Conditions of Approval: Project is subject to all current City of Meridian ordinances and Preliminary
Plat (PP-03-036) and Final Plat (FP-04-053) applications associated with this site. The issuance of
this CZC and Design Review approval does not release the applicant from airy previous requirements of
the other permits issued for this site.
Landscaping_ The Landscape Plan prepared by Harvest Design on 2/20/08, labeled Sheet LS-
1, is approved (stamped "Approved" on 4/2/08 by the Meridian Planning Department) with the
following modifications/notes:
1. Per UDC 11-3B-8C2d, evergreen trees ("KFDC") are prohibited in interior
planters; please replace with a Class I or II deciduous tree.
The approved landscape plan is not to be altered without prior written approval of the Planning
Department. No field changes to landscape plan permitted; prior written approval of all material
changes is required. Prior to final inspection and sign off for this project, a written certificate of
completion shaII be submitted to the Planning Department, prepared by a landscape
architect, landscape designer or qualified nurseryman responsible for the landscape plan
upon completion of the landscape installation. The Certificate of Completion shall verify that
all landscape improvements, including plant materials and sprinkler installation, are in
substantial compliance with the approved landscape plan.
Site Plan: The Site Plan prepared by BRS Architects, on 2/20/08, labeled Sheet SDl.l & SD1.2, is
approved (stamped "Approved" on 4/2!08 by the Meridian Planning Department) with the following
changes:
1. Per UDC 11-3C-SB, all off-street parking areas shall be provided with a
substantial wheel restraint to prevent cars from encroaching upon abutting
private and public property or overhanging beyond the designated parking stall
dimensions, or the parking stall dimensions may be reduced 2 feet in length if 2
feet is added to the width of the sidewalk or landscaped area.
The approved site plan is not to be altered without prior written approval of the Planning
Department.
Elevations: Elevations. prepared by BRS Architects on 2/20/08, labeled Sheet A4.1 & A4.2, comply with
the design standards listed in UDC 11.-3A-19C and are approved (stamped approved on 4/2/08) with no
changes from the Planning Department.
Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved
specifications and in accordance with UDC 11-3A-15.
Protection of Existing Trees: Any existing trees on site must be protected of mitigated for in accordance with the
Tree Preservation section ofthe City's Landscape Ordinance. Per UDC 11-3B-10, coordinate with the Parks Department
Arborist (Elroy Huff, 888-3579) for approval of protection/relocation measures for the existing trees prior to construction.
Any severely damaged tree must be replaced in compliance with UDC 11-3B-10-C.5.
Parking_ The proposed parking areas shall be paved and striped in accordance with UDC 11-3C and 11-3B. Project
engineer/azchitect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans with
Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA and signed accessible.
Curbing: Per UDC 11-3B-SI, all landscape areas adjacent to driveways, pazking lots, or other vehicle use areas, must
be protected by curbing, wheel stops, or other approved protective devices. Curbing may be cut to allow for storm water
runoff.
Sidewalks: All sidewalks shall be constructed in accordance with 11-3A-17. Sidewalks shall be constructed prior to
occupancy.
Drainaue: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully vegetated, and shall be
designed in compliance with UDC 11-3B-11 and UDC I I-3A-18.
Li tin :Lighting shall not cause glare or impact the traveling public or neighboring development and comply
with lighting standards as defined in UDC 11-3A-11.
Signage: No signs are approved with this CZC. All business signs will require a separate sign permit in compliance
with UDC 11-3D.
Trash Enclosure: All dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash enclosures must be built in
the location and to the size approved by SSC.
Handicap-Accessibility: The structiue, site improvements and parking areas must be in compliance with all federal
handicap-accessibility requirements.
ACRD Acceptance:. All impact fees, if any, shall be paid prior to the issuance of a building.permit. If any changes must be
made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian
Planning staff for approval prior to the issuance of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. All
changes in occupancy need to comply with the requirements of the Building Department. It is unlawful to use or occupy any
building or structure until the Building Official has issued a certificate of occupancy. A certificate of occupancy or
temporary certificate of occupancy is obtained from the Building Department (208) 887-2211 after inspections are complete
and the field inspection record is returned to the Building Department.
Plan Modifications: Except for the changes mentioned above, the approved Site Plan, Landscape Plan, and Elevations,
stamped "Approved" on 4/2/08, are not to be altered without prior written approval of the Planning Department. No
significant field changes to the site or landscape plans are permitted; prior written approval of all changes is required.
Note: If the plat for the subdivision in which this property lies has not been recorded, all subdivision
improvements shall be installed prior to occupancy of the Srst structure in the subdivision.

Baker Construction is proposing to build a 4,750 s.f. single story retail shell
building on Lot 6 Block 1, Southern Springs Subdivision, located at the Northeast
corner of Meridian and Overland roads.
Current designs have the highest point of the building 27'-4" above finished floor.
Building finishes include stucco walls, with stone accents. The accent roofing will
be "Corrugated" metal panels, antique copper-coat color, with 7/8" deep ribs,
and low slope single-ply roofing for the bulk of the roof area. Mechanical rooftop
units will be screened by a parameter parapet. The color palate will include
greens, light tans, dark bronze and other earth tones.
Per prior discussion with Meridian Planner Caleb Hood, the building is not
required to have a formal design review since they are located in a C-G zone and
are under 200,000 s.f.

This proposal meets the following standards:
1. Architectural character:
a. Facades: The facades that face the public streets incorporates
modulation by virtue of the changes in parapet heights, wall planes,
colors and textures along the entire length of the facades.
b. Primary public entrance: Building is amulti-tenant retail shell. Each
tenant entrance is defined by storefront glazing and covered entry.
c. Roof lines: The roof design demonstrates varying parapet heights,
and (2) party-hat towers.
d. Pattern variations: The building design incorporates changes in
texture via the use of stone accents, stucco, corrugated roofing and
glazing materials.
e. Mechanical equipment: All rooftop mechanical units shall be screened
from the public as viewed from the property lines via parapets and
mechanical screens, if required.
2. Color and materials: The exterior of the building walls demonstrates the
appearance of high-quality materials such as stucco, corrugated roofing and
stone accents.
3. Parking lots: The building and parking area are partially screened by
landscaping that is located along Overland and Meridian Roads.
4. Pedestrian walkways:

a. A continuous internal pedestrian walkway that is a minimum of ~ six
feet wide is provided from the perimeter sidewalk to the building

entrance. This walkway minimum width shall be maintained clear of
any outdoor displays, vending machines, or temporary structures.
b. The internal pedestrian walkway is distinguished from the vehicular
driving surfaces through the use of scored/stamped concrete.

spaces or 200 feet away from the building's entrance.

Southern Springs Subdivision. The conditions and requirements also apply to MCZC-08-

• Prior to final approval you will need to submit construction plans to the ACRD
Development Review Department to insure compliance with the conditions identified
above or for traffic impact fee assessment. This is a separate review process that

Development Process Checklist

7. Roadway Improvements Adjacent To and Near the Site
Overland Road is a minor arterial roadway with 2-travel lanes including a left turn at the intersection.
There are no roadway improvements such as curb, gutter or sidewalk abutting the site.
The preliminary right-of-way necessary for Overland Road is estimated at 52-feet from centerline
abutting the site. The applicant should work with ACHD Traffic staff and Development staff for the
dedication of additional right-of-way needed for the turn lanes and necessary signal control boxes
and poles.
Meridian Road
Meridian Road (State Highway 69) is under the jurisdiction of Idaho Transportation Department (lTD).
The applicant should coordinate the right-of-way requirements and the proposed deceleration lane
with ITD.
2. Sidewalk
District policy requires 5-foot wide (minimum) concrete sidewalk on all collector roadways and arterial
roadways (7204.6.5).
In accordance with District policy the .applicant should be required to construct sidewalk abutting the
frontage of Overland Road. However, this segment of Overland Road will be reconstructed within the
next five years. Due to the preliminary nature of the design, the applicant should road trust for the
sidewalk in lieu of construction so that it may be constructed in its ultimate location with the project.
The applicant is proposing to construct anorth-south pathway along the east property line, and
should work with ACHD Traffic staff and Development staff for the placement and tie-in for the
proposed pathway to the future sidewalk abutting the site.
District policy 7203.6 requires the applicant of a proposed development to make improvements to
existing damaged sidewalk; curb and gutter construction or replacement; replacement of unused
driveways with standard curb, gutter and sidewalk; installation of pedestrian ramps; pavement
repairs; signs; traffic control devises; and other similar items in order to correct deficiencies or replace
deteriorated facilities.
The applicant should construct a pedestrian ramp onto Overland Road to reduce fhe conflict with
pedestrian/vehicular traffic. The pedestrian ramp should be constructed in compliance with ADA
standards. Coordinate the construction and location with District staff. The pedestrian ramp should be

3. Public Rights-of-Way Trust Fund
District policy 7203.8 states, if the District determines that is necessary or desirable to defer making
some or all of the improvements described, the developer shall contribute the estimated value of the
improvements to the Public Rights-of-Way Trust Fund.
/n lieu of constructing the sidewalk on Overland Road, the applicant should be required to provide a
$2,840.00 deposit to the Public Rights-of--Way Trust Fund for the cost of constructing 5-foot wide
concrete sidewalk for approximately 142-feet abutting the frontage on Ovedand Road. ($20.00 per
L.F.)
In lieu of constructing the pedestrian ramp on Overland Road, the applicant should be required to
provide a $350.00 deposit to the Public Rights-of--Way Trust Fund for the cost of constructing the
pedestrian ramp.
Successive Driveways
District policy 72-F5, requires driveways located on collector or arterial roadways with a speed limit of
35 to align or offset a minimum of 150-feet from any existing or proposed driveway.
Driveway Construction
Graveled driveways abutting public streets create maintenance problems due to gravel being tracked
onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to
pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the
roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge.
District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles
to a maximum width of 35-feet. Most commercial driveways will be constructed as curb-cut type
facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for
driveways accessing collector and arterial roadways.
5. Center Turn Lanes and Tapers
District policy 7204.8 states, if traffic volumes from a proposed development warrant turn lanes into or
out of the site, the applicant may be required to dedicate additional right-of--way to accommodate the
improvements. The applicant will not be compensated by ACHD for the dedication of additional right-
of-way and pavement widening.
District policy 3004.1, 72-F8, AASHTO guidelines and the MUTCD guidelines require the turn lane to
be constructed to provide a minimum of 100-feet of storage with shadow tapers for both the approach
and departure directions. Coordinate the design of the turn lane with District staff.
District policy 3004.1 and AASHTO Guidelines require tapers to be constructed on a varying basis
contingent upon the posted speed limit. Coordinate the design of the taperwith District staff.
As indicated on the site plan the applicant is proposing to construct a deceleration lane on Meridian
Road with the project. The applicant should contact the Idaho Transportation Department (ITDJ for
the scope of wodc for the Overland Road/Meridian Road intersectidn project.
The applicant should coordinate with ACRD Traffic staff and Development Services staff for the
scope of work for the Overland Road/Meridian Road intersection project. The applicant should be
required to meet alt AASHTO and MUTCD guidelines.
C. Special notification to the Applicant and the City of Meridian
The applicant is proposing to locate a pedestrian pathway abutting the proposed development skirting
Ten Mile Creek. The pathway easement begins at Overland Road abutting the eastern boundary line
extending to the south boundary line. Staff is supportive of the proposed pathway and the location to
provide for pedestrian access and neighborhood connectivity.
The applicant should work with ACRD Traffic staff and Development staff for the placement and tie-in
for the proposed pathway to the sidewalk extending to the intersection of Overland Road and
Meridian Road.
E. Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of-way.
2. All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.
4. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by
the District. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details.
5. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
7. Construction, use and property development shall be in conformance with all applicable requirements
of the Ada County Highway District prior to District approval for occupancy.
8. Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #197, also known as Ada County Highway District Road Impact Fee Ordinance.
9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in
the event any ACRD conduits (spare or filled) are compromised during any phase of construction.
10. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative
of the Ada County Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
11. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other
regulatory and legal restrictions in force at the time the applicant or its successors in interest advises
the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the
time the change in use is sought.
Request for Reconsideration of Commission Action
Request for Reconsideration of Commission Action: A Commissioner, a member of ACHD
staff or any other person objecting to any final action taken by the Commission may request
reconsideration of that action, provided the request is not for a reconsideration of an action previously
requested to be reconsidered, an action whose provisions have been partly and materially carried
out, or an action that has created a contractual relationship with third parties.
a. Only a Commission member who voted with the prevailing side can move for reconsideration,
but the motion may be seconded by any Commissioner and is voted on by all Commissioners
present.
If a motion to reconsider is made and seconded it is subject to a motion to postpone to a
certain time.
b. The request must be in writing and delivered to the Secretary of the Highway District no later
than 3:00 p.m. on the day prior to the Commission's next scheduled regular meeting following
the meeting at which the action to be reconsidered was taken. Upon receipt of the request,
the Secretary shall cause the same to be placed on the agenda for that next scheduled
regular Commission meeting.
c. The request for reconsideration must be supported by written documentation setting forth new
facts and information not presented at the earlier meeting, or a changed situation that has
developed since the taking of the earlier vote, or information establishing an error of fact or
law in the earlier action. The request may also be supported by oral testimony at the meeting.
d. If a motion to reconsider passes, the effect is the original matter is in the exact position it
occupied the moment before it was voted on originally. It will normally be returned to ACHD
staff for further review. The Commission may set the date of the meeting at which the matter
is to be returned. The Commission shall only take action on the original matter at a meeting
where the agenda notice so provides.
e. At the meeting where the original matter is again on the agenda for Commission action,
interested persons and ACHD staff may present such written and oral testimony as the
President of the Commission determines to be appropriate, and the Commission may take
any action the majority of the Commission deems advisable.
f. If a motion to reconsider passes, the applicant may be charged a reasonable fee, to cover
administrative costs, as established by the Commission.

1. Architectural Character:
a. Facades: Facades visible from a public street shall incorporate modulations in the facade, roof '... .

b. Primary public entrance(s): The primary building entrance(s) shall be clearly defined by the
architectural design of the building. Windows, awnings, or arcades shall total a minimum of
30% of the facade length facing a public street.
c. Roof lines: Roof design shall demonstrate two or more of the following: a) overhanging eaves, b)
sloped roofs; c) two or more roof planes; d) varying parapet heights; and e) cervices.

2. Color and materials: Exterior building walls shall demonstrate the appearance ofhigh-quality
materials of stone, back, wood or other native materials. Acceptable materials include tinted or _
texmred masonry block, textured arohitectural coated wnerete panels, tinted or textured masonry
block, or stucco or smeco-like synthetic materials. Smooth-faced concrete block, tilt-up concrete

panels, or prefabricated steel panels are prohibited except as accent materials. ;~ _,
3. Parking Lots: No more than 70% of the off-street parking area for the s[mcture shall be located
between the front facade of the stmcmre and abutting strcets, unless the principal building(s) and/or
parking is/are screened from view by other stractures, landscaping and/or beans.
4. Pedestrian walkways: -
a. A continuous interval pedestrian walkway that is a minimum of eight feet in width shall be
provided from the perimeter sidewalk to the main building entrance. The walkway width shall

be maintained clear of any outdoor sale displays, vending machines, or temporary structures ~

b. The interval pedestrian walkway shall be distinguished from the vehicular driving surfaces _~_..
