The Motion was made by Giesler and seconded by Myers that the City Council of the, City of Meridian does hereby adopt & approve the Findings of Fact and Conclusions as prepared by the City Attorney: Notion Carried: Roll Call Vote: Morraa, Yea: Giesler, Yea: Myers, Yea: Tolsma, Yea: The Motion was made by Giesler and seconded by Myers to approve the Fence Variance for John & Ruth Nlaxtier: Motion Carried: All Yea: Item #2: Public Hearing: Vacation of BLK 3 & 4 Futur-Ida Sub. #l: Mayor Kingsford: I will now open the Public Hearing, is there anyone fran the audience who wishes to offer testimony on this issue? Cornel Larson, Sundance Properties, Larsen was sworn by the City Attorney: Larsen: We are asking to vacate Blk 3 & 4 of the Etittara-Ida Subdivision in order for us to build a 38,000 square foot building at that location for Freidman Bag Canpany, we have also approached Ada County Highway District on the vacation of Taylor Place and West Second Street. The Highway District does not have a problan with that except the requirement of a wldesac which we worked with theist today and I think we have this resolved, the curb, gutter & sidewalk issue I think we also have that resolved with themI think they would consider waiving than if the City Council would look favorable on that. Mayor Kingsford: Any questions of the Council? Tolsma: The City Engineer had sane questions about the water & sewer lines that are on that property. Larsen: We would be providing easements for that, he had also requested that we plug any of the stubs that were put in and if we can determine where they are we would get those taken care of. There were none. Is there anyone else fran the Public that wishes to testify on this request? There was no response, the Public Hearing was closed. We have an Ordinance on this item that will be consid- ered later on the Agenda. Item #3: Public Hearing: Final Plat on Glennfield Manor $3, 27 Lots: Mayor Kingsford: At this time I will open the Public Hearing, is there anyone in the audience who wishes to offer testimony on this request? T12re was no response, the Public Hearing was closed: Is there a Motion or does the Council have any questions? Giesler: There were a number of caRnents fran the City Engineer on this, sane of then seen to be quite important, have you seen these caanents fran him? Laser: We just received them this afternam and have not had a chance to go over them and make the necessary corrections or changes. Morrow: If that is the case, I think it would be best to table this until they have reviewed these cannents. The Motion was made by Morrow and seconded by Giesler to table this request until the next meeting which will be September 19, 1989: Notion Carried: All Yea: Giesler: Why did they just receive these today, I want to make sure this was not our fault in getting things sent out: City Engineer: I mailed then to their engineer on the 28th of August. Giesler: That answers my question: Laser: This table will be alright with us: Item # 4: Approve Covenants on Glennfield Manor #3: Mayor Kingsford: Council Members if you have any questions you would like tc ask the Counselor and I think the City Engineer had sane catmez:ts: City Attorney: I had a catanent on the setback restrictions, irrigation, fences, signs, trash & rubbish, on paragraph 19, and the Architectural Control Committee: City Engineer: I had cacenents on land classification, setbacks, fences,. sight distance at intersections and the yard lights: Mayor Kingsford: Gentlemen, the Subdivision Final Plat is being tabled, would you like to make can<nent on any of these items: Laser: We could take these Garments that have been made and have then by the next meeting: Mayor Kingsford; Probably it would be appropriate for us to table .this also and I might ask you to get with the City Attorney or maybe he could get you a copy of the ones he mentioned for your consideration as well. Ln order to have their water turned back on there will be an additional fee Of $10.00: They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code, even though they appeal their water will be shut off: The Motion was made by Tolsma and seconded by Myers to approve the turn-off list with the exception of Wi]ma Blair: Motion Carried: All Yea: Mayor Kingsford: The amount of the delinquencies this month is $9,666.80: Item # 9: Approve the Bills: The Motion was made by Tolsma and seconded by Myers to approve payment of the Bills: Notion Carried: A11 Yea: Item #10: Resolution #128: Resolution Proclaiming General City Election: Mayor Kingsford: A Resolution proclaiming a general City Election, to be held Novanber 7, 1989, designating the polling place, designating the Registrar aril Deputy Registrar and ordering the City Clerk to give notice of such election. Resolution #128 specifies there are three City Council Seat open, two for four year term and one for two year term, the two polling places will be for Precinct I, Meridian Fire Station & for Precinct II the American Legion Hall: The Notion was made by Myers and seconded by Tolsma to approve Resolution #128: Notion Carried: All Yea: Item #11: Ordinance # 514: Ordinance Vacating Blk 3 & 4 of Futur-Ida Sub: Mayor Kingsford: An Ordinance vacating a portion of Futur-Ida Subdivision #1, of record in Ada County, Idaho, specifically B1ks 3 & 4 of said Future-Ida Subdivision #1, according to the official plat thereof, in Book 43 of Plats at Pages 3475 & 3476, records of Ada County, Idaho and which is located in the Southeast Quarter of Section 12, T3N, R1W, Boise Meridian, Pda County, Idaho and providing 'an effective date, is there anyone in the audience who wishes Ordinance #514 read in its entirety, there was no response, are there any questions of the Council? Morrow: It may not be in the City's best interest to eliminate in this particular project and this location the curb, gutter & sidewalk, the reason being this is in old town and the elevations should be well established we do not have a situation like we have had for Western Frniipment and the outfits along Overland where it is a major road that is going to be developed in the future through a LID or however. Does not seen it make sense at this location to eliminate ACHD request for curb, gutter & sidewalk. Giesler: I would like to mention I would like to abstain on this issue since it abutts my property. There was further discussion on this, protection of the road edge, the culdesac turnaround, drainage and etc. MERIDIAN CITY COUNCIL • • SEP'IB[VIDER 5, 1389 PAGE # 5 Larsen produced pictures and drawings of the building to shwa the Council Manbers: The Motion was made by Myers to approve Ordinance #514 with suspension of the rules: Notion died for lack of second: The Motion was made by Morraa and seconded by Myers that the Hales and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance #514 as read be passed and approved with the provision that no drainage water per allowed to stand on the site and that long teen it be noted that provisoes will be made for the rebuild of the road to including curb, gutter & sidewalk and at such time all property owners will participate by way of either a voluntary LID or a mandated LID. Notion Carried: Roll Call Vote: Morrow,Yea: Giesler, Abstain: Myers,Yea: Tolsma, Yea: Giesler: I am pleased that sanething is happening over there, that the weeds will be caning down, I am definitely not against the project: Department Reports: Nbrraa: A couple things, I need the imput fran the City Council as to what they think about the setbacks we talked about a month or so ago as far as the trailer courts, the separation of the trailers, it has been suggested by the Fire Department the minimium acceptable to than is five feet. I need to know how you want to structure the Orriia~ance or Resolution or however we are going to change the existing Ordinance. The other thing is the City Engineer gave you a copy of sane information on the pressurized irrigation systems and I would like sane imput by next meeting also concerning that and only because all the sudden here we have several subdivisions that are caning up for annexation and zoning and if we are going to deal with the irrigation issue either deal with it naa or forget it because we are beginning to get past the point of no return in terms of the irrigation. Then in teens of the fences and the fence Variances whether we are going to change the systan to have the Police Chief, the City Engineer and a designated fence ca[mittee just review than and not go through the variance process. Mayor Kingsford: Council Manbers all those at the next meeting, please c;cme prepared. Morrow: The last item I have, due to my firm belief in terms of everybody serving their time and then moving on dawn, I will not be a candidate for re-election in November. Giesler: I want to announce that Thursday night is taking on the Chamber of Camierce in the whiffle ball game, I inn the Coach again this year. Myers: I will have the information for you at the next meeting what the surrounding cities are going to do with this raise on the dump fees. The Mercy Medical Hospice Golf Tournment was a huge success. Tolsma: A couple of thing, Mr. Nesmith dropped his application for Conditional Use Permit and few of the neighbors would like to know when we are going to have him cleanup his property and move the trailers and vehicles out that are not supposed to be there and get the weeds and trash cleaned up and they are also questioning the back yard of our creamery property about his parking lot that is starting up again. Mayor Kingsford: Chief will you get after those. The Motion was made by Morrow and seconded by Giesler to approve the appointment of Tan Hammond to a three term on the Board of the Econanic Development Corporation: Motion Carried: All Yea: Mayor Kingsford: At this point the City Attorney has asked that we go into executive session for him to update the Council on two itans of litigation pending before the City. The Motion was made by Myers and seconded by Tolsma to go to Executive Session for an update on pending litigation at 8:30 p.m.: Notion Carried: All Yea: Mayor Kingsford: I will now reconvene the Meeting at 8:55 p.m., for the minutes the Counselor did update the Council on the two pending item of litigation, no action was taken, we have on advice of Counsel left those to expire and be granted with our disapproval by sixty day no response. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MERIDIAN, IDAHO, THAT: SECTION 1. The general City election will beheld in and for the City of Meridian, on the 7th day of November, 1989, at which time there will be elected two councilmen to serve for a term of four years and one;~to serve ,for a term of two years, or until the election and qualification of their successors. SECTION 2. The following are designated as the polling places for such election: FOR THE FIRST PRECINCT: Meridian Fire Station, 716 Meridian St.; FOR THE SECOND PRECINCT: American Legion Hall, 22 W.
