Conditions of Approval: Project is subject to all current City of Meridian ordinances and previous conditions of
approval for Bellabrook Villas associated with this site (RZ-07-006, CUP -07-038, PS -07-002, and Development
Agreement Instrument #108013617). The issuance of this CZC does not release the applicant from any previous
requirements of the other permits issued for this site.
Note: The applicant has revised the siteplan from that approved with CUP -07-038, asfollows: the 4 Alex units
have been split into duplex units around the site perimeter. The Planning Director deems this change to be a
minor modification as allowed in UDC 11 -5B -6G2 and has approved the revision.
Landscaping_ The Landscape Plan, prepared by Erickson -Civil, Inc. (stamped by Tom South) on
11/16/07, labeled Sheet L-1, L-2, and L-3, is approved (stamped "Approved" on 4/23/08 by the Meridian
Planning Department) with no changes. This approval is not for landscaping/fencing outside of the
Locust Grove Road frontage buffer.
The approved landscape plan is not to be altered without prior written approval of the Planning Department. No
field changes to landscape plan permitted; prior written approval of all material changes is required. Prior to fmal
inspection and sign off for this project, a written certificate of completion shall be submitted to the Planning
Department, prepared by a landscape architect, landscape designer or qualified nurseryman responsible for
the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify
that all landscape improvements, including plant materials and sprinkler installation, are in substantial
compliance with the approved landscape plan.
Site Plan: The Site Plan, prepared by Erickson -Civil, Inc. (stamped by Ross Erickson on 4/14/08), labeled Sheet C-
1, is approved (stamped "Approved" on 4/23/08 by the Meridian Planning Department) with the following
conditions:
• Provide a central mailbox location as shown on the site plan with provisions for parcel mail, per
UDC 11-4-3-27B7.
• The Applicant shall post a sign at the end of the private street at the east vroverty boundary stating
that the road will be extended in the future.
• "No Parldne signs shall be erected along the streets surrounding Units 15-18 and 23-26.
The approved site plan is not to be altered without prior written approval of the Planning Department.
Ini anon: An underground, pressurized irrigation system must be installed to all landscape areas per the approved
specifications and in accordance with UDC 11-3A-15.
Protection of Existin Trees: Any existing trees on site must be protected or mitigated for in accordance with the Tree
Preservation section of the City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department
Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to
construction. Any severely damaged tree must be replaced in compliance with UDC 11 -3B -10-C.5.
Curbins: Per UDC 11 -3B -5I, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must
be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm
water runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to
occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be
designed in compliance with UDC 11-3B-11 and UDC 11-3A-18.
Ing: Lighting shall not cause glare or impact the traveling public or neighboring development and comply with
lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All signs will require a separate sign permit in compliance with
UDC 11-3D.
Trash Enclosure: All dumpster(s) must be screened in accordance with UDC -11-3A-12. Trash enclosures must be
built in the location and to the size approved by SSC.
Handicap -Accessibility: The structure, site improvements and parking areas must be in compliance with all federal
handicap -accessibility requirements.
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes
must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City
of Meridian Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy.
All changes in occupancy need to comply with the requirements of the Building Department. It is unlawful to use or
occupy any building or structure until the Building Official has issued a certificate of occupancy. A certificate of
occupancy or temporary certificate of occupancy is obtained from the Building Department (208) 887-2211 after
inspections are complete and the field inspection record is returned to the Building Department.
Plan Modifications: Except for the changes mentioned above, the approved Site Plan and Landscape Plan, stamped
"Approved" on 4/23/08, are not to be altered without prior written approval of the Planning Department. No
significant field changes to the site or landscape plans are permitted; prior written approval of all changes is required

RE: Betiabrook Villas — CZC Phase One (Site & Landscape Work)
Dear Sonya,
Please find the enclosed application for a Certificate of Zoning Compliance (CZC) for the
Betlabrook Villas Site and Locust Grove frontage landscape work. The intent of this application
is to cover all work with exception of the vertical construction for the building units, shared
driveways, and landscaping & fencing outside of the Locust Grove Road frontage buffer.
Subsequent CZC applications will be submitted for building & shared driveway construction and
associated landscaping & fencing.
Approved applications for this project include a Conditional Use Permit (CUP -07-038), a Rezone
Application (RZ-07-Ott), and a Private Street Application (PS -07-002). Also, a Developrra'nt
Agreement was entered into with the City for the approval (Ord 08-1347, Inst# 108013617).
The attached site plan in conformance with the amended building elevations and site pian
stamp dated on April 14, 2007, which was submitted to the City of Meridian on April 14, 2007.
Changes from the original site plan and building elevations were coordinated with and approved
by the City of Meridian Planning Director. The changes include splitting five of the four -unit
buildings into ten (10) two -unit buildings. With this modifiraiion a total of thirteen (13) two -unit
structuras and two (2) four -unit structures will be constructed. Further, due to changing market
conditions, the third stories of fourteen (14) of the units will be deleted and final building plans
will be prepared in accordance with the amended binding elevations that were submitted and
approved with some minor architectural comments (window additions & rocklbridc finish
additions).
DA CONDITIONS COVERNIG DEVELOPMENT OF SUBJECT PROPERTY.
5.1 The Development of this site shall substantially comply with the site plan and conceptual
elevations submitted with the application (shown in Exhibit C) and presented at the
public hearing.
The proposed site plan, as amended, was determined by the P&Z Director to be in
substantial compliance wish the site plan that was approved and pmmnted at the public
hearing. As indicated above, final building elevafions will be submitted wrih burg
plans under a subsequent CZC. Final buiding elevations, as amended, were also
determined to substantially comply with the concept elevations presented at the hearing.
SITE SPECIFIC REQUIREMENTS (CONDITIONAL USE PERMIT)
1.2.1 The proposed CZC complies.
1.2.2 Final landscape and fencing construction plans have been prepared by South
Landscape Architecture and are included with this submittal. The pian is in compliance
with the conditions of approval Wed under this item.
1.2.3 A ten foot multi -use pathway will be constructed along Five Mile Creek as shown.
1.2.4 An approval letter for private street names from the Ada County Street naming
Committee is attached.
1.2.5 Private streets will be constructed in compliance with UDC 11-3F
1.2.6 Items identified under this condition of approval will be addressed with the fust
subsequent CZC application for vertical building construction.
1.2.7 Proposed private streets and sidewalks meet this condition. Sidewalk has been
removed as noted, the private sheet will be constructed to a 29 -foot width to
accommodate parking on one side. Appropriate `No Parking' signage is proposed at the
required locations.
1.2.8 The development will comply.
1.2.9 E)Mng and weed perlmeier fencing is shown on the attached Landscaping and
Fencing Plans. Perimeter fencing will be constructed with this CZC, prior to issuance of
a CZC for building construction.
1.2.10 A Condominium Declaration will be prepared with the construction of the first phase of
vertical construction. The declaration will include provisions for maintenance and
ownership responsibilities for the mof the development, including, but not
runited to, structures, parking, common areas, and other development features.
1.2.11 Underground pressure irrigation is included with this development. The underground
pressure irrigation main system has already been constructed. Secondary sprinkler
lines will be Installed to irrigate the landscaping associated with each subsequent phase
of vertical construction.
12.12 An agreement granting cross access to the property to the east will be recorded prior to
submittal of a CZC apron for vertical cow. The agreement will inch use
and maintenance provisions. The property to the east was recently acquired by a vested
party in the Bellabrook Villas project and applications will be submitted to carry on the
Bellabrook theme to the east in the near future.
1.2.13 A sign will be posted at the end of the private street (stubbed to the east) indicatin8 that
the street will be extended in the future.

The District has reviewed the plans for the above referenced project, and they are accepted for public
street construction. By stamping and signing the improvement plans, the Registered Engineer ensures
the District that the plans conform to all District policies and standards. Variances or waivers must be
specifically and previously approved by the District in writing. Acceptance of the improvement plans by
the District does not relieve the Registered Engineer of these responsibilities.
The fees are shown on the attached checklist. All fees must be paid prior to scheduling signature of the
final plat or requesting a permit.

As a note of clarification, if this road is to be dedicated in the future for public right-of-way the
applicant/owner will have to meet all Ada County Highway District, ISPWC, State and Federal
standards, policies, and protocols at that time of proposed dedication (including entering into
any required easements or license agreements and all existing utility easements in proposed
right-of-way must be vacated prior to acceptance). The District cannot guarantee that the
