The regular meeting of the Meridian City Council called to order at 7:30
p.m. by Mayor Grant Kingsford.
Members Present: Bill Brewer, Ron Tolsma, Bert Myers, Bob Giesler.
Others Present: Dale Newberry, Lloyd Howe, Doug Nichols, Greg Walker,
Wilma Blair, Bill Barkell, Kenny Bowers, Joel Johnson, Chris Johnson,
Steve Gratton, Moe Alidjani, Lee Roy Nelson, Gary Schaffer, Sara Ewing,
Curt Dietz, Charles Liggett, Max Boesinger, Wayne Gibbs, Earl Ward,
Bob Spencer, Tom Cole, Wa1t Morrow, Gary Smith, Bob Mitich, Larry Grant,
Wayne Crookston, Rex Harrison.
Minutes of previous Meeting held October 15, 1984 were approved as
written.
Mayor Kingsford welcomed members of Scout Troop #128 and #129 who were
in attendance at the Council Meeting for Merit Badge credits.
Mayor Kingsford read a Proclamation proclaiming the week of November
4-10, 1984 as Key Club Week. (Proclamation on file with these minutes).
Mayor Kingsford reconized and congratulated Mr. Moe Alidjani who was
present at the Council Meeting on receiving the Meridian Chamber of
Commerce "Man of the Year" Award.
Item #l: Public Hearing, to adopt Industrial Bond Resolution for
Newberry Enterprises.
Mayor Ringsford opened the meeting for Public Hearing.
There was no comment, hearing closed.
The Motion was made by Brewer and seconded by Tolsma to approve
Resolution #93 to adopt and grant final approval of Bond Resolution
#4 of the Economic Development Corporation of the City of Meridian
for the issuance of the Corporations Industrial Revenue Bonds to t
Newberry Enterprises in the amount of $400,000.00 and execution of.
the documents necessary thereto.
Motion Carried: Brewer, Yea: Tolsma, Yea: Myers, Yea: Giesler, Yea:
Item #2: Public Hearing, Annexation and Zoning Request by Upland Industries.
Mayor Kingsford opened the meeting for Public Hearing.
There was no testimony, hearing closed.
The Motion was made by Giesler and seconded by Brewer to approve the
Findings of Fact and Conclusions asprepared for the Meridian Planning
and Zoning Commission.
Motion Carried: Al1 Yea.
The Motion was made by Giesler and seconded by Brewer to approve the
annexation and zoning request by Upland Industriesof the Johnson
property.

Item #3: Public Hearing, Annexation & Zoning Request by Rex Harrison.
Mayor Kingsford opened the meeting for Public Hearing.
There was no response, hearing closed.
Mayor Kingsford, any questions of the Council?
Councilman Giesler, any problems with the comments?
Councilman Giesler was advised Mr. Harrison had no problems with the
comments or recommendations.
The Motion was made by Tolsma and seconded by Brewer to approve the
Findings of Fact and Conclusions as prepared for the Planning &
Zoning Commission.
Motion Carried: All Yea.
The Motion was made by Tolsma and seconded by Brewer to approve the
Annexation and Zoning request of Rex Harrison and that Water and Sewer
Hookup fees be paid in advance.
Motion Carried: Al1 Yea.
Item #4: Public Hearing, Variance, Preliminary and Final Plat of
Sunnybrook Farms #4.
Mr. Wayne Gibbs, JUB Engineers was present to represent this request.
Mayor Kingsford opened the meeting for Public Hearing.
There was no testimony, hearing closed.
Mayor Kingsford, Mr. Gibbs are all the residents in Sunnybrook aware
of the Park, Lot#1, Block 14, and the assessments that will be required
for upkeep?
Mr. Gibbs, Sunnybrook #1 will not be assessed, but in Sunnybrook #2
and #3 this was part of the recorded covenants on these phases the
same as it will be in Sunnybrook #4.
The Motion was made by Brewer and seconded by Giesler to approve the
Variance as requested.
Motion Carried: Al1 Yea.
The Motion was made by Brewer and seconded by Tolsma to approve the
Preliminary and Final Plat of Sunnybrook #4.
Motion Carried; All Yea.
Mr. Max Boesiger asked the Mayor and Council about the possibility
of having water meter's and building permits before Street is paved
and not having square footage designated on plat. This is to be
researched and answer to be given later.

Item #5: Public Hearing, Variance, Preliminary and Final Plat Meridian
Place Subdivision # 2:
Mayor Kingsford opened the meeting for Public Hearing.
There was no comment, hearing closed.
Mr. Wayne Gibbs, JUB Engineers, who was present representing this
request advised the Council that the covenants submitted prior were
not correct and presented a corrected copy of the covenants, he also
asked that the Council include two items in their approval for the
School District benefit, these items are that the two accesses to
the School Site were sufficient and that there would be no further
request for additional access at time of construction and that Lot #2
Block 6 be designated as an educational site.
Motion was made by Brewer and seconded by Tolsma to grant the Variances
requested in Meridian Place Subdivision #2.
Motion Carried: All Yea.
The Motion was made by Brewer and seconded by Tolsma to approve the
Preliminary and Final Plat of Meridian Place Subdivision #2 and that
Lot #2, Block 6 be designated as an educational site and that no
further access will be required other than that shown on plat.
Motion Carried: All Yea.
The Motion was made by Brewer and seconded by Giesler to have City
Attorney review the new covenants before the plat is signed by the
City Clerk.
Motion Carried; All Yea.
Item #6: Pre-Termination Hearing, Water, Sewer, Trash Deliquencies.
Mayor Kingsford read, This is to inform you in writing, if you choose
to, you have the right to a pre-termination hearing, at 7:30 p.m.
November 5, 1984 before the Mayor and Council, to appear in person to
be judged on facts and defend the claim made by the City that your
water, sewer and trash biZl is delinquent. You may retain counsel.
This service will be discontinued on November i4, 1984 unless payment
is received in full. Is there anyone in the audience who wishes to have
a hearing?
Mrs. Wilma Blair, 1239 W. 2nd was present and presented a money order
in the amount of $54.90 which covered her overdue bill.
No one else was present.
Mayor Kingsford, Due to the failure to pay their water bill or to
present any valid reason why the bill has not been paid, their water
shall be turned off on November 14, 1984. In order to have their
water turned back on, there will be an additional fee of $10.00. They
are hereby informed that they may appeal or have the decision of the
City reviewed by the Fourth Judicial District Court, pursuant to Idaho
Code. Even though they appeal, the water will be shut off.

Mayor Kingsford stated the total amount of deliquencies were $4432.80.
The Motion was made by Giesler and seconded by Myers to approve the
turn-off list.
Motion Carried: All Yea.
Mr. Charles Liggett, 2084 LeAnn Way, advised the Mayor and CounCil that
he had been unable to hear and had a question on Sunnybrook Farms #4
as to whether or not the square footage designation of the homes were
required as in Sunnybrook #3.
Mayor Kingsford advised Mr. Liggett that the square footage was des-
ignated on the plat according to City Ordinance.
Mr. Liggett, I have no objections then to this request.
Item #7: Bills.
The Motion was made by Tolsma and seconded by Brewer to approve the
bills.
Motion Carried: Al1 Yea.
Item #8: Ordinance #441.
Mayor Kingsford read, An Ordinance providing for the control of air
pollutant emissions from motor vehicles above certain levels as det-
ermined by the Air Quality Board, requiring annual inspections of
motor vehicles, providing for exemptions of certain vehicles, requir-
ing inspection fees, establishing (the authority for issuing licenses
for emmissions inspection stations, providing for the promulgation
of rules and regulations for the enforcement of this ordinance, and
providing penalties for the violation of the ordinance, to be effective
upon approval hereof, Is there anyone in the audience who wishes
Ordinance #441 read in its entirety? No response.
The Motion was made by Giesler and seconded by Tolsma that the rules
and provisions of 50-902 and all rules and provisions requiring that
Ordinances be read on three different days be dispensed with and that
Ordinance Number 441 as read be passed and approved.
Motion Carried: Brewer, Nay; Tolsma, Yea; Myers, Nay; Giesler, Yea;
Mayor Kingsford broke a tie vote and cast a yea vote, therefore
Motion carried.
Item #9: Resolution # 94.
Mayor Kingsford read, a resolution authorizing the City of Meridian's
agreement and excutions of the Joint Powers agreement pertaining to
motor vehicle emissions control,is there anyone in the audience who
wishes Resolution #94 read in its entirety?
There was no response.
The Motion was made by Brewer and seconded by Myers to approve Resolut-
ion # 94.

Item #10: Ordinance# 442.
Mayor Kingsford read, Upland Industries-Johnson Annexation, an
Ordinance annexing and zoning certain real property which is
described as the Northwest Quarter of the Southwest Quarter of
the Northwest Quarter of Section 9, Township 3 North, Range 1 East,
Boise-Meridian, is there anyone in the audience who wishes Ord-
inance #442 read in its entirety?
There was no response.
The Motion was made by Myers and seconded by Tolsma that the rules
and provisions of 50-902 and all rules and provisions requiring that
Ordinances be read on three different days be dispensed with and
that Ordinance Number 442 as read be passed and approved.
Motion Carried: Al1 Yea.
Item #11: Ordinance # 443.
Mayor Kingsford read, Rex Harrision Annexation, an Ordinance annexing
and zoning certain real property wh ich is described as a tract of
land in the NWQ NW; of Section 11, T. 3N, R. 1W, B.M. Ada County,
Idaho, is there anyone in the audience who wishes Ordinance #443
read in its entirety?
There was no response.
The Motion was made by Tolsma and seconded by Giesler that the rules
and provisions of 50-902 and all rules and provisions requiring
that Ordinances be read on three different days be dispensed with
and that Ordinance Number 443 as read be passed and approved.
Motion Carried: All Yea.
Department Reports:
Mayor Kingsford brought up the matter of the persons going through
the City at the present time passing out flyers for the service of
painting house numbers on curbs. He advised that this was in no
way endorsed by the City. He also stated he was not in favor of
the passing of flyers in the residential areas and would like to
investigate the possibility of a Ordinance against door-drops.
The Motion was made by Brewer and seconded by Giesler to have the
City Attorney check into an Ordinance against door-drops.
Motion Carried: All Yea.
Gary Smith, City Engineer: You have received the revised Rate Study
and would the Mayor and Council want to have a workshop to go over
this as well as the Policy Statement which was submitted prior.
It was the concensus of the Mayor and Council to schedule a workshop
on November 15, 1984 at 7:30 p.m. to review the Rate Study as well

as the Policy Statement and that the Water and Sewer Department Heads
be present.
Councilman Tolsma, the Water Department included a new pickup in their
1984/85 budget and in checking around on prices we have found a new
1984 Ford 150 for $8,444.00. This pickup would fit the needs of the
Water Department and is the best price found. I am asking for Council
approval to purc:hase this unit.
The Motion was made by Myers and seconded by Brewer to approve the
purchase of 1984 Ford 150 Pickup for the Water Department in the amount
of $8,444.00.
Motipn Carried: All Yea

made by Meyers and seconded by Tolsma to adjourn at 8:35 p.m.

Section 2 LEGISLATIVE FINDIN~S ~ND PURPOSE.
l~. It is found and declare~ that exhaust emissions f_rom motor

vehicles are the major source of carbon monoxide air pol-
lution in Ada County and the City of Tderidian and such air
pollution is a health hazard in Ada County of whi~h the City
of r4eridian is a part.
B. It is further found and declared that an effective system of
periodic motor vehicle inspection and maintenance and consumer
education will reduce the level of vehicular air pollution and
provide motorists with objective maintenance information re-
garding their vehicles.
C. It is further found and declared that the federal government
has mandated t~ the several states and local entities the
ultimate responsibility for periodic motor vehicle inspection
and maintenance. Ada County has been designated as a:non-
attainment area for carbon monoxide and as such is mandated
under the Clean Air Act to implement a motor vehicle in-
spection and maintenance proc~ram; that the Gity of r~eri~.~an
is in Ada County and an integral part thereof.

welfare of the citizens of PZeridian, to provide for the con-
trol of air pollutant emissions from motor vehicles above

mate legislative purpose and that an emission control program
will result in motor vehicle fuel savings for the residents
of Meridian. ~
F. It is further found and declared that the adoption of this
Section is pursuan~t to ~6e~tion 49-582 (t) , Id$hv Code - and
that this Section is temporary and e~erimental in natu~e and

Section 3 DEFINITIONS: : AIR PRO~R1~2--The ;P~utomotive Inspection
and Readjustment Froc~ram established kiy the Air
Quality Board in accordance wit:~ this Section which
implements and operates the annual idle emissions test
for 1970 and newer gas powered motor vehicles under
8500 gross vehicle weight. This action ~s~ablishes
an "idle test" that meets the requirements ~or "r2otor
Vehicles ; Emission Cont~rol System Perfo~nance Warranty
Short Tests", Zisted in Section 2D7 (b) of` the Clean
Air Act, 42 tJ.S.C. 754I(b) .

AUTOA40TIVE INSPECTION AND READJUSTP~fENT {AIR) STATION--
A facility which meets the requirements of the Board
and is so equipped as to enable a vehicle e~aust gas
emissions inspection and any necessary adjustments to
?~e performed and which is owned or operated by a person
licensed by the Board to operate an emissions insnectio
station.
BOARD--The Air ~uality Board. It shall be an entit~
created pursuant to the provisions of Title 67, Chapter
23 of the Idaho Code. The composition and organization
of the Board shall be as set forth in the joint powers
agreement executed subsequent to this Section by the
participatiny public agencies.
CARBON r20NOXIDE---The chemical compound containing one
atom of carbon and one atom of ~~gen.
CE?2TIFICATE OF CO!`~PLIANCE--A sticker containinc~ a
certified statement that the vehicle described therein
is in compliance with the requirements of this Section
and the rec~ulations adopted pursuant to this ordinance.
It shall ~ae displayed in a visible area of the lower
Zeft front windshield of a motor ve?zicle. It shall be
issued on an annual basis to every nonexem~t motor
vehicle complying with inspection in conformity to
this Section and the regulations of the Baard.
EMISSIONS MECHANIC--An individual licensed in accord-
ance with Board specifications to inspect and adust
motor vehicles with are subject to the authomobile
inspection program.

MODEL YEAR--The year designated by the Idaho Department
of Transportation Motor Vehicle Certificate of
Registration.
MOTOR VEHICLE--Any self-propelled, gasoline fueled or
gasoline mixed fueled vehicle with f.our.or more wheels
in contact with the graund.and weighing.more than
1,500 poun~s but less than 8,500 pounds gross vehicle
weight, rec~istered or required to. be regi5tered in Ada
County. For the purposes of this Section, the follow-
ing motor vehicles shall be ex.empt from compliance.
Motorcycles as defined in Section ~9-101, Idaho Code;
"Idaho Old Timers" as defined in Section 49-134, Idaho
Code ;
Farm tractors as defined in Section 49-101, Idaho Code~
Vehicles with a model year prior to and including 1969;
Such other types of. motor vehicles as may be exempted
by rules and regulations adopted pursuant to this
Section.
P40TOR VEHICLE O~JNER--A person whose name appears as
owner on the r4otor Vehicle Certificate o~ Registration.
Al1 owners shall be subject to the enforcement and
penalties of this Section for noncompliance with the
motor vehicle requirements of this Section.

Section 4 INSPECTION-MAINTENANCE PROGRAI!~i CREATED:
A. The Board shall impleMent a program for the mandatory annual
exhaust emissions inspection and maintenance o~ certain motor
vehicle.s registered or required to be rec~istered -in~`.~da ~ounty
including a11. motor vehicles owned by government ,ent~.ties and
public utilities.
B. The exhaust emissions inspection of each~;ii~otor,vehicle shall
include all of the follo~ainy: ~~
l. A measurement of the vehicle's cax'bon monoxide emissions
using an a~proved exhaust gas analyzer or other'device
as approved by the Board,to sample the vehicle's exhaust.
2. A determination, according to test criteria established
pursuant to this Section as to whether the ve'~icle~s
carbon monoxide emissions meets the test criteria.

C. Any person whose vehicle has been inspected at an official
emissions inspection station shall, if such vehicle ~aas not found

(10) calendar days o~ the initial exhaust emission~ inspection,
b ut not thereafter, to return such vehicle to the same emi.ssions
inspection station for on~ reinspection without charge.
D. Subsequent to the adoption and effective date o~ this Or~
dinance, all nonexempt motor vehicles shall be regui.red to corlply
with the inspection requirements of this Section at such time as
said motor vehicles are required to rec~ister or renew regi.stratio
under Title 49 of the Idaho Code or upon the expiration date o,f
any cerfificate of compliance for said motor vehicle i~ different
than the registration/renewal date. The certificate of complianc
expiration date shall, in all cases, determine the compliance
date for reinspection. ~11 nonexempt motor vehicles must be
inspected annually. Motor vehicles which are under temporary
registration which do not have a current certificate of complianc
are required to have an emissions test perfarmed within ten (10)

calendar days of the expiration of the temporary registration.
(Temnorary registration is valid for 3 working days.) 2~otor
vehicl~~ must be reinspected during the month the certificate of
compliance expires. The .Rules and Regualtions shall require the
return ~f a test data form indicating inspection compliance. It
shall be prima facie evidence of a violation of_ this Section if
said iorm is not returned when required or a certificate of
compliance is not displayed.
Section 5 DUTIES APdD PO~rTERS OF THE BOARD>
A. The Board, in accordance with the criteria herein expressed,
shall adopt Rules and Regulations as are necessary for the im-
plementation and operation of the AIR Program and amen~ those
Rules and Regulations ~rom time to time as it deems neces~arv,
Any such amendments must be made at regularly scheduled .~ir
Quality Board meetings with fourteen (la) days public notice of
such meetings. The appropriate governmental entities, AIR station
and AIR emissions mechanics shall be notified of such amendments.
B. In developing "Rules and Regulations" for the implementation
and enforcement of this Section, the Board shall appZ~ the fo1-
lowing staridards:
1. The ambient concentrations of carbon r.lonoxide ~rom motox
vehicles in the City of :r.~eridian and Ada County;
2. The public health interest, includinex social and economic
costs of air pollutants an~ their control;
3. The requirements of the Federal Clean Air 13,ct, as amended,
the emission reduction benefits of the inspection and
maintenance program and the Ada County Transportation
~
Control Plan;
4. Technological developments in autoMOtive emission control
equipment, repair or testing;
5. Amendrrzents to the Rules and Regulations s:~all be ad-
ministrative in nature for the purpose of addressing
changes in technology and law an~ to ensur_e the proper
and efficient implementation and operation o.f, the AIR
Program.
C. The Board may recommend amendments to ~he sche~ule of fees
for certificates of compliance, which shall be sufficient to Meet,
but shall not exceed, the estimated cost of the initiation,
operation and enforcement of the program of inspection of motor

2. Require the emissions inspection station to re~nit to the
Board for deposit in the vehicle inspection fund,.
established pursuant to suY~-section 6A Ordir~ance, that
portion of the vehicle inspection fee to defray the cost
of administering and enforcina the provisions of this
Section.
~. Th~ Board shall conduct ongoinc~ cost-henefit analxses and
other evaluations of the inspection program, in~luding, but not
limited to, observed patterns of malfunctions in inspection:of
motor vehicler':s exhaust emissions control devices, quantities
of reductions in air-pollution in Ada County and t~e City of
Meridian suaject to the provisions of this Section, and make
recommendations to improve the inspection program. The Board
shall provide annual written reports on such analyses and evalua-
tions .
E. In order to document the evlauation required in sub-section D-
above, the Board shall compile and maintain records o~ maintenance
and repairs performed pursuant to this Section. A written summary
xeport of such information shall be prepar.ed annually by' the Baard
and made available to the public upon request.
F, In performing its duties and responsibili.ties, the_IIoard shall
have the authority to un~ertake any action reasonably necessax~y
to the performance of said duties, including but not linu.t~d to:
1. The employment and personnel management of necessaxy staffj
positions; '
2. The execution of necessary contracts and documents;
3. The authorization of expenditures from the PROtor Vehicle
Inspection Fund;
4. The ~orraulation of regulations necessary to the implemen-~
tation and administration of the program;
5. Conduet regular mee~ings;-,
6. Acquire and dispose of personal property.~

A. There is hereby established a P•Zotor Vehicle Emissions Inspec-
tion Fund which shall consist of the follocaing:

aspect of the emissions inspection program.
C. The Board shal.Z appropriate and ~udget on a fiscal year basis,
in accordance with the statutory requirements of the meznber
agencies indicating expenditures to be made in implementation and
administration of the motor vehicle emissions inspection program
established according to this Section. The budget shall include
indication of sources o.f income to be used for such expenditure
and justification for the magnitude of the inspection fee to be
levied according to this Section.
Section 7 INSPECTION C.F.ITERIA AND COSTS-- :. - ti:-~-
A. Applicability--All nonexempt motor vehicles must be inspected
at an AIR Station in accordance with Section 4 of this Ordinance.
Nonexempt motor vehicles of the model year 1970 and newer~regis-
tered or required to be registered in Ada County by residents of
~~teridian must comply wit:~ the yearly Emissions Test and Adjust-
ments proce.dures i~ the vehilce excEeds the model year percent

B. Identification of motor vehicles required to comply wi.th the
Automotive InsPection & Readjustment Program.
1. I~otor vehicles that a:re required to comply with the Air
program will be indentified with an P_i~r Program Certifi-
cate of Compliance Sticker in tne lower 1:eft corner ot
the front windshield.
2. The Cerfificate of Compliance sticker will be on the same
color as the lisense plate registration sticker.
3. The Certificate of Compliance sticker will expire one
year from the last day of the month of i~suance,

l. Tampering--Motor vehicles of the model years 1984 and
newer are to be inspected for the presence of the

catalytic converter, presence of the air pump and size of
the fuel restrictor. Motor vehicles which have had those
systems removed or defaulted are to be denied a Certif-
icate of Compliance until the motor vehicle owner restores
them to their original or operating condition. The syste~
are not required to be installed on motor vehicles which
at the time of production ~id not have the system instal-
led by the namufacturer.
2. Y~Iotor vehicles emissions must be less than or equal to
the following carbon monoxide emission pass-fail criteria
in order for a Certificate of Compliance to be issued
without further adjustment or testing.

3. The initial test cost i.ncluding the $3.00 com~liance
sticker charge shall not exceed $10.0~J, theref.ore the
maximum an AIR station may charge for the test alone is
$7.00. If a vehic~:e fails the initial test and elects to
utilize the 10 day period allo~~ed for independent cor-
rection, the charge for that test without the issuance of
a sticker shall be no more than $7.00. ~Jhen the zn~tor
vehicle is returnecl and passes the free retest a
Certificate of. Compliance is issued and no more than $3.00
may be charged.
4. Fees for the adjustment and/or repair required by the --
Rules and Regulations shall not exceed fifteen (15~
dallars for motor vehicles of 1970 model year to and
including a 198J model year_. The adjustment fees for 19~31
and newer shall not exceed thirty (30? dollars.
5. Free retest procedures are availa3~le for those motor
vehicle owners whose motor vehicle exceed the model year
percent CO standards. These motor vehicles have ten cal-
endar days to have adjustments and/or repairs performed
outside of the AIR station. These motoz vehicle owners
must return the motor vehicle to the original test site
for free retest. If the percent CO standards are still
exceeded, the licensed AIR station must ~erform the
adjustments and/or repairs required by tne P.ules and
~ •
Regulations in order for a Certificate of Compliance to
be issued. The cost limits for these adjustments and/or
repairs may not exceed fifteen dollars ($15.00) .for model
years 1970-1980 or thirty dolla~s ($30,Oa) fox model years
1981 and newer.
Section 8 EP~ISSIONS INSPECTION STATIOrdS :
A. Licensing.
l. The Board shall formulate Rules and Regulations ~roviding
for the licensing of AZR stations.
2. In developing Rules and Regulations for the licensing of
an AIR Station, ~he Board shall consider criteria includ~-
ing but not limited to the following:
a. Possession of an approved exnaust gas analyzer, other
tools and equipment and licensed personnel necessary to
conduct the requized emissions test; andk
b. Other criteria as deemed necessary` by tT~e` Board in
order to further the public interest and car,ry.out the
purposes of this Section. , "
3. The Board shall adopt Rules and Regulations providing
for the submission by holders o~ an AIR Stat~on I,icense
of such information"as they deem reasonably necessar~I to ,
carry out the purposes :of this Section.
4. The Boaxd, upon notice and an opportunity for a hearinq, ~
may revoke and require the surrender anu forfeiture of
any AIR Station License of the AIF Station perz~ittee if it
finds that such stat2on is not operated in accardance with
this Section or the Rules and Regulations adopted
pursuant to this Section. The Board shall notify the
licensee in writing of the date, time and place of the
, hearin~ and the grounds for revocation at least ten (10)
days prior to the scheduled date of the hearing. At the
hearing, the licensee may present evidence, call witnesses
and be represented by counsel. Within ten (10~ days after
the hearinc~ the Board shall noti.fy the licensee in writing
of its decision and shall specify the findings foxming the
basis of the decision. Ugon revocation o~' an AIR station
license, the licensee shall return to t~.e Board all.

2. In developing Rules and Regulations for the qualif,ications
of a person for an emission inspectiQn mechanic, the
Board shall consider criteria including but not limited
to the following:
a. Sucessful completion of the Board autho'rized emission
mechanic fifteen (15) hour course or pass th~ ehallenc~e
test ofzered in lieu of the course.
b. Other criteria as deemed necessary by the Baard in
or~er to further the Public interest and carr~ out the
purposes of this Section. .
3. The Board shall adopt Rules and Regulatians-pzoviding foar
the submission by holders of emission mechanics licenses
of such information as they deem reasonably necessary to
carry out the purposes of this 5ection.
4. The Board, upon notice and an oppoxtunity for a hearing, I
may revoke and requixe the sur_render and for.feiture of
any Air Emission Mechanics License if the Board finds
that such mechanic does not operate in accordance with
this Section or the Rules and ~egulations adopted puz-
suant to this Section. TY~e Board shall noti~X the
licensee in writing of the date, time and place of the
hearing and the grounds for x'evocation at least ten (10)
days prior to the scl~eculed date of the hearing, At the
hearing, the licensee may present e~idence, call witnesses

inspection program, as well as to elicit publYC participation in

B. The I3oard shall prepare public information for the beri~e~it of
the owners o~f motor vehicles subject to the provisiQns~o£ thi.s,
Section. This information shall explain the inspection`proc~ram,
the owner's responsibilities under the program,.and the most com-
mon adjustments and repairs likely to be xec~uired in order for

the owner's vehicle to pass inspection. It shall further provide
the locations of stations at v~'riich the inspection requirement can
be met, scheduling information, and information of the location
and availability of inechanics to per`form repairs for"the inspectio
program. It shall be c~istributed by the BoarcT.to ow~ers of motor
vehicles subject to the provisions of this 5ection, free of charge
at the time at which they are offi~ia].ly informed of`the inspectio
requirement. . ~ ~
C. The Board shall conduct a series of Qrien~~tio~ seminars to
familiarize automobile mechnaics and owners`of,motor vehicles
subject to the provisions o.f this ~ection with the standards,
procedures and forms to be utili~ed in the inspectian program and,
in particular, with maintenance and repair procedures recomznended
by the Board for performance on vehicles failing to pass
inspection. Such seminars shall be conductec? at locations select-
ed on the vasis of participants' convenience of access. .
Section 15 EFFECTIVE DATES--This Ordinance shall be rendered null
and void 3 years ~rom August 1, 19~~, unless extended
by Ordinance.
Section 16 PENALTIES--Any person who violates any provision of
this Section shall be deemed c~uilty of an infraction
and, upon conviction thereof, sha11 be fined $25.0~
for each vioiation.
Section 17 JOINT ORDINANCES--The Ada County Comznissioners have
previously passed an Ordinance which is the counter-
part of this Ordinance ~or the City of rZeridian and
is basically ic3entical to this Ordinance; other
cities in ~da County may already have passed or will
pass, such an Ordinance; the City o.f T~eridian, by
- this Ordinance, has aqreed that carbon manoxide in
the City of i+ieridian should be reduced a~d this
Ordinance is passed to endeavor to do so; the City
finds that the delegation of authority to the Air
2uality Board is appropriate and the most ef.f_icient

to the following terms and conditions of this Agreement.
1. Term. As concerns the City of r'teridian the term of this
Agreement shall commence from the date of passage and terminate
the 31st day of December, 1987, unless the motor vehicle emissions
control program is sooner terminated.
2. Bo~rd Created. There is hereby created an entity to be
known as the Air Quality Board, to act on behalf o~ each pu.~lic
agency signatory to this Agreement, for the purpose herein ex-
.pressed. The Board shall consist of one elected official from
each agency, one citizen-at-large to be appointed by Ada County,
one citizen-at-large to be appointed by Boise City, and one elect-
ed official or citizen-at-large to be appointed by the Ada County
Highway District. One representative of the Public Health nistrict
IV;, or any agency that may succeed to its powers and duties, shall
serve as an ex-o.fficio member. Each ac~ency shall be responsible
for selecting its representative(s) who shall serve .for the full ~,
term of the Board, unless sooner reMOVed or replaced by the
appointing ag~ncy. The Board shall select a chairman to preside
over meetings to be conducted under the "Robe,rt''s Rules of Order,"
and to be held at least once every month. The duties, resgonsi-
bilities and guidelines for the Board are set forth in the P4otor
Vehicle Emissions Control Ordinance, a copy of which is attached
hereto marked Exhibit "A" and incorporated herein by reference

3. Purpose of the Board. The purpose of the Board sha11 be
to implement and administer the motor vehicle emissions control
program as the same is set forth in Exhibit "A" attached hereto.
4. Funding. Funding for the prog~a~l shall be a combination
of state or fede.ral grants, matching funds, and inspection fees.
All financial transactions for the program shall be within the
vehicle emissions inspection fund established in Exhibit "A" and
shall be accounted ~or in accordance wi~h generally accepted
accounting principles. Budgetary procedures of the Air Quality
Board shall be as specified in Exhibit "A."
5. Termination. The Board shall not be terminated priz~r to
the stated termination date of the PROtor Vehicle Emissions Con-
trol Ordinance attached hereto as Exhibit "A;" The withdrawal
of any agency prior to termination shall constitute a forfeiture
of any funds or properties .contribute~ by said act~ncy:to the Air

Quality Board. Upon mutually agreed termination~of the i~iotor
Vehicle Emissions Control Ordiriance by al`l participating
agencies, the remaining funds or property contributed by each
participating agency shall be returned to that agency.

OF MERIDIAN, IDAH'0, OF ITS INDUSTRIAL
DEVELOPMENT REVENUE BOND IN THE FORM OF THE
NONRECOURSE REVENUE NOTE (NEWBERRY
ENTERPRISES) 1984 IN THE AGGREGATE PRINCIPAL
AMOUNT OF $400,000.00 AND APPROVING THE
RESOLUTION'OF SAID PUBLIC CORPORATION
AUTHORIZING SAID BOND, INCLUDING THE AGREEMENT
AND DOCUMENTS RELATING THERETO.
WHEREAS, the Economic Development Corporation of the City of
Meridian, Idaho, has filed with this City Council its Resolution
approving the issuance by said Corporation of its industrial
development revenue ibond pursuant to Title 50, Chapter 27, Idaho
Code, as amended (the "Act") in the form of its Nonrecourse
Revenue Note (Newberry Enterprises) 1984 together with execution
of the documents necessary thereto;
WHEREAS, at least fourteen days published notice of public
hearing and meeting to adopt an industrial revenue bond resolution
has been given;
WHEREAS, the City Council has reviewed said Resolution and
intends by the adoption of this resolution to approve the same;
NOW, THEREFORE, the City Council of the City of Meridian does
resolve as follows: ~
Section 1. Tihe Resolution of the Economic Development
Corporatio~the City of Meridian, Idaho, approving the issuance
of its industrial development revenue bond in the form of the
Nonrecourse Revenue Note (Newberry Enterprises) 1984, in the
aggregate principal amount of $400,000.00, and execution of the
