Department Reports . ~. , , Meridian City Council April 2 1984 Regular meeting of the Meridian City Council was called to order by Mayor Kingsford at 7:30 p.m. Council MembersPresent: Bill Brewer; Ron Tolsma; Bert Myers; BobGiesler;. Others Present: Doug Nichols; Vern Schoen; Bruce Stuart; Gary Smith; Earl Ward; Norman Fuller; R.C. Spencer; Marnell Chenowith; Gary Schaffer; Steve Gratton; Kenny Bowers; R.B. Glenn; John Matzinger; Elaine Schlekeway; Harriet Gutertz; Wayne Crookston Jr.; Jack Niemann; Minutes of the previous meeting held March 19, 1984 were approved as written. Item 1 Proclamation Declaring National Wrestling Week Mayor Kingsford Proclaimed: "Whereas the City of Meridian commends the amateur wrestlers of the Meridian School District and all other amateur wrestlers in the State of Idaho. Therefore, as Mayor of Meridian, I do hereby proclaim the week of April 1-7, 1984 National Amateur Wrestling Week and urge all residents to join in our salute." Item 2 Proclamation Declaring National Library Week Mayor Kingsford Proclaimed: "Whereas, Americans have access to unlimited knowledge at their local libraries; and Whereas, America's libraries are free and open to all people; and Whereas, the quality, diversity and quantity of information provided by local librariesis dependent upon community support; and Whereas, the library in Meridian are celebrating National Library Week with the Theme, "Knowledge Is Real Power;"and Whereas, that theme encourages everyone to use resources available to them in their libraries to help them succeedin all aspects of life; Therefore, I, Grant P. Kingsford, Mayor of the City of Meridian, Idaho, proclaim April 8-14, NATIONAL LIBRARY WEEK in Meridian, Idaho, and encourageall citizens to use our library to gain the knowledge they need." Item 3 PUBLIC HEARING: Vacation of Walkways Settlers Village Mayor Kingsford opened the Public Hearing. There was no testimony. Mayor Kingsford closed the Public Hearing. Kingsford mentioned that this was to accomodate a change from hight density dwelling to single family dwellings. The Motion was made by Giesler and seconded by Myers to allow the vacation of the walkways in Settlers Village by N&D Inc. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; Item 4 Pre-Termination Hearing; Water/Sewer/Trash Delinquencies Mayor Kingsford read: "This is to inform you, if you choose to, you :have the right to a pre-termination hearing, at 7:30 p. m., April 2nd, 1984, before the Mayor and Council, to appear in person to be judged on facts and defend the claim made by the City that your Water, Sewer, and Trash bill is delinquent. You may retain counsel. This .service will be discontinued April 10th, 1984, unless payment is received in Full." Mayor: "IS there anyone present that wishes a pre-termination hearing?" There was no response. • • • Meridian City Council 2. April 2, 1984 Ztem #4 Pre-Termination Hearing Cont'd . Mayor: "Due to their failure to pay their water bill or to present any valid reason why the .bill has not been paid, their water shall be turned off on April 10th, 1984. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal, the water will be shut off." The Motion was made by Tolsma and seconded by Myers to approve of the turn-off list. (On file with these minutes) Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; Amount Delinquent: $2,683.80 Item 5 PUBLIC HEARING: Amended Plat & House Square FootageCrestwood Estates Sub. #3 R.B. Glenn representing Crestwood, explained that 7 acres are being re-platted from multi-family dwelling to sing family dwellings. Vern Schoen, Building Inspector said everything "Looked good." Mayor Kingsford opened the Public Hearing. Mrs. ElaineSChlekeway was present. Mrs. Schlekeway said that she had no objections to the re-plat of the Subdivision, but was very concerned over the earth burin that is just adjacent to her property. Schlekeway cited weeds, blowing dirt, and noise as a few of her concerns. Glenn said that the orginial intent of the burin was that of a buffer, sim~¢lar to the buffer in Crestwood #l. Steve Gratton, an area realtor said that plans include a fence along the top, such as in Crestwood #1, and that the burin will be landscaped. Gratton said that the care of the buffer will probably be maintained by a home-owners assocation such as in Crestwood #1. Schlekeway pointed out that the height of the burin as it stands at present, would make it impossible to maintain landscaped or not. Kingsford assured that the matter would be looked into. Kingsford closed the Public Hearing. The Motion was made by Brewer and seconded by Giesler to approve the Amended Plat and House Square Footage in Crestwood Estates Subdivision #3. Motion Carried: Brewer, yea;.TOlsma, yea; Myers, yea; Giesler, yea; John Matzinger, CTM Engineering, the. Engineering firm represeting Crestwood #3 commented the the burin was a requirement in the orginial plan and was installed at a considerable expense. Matzinger said that plans include for the burin to be flattened out and landscaped. Matzinger said that this could be an assest to everyone, and apoligized to Mrs. Schlekeway. Glenn assured Mrs. Schlekeway that they would look into the matter and try to doranything that we can. . ,, , Meridian City Council 3 Item 6 Bills The bills were presented. The Motion was made by Tolsma and seconded by Myers to approve of the bills. Motion Carried: Brewer, yea; Tolsma, yea; Myers yea; Giesler, yea; Item 7 Ordinance Number 429: Amendments to Comprehensive Plan. 2 Mayor Kingsford presentedOrdinance Number429, Amendments to Comprehensive Plan. Mayor Kingsford: "IS there anyone present that wishes Ordinance #429 read in its entirety?" There was no response. The Motion was made by Myers and seconded by Giesler that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 429 as read be passed and approved. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; Item 8 Ordinance Number 430: Zoning & Development Ordinance. Mayor Kingsford presented Ordinance Number 430, Zoning & Development Ordinance. Mayor Kingsford: "Is there anyone present that wishes Ordinance #430 read in its entirety?" The was no response. The Motion was .made by Brewer and seconded by Tolsma that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 430 as read be passed and approved. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; The Motion was made by Tolsma and seconded by Myers to set the fees for copies of the Zoning Ordinance at $6.00, and of the Subdivision Ordinance at $4.00, and $10.00 for both. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; The Motion was made by Myers and seconded by Brewer to approve of the printing of the Attorney's Summary of the Ordinances in the Valley News Times. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; Item 9 Department Reports There was no business to report, however, Mayor Kingsford commented that he had received Vern Schoen's letter of resignation, and thanked Vern for all his hard work, and many years of dedicated service to the City. Giesler commended the hard work of the P&Zand Chamber on the Ordinances. Being there no other business .
