Conditions of Approval: Project is subject to all current City of Meridian ordinances and annexation and
zoning (AZ -03-018 and AZ -03-022), preliminary plat (PP -06-022), final plat (FP -07-020), variance (VAR -06-
002 and VAR -07-010), and development agreement modification (MI -07-008) applications associated with
this site, if applicable. The issuance of this permit does not release the applicant from any previous
requirements of the other permits issued for this site.
Landscaping_ The Landscape Plan prepared by The Land Group, Inc., dated 12/12/07 and labeled Sheets L1.0
— L 1.4, are NOT approved with this CZC. The landscaping adjacent to Eagle and Ustick Roads was approved
with the final plat application (FP -07-020) and the landscaping for each individual building pad shall be
approved with each individual building pad CZC.
Site Plan: The Site Plan prepared by The Land Group, Inc., dated 01/17/08 and labeled sheet C1.10, is
approved (stamped "Approved" on April 24, 2008 by the Meridian Planning Department) with the following
changes/notes (see redline changes on site plan):
1) The drive-through establishments shown on the site plan are not approved with this CZC and shall be
approved with each building pad CZC. All drive-through establishments shall meet the standards set
forth in UDC 11-4-3-11, and shall apply for a conditional use permit, as applicable.
Except for the changes mentioned above, the approved site plan is not to be altered without prior written
approval of the Planning Department.
Parking: Several parking areas appear to be substandard and do not meet the standards set forth in the
Unified Development Code. The proposed parking areas shall be paved and striped in accordance with UDC
11-3C and 11-313. Project engineer/architect shall certify that the number and size of handicap -accessible
spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage
in accordance per ADA and signed accessible.
Trash Enclosure: The trash enclosures depicted on the site plan are NOT approved with this CZC and
shall be approved with each individual building pad CZC.
Li htin : Lighting shall not cause glare or impact the traveling public or neighboring development and
comply with lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in
compliance with UDC 11-3D.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the
approved specifications and in accordance with UDC 11-3A-15.
Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in accordance with
the Tree Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the
Parks Department Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the
existing trees prior to construction. Any severely damaged tree must be replaced in compliance with UDC 11-
3B -10-C.5.
Curbing: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use
areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to
allow for storm water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed
prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and
shall be designed in compliance with UDC 11-3B-11 and UDC 11-3A-18.
Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all
federal handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any
changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be
submitted to the City of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of
Occupancy. All changes in occupancy need to comply with the requirements of the Building Department. It is
unlawful to use or occupy any building or structure until the Building Official has issued a certificate of
occupancy. A certificate of occupancy or temporary certificate of occupancy is obtained from the Building
Department (208) 887-2211 after inspections are complete and the field inspection record is returned to the
Building Department.
Plan Modifications: Except for the changes mentioned above, the approved Site Plan stamped "Approved" on
April 24, 2008, and is not to be altered without prior written approval of the Planning Department. No
significant field changes to the site or landscape plans are permitted; prior written approval of all changes is
required.
Note: If the plat for the subdivision in which this property lies has not been recorded, all subdivision
improvements shall be installed prior to occupancy of the first structure in the subdivision.

At the City Council hearing where we obtained project approval the mayor mentioned
that she had an issue with parking layouts at a number of existing shopping centers across
town. She specifically is against parking that backs into main drive isles. We have
submitted a CZC application for your review of the overall parking and traffic flow.
Additionally, we would like your review of the perimeter landscaping on both Eagle and
Ustick Roads.
Each individual parcel will be submitted separately for parcel layout, landscaping,
building design, and any changes to internal parking. At this time we are just looking for
your review and approval of our main driveways and building pad layout.

RE: Narrative describing Gateway Marketplace CZC
I am writing to describe the Gateway Marketplace Subdivision for the Certificate of Zoning Compliance
application.
The site is located at the southeast corner of the Eagle Road and Ustick Road intersection. More
specifically located in a portion of the northwest quarter of Section 4, Township 3 north, Range 1 east,
Boise Meridian, Meridian, Ada county, Idaho.
ACHD has constructed offsite improvements including two drive way approaches on Ustick road. Two
right -in, right -out approaches are currently being constructed along Eagle road, one at approximately 800
feet and one at approximately 1320 feet south of the Eagle and Ustick intersection.
This phase is approximately 17.3 acres consisting of 16 buildable lots and 1 non Buildable lot for a
pressure irrigation pump station. The CZC application is for the common area landscape and parking lot
and infrastructure construction.
As with most commercial developments that are tenant driven, the platting will most likely be modified as
time passes to combine and/or move lot lines to accommodate end users. Building configuration,
placement, and quantity may change with general circulation patterns remaining the same. The mix of
retail/ restaurant uses may change depending on market demand. A maximum of 250,000 square feet of
building area will be constructed, which is less than 25% building coverage over the entire site.
Buildings shall be located on the site to address the public way with elevations that create interest. This
will be accomplished through the use of broken planes, windows, cornices and fenestration that produce a
rhythm of materials or patterns. Large flat walls or surfaces will not be allowed. Buildings will be required
to incorporated a variety of high quality materials, including stone, brick, stucco and timber. These natural
materials may be trimmed or accentuated through the use of a limited amount of more finished materials
such as chrome, aluminum, or gloss painted trims. The heights and elevations are to be varied to reduce the
appearance of large mass. This will be accomplished through varying rooflines, canopies or arcades,
designed with proper proportions and complimentary materials.
Mechanical equipment & utility areas are to be properly screened through the use of dense landscaping or
walls which are complimentary to the architecture of the building and development.
Sewer service would be provided by the City of Meridian via an 8 inch sewer main to be continued south
from Ustick road and an 8 inch sewer main to be continued west from the East property line. Water
service would be provided by the City of Meridian via an 8 inch main to be looped through the site with
stubs for future connection to the proposed development to the east. Pressure irrigation service will be

A light fixture with a light distribution where no candela (light)
occurs at or above an angle of 90° above nadir. Additionally, the
candela per 1000 lamp lumens does not numerically exceed 100
(10%) at a vertical angle 80° above nadir. This applies to all lateral
angles around the luminaire.

requirements for light pollution. The Greenbriar Flat Lens is designed to meet the Illuminating
Engineering Society of North America's (IESNA) requirements for classification as a full cutoff fixture.
Greenbriar Flat Lens Vertical Burn fixtures combine
the benefits of traditional Vertical Burn technology
with the cutoff advantages of a flat lens. The reflector
system totally surrounds the vertically oriented lamp
to control the lamp output, while optimizing light
distribution and energy consumption. The lamp is
positioned within the reflector system to produce
sharp cutoff lighting required in strict zoning areas. In
addition, the lamp's arc tube is perpendicular to the lens, minimizing arc image and maximizing
the distance to the lens surface. This helps to reduce any perceived glare.

HOUSING
Greenbriar fixtures are available in two sizes to best complement your site
/ design and lighting requirements (see Dimensions Chart). All fixtures are finished
to provide a clean, sharp appearance and weather -tight construction.
The Greenbriar Reduced is designed around a 1000 Watt Metal Halide Reduced
Envelope lamp, allowing for a more compact housing. This results in reduced
windloads for lower EPAs, and permits the use of existing poles for retrofitting
or lighter -gauge, less expensive poles for new construction.

Clear lamps are supplied as standard. Choose Pulse -Start Metal Halide,
Super Metal Halide, Super Metal Halide Reduced Envelope, Metal Halide,
Metal Halide Reduced Envelope or High -Pressure Sodium lamps to meet your
specific lighting requirements.

The Greenbriar Series offers five high-performance, high-tech reflectors which
are completely rotatable for flexible, uniform light distribution. Available reflector
systems include: Type II, Type III, Type FA, Type FP, and Type V.
LENSES
Flat lenses are available for sharp cutoff lighting, while contoured lenses provide
broad lighting coverage. All flat and contoured lenses are sealed to the aluminum
housing with an EPDM gasket to prevent entry of dust, moisture and insects.

Each Greenbriar fixture is finished with DuraGrip® LSI's baked -on,
polyester -powder coat finishing process. LSI's DuraGrip finish
withstands weather changes without cracking or peeling, and
