Safety Requlrements - The tnstrument shall meet the safety requtrements referenced tn 36 Federal Reg(ster 105 dated May 29, 1971. h) Sample Handling System - AII materials of the sample handltng system that come into contact wtth the gas sample, tncluding tallp(pe extenders, shall not contam(nate nor change the character of the gases to be analyzed. AIl Interna~l surfaces shall be corroslon resistant to vehlcle exhaust gases and constructed of such materfals as to minimlze molecular hydro- carbon.hang-up effect. I) System Response Time - The exhaust gas analyzer concentration shall read 90 percent of the ffnal stabllized reading within ten (10) seconds after a step change in concentration level ls Inttlated at the tailpipe sample probe Inlet. -10- , . • • J) Temperature Operattnq Ranqe - The exhaust gas analyzer shali operate within the speclfled performance il~tts tn amblent atr temperatures from 35°F (2°C) to 110°F (43°C> whlie exposed to wind from zero to 10 mph (16 kph). The exhaust gas analyzer shall be unaffected by amblent atr temperatures ~ot 0°F (18°C) to 130°F (54°C) when in storage. k) Drift - Zero and span drlft of warmed-up exhaust gas analyzer shali not be greater than + 3 percent of full scale durtng one hour of operatlon. f. Test Gas Specif(cattons 1. Test Gas Blend a) The test gas used for~spanning exhaust gas analyzers supplted to AIR Program stations shall be a tri-blend of Nydrocarbon (HC) and Carbon Monox(de (CO) in a base of Nltrogen (N2). The Hydrocarbon shall be Propane. The HC and CO con- centrattons must be within the range below: HC: 220-880 parts per mtlllon (ppm) Propane C0: 0.6-2.4 percent Carbon Monoxlde '" b) The accuracy of the test gas blend shall be and certifled by the biender to be within + 2 percent of labeled concentration and traceable to the National Bureau of Standards. 2. Contatners a) Test gases shail be supplled In containers which meet all the provisions of the Occupational Safety and Health Adminlstratton (OSHA), as specified In 36 Federai Regtster 105, dated May 29, 1971. b) Contalners may be etther low pressure, 7.5 cubic foot DOT 39 non-rechargeable bottles or ff high pressure reuseable cyl(nder type, they must meet the following requirements: 1) The cylinder shall meet DOT speclf(cattons for 1-A, 3-A, 3-AA, T, or equlvalent cyllnders. 2) The rated servtce pressure shall be a minlmum of 1800 psl. 3) GGA-350 dlaphragm packless valves shall,be tnstalled in the cyltnders. _~ , • 3. Production ~ a) The gas biender shall produce the test gas in batch form. A batch shali be constdered to be any number of cylinders of identical concentrations produced at any given blending. b) The gas supplier shail provlde the Air Quality Board one (1) bottle of gas selected at random from each batch. The Alr Qualtty Board reserves the right to request addittona) samples if deemed necessary. These samples will be checked to vertfy the concentrations specified in Section IV, 1., 1, a. c) The gas blender must follow the biending procedure Ilsted fn the technical report, EPA Recommended Practice For Naming ~ I/M Cal(brat(on Gas, EPA-AA-TSS-83-8-B, September 1983. The gas supplier must provide the Atr Qualtty Board wtth documen- tat(on that will certify the gas was blended accordtng to the above procedu~e. Coptes of the practice are avallabie trom the Alr Qualtty Board. 4. Gas Supplter Records a) For each batch blended, a record must be kept by the gas _ supplter as to the whereabouts of each bottle sold. These records must ~ made available to the Air Quality Board. The records must be kept for one year from the ttrne the last bottle of the batch ts sold to an AIR Program statlon. 5. Batch Recall Procedure In the event a batch of test gas is suspected as being out of the specificatlons Iisted in Section IV, I., 1,~a. The Atr Qualtty Board wlll follow the procedure below: a) The Alr Qualtty Board wtl) request the gas biender to (ocate all of the bottles from the batch. b) A check to vertfy the cylinder concentratlon wtll be made. c) If the batch ls aonf(rmed to be out of spectftcatlons, the gas supplter w(fl be notlfied In writing. The gas suppller will have 14 days from the.time of notificatton to provtde the Atr Program stations new bottles of test gas. d) The replacement test gas musf ~ produced and undergo the same name verPflcatlon and approval as spec(fied above. e) A count ot the recalled gas bottles and any bottles whlch were not located or recalled, for any reason, will be pro- vided to the Atr~Qualtty Board. No person shall in any manner represent any place as an AIR Program stat(on for the performance of emissions tests unless the statlon has obtained an AIR Program station (icense. 2. No person shall perform an AIR Program veh(cle exhaust emisslons tests at a Itcensed Air Program station unless he/she possesses a valid Emisstons Mechanic~s License. 3. The statlon Is requlred to notify the Atr Quallty Board In wr(ttng five (5) days after employing an Emtssions Mechanic. 4. The statlon is required to nottfy the Alr Quality Board wtthln five (5) days of terminating an Emisstons Mechanlc. 5. Noncompliance with any sectlon of this handbook or any rules or regulatlons promulgated by the Alr Quality Board can be Justif(ca- tlon for denial, suspenslon or revocatlon of either the statton Ilcense or the Emiss(ons Mechantc~s License or both. B. Alternate Fuel Identlftcatton AIR Program Stations are requtred to (dentify motor veh(cles that do not have gasoline eng(nes. Vehicle owners may bring their motor vehicles to any AIR P~ogram Statlon to have their vehlcle fdentifted. The Licensed Emissions Mechanic wlll verlfy the Information on the data form wtth the motor vehlcle~s registration. If the owner does not have a data form, copy the regtstratlon informatlon onto a data form, enter the`fuei type, record the station and mechanics number, stgn and date the torm. The Afr Quality Board~s copy of the data forms are to be mailed to the Alr Qual(ty Board. C. Certtficates of Compllance 1. General a> No person shall make, issue or knowtngly use any Imitatton or counterfe(t Certlftcate ot Compltance wtndow sticker that des(gnates the motor vehtcle complies wlth the AIR Program. b) No person shall possess a Certificate of Compliance If he knows the same ts counterfeit or was issued for another motor vehicle, or was t~ssued without an Emtsstons.Test havtng been made. -13- • • c) Certificates of Compliance are not to be sold, loaned, trans- ferred or given to other AIR Program statlons or tndtviduals. The AIR Program.statlon shall be able to account for aii Ce~tlt(cates of Compitance that have been purchased by that statlon. d) AIl unused Certificates of Compllance shali be kept In a secure manner. e) Any Certlflcates of Compllance found to be mtsstng, stolen or unaccounted tor, shall be reported to the Alr Quality Board fn writing wtthln twenty-four hours. f) Upon transfier of ownership or terminat(on of the station, the license and all Certlficates of Compliance must be immedlately forwarded to the Air Qual(ty Board. g) Upon the canceilatton or revocatlon of the Air Program Statlon Ltcense of any station, the Air Quallty Board shall collect unused Cerfilficates of Compliance and refund to the station the money collected for these cert(ftcates. 2. Purchase of Certificates of Compliance a) Any person acquirtng a business which has been licensed as an AIR Program statton Is prohibited from using eFther the AIR Program Station L(cense or Certiflcates of Compliance issued to the former business. b) Certiftcates of Compliance may be purchased by the statlon representative from the Air Quality Board office, 650 Ma(n Street, Bolse, Idaho 83702. Payment must be made wtth a check or money order drawn to the Air Qual(ty Board. c) Sales requests wlll be accepted only from a representatlve of the AIR Program statlon possessing an acceptable form of tdentiftcatton. The full purchase prtce will be collected at the time of the request. ~ . d) Cost of the Certiflcate of Compllance will be.establlshed by the Alr Qua.lity Board. The certificates wlll be avallable for purchase in lots of 25, 50, 100 and 500. e) Unused and exptred Certiffcate of Compliance wiil be purchased from the Licensed AIR Program Station by the Air Quallty Board. -14- • D. Quallty Control 1. Qualtty control is the responslbtlity of the AIR Program Statton. ~ 2. Quality Control Tasks: a) Information concerning the results ot the puality Control ,, procedures Is to be recorded on the analyzer Log Book Forms. Log Book Forms are to be kept In good order by the AIR Program statlon and ready for the Alr Qualtty Board~s . monthly inspection. b) Daily procedures: 1> Mechanlcally zero the anatyzer ppm HC and CO percentage scales. 2) Turn the analyzer on. Record the ttme. The analyzer ts required to be left on during normal buslness hours. The statlon Is responsible for the purchase of the test gas, pressure regulator, flow control vaive and a devlce to equalize flow between the gas cylinder and analyzer pump, or other system that equalizes gas pressure and flow from the test gas cylinder to the analyzer. It. Connect th~e test gas cylinder to the analyzer probe. Record the analyzer meter reading. Compare the.analyzer readtng to the test gas concent~atton. The analyzer readtng must be wlthin + 5 percent of the labeled test gas concentratlon. If not withln ± 5 percent the analyzer ts required to be callbrated by authorized personnel. The AIR program statlon is not to perform emisslons test or Issue certlficates of compllance until the analzer readtngs are wtth(n the + 5 percent range of the labeled test gas concentration. 2) Analyzer Leak Check i. Analyzers wtth caltbratton ports. Connect the test gas cyllnder to the callbratton port of the analzer. Record the analyzer meter reading. Compare this reading to the readt,ng obtained ustng the test gas cyltnder connected fio the probe. These readings must be wtthin 3 percent ot each other. If the readings are not withtn 3 percent examtne the sample Ilne and pump for leaks. Conttnue checking the sample handltng system until th~ readtngs are wtthin 3 percent.~ The AIR Program Statton is.not to perform Emisslon Tests or issue Certlficates of Compllance unttl the analzer callbration port and probe readings are wtthin 3 percent. . . ii. Analyzers without calibratlon ports. The leak check IS to be performed by restrtcting the sample gas fiow through the analyzer untll the analyzer Low Flow i.nd(cator Ilght comes on. Perform HC hang-up check. Wtth the analyzer on the low range scale (analog meters), allow the probe to sample zero or room air for 30 seconds. If the hydrocarbon reading is greater than 20 ppm after 30 seconds, then the system should be allowed to purge itself by sampl(ng room a(r. If after 2 minutes of purgtng, the HC reading (s stili greater than 20 ppm HC, the probe and Ilne should be dlsconnected from the analyzer and cieaned (usually by blowing clean, dry compressed air through lt>. Vehicles tested after registratton month: a) Indtviduals who have thelr veh(cles tested after the regtstratton month may be requtred to pay a(ate charge, establtshed by the Alr Quality Board. Thus far no late charge penatty has been establlshed. If the tncidence of late regtstrants is great this charge may be instltuted to cover the Increased workload caused by this special process. b) The AIR Program statton shall collect the late charge (mmedlately after performing the Exhaust Emisslons Test. The station representative will mail the data form and the Alr Qualtty Board's portton of the late cha~ge to the Atr Program Administrator, 650 Main Street, BoT.se, Idaho, 83702. VI. EMISSIONS TEST A. General 1. The Emtsstons Test must be performed by a Itcensed Emtsslons Mechanic. 2. The Emissions Test must be performed at a Iicensed Automotlve Inspection b ReadJustment Program Statlon, as described tn Section IV, AIR PROGRAM STATION LICENSING, and Sectlon V, AIR PROGRAM STATION OPERATION. ~ ' 3. A mob.lle Atr Program Statlon must notify, tn wrlttng, the motor vehicle owner prior to performance of an Emissions Test, of how and where a free reinspect(on may be obtatned. B. Applicabillty AII nonexempt motor vehlcles must be inspected at an AIR Statlon on or before the end of the month when sald motor vehlcies must be regtstered or have registratlon renewed. Nonexempt motor vehicies of the model year 1970 and newer registered or required to be registered In Ada County must compiy w(th the yearly Emisstons Test and adJustment proce- dures if the vehlcle exceeds the model year percent CO standards. The motor vehicle engine should not idle for more than two min.utes prior to performance of the Emissions Test. If the vehicle is not warm, have the owner „ drive the vehicle for 2 to 5 minutes. If the vehtcle has been at idle for 2 or more mtnutes, increase the engine RPM to 2500 RPM and hold for 15-20 seconds, then record analyzer read(ng. 2. First Test Procedure It is strongly recommended that.any motor vehlcle covered by Sec- t(on 207b or Sectlon 207a, Warranty Provisions of the Federai Clean Afr Act, have the Emissions Test performed at a(icensed AIR Program si~ation that is also an authorized warranty repatr factltty. a. Vertfy the Information prtnted on the data form wtth the information pr(nted on the motor vehlcle.registratton form. Examine the exhaust system for the presence of the catalyttc converter. Insert the probe tnto the tallpipe, turn the analyzer control to the test mode posltton and after the analyzer stabilizes or after 30 seconds, record the CO percentage and ppm HC readings in the ftrst test block on the data form. If the analyzer does not stabillze after 3.0 seconds, record the highest reading. ~ i. If the exhaust pipe is baftled, a tailptpe extender of at least 12 inches long, and that ffts snugly around tlie exhaust pipe, must be attached prtor to the em(sslons test. 11. It is found and declared that exhaust emissions from motor vehicles are the major source of carbon monoxide air pollution in Ada County~ and such air pollution is a health hazard in Ada CountY. B. It is fu~ther found and declared that an effective system of periodic motor vehicle inspection and maintenance and consumer education wi.ll reduce the level of vehicular air pollution and provide motorists with objective maintenance info~mation regarding their vehicles. ~ ~ C. It is further found and declared that the federal government has mandated to the several states and local entities the ultimate responsibility for periodic motor vehicle in'spection and maintenance. Ada CountY has been desic~nated as a non-attainment area for carbon monoxide and as such is man- dated under the Clean Air Act to implement a motor vehicle inspection and maintenance proqram. - D. The purpose of this ordinance ls to protect the health and •+~elfare of the citizens of Ada County, to provide for the control of air pollutant emissions from motor vehicles above certain levels as determined by the Board and to require annual inspection of certain motor vehicles in order to comply with the Federal Clean Air Act, as amended. _ E. It is further found and declared that fuel economy is a legitimate legislative purpose and that an emission control p'royram will result in motor vehicle fuel savings for the~residents of Ada County. APPRO~'ED EXHAUST GAS A device for sensing the amount of air ANALYZER contaminants, including carbon monoxide in the exhaust emissions of a motor vehicle. The Board sha I I ~.esa-Q.r~ i mp l ement a program for the mandatory annua I exhaust emissions inspection and maintenance of certain motor vehicles registere~ or required to be registered in Ada County including all motor vehicles owned by government entities and public utilities. •~ B. The exhaust emissions inspection o,f each motor vehicle shall .include all of the following: 1. A measurement of the vehicle~s carbo.n monoxide emissions using an approved exhaust gas analyzer or other device as approved by the Board to sample the vehicle~s exhaust. ~'~ - 2. A determination, according to test criteria established pursuant to this Section whether the vehicle's carbon monoxide emissions meets the test criteria. 3. Where applicable, an indication to the vehicle's o~~ner of the probable cause of any malfunction or misadjustment responsi~le for the vshicle's failure to comply with the pass-fail criter.ia developed pursuant to this Section. • C. Any person whose vehicle has been tnspected at an official~emissions insppc- tion station shall, if such vehicle was not found to comply with the pa5s- fail criteria, have the vehicle repair undertaken at the owner~s expense, and have the right within ten (10) calendar days of tfie initial exhaust emissions inspection, but not thereafter, to return such vehicle to the same emissions inspection station for one reinspection without charge. ~ D. This Section shall be implemented on a.mandatory basis effective August 1, 1984. The period of time commencing with the effective date of this Section and ending July 31, 1984, shall serve as a voluntary period of compliance and tr~ial inspection program. Uuring said period, the Board shall: 1. Formulate ~nd submit to each participatiny public agency for adopYion the final standards and regulations necessary to impl~ement the man- datory program; 2. Determine the facilities necessary to commence inspection of vehicles in compliance with this Section. . r M -5- • . 3. Prepare and publish public information to distribute to vehicle owners subject to this Section. 4. Conduct other p~blic information activities in conformity to Section 6--1--3-13 hereof. ~ E. Subsequent to the voluntary compfiance and trial period ending July 31, 1984, ' , . all nonexempt motor - vehicles shail be ~equired to compiy with the inspectTon requirements of ~ this Section et such time as said motor vehicles are required to.reqister or renew registration under Titie 49 of the Idaho Code or upon the expiration . :date of ~ certificate of compliance for said motor vehicle if different "than the registration/renewal date. The certificate of compliance expira- . tion date shall, in all cases, determine the compliance date for reinspec- tion. AIl nonexempt motor vehicles must be inspected annually.._Motor _ vehicles which are under temporary registration which do not have a current certificate of compliance are required to have an emissions test performed within ten (10) calendar days of the expiration of the temporary reqistre- tion. (Temporary registration is valid for 3 working days•> Motor vehicles must be reinspected durin9 the month the certificate of compliance expires. The Rules and Regulations shali require the return of a test data form indi- cating inspection compliance. It shall be Prima facie evidence of a viola- tion of this Section if said form is not returned when r~quired or a certificate of compliance is not displayed. 6--1--3-5: DUTIES AND POWERS OF THE BOARD: A. The Board,~in accordance with the criteria herein expressed, shall fe~a#~ adopt ~-c# ~tu (es and ~iegu I at i ons as are necessary for the implementation and operation of the AIR ProQ~am and amend those s~ra~-i-e~aa-~tules and ~Regulations from time to time as it deems necessary_.A~ such amendments must be made at regularly scheduled Air ualit Board meetings with fourteen (14) days uP blic notice of such meetinys. There is hereby established a Motor Vehicle Emissions Inspection Fund whi~ch shall consist of the fo~llowing: 1. Money appropriated thereto by any local entity; 2. Federal or state funds to assist the'implementation and administration of the emissions inspection proyram; B. t~loneys in the motor vehicle emissions inspection fund may be used in paying costs incurred by the Board in administering any aspect of the emissions ~ inspection program. • C. The Board shall appropriate and budget on a fiscal year basis, ~n ~ccordencp with the statutpry requirements of #he member aqencies indicatinq expen- ditures to be made in implee~entation and administration ofi the motor vehicle emissions inspection progra~ established according to this Secti~on. The budget shall include indicaiion of sources of incoms to be used for such + ~ expend.iture and justification for the magnitude of the inspection fee to be levied according to this Section. ~ 6--1--3-7: INSPECTION CRITERIA AND COSTS:. The Board shall make known to owners of subject vehicles the purpose of the vehicle emissions inspection program. A program of inestings, public hearings, mass media coverage, or any other form of communication shall be prescribed and provided, to orient and educate the public ~egarding the pur- pose of the emissions inspection program, as well as to elic.it public par- ticipation in the development and operation of the inspection program. B. The Board shall prepare public informafion for the benefit of the o~+rners of motof vehicles subject to the provisions of this Section. This information shall explain the inspection program, the owner's responsibilities~ under the prograr~, and the most comm~n adJustments and repairs likely to be required in order for the owner's vehicle to pas.s inspection. It shall further pro- vide the locations of stations at which the inspection requirement can be met, scheduling informatio~, and information ot the location and availabi- lity of inechanics to perform repairs for the inspection program. I't shall be distributed by the Board to owners of motor vehicles subject ~o the pro- visions of this Section, fre~ of charge at the time at which they are offi- cialty informed of the inspection requirement. r -14- ~ • . ~' C.'
