BY THE CITY COUNCIL: BIRD, BORTON, ROUNTREE, ZAREMBA
AN ORDINANCE OF TIIE CITY OF MERIDIAN REVISING CHAPTER 3, ARTICLE E
OF TTTLE 11 OF TIDE MERIDIAN CITY CODE, RELATING TO TEMPORARY USES.
WHEREAS, the City Council finds that it is in the best interest of the City of Meridian
to accommodate within our community outdoor sales and temporary uses that: 1) complement
existing City of Meridian businesses; 2) aze safe, attractive, and desirable; 3) add variety to the
shopping and/or dining opporttanitics available to City of Meridian residents; and 4) support and
encourage community events and celebrations;
WI3EREAS, provisions regulating such outdoor sales and temporary uses have
previously been set forth within Title 11, Chapter 3 of the Meridian Unified Development Code
("UDC"), but given the inter-departmental nature of ensuring that City resources aze available to
manage outdoor sales and temporazy uses, the City Council finds that it is more efficient to
provide for regulation of such sales and events in Title 3, Chapter 4 of the Meridian City Code,
which shall be amended accordingly in a separate ordinance;
WHEREAS, these revisions to the UDC are intended to make it clear that, with some
specifically enumerated exceptions, any and all allowed temporary uses occurring on property
within the City of Meridian shall be accessory to an approved use of such property;
NOW, THEREFORE, BE IT ORDAINED BY TI3E MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAIiO:
SECTION 1: That the definition of "TEMPORARY USE," set forth in Chapter 1,
Article A of Title 11 of fhe Meridian City Code, shall be amended to read as follows:

SECTION 2: That Chapter 3, Article E of Title 11 of the Meridian City Code, shall be
amended to read as follows:
11-3E-1: PURPOSE: The regulations of this article are intended to allow for eke temporary eF

11-3E-2: APPLICABILITY: The regulations of this article shall apply to all temporary uses in

all districts with the exception that ,

site, community events occurring at public parks and at education institutions, and ternporary_
uses that are conducted as part of the curricular or extra-curricular pro~,gQfan education

are not intended to include retail or other services that are customaril carried on as a business.

I. ].-3E-3: PROCESS AND STANDARDS: Temporary,uses shall be accessory to a conditional

SECTION 3. That all ordinances, resolutions, orders, or parts thereof or in conflict with
this ordinance are hereby voided. /
