WHEREAS, the National Flood Insurance Program is a federal program which enables property owners in participating communities to purchase insurance as protection against flood losses in exchange for the adoption of community floodplain management regulations that reduce future flood damages; WHEREAS, the City of Meridian is a participating community in the National Flood Insurance Program; and WHEREAS, the regulatory standards set forth in this ordinance meet or exceed the regulations of 44 C.F.R. Sections 59-65 and Parts 70 and 73, regarding floodplain management, for the protection of public health, safety and welfare; and WHEREAS, the policies expressed herein are designed to protect public health, safety and welfare by minimizing public and private losses due to flood conditions; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: SECTION 1: That Title 10 Chapter 6 Flood Damage Prevention of the Meridian City Code is hereby amended as follows: CHAPTER 6 FLOOD DAMAGE PREVENTION 10-6-1: FINDINGS OF FACT, PURPOSE AND OBJECTIVES: A. Findings Of Fact: 1. The . Special F'lood Hazard Areas of the City are subject to periodic inundation which caiz results in loss of life, a~A-property dama~e, hazard to health, and safety~~, disruption of commerce and governmental services, extraordinary public FLOOD DAMAGE PREVENTION AMENDMENT ORDINANCE - PAGE 1 OF 19 expenditures for flood protection and relief, and impairment of the tax base, all of which adversely affect the public health, safety and general welfare. 2. Statement Of Purpose: It is the purpose of this Chapter to promote the public health, safety, and general welfare, and to minimize public and private losses due to flood conditions in specific areas by provisions designed: 1. To protect human life and health; 2. To minimize expenditure of public money and costly flood control projects; 3. To minimize the need for rescue and relief efforts associated with flooding and generally undertaken at the expense of the general public; 4. To minimize prolonged business interruptions; 5. To ~~~minimize damage to public facilities and utilities such as water and gas mains, electric, telephone and sewer lines, streets, and bridges located in areas of special flood hazard; 6. To help ~~emaintain a stable tax base by providing for the sound use and development of areas of special flood hazard so as to minimize future flood blight areas; 7. To ensure that infonnation regardi~ the location of Special Flood Hazard_ Areas is read.ily available to~otential property buyers and other interested peopl_e~~ , ; and 8. To ensure that those who occupy Special Flood Hazard Areas+'~° °r°°° ^~ °~°~:°' #~c~~~ assume responsibility for their actions. C. Methods Of Reducing Flood Losses: In order to accomplish its purposes, this Chapter includes methods and provisions for managin d~pment in flood prone areas to insure that: 1. Basis For Establishing Special Flood Hazard Areas : The areas of special hazard identified by the federal insurance administration in a scientific and engineering F~lood I~nsurance Sstudy (FIS) and €Flood ~Insurance R~ate M~ap (FIRM) for Ada County, Idaho, and incorporated areas entitled "FIRM Community Panel #16001CIND0AF3 of Ada County, Idaho, and its incorporated areas effective ~October 2, 2003", is hereby adopted by reference and declared to be a part of this chapter together with any subsequent revisions thereof. The flood insurance study and flood insurance rate map(s) are on file in the office of the flaodplain administrators~3~er~. ~n..,a n~_ i nnn ~ n ~nn: o~+ ~ i a ~nn~~ ~ C. Penalties For Noncompliance: No development shall take place~*M.~+„r° ~r'~-~a ~"~„ ~,o,.on~o,. ~.o ,. „~,r,,.+oa ~,.,..,~oa e~*o.,aoa ,o...oa „r*o«oa withOUt full , ,^ ,^ compliance with the terms of this Chapter and other applicable regulations. Violation of the provisions of this Chapter by failure to comply with any of its requirements, including violations of conditions and safeguards established in connection with conditions, shall constitute a misdemeanor. Any person who violates this Chapter or fails to comply with any of its requirements shall, upon conviction thereof, be subject to penalty as provided in Seetion 1-4-1 of this Code for each violation, and in addition shall pay all costs and expenses involved in the case, including attorney fees. Nothing herein contained shall prevent the City from taking such other lawful action as is necessary to prevent or remedy any violation. CB~~~^,~, ~-~-_° ~ 01~; a===u. z°°° ~u~; D. Abrogation And Greater Restrictions: This Chapter is not intended to repeal, abrogate, or impair any existing easements, covenants or deed restrictions. However, where this Chapter and another chapter, easement, covenant, or deed restriction conflict or overlap, whichever imposes the more stringent restrictions shall prevail. Additionally, in tlie cvent that anv of the reauirements of this chanter are in conflict with those of 4__4 CFR part 60, the more strin~:ent restrictions shall prevail. E. Interpretation: In the interpretation and application of this Chapter all provisions shall be: 1. Considered as minimum requirements; 2. Liberally construed in favor of the governing body; and 3. Deemed neither to limit nor repeal any other powers granted under State statutes. F. Warning And Disclaimer Of Liability: The degree of flood protection required by this Chapter is considered reasonable for regulatory purposes and is based on scientific and engineering considerations. This Chapter does not imply that land outside the areas of special flood hazard or uses permitted within such areas will be free from flooding or flood damages. This Chapter shall not create liability on the part of the City, any officer or employee thereof, or the Federal Insurance Administration, for any flood damages that result from reliance on this Chapter or any administrative decision lawfully made hereunder. ~n,.,a cti~ ,,, ~, oo> > 10-6-4: ADMINISTRATION: A. Establishment Of Floodplain Development Permit: 1. Floodt~lain Development Permit Required: A Floodplain ~evelopment P~ermit shall be obtained before construction or development begins within any area of Meridian Floodplain Overlav District as defined in subsection 10-6-2~ of this Chapter. The permit shall be for all ^+~^,^'„~°~ ;~~,,,a:~~ , , development including fill and other activities also as set forth in Section 10-6-2 of this Chapter. a. Exemptions: At the discretion of the Floodplain Administrator, development that will have ne~li ibg le impact to flood characteristics may be exempt from the permit requirernent. 2. Application For Floodplai.n Development Permit: Application for a Flood lain ~Development ~Permit shall be made on forms furnished by the Building Department and may include, but not be limited to; plans ~^~~ drawn to scale showing the nature, location, dimensions, and elevations of the area in question; existing ande~ proposed structures, fill, storage of materials, drainage facilities, and the location of the foregoing. Specifically, the following information is required: a. Description of site work to be done in the Meridian Floodplain Overlay District. b. Base Flood Elevations and floodway location in the project area'~°~ r° °na °~°° ~e~~}e~e~_ c. Elevation of the lowest floor and lowest finished floor of a11 structures. d.. Calculations or backwater model results showin~ the effect of the development on Base Flood elevations ~~~~~~~„••~~*° for areas without a FIS-mapped floodwav.: c. Designation Of Floodplain Administrator : The FIoodplain Administrator shall be desi mated by the City Engineer, and ' is hereby appointed to administer and implement this Chapter by granting or denying Floo~lain ~evelopment P~ermit Aapplications in accordance with its provisions. C. Duties And Responsibilities Of the Flood~lain Adininistrator . Duties of the Floodplain Administrator shall include, but not be limited to: 1. Review and evaluate Floodnlain Develonment Permit Applications a. Deterinine whether°°~~' ^" a°~~°' °^+ ^° ;+~ +^ ~'°*°^r;,,° +~~* the permit requirements of this Chapter have been satisfied. b. Make interpretations where needed, as to specific location of the boundaries of the Special Flood Hazard Area or Meridian Floodplain and Floodway Overlav Districts (for example, where there ~pears to be a conflict between a m~ped boundary and actual field conditions). b. Submit amendments as a~pro~riate to Citv Council for approval.~'~~^* ,. ~t,~+ ~~.e ~,,,,a „ ,.;~., : ,.+ a;,,,;.,;~~.oa .. . , D.- Appeals and Variances 1. Appeal and Variance Procedures~: a. The City Council shall hear and decide appeals and requests for variances from the requirements of this Chapter. b. The City Council shall hear and decide appeals when it is alleged there is an error in any requirement, decision, or determination made by the Floodplain Administratar~~~-Be~ in the enforcement or administration of this Chapter. The Floodplain Administrator and applicant shall eonsult with the Citv En ineer prior to appealing to City Council. c. Those aggrieved by the decision of the City Council, or any taxpayer, may appeal such decision to the Fourth Judicial District Court, Ada County, Idaho, pursuant to Idaho Code chapter 52, title 67. In passing upon such applications, the City Council shall consider all technical evaluations, all relevant factors, standards specified in other sections of this Chapter; and (1) The danger that materials may be swept onto other lands to the injury of others; 2 The dan er to life and ro e due to floodin ' a°^,°"°; ~) g P P riY g,. o (3) 'The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owner; (4) The importance of the services provided by the proposed facility to the community; (5) The necessity to the facility of a waterfront location, where applicable; (6) The availability of alternative locations for the proposed use which are not o~ subject to flooding ~ „ a~°m ~ • (7) The compatibility of the proposed use with existing and anticipated development; (8) The relationship of the proposed use to the Comprehensive Plan and floodplain management program for that area; (9) The safety of access to the property in times of flood for ordinary and emergency vehicles; (10) The expected heights, velocity, duration, rate of rise, and sediment transport of the flood waters and the effects of wave action, if applicable, expected at the site; and (11) The costs of providing governmental services during and after flood conditions, including maintenance and repair of public utilities and facilities such as sewer, gas, electrical, and water systems, and streets and bridges. e. The Ploodplain Administrator ' b shall maintain the records of all appeal actions and report any variances to the Federal Insurance Administration upon request. 2. Conditions For Variances: a. (2) A determination that failure to grant the variance would result in exceptional hardship to the applicant; (3) A determination that the granting of a variance will not result in i~s~ea$e~ ~'~~^~' "°~^'~*°, additional threats to public safety, extraordinary public expense, create nuisances, cause fraud on or victimization of the public ~° ;a°^*;~°a :~ c„":.°~~:~~ r'^~' „~,'~;° ~'°^*;,~„,= or conflict with existing local laws or ordinances. ~4,) A determination that the variance is the mininrum necessarv, considering; the flood hazard, to afford relief. Any variance should allow onlv minunum deviation from the rec~uirements of this code. €c. U;~on consideration of the factors of subscction Dld of this Section and the pur~oses of tllis Cha~ter, the Cit~Council mav attach such conditions to the 7rai~. ltin~ of variances as it deems necessary to further the purpose of this C1lapter. d. Variances as interpreted in the National Flood Insurance Program are based on the general zoning law principle that they pertain to a physical piece of property; they are not personal in nature and do not pertain to the structure, its inhabitants, economic or financial circumstances. Standards for developmenf in the Meridian Floodway Overlav District will then applv. d. ~lectronic Map / Drawin~Submittal: The Floodplain Development Permit Applicant shall provide electronic drawings showin~ newly mapped flood~lain and floodway Drawings shall be submitted according to the Citv of Meridian AutoCAD Standards. 2. Elevation Requirements: ~1) The lowest finished floor area of any structure, including mobile/manufactured. homes, shall be elevated to be no less than two feet (2') above the Base Flood Elevation. ~2) The lowest floor of any str~YCtuxe shall be elevated to one foot (1' ) above Base Flood Elevation. (3) All manufactured homes shall be elevated on a per.manent foundation and meet the same elevation requirements as other structures. b~.
