SAVINGS CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE

Section 1. That Title 10, Chapter 3, Meridian City Code, is amended to read as follows:

A. NEC Adonted. There is herebv adonted bv the Mavor and the Citv Council, for the
purposes of re latin~ all electrical construction associated with the erection,
construction, enlargement, alteration, repair, movin~, removal, demolition, conversion,
occupanc~quipment use, height, area, and maintenance of all buildin~s or structures;
providin~ for the issuance of permits, and collection of fees thereof; and providing for
penalties for the violation thereof, certain electrical codes known as the 2008 edition of
the National Electrical Code of the National Fire Protection Association, and the same are
herebv adopted and incorporated in full as if set forth at length herein, including all
appendices thereto, save and except such portions as hereinafter deleted, modified or
amended bv this section (hereinafter NEC). .
B. A~plication. The NEC as adopted by this chapter, as well as all provisions of this
chapter, shall apply to the followin~
1. Functions and duties of the Electrical Inspector.
2. New Installations. Buildings with construction permits dated after the adoption of

this ordinance shall complv with the requirements of the NEC. No person shall
occup.~v newlv constructed building which is, in whole or in part, in violation
of the provisions of the NEC.
3. Existing Installations. Existin~ electrical installations that do not comply with the
provisions of the NEC shall be permitted to be continued in use unless the Citv
Electrical Inspector deterrnines that the lack of conformity with the NEC ~resents
an imrninent dan~er to occupants or the occupancv classification changes. Where
changes are required for correction of hazards, a reasonable amount of time shall
be given for compliance, depending on the degree of the hazard.
4. Additions. Alterations, or Renairs. Additions, alterations, or renairs to an
buildin~, structure, or premises shall conform to that required of a new building
without requiring the existing building to comply with all the requirements of the
NEC. Additions, alterations, installations, or repairs shall not cause an existin~
building to become unsafe or to adverselv affect the performance of the buildin~
as determined bv the City Electrical Inspector. Electrical wiring added to an
existing service, feeder, or branch circuit shall not result in an installation that
violates the provisions of the NEC.
C. Amendments. The following amendments to the NEC shall applv:

from one location to another the service entrance shall be inspected and made to

2. A new nrovision shall be added as follows.
Metal Racewavs in Commercial Buildin~s. Notwithstandin~provisions of
NEC Article 334.10(1-3), all electrical wark in any building to be used for
commercial purposes shall be wired in an approved raceway, with the exception
of communication and si aling_
3. A new provision shall be added as follows.
Suspended Ceiling Li ts. Any and all suspended ceilin~ghts shall be
suspended by means of su~port wires independent from electrical wiring. This
shall include smaller lights, includin~, but not limited to, exit signs. Suspended
ceilin~~hts over one square foot in area shall be suspended bv means of two (2)
support wires, one on each diagonal corner.
4. A new provision shall be added as follows.
Bell Rin i~n~ Transformers. Bell ringing transformers shall be accessible for
upkeep and repair, and shall not be located in attics.
5. A new provision shall be added as follows.
Certification and approval of electrical products and materials.. All materials,

devices, fittings, equiprnent, apparatus, fixtures, and appliances installed or to be
used in installations that are supplied with electric ener~v shall be:
a. Tested, examined, and certified/listed bv an accredited electrical product
testing laboratory as set forth in the list thereof maintained bv the Idaho
Division of Buildin~Safety, Electrical Bureau; or
b. Annroved bv the Citv Electrical Insnector, nrovided that such material
device, fittin ,~equipment, apparatus, fixture, and/or appliance equipment
is installed under an electrical permit issued pursuant to this chapter and
conforrris to industrv and/or NEC standards. Where in the judgment of the
Citv Electrical Inspector a field evaluation is necessary to determine the
compliance of the material, device, fitting, equipment, apparatus, fixture,
and/or appliance equipment with industrv and/or NEC standards, such
field evaluation shall be completed bv an accredited electrical product
testin~ laboratory as set forth in the list thereof maintained bv the Idaho
Division of Buildin~ Safetv, Electrical Bureau. Such approval shall not be
required for products that are certified/listed on the list thereof maintained
bv the Division of Building Safetv, Electrical Bureau.
6. A new provision shall be added as follows.
Tempor .ar~
a. Anv and all electrical circuits and/or wirin~ which are in, unon, or used
within a temporary structure and/or which are at, for, or used b~
temporary use shall be protected b~ground fault circuit interrupter
protection (GFCI) at the source. This shall include, but shall not be
limited to, all cords that are located in, upon, or across open areas, parking
areas, walkwa,~planters, drive aisles, and/or inside an~portion of a
temporary structure.
b. Anv and all li~htin~ bulbs which are in, unon, or used within a ternnora
structure and/or which are at, for, or used b~porary use shall be
completely enclosed b~glass fixture lens. Anv and all fluorescent lamps
which are in, upon, or used within a temporary structure and/or which are
at, for, or used by a temporary use shall be completely enclosed in tube
u~ards•
c. Any and all temporarv or extension cords used for power in, upon, at, for,
or used bv a temporarv structure and/or a temporarv use shall be in good
condition and undamaged, and shall have no splices or open conductors.
7. Article 210.12 shall be deleted and replaced with the followin 1~~~
Arc-Fault Circuit-Interrupter Protection.
a. Definition: Arc-Fault Circuit Interrupter. An arc-fault circuit interrupter

is a device intended to provide ~rotection from the effects of arc faults by
recognizing characteristics unique to arcin a~ nd bv functionin t~
energize the circuit when an arc fault is detected.
b. Dwelling Unit Bedrooms. All 120-volt, sin l~e phase, 15- and 20-ampere
branch circuits supplying outlets installed in dwelling unit bedrooms shall
be protected bv a listed arc-fault circuit interrupter, combination type
installed to provide protection of the branch circuit.
c. Exception: The location of the arc-fault circuit interrupter shall be
permitted to be at other than the origination of the branch circuit in
compliance with both of the followin~
~1) The arc-fault circuit interrupter installed within six (6) feet of the
branch circuit overcurrent device as measured alon~ the branch
circuit conductors.
~2) The circuit conductors between the branch circuit overcurrent
device and the arc-fault circuit interrupter shall be installed in a
metal raceway or a cable with a rnetallic sheath.
8. Article 680.26 shall be deleted and replaced with the following lan ua~
Bondin~.
a. Performance. The bondin~ reauired bv this section shall be installed to
eliminate volta~gradients in the pool area as prescribed. This section
does not require that the 8 AWG or larger solid copper bondin~ conductor
be extended or attached to anv remote panelboard, service equipment, or
any electrode.
b. Bonded Parts. The followin~pecified parts shall be bonded to e~
11 Metallic Structural Cornnonents. All metallic narts of the nool
structure, includin~ the reinforcing rnetal of the pool steel, coping
stones, and deck, shall be bonded. The usual steel tie wires shall
be considered suitable for bonding the reinforcing steel to e~ther,
and weldin or special clarnping shall not be required. These tie
wires shall be made tight. If reinforcing steel is effectively
insulated bv an encapsulatin~ nonconductive compound at the time
of manufacture and installation, it shall not be required to be
bonded. Where reinforcing steel is encapsulated with a non-
conductive compound, ~rovisions shall be made for an alternate
means to elirninate volta~~radients that would otherwise be
provided bv unencapsulated, bonding reinforcin sg teel•
~2) Underwater Lightin~. All forming shells and mounting brackets

or no-niche luminaries/fixtures shall be bonded unless a listed low-
volta e~l~i ting svstem with nonmetallic forrning shells not
requiring bonding is used.
~3) Metal Fittings. All metal fittings within or attached to the pool
structure shall be bonded. Isolated parts that are not over 100 mm
~4 inches) in anv dimension and do not penetrate into the pool
structure more than 25 mm (1 inches) shall not require bondin~
41 Electrical Eauinment. Metal narts of electrical eauipment
associated with the pool water circulatin~ystem, includin~pump
rnotors and metal parts of ecLuipment associated with pool covers,
including electric motors, shall be bonded. Metal parts of listed
equipment incorporating an approved svstem of double insulation
and providin~ a means for grounding internal non-accessible, non-
current-carrying metal parts shall not be bonded. Where a double-
insulated water-pump rnotor is installed under the provisions of
this rule, a solid 8 AWG cooper conductor that is of sufficient
len~th to make a bonding connection to a replacement motor shall
be extended from the bonding ~rid to an accessible point in the
motor vicinity. Where there is no connection between the
swimming,pool bondin~~-id and the equipment .groundin~s sy tem
for the premises, this bonding conductor shall be connected to the
equipment grounding conductor of the motor circuit.
(5) Metal Wiring Methods and Equipment. Metal-sheathed cables and
racewavs, metal ~pin~, and all fixed metal parts except those
separated from the pool b~permanent barrier shall be bonded
that are within the followin~ distances of the pool:
~) Within 1.5 m(5 ft) horizontallv of the inside walls of the
pool•
(b) Within 3.7 m(12 ft) measured vertically above the
maximum water level of the pool, or any observation
stands, towers, or platforms, or an dy ivin~ structures.
c. Common Bonding Grid. The parts specified in subsection (b), above,
shall be connected to a comrnon bondin~grid within a solid copper
conductor, insulated, covered, or bare, not smaller than 8 AWG.
Connection shall be made by exothermic welding or by pressure
connectors or clamps that are labeled as bein~ suitable for the purpose and
are of stainless steel, brass, copper, or copper allov. The comrnon bondin~
~rid shall be permitted to be any of the following:
(1) The structural reinforcin~ steel of a concrete pool where the

reinforcing rods are bonded to et~ her by the usual steel tie wires or
the equivalent. ~
(2) The wall of a bolted or welded metal pool
(3) A solid cooper conductor, insulated, covered, or bare, not srnaller
than 8 AWG.
~4) Rigid metal conduit or intermediate metal conduit of brass or other
identified corrosion-resistant metal conduit.
d. Connections. Where structural reinforcing steel or the walls of bolted or
welded metal pool structures are used as a comrnon bondin~grid for
nonelectrical parts, the connections shall be made in accordance with
Article 250.8.
e. Pool Water Heaters. For pool water heaters rated at more than 50
amperes that have specific instructions re~ing bondin~ and grounding,
onl t~parts desi~nated to be bonded shall be bonded, and onlv those
parts designated to be grounded shall be grounded.
9. Annex H. Annex H of the NEC, also known as Article 80, is not adopted.
10-3-2: ELECTRICAL INSPECTOR:
A. Established. There is hereby established within the Citv of Meridian the position of
City Electrical Inspector.
B. Qualifioations. The Citv Electrical Inspector shall maintain the following qualifications
at all times.
1. Certificate. The City Electrical Inspector shall maintain certification bv a
nationall~gnized inspector certification ~rogram approved by Citv Council.
The certification pro~ram shall specificall~quali the City Electrical Inspector in
electrical inspections.
2. Experience. The City Electrical Inspector shall demonstrate expertise in the
followin areas:
a. All applicable provisions of the NEC, this chapter, and Meridian City
Code;
b. Standard materials and methods used in the installation of electric
equipment;
c. Approved methods of construction for safetv to persons and propert~

d. All applicable provisions of Idaho Code and the Idaho Administrative
Procedures Act; and
e. At least four (41 vears' exverience as an electrical insnector; ei~ht (8
years' experience in the installation of electrical equipment; or a degree in
electrical en ineerin~ from an accredited college or universit~plus two 2)
years' practical electrical experience.
C. Duties and Authoritv. The Citv Electrical Inspector shall be authorized to perform the
followin d~ uties:
1. Administer the requirements of the NEC and this chapter.
2. Perform electrical inspections as set forth in NEC Article 90.2 and this chapter.
Upon performance of such inspections, the Electrical Inspector shall issue a
certificate stating the results of same, including anv necessary corrections.
3. Assist the Fire Chief in the investigation of fires causeci bv electrical installations.
4. Review and approve construction plans, drawings, and specifications for electrical
svstems.
5. Review and approve plans for the design, alteration, modification, construction,
maintenance, and testin~ of electrical svstems and equipment.
6. Regulate, control, and inspect electrical installations at, for, or used b,v temporary
uses.
7. Render interpretations of the rec~uirements of the NEC and of this chapter.
8. Disconnect or order the disconnection of. a buildin~ and/or nremises from its
source of electric supplv where the use of any electrical equipment or its
installation is found to be installed in violation of the NEC or this chapter, or
which is dangerous to human life or propertv. Upon such disconnection, a seal
shall be placed thereon and a notice served, listing the causes for the
condemnation and/or disconnection and the penalty for the unlawful use thereof.
It shall be unlawful for anyperson to use such disconnected wirin ,~apparatus, or
fixtures or to remove, break or deface anv seal so placed.
9. Enter and inspect, at all reasonable times, any building, structure, or premises for
dangerous or hazardous conditions or equipment as set forth in the NEC or this
chapter and/or for electrical inspections as authorized bv the NEC or this chapter.
Prior to entering a premises, the Cit~Electrical Inspector shall:
a. Obtain the consent of the occupant thereof or obtain a court order or

warrant authorizing entr ,y except that where an emer~ency exists, the
Electrical Inspector may enter a premises without consent or court order.
For purposes of this section, "emergency" shall be defined as
circumstances that the City Electrical Inspector knows or has reason to
believe exist and constitute immediate dan er to persons or propert~
b. Identifv him/herself as the Citv Electrical Inspector, verballv and by
displav of badge, uniform, or other credentials issued bv the CitY
10. Order anYperson to rernove or remedv dangerous or hazardous conditions or
equiprnent and/or any condition hazardous to life, safet~propertv. Any.person
failin to comply with such order shall be in violation of this chapter. '
11. Order that anv installation be exposed for inspection where such installation was
subject to inspection, approval, and/or permittin~prior to use but was covered or
concealed without having first been inspected, approved, and/or properly
perrnitted.
12. Order the imrnediate evacuation of any occupied buildin~ with hazardous or
unsafe conditions that present imminent danger to building occupants.
D. Interference or Imnersonation Prohibited. No person shall interfere with the City
Electrical Inspector in carrying out the duties and functions prescribed by the NEC or this
chapter. No person shall use an ~~~e, uniform, or other credentials to impersonate the
City Electrical Inspector.
10-3-33: STATE LICENSE REQUIRED:
It shall be unlawful for any person, firm or corporation to carry on the business of electrical
''~ork without first having secured a state electrical contractor's license or having in his
possession a license recognized by the °+~+° °'°~~-~~~„",r°",Idaho Division of Building Safet
Electrical Bureau, excevt that an owner of a nrimarv or secondarv residence nerformine
electrical work in such primarv or secondarv residence or an associated outbuilding shall not be
required to be licensed pursuant to this section, so long as such property owner first obtains a
permit as required by this chapter. The CitYof Meridian buildin~department shall not issue an
electrical permit to an~person so excepted from this requirement if the City Electrical Inspector
determines that such nerson is not comnetent to desim or install the electrical work for which the
permit is sou~ht

10-3-4: PERMIT REQUIRED; APPLICATION; ISSUANCE:
A. Permit required. It shall be unlawful for any person, firm or corporation to place or
install in any building, structure, or premises any wiring, apparatus or fixture for the use
of electric current for light, heat or power, or to make any alterations or changes in, or
additions to any wiring, apparatus or fixtures for such use, without first obtaining from
the ^~*~~ °'°^*^^~' ~~~~°~*~~ Citv a written permit to do such work. Provided, however,
that no perrnit shall be required for repairs to existing installations where the value of
such repairs, including material and labor, does not exceed fiftv dollars ($50.00), so long
as the City Electrical Inspector is notified immediatelv upon the completion of such work
for inspection and approval.
B. Permit application. ~sl~ The permit a~plication shall be in such form required b.v the
buildin~department and s~e-t~e shall indicate:
1. Name and address of the applicant;
2. Detailed description of the work for which the permit is sought;
3. Total value of the work for which the permit is sougllt;
4. Location by street and address where such work is to be done; and

C. _ Issuance of Permit. Upon the Citv Electrical Insnector's anvroval of an annlication for an
electrical permit, the Buildin~Department shall issue a permit. AnXpermit issued
pursuant to this section shall ~se state the scope and kind of work permitted; the location
by street and number of the building where such work is to be done; the operation,
activities, and/or work for which the permit is issued; the name and address of the
permittee; the date of issuance of the permit; the period of validitv of the permit; and any

D.__ Addition or Alteration of Approved Plans. Any addition or alteration of approved plans

and/or permitted work shall require the application for, and issuance of, a new or
amended permit.
E. Copy of Permit to be Posted. A cop,v of the permit shall be posted or otherwise readily
accessible at each work site.
F. Permit Validity Conditioned on Inspections. The validitv of all electrical permits shall be
conditioned upon the completion of the followin~pections bv the Citv Electrical
Inspector:
1. Rou~hed-In Insnection. When electrical work for which a nermit was issued is
rou ed in, permittee shall, in writin , noti the City Electrical Inspector of such,
and upon payrnent of any inspection fee per fee schedule, the Electrical Inspector
shall inspect such work within two ~) working days of recei~t of such written
notice and fee. Upon completion of such Rou~hed-In Inspection, the City
Electrical Inspector shall indicate such by affixing a tag or label stating the date of
inspection. It shall be unlawful for an~person to conceal any electrical work
prior to such inspection.
2. Final Insnection. When electrical work for which a nermit was issued is read
for final inspection, the permittee shall, in writin , noti the City Electrical
Inspector of such, and upon payrnent of any inspection fee per fee schedule, the
Citv Electrical Inspector shall inspect such work within two (2) workin~days of
receipt of such written notice and fee. "Ready for final inspection," for purposes
of this section, shall be defined as the completion of all enclosed plurnbing,
heating, furnace work, and/or as fittings. Where, upon final inspection, the City
Electrical Inspector finds the installation to be in conformity with the statues of all
a~plicable laws and standards, the City Electrical Insnectar shall issue a certificate
of approval authorizing the connection to the supplv of electricity and shall send
written notice of such authorization to the supplier of electric service. It shall be
unlawful for anv person to make connection to a supplv for electricitv or to supplv
electricit t~v electrical equipment installation for which no valid permit is in
effect or that has been disconnected or ordered to be disconnected.
3. Elective insnections. The Citv Electrical Insnector mav visit anv buildin
structure, or prernises where work mav be done under a permits issued under this
chapter and inspect all electrical work and/or installations. If, upon inspection,
any installation is found to be noncompliant with the NEC or industrv standards,
the Citv Electrical Insnector shall immediately forward to the person making the
installation a written notice statin~ the defects found.
G. Permit Validity Conditioned on Compliance. The validitv of all electrical permits shall
be conditioned on cornpliance with the requirements of the NEC, this chapter, and any
and all applicable laws and standards.
H. Revocation of nermits.

1. The Citv Electrical Inspector shall be authorized to revoke a permit or approval
issued if any violation of the NEC or of this chapter is found upon inspection.
2. The Citv Electrical Inspector shall be authorized to revoke apermit or approval
issued if there are any false staternents or misrepresentations submitted in the
permit application or plans on which the permit or approval was based.
3. An~person who en~~es in any business, operation, or occupation, or uses any
buildin~, structure, or premises after the permit issued therefor is suspended or

10-3-85: NONLIABILITY OF CITY:
This chapter shall not be construed to relieve from, or lessen the responsibility of, any person
owning, operating or installing any electrical wires, appliances, apparatus, construction or
equipment for damages to anyone injured or damaged either in person or property by any defect
therein; nor shall the city or any agent thereof. be held as assuming such liability by reason of
inspection, approval, and/or certification as authorized herein ~~ ~°~*;~~~*° ~~:~~„°^*;^~ ;°~„°a

10-3-96: ~~~SEVERABILITY; SAVINGS CLAUSE:
Should any section, paragraph, sentence, clause or phrase of this chapter or of the se~e NEC
hereby adopted or this chapter be declared ,unlawful or invalid for any reason or
cause, the remainder of said chapter or code shall not be affected thereby and the same shall not
invalidate or void the remainder of the NEC as adopted or this chapter~~~~. All
ordinances, resolutions, orders or parts thereof in conflict herewith are hereb~pealed,
rescinded and annulled.
10-3-~A7: NOTICES; PENALTY:
A. Written Notice of Violation. Whenever the City Electrical Inspector finds a violation of
this chapter or of the NEC, he shall issue written notice describing such violation and the
facts and circumstances supporting such findin~ ,
B. Service of notice. Anv order or notice issued nursuant to a nrovision of this chanter shall
be served upon the owner, operator, occupant, or other person responsible for the
condition or violation1 either bv personal service or U. S. Mail. Where a notice pertains to
abandoned or unattended premises, a cop.v of such order or notice shall be posted on the
premises in a conspicuous place at or near the entrance to such premises and mailed by
re~istered or certified U.S. mail to the last known address of the owner or occupant.
C. Penalt,~Any person violating the provisions of this chapter or of the NEC shall be
deemed guilty of a misdemeanor-.

Section 2. That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the
Mernbers of the full Council, the rule requiring two (2) separate readings by title and one (1)
reading in full be, and the same is hereby, dispensed with, and accordingly, this Ordinance shall
be in full force and effect on July 9, 2008.
