Request for Fee Increase Attorney APPROVED Meridian City Council February 21, 1984 Regular Meeting of the Meridian City Council was called to order by Mayor Grant P. Kingsford at 7:30 p. m. Council Members Present: Bill Brewer; Ron Tolsma; Bert Myers; Bob Giesler Others Present: Doug Nichols; Bruce Stuart; Robert Davis; Vern Schoen; H. Guthertz; Gary Schaffer; Moe Alidjani; Gary Smith; Earl Ward; Don Hubble; Glen Scott; Norman Fuller; Jack Sweet; Jerry Sweet; Bob Spencer; Wayne Crookston Jr.; Laura Hobbs; Jack Blattner; Todd Hammons; Jack H. Niemann; Minutes of the previous meeting held February 6, 1984 were approved as written. Mayor Kingsford made the following proclamation: "Whereas, the Future Farmers of America with vocational agriculture education is a strong force for America's agriculture; and Whereas, members of the FFA are playing an outstanding role in assuring the future progress and prosperity of our nation; and Whereas, the FFA motto - "Learning to do, doing to lean; earning to live, living to serve" - gives a direction of purpose to these future leaders for tomorrow's agriculture; and Whereas, the FFA performs the valuable service of developing leadership, encouraging cooperation, promoting good citzenship, teaching modern information, and inspiring patriotism among its members, THEREFORE, I do hereby designate the week of February 18-25, 1984 as FFA WEEK." Item 1 Request by Sanitary Service for Extension of Contract Moe Alidjani explained the need for an extension of his contract. (Tape on File) Alidjani presented a letter outlining his request for the extension to the Council Members. (On file with these minutes) Alidjani is requesting that he receive payment on the 15th and the last day of each month, rather than once a month, an 8 year extension to the existing contract, and that the 5~ collection fee should apply to the gross income collected by the City before paying the landfill bill by Sanitary Service, Inc. and not after. Alidjani told the Council that he is planning to expand and to upgrade his equipment. The Motion was made by Myers and seconded by Giesler to accept the proposal for a contract extension as outlined in Alidjani letter, by Sanitary Service. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; Item lA Intermountain Arms; Jack Sweet Mr. Sweet explained to the Council that he is requesting changes in the building that was formally the Meridian Recreation Center. Sweet said that Intermountain Arms to planning to expand and would like to replace the windows on the West and North of the buildingwith contrete blocks, which would be stuccoed over. Sweet would also like to take a 20 foot section of the North wall out, putting in an archway connecting the two buildings. Sweet said he plans to use the basement for a storage area in ~. general and use the front part of the upstairs for offices and an additional display area. Vern Schoen, Building Inspector told the Council that once the wall is opened up make both buildingsas one, the old part must be brought up to code. Schoen said that the building is rated as H-1, which is the highest hazzard rating of all. Code also requires that both basements be sprinkled, that there be extensive separation for the living area above, and a full remodel be done. Schoen said that he would "recommend that intermountain Arms follow the normal procedure by obtaining a building permit as required for all commercial businesses by the Uniform Building Code. Due to the hazardous occupancy of Intermountain Arms, and variation or deletion from the U.B.C. must be a Council decision." Schoen continued: "The City of Meridian department heads will have to speak for their own department, as well as the Idaho Department of lbabor being responsible for electrical and plumbing requirements." Meridian Cit Council 2. Februar 21, 1984 Item lA Cont'd - Intermountain Arms Councilman Brewer said that he felt that the building was one of the best constructed of the "old" downtown area. Brewer said that he feels that intermountain Arms is one of the best businesses in town and is going "on line to expand and grow." Brewer said that he feltthe Codes were a guideline and the Council should vary from them in this instance. Brewer: "I see no problem at all in granting the variance from the Code." Councilman Myers said that he was concerned about the electrial. Sweet told the Council that he has had the electrial looked at and it seems to be "quite good." It was determined that Sweet would need a variance from the requirements for an architectural drawing, so that the windows can be closed up right a way. Mayor Kingsford told the Council that Sweet had agreed to present an architectural drawing at a later date. Sweet would also need a variance from the requirement of sprinkling the basment, and .the H-1 occupancy that requires that it be 60 feet away from another building. Hook-up fees were discussed.. (Tape on File) .Mayor Kingsford said that he doesn't envision any increase in the hook-up fees. Earl Ward, Wastewater Supt. echoed Kingsford saying that there were "no problems with the hook-up fees." Councilman Giesler said that he is very concerned with the variance from sprinkling. Giesler said that because of the hazardous materials he was concerned with the safety of the firemen. Giesler asked that Sweet check into the possiblity of sprinkling to see if it might be feasiable. Sweet said that he would look into sprinkling. Councilman Tolsma said that he is also concerned with the sprinkling and would like to see if there is any way possible to get sprinklers in there. Councilman Myers said that he felt that he did not have enough information to make a decision on the variances. Sweet told Myers and the other members of the Council that they were welcome to come and take a guided tour of the building and get a full explaination of the expansion, but time is creating an economic problem, and this must be expedited if at all possible. Mayor Kingsford said that he had every faith that they would proceed correctly. Tolsma again stated that the only problem that he has is with the sprinkling. Sweet said that possibly they could take a portion of the basement, store all hazardous materials in that portion, and sprinkle that portion. Giesler said it is not only the hazardous materials, but the basement itself, which is very dangerous in case of a fire. There was discussion. (Tape on File) The Motion was made by Tolsma and seconded by Giesler to grant a variance from the UBC requiring an architectural drawing be submitted; allowing the windows to be closed up; and that an H-1 occupancy be 60 feet away from other buildings. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; Sweet said that he would work. on 4etting the architectural drawing submitted ASAP, for Item the cutting through the common wall. 2 Approval to Waive Fees for Conditional Use Permit for Senior Citizens Center The Motion was made by Tolsma and seconded by Brewer to waive the fees for a Conditional Use Permit for a Senior Citizens Center. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; City Council 3' Item 3 FROM TABLE: Norman Fuller - Meridian Greens Councilman Brewer called upon City Attorney Wayne Crookston as to where the Council stood on Meridian Greens. (Platting etc.) Crookston presented a synopsis to the Council; When annexed in 1977, water and sewer was to come to the City. In January of 1978, beforethePlanning & Zoning, the Preliminary Plat, water from the City and sewer to be temporary. Prelimary Plat was approved by the Council on 2-6-78 with the Developer to bring City water; Sewer with Pahse I, or drainfield for sewage as temporary meansure; wet sewer lines to drainfield; wet line to connect to City sewage lines when available. On March 20, 1978, depending on economics, water line with first phase definately, and sewer lines with first phase possibly. In September of 1979, final Plat was approved by the Council subject to posting an acceptable performance bond to the City for completition of the golf course. The performance bond was never posted. Bill Brewer: "Why no golf course now?" Fuller stated that he felt Meridian does not need another golf course, the economics do not warrant a golf course, and more and more people are desiring not to live on a golf course. Brewer said .that he agreed, but believes that the project is premature until water and sewer go under the freeway. Don Hubble, Engineer reported on the soils of Meridian Greens. (Tape on File) Bob Davis, a local businessman, told the Council that only hope to expand the retail market of Meridian is by growth, and that there is a"risk involved only if we don't expand our market." There was again discussion concerning septic systems, their possiblity of malfunctions, and what complications they may cause. (Tape on File) Crookston told the Council that they could structure their approval so the 18 lots deal with septic systems, and that any other lots developed have what. ever other utilities the Council might require. Crookston said that these restrictions could be reflected in the minutes and the documents recorded. Crookston said that he believes that they need a variance from bringing City Water to the development; the posting of a performance bond on the golf course; and on the time between preliminary and final plat. Crookston said that he still feels that there may bea problem with the City's agreement with the Sewer & Water District. The City needs the Sewer& Water District Board's concurrance with whatahe Council is doing. The Sewer & Water District have jurisdiction over the sewer and water in Meridian Greens. City Engineer, Gary Smith, reported that the plat has been signed by everyone necessary except for the City Council. Smith pointed out that the plat was approved showing the sewer and water extended. Smith saidthat in his opinion, Meridian Greens should "start. over through all agencies." Attorney Crookston pointed out that no plat shall be accepted for recording unless laid plat has been certified within 30 days prior to recording, so that they would have to go to through the agencies again for signatures. Councilman Brewer said that he feels the City is "defeating it's purpose which is not to allow septic tanks." The Motion wasmade by Brewer to disapprovethe request. by Meridian Greens. Motion Died for lack of a second. Meridian Council zl Item #3 Norman Fuller - Meridian Greens - Cont'd . There was more discussion concerning the use of septic systems. (Tape on File) Fuller told the Council that if septic .systems were restricted to 18 lots, it would not be acceptable. Councilman Giesler said that he thought they were working with only 18 lots and nothing else. Giesler said that he could see problems starting if there was a possibility of all Meridian Greens going to septic systems. The Motion was made by Brewer to disallow the request by Meridian Greens. The Motion was seconded by Giesler. Motion Carried: Brewer, yea; Giesler, yea; Tolsma, Abstain;. Myers, Abstain; Item 4 Request for Fee Increase Attorney Mayor Kingsford reported that he had done some checking into Attorney Fees. Kingsford told the Council that the Attorney Fees now are on the very low end of a broad range. The Motion was made by. Brewer and seconded by Myers to approve of an increase in Attorney Fees at $70.00/hr. pass-through; $35.00/hr. Civil; and $30.00/hr Criminal; effective March 1, 1984. Motion Carried: Brewer, yea; Tolsma, yea.; Myers, yea; Giesler, yea; Being there no other business to come before the Council .
